Ground Water Management and Protection Act (Neb. Rev. Stat. §§ 46-701 to 46-754), the South Platte Natural Resources District (SPNRD) provides notice that it will hold a public hearing on Thursday, April 19, 2018 at 6:30 p.m., or 30 minutes following the end of a public informa-tion session, whichever is later, at the Western Nebraska Community College (WNCC) - Sidney, 371 College Drive, Sidney,

Nebraska, to consider the proposed Amended and Restated Districtwide Ground Water Management Area Rules and Regulations (the Rules). The geograph-ic area of the management area, which includes the proposed amended con-trols, is all of the land area located within the bound-aries of the SPNRD, which includes all of Kimball, Cheyenne and Deuel Counties and as shown on the map attached to the Rules as Appendix B. All interested persons may appear at the hearing and present testimony or pro-vide other evidence rel-evant to the issues being considered. A public infor-mation session concerning the above will be held at 5:00 p.m. on the same date and location.

A general description of all controls proposed for amendment and for the contents of the Rules proposed for amendment are as follows: A) delete Rule number 6.4 from the Table of Contents and renumber accordingly; B) revise Appendix C to reflect the 2016 through 2018 Allocation Period; C) the addition of Appendix C1 to reflect the prelimi-nary range for the 2019 through 2021 Allocation amounts in Subareas A, B, C, D, E and F; D) amends the definition of Training Certification, Rule number 4.87; E) amend-ment to Rule 6.2, Permit to Construct a Water Well; F) on page 18, deletes Rules 6.4 and 6.4.1. involving Training Certification, and the following Rules are renumbered accordingly; G) revise Rule 6.6.1.1 to reflect the 2016 through 2018 Allocation Period and Allocation amounts; H) adds proposed Rule 6.6.1.2: preliminary Allocation amounts in Acre-Inches by Subarea for the 2019 through 2021 Allocation Period, which are as follows:

When the Board deter-mines the final amount of the Allocations after the public hearing and receiv-ing written comments, the Allocations for each Subarea shall be a specific number of Acre-Inches for each Subarea, and not a range of Acre-Inches for each Subarea.

In addition, proposed Rule 6.6.1.2.1 provides for Allocations in Subareas A, B, C, D, E and F for a three (3) year Allocation Period; and proposed Rule 6.6.1.2.1.1 provides that in 2021, the Board will set

Allocations for a new three (3) year Allocation Period, to commence in 2022 for all Subareas;

I) Also, for the pur-pose of discussion at the public hearing, amended Rule 6.6.1.4 preliminar-ily sets the Carryforward and Carryforward Cap range between ten (10) and sixteen (16) Acre-Inches following the three (3) year Allocation Period in Subareas A, B, C, D, E and F, and every Allocation Period thereafter.

When the Board deter-mines the final amount of the Carryforward and the cap on the amount of Carryforward (“Carryforward Cap”) after the public hearing and receiving written com-ments, the Carryforward and Carryforward Cap shall be a specific num-ber of Acre-Inches, and not a range of Acre-Inches for the Carryforward and Carryforward Cap;

J) On page 36 of the proposed amended rules and regulations, adds Training Certification requirement language to Rules numbered 7.2.1 and 7.2.1.1; K) adds Rule 7.3.1, “In a Phase II Quality Management Subarea, all requirements in Phase I will be met,” and the fol-lowing Rules are renum-bered accordingly; L) adds to Rule 7.7.4, “In addi-tion, the Board, in its sole discretion, may determine to maintain the Quality Management Subarea des-ignation, but to remove the Training Certification requirement.”
