525 BEACH STREET SAGA IS ACE GETTING IN BED WITH DIRTY REVERE GOVERNMENT AND FAILING IN ITS MISSION STATEMENT TO PROTECT LOW INCOME AND MINORITY COMMUNITIES FROM HARM? Our Vision of Change Systemic change means moving beyond solving problems one by one to eliminating the root causes of environmental injustice. ACE is anchoring a movement of people who have been excluded from decision-making to confront power directly and demand fundamental changes in the rules of the game, so together we can achieve our right to a healthy environment. *************** The problem in this instance is that Clifford Pisano claims that an ACE staff attorney had actual knowledge of hazardous conditions that may trigger an EPA investigation and Superfund status. Mr. Pisano has lived at 537 Beach Street – right next to this site -- for forty (40) years. He says that Gibbs Oil Company used the site for many years without a full cleanup or assessment despite the fact that the City granted a Residential Variance last fall. He has seen construction and movement of tanks, and says that they have tried to conceal bad walls that may contain mold. 1

525 BEACH STREET SAGA

IS ACE GETTING IN BED WITH DIRTY REVERE GOVERNMENT AND FAILING IN ITS MISSION STATEMENT TO PROTECT LOW

INCOME AND MINORITY COMMUNITIES FROM HARM?

Our Vision of ChangeSystemic change means moving beyond solving problems one by one to eliminating the root causes of environmental injustice. ACE is anchoring a movement of people who have been excluded from decision-making to confront power directly and demand fundamental changes in the rules of the game, so together we can achieve our right to a healthy environment.

***************The problem in this instance is that Clifford Pisano claims that an ACE staff attorney had actual knowledge of hazardous conditions that may trigger an EPA investigation and Superfund status.

He further claims that Attorney Rubin initially told him that she would provide him with documents that she has on file, but she has gone silent on him. He is worried that the Mayor and Councilor Ira Novoselsky are well aware of the situation, and he worries that some Councilors may have development friends who have exerted undue influence to keep things quiet. He claims this is a build-at-all costs

project that is a risk to the community. Mr. Pisano and other abutters successfully lobbied against a similar project on the subject area in 2007. He asserts that there is no material difference in the situation today. His Facebook page: https://www.facebook.com/pages/Occupy-Beach-Street/352401604790045?sk=wall

Mr. Pisano reiterates that he has personally seen work being done there in violation of basic environmental law principles. The proposed development seen at the bottom of this page is juxtaposed with photographs fro present day. He has filed a lawsuit that may face some procedural hurdles, and the possibility of Federal intervention looms large.

See generally U.S. v. Atlas Chemicals v. R. Emory Mabry (U.S. E.D. Pa 1993 U.S. Dist. LEXIS 14428

If tape and paper with paint-thinner mixture overspray is a RCRA hazardous waste, then it is by [*6] necessity a "hazardous substance" under CERCLA. 42 U.S.C. ß 9601(14)(C).

Well folks whether it be paint thinner…. or raw oil, it is serious. I was a New England zoning manager in wireless and am very familiar with issues of contamination and what must be done to set things straight. I have a friend who works for the EPA in a location I will not disclose, but yes he’s a heavy. Years ago my father retired as an environmental chemist, and I used to ride my bicycle to work right across the Aberjona River in Woburn, home of the now infamous story of “A Civil Action.” It is one of my favorite books of all time. If there is something not being told in Revere, I’m going to take these people on a hell ride they will never forget. If his administrative appeal is time-barred I think he and the abutters can still mount a Nuisance lawsuit.

“Right now I’m not certain of all of my rights…. I would have filed a long time ago to perfect my [ZBA] appeal,” says Pisano. “But I think I got played…. ACE Attorney Staci Rubin led me to believe everything was okay with the way I was proceeding and she never corrected me…. Then today she wrote me today saying she couldn’t help me and she didn’t even offer me the documents she told me she had about Gibbs Oil for years and years……”
