CHARTER ORDINANCE NO. 27A CHARTER ORDINANCE AMENDINGCHARTER ORDINANCE 19, EXEMPTINGTHE CITY OF GARDNER, KANSAS FROMTHE PROVISIONS OF K.S.A. 14-103, 14-109, 14-111, 14- 201, 14-204, 14-205,14-207, AND 14-308, RELATING TO THECOMPOSITION AND METHOD OF ELECT-ING MEMBERS OF THE GOVERNINGBODY AND THE APPOINTMENT OF CER-TAIN OFFICERS AND EMPLOYEES OF THECITY; PROVIDING SUBSTITUTE AND AD-DITIONAL PROVISIONS; AND REPEAL-ING SECTION 4 OF CHARTER ORDI-NANCE NO. 26.BE IT ORDAINED BY THE GOVERNINGBODY OF THE CITY OF GARDNER, KAN-SAS:SECTION 1. Section 3 of Charter Ordi-nance No. 19 of the City of Gardner, Kan-sas shall be amended to provide as fol-lows: “The City, by virtue of the powers vestedin it by Article 12, Section 5, of the Consti-tution of the State of Kansas, herebyenacts the following substitute and addi-tional provision (replacing K.S.A. 14-103,14-109, 14-201, 14-204, 14-205 and 14-308, provided that only those provisionsof K.S.A. 14-109 and 14-205, as may beamended, relating to the qualifications ofthe members of the governing body arenot substituted and replaced by this Char-ter Ordinance with the remainder of suchstatutes being substituted and replacedhereby and further replacing Charter Or-dinance No.4):Election of officers; terms; vacancies.The mayor and five councilmembers shallconstitute the governing body of the cityand shall be elected at-large for four-year terms or until their successors arequalified. Those governing body positionswith terms expiring in April 2017, shallexpire on the second Monday in Januaryof 2018, when the city officials elected inthe November 2017 general election takeoffice. Those governing body positionswith terms expiring in April 2019, shallexpire on the second Monday in Januaryof 2020, when the city officials elected inthe November 2019 general election takeoffice. A general election of city officers shalltake place on the Tuesday succeedingthe first Monday in November 2017. Suc-ceeding elections shall be held on suchdate every two years thereafter for allsuch governing body positions whoseterms have expired. Those elected inNovember general elections shall takeoffice on the second Monday in Januaryfollowing the election. All elections for theCity of Gardner, Kansas shall be nonpar-tisan. The officers elected hereunder shall be

qualified pursuant to the laws of the Stateof Kansas. The removal from the City ofany officer elected hereunder who isrequired by State law to be a qualifiedelector thereof, shall occasion a vacancyin such office. In case of a vacancy in the council oc-curring by reason of resignation, death,or removal from office or from the city,the governing body shall appoint a quali-fied elector to fill the vacancy until thenext election for that office. In case anyperson elected as a council member ne-glects or refuses to qualify within 30 daysafter election, the council member shallbe deemed to have refused to acceptthe office and a vacancy shall exist. Thegoverning body shall appoint a qualifiedelector to fil1 the vacancy.In case of a vacancy in the office ofmayor, the president of the council shallbecome mayor until the next regular elec-tion for that office and a vacancy shalloccur in the office of the councilmemberbecoming mayor.”SECTION 2. Section 4 of Charter Ordi-nance No. 26 of the City of Gardner, Kan-sas, which previously amended Section3 of Charter Ordinance No. 19, is herebyrepealed. SECTION 3. Those provisionsstated within Charter Ordinance No. 19and Charter Ordinance No. 26 of the Cityof Gardner, Kansas which are inconsis-tent with the foregoing are hereby re-pealed.SECTION 4. This Charter Ordinance shallbe published once each week for twoconsecutive weeks in the official Citynewspaper.SECTION 5.
