CityA meeting of the Mayor

and Council of the City of Sidney, Nebraska, was convened in open and pub-lic session at 7:15 P.M. on April 25, 2017 in the Council Room. Present were: Mayor Arterburn and Council Members: Gaston, Utley and Olsen. Absent: Council Member Gallaway. Others pres-ent: City Manager Sadler, City Attorney Leef and City Clerk Anthony. Notice of the meeting was given in advance thereof by publi-cation in The Sidney Sun Telegraph, the designated method for giving notice, a copy of the proof of pub-lication being attached to these minutes. Advance notice of the meeting was also given to the members of the City Council and a copy of their acknowledg-ment of receipt of notice is attached to these minutes.

Availability of the agenda was communicated in the advance notice and in the notice to the City Council. All proceedings shown hereafter were taken while the convened meeting was open to the attendance of the public.

Mayor Arterburn informed the public of the location of the posted Open Meetings Act.

Utley moved, Gaston seconded “That Council Member Gallaway be excused from this meet-ing.” Roll call vote: Yeas: All council members pres-ent. Absent: Gallaway.

Gaston moved, Olsen seconded “That the min-utes of the April 11, 2017 meeting be approved as printed.” Roll call vote: Yeas: All council mem-bers present. Absent: Gallaway.

Melissa Norgard, Economic Development Director, presented the following items in her Economic Development Report: 1. Sandhills Publishing were up and running April 17 at 630 Illinois Street and has already hired 22 employ-ees and looking to hire an additional 15-25. Positions included customer service, collections specialists and expanding into interac-tive designers. 2. Long Term Care Group which use home positions is looking at Sidney and will be par-ticipating in the Job Fair at WNCC the first week in May. 3. Sandhills Energy solar farm project is still moving forward to build a 25-40 mega watt solar project near Sidney. 4. Lukjan Metals and the City are going thru the process of LB840 and CDBG pieces in order to get started. 5. Data Center Marketing Postcard will be sent to 28 companies identified in the target market study. 6. Meetings have been held with top local business-es to ensure they know who they can contact to discuss economic issues, concerns and suggestions. 7. Contact with the State – Dan Curran, Director of Business Development. 8. Need to advertise for two members to the Economic Development Citizen’s Advisory Committee and schedule a meeting once a full slate of members is established. There were no objections to the advertis-ing for two members.

Ben Dayton, Planning and Zoning Administrator, reported on the Final Report of the Planning Commission re: a new proposed ordinance regard-ing signs and sign main-tenance was considered. Utley moved, Gaston sec-onded “That RESOLUTION NO. 20170403 be passed and adopted.” Roll call vote: Yeas: All council members present. Absent: Gallaway.

BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF SIDNEY, NEBRASKA:

That the Planning Commission of the City of Sidney, Nebraska, has submitted to the City Council of the City of Sidney, Nebraska, its final report regarding Proposed Chapter 1272 Sign Ordinance of the Codified Ordinances of the City of Sidney; and

That the City Council of the City of Sidney propos-es to consider said report; that a public hearing will be held thereon in the

Municipal Building of the City of Sidney, Nebraska, at 7:15 o’clock P.M. on the 9th day of May, 2017 at which time and place par-ties in interest and citizens shall have an opportuni-ty to be heard; and that the City Clerk is hereby directed to give the proper notice of said hearing in compliance with the law at least ten days prior to said hearing.

City Manager Sadler reviewed the water rate structures that are being proposed in Ordinance No. 1788. City Clerk Anthony read by Title for the sec-ond time the Ordinance entitled “AN ORDINANCE OF THE CITY OF SIDNEY, NEBRASKA, RELATING TO WATER SERVICE RATES, EFFECTIVE DATE OF RATES, AMENDING SECTIONS 1042.21 AND 1042.24 OF THE CODIFIED ORDINANCES OF THE CITY OF SIDNEY, NEBRASKA; AND PROVIDING FOR PUBLICATION”. Due to no motion made to suspend the Statutory requirement requiring the ordinance to be read by title three dif-ferent days, the Ordinance will be presented again at the May 9, 2017 Council meeting.

City Manager Sadler reviewed the sewer rate structures that are being proposed in Ordinance No. 1789. Discussion was held regarding what impact these new sewer rate structures would have on the customers with large usage of water. City Clerk Anthony read by Title for the second time the Ordinance entitled “AN ORDINANCE OF THE CITY OF SIDNEY, NEBRASKA, RELATING TO SANITARY SEWER SERVICE RATES, EFFECTIVE DATE OF RATES, AMENDING SECTION 1045.31 OF THE CODIFIED ORDINANCES OF THE CITY OF SIDNEY, NEBRASKA; AND PROVIDING FOR PUBLICATION”. Due to no motion made to suspend the Statutory requirement requiring the ordinance to be read by title three dif-ferent days, the Ordinance will be presented again at the May 9, 2017 Council meeting.

City Manager’s Report: Reminder that the new Finance Officer will begin on May 15 and the Governor’s Whistle Stop on August 5th. There have been several requests for use of City property. The Firemen’s Ball had a good turnout. Chief of Police Aikens shared the infor-mation about the “Drug Take Back” on April 29th. City Attorney Leef reported that the arbitration with NMPP was ruled in favor of Sidney 2-1. NMPP could appeal within 10 to 30 days. If this happens, no additional information will have to be submitted by the City.

Council Comments: Gaston congratulated Nienhueser Construction on their years of service to the community of Sidney. Their farewell open house was held earlier this eve-ning. He also presented the Mayor with the Tree City USA flag that he had received for Sidney at the Tree Give Away. Olsen asked about the old Fed Ex lot for a possible place for truck parking. City Manager Sadler and Economic Development Director Norgard said they were working on this loca-tion and others but had nothing to report at this time. MAYOR ARTERBURN
