Welcome to the CMP™ Program The CMP™ program is the only certification program of its kind which recognizes the skill and proficiency of professionals in the Medicaid Planning field. CMP certificants come from a variety of backgrounds and professions, including law, finance, accounting, social work and the geriatric care community. The CMP™ program seeks to unify the planning community under a universal standard of ethics and professional responsibility, as well as recognize the outstanding members of the profession who have the education, experience, and quantifiable skill to be recognized by their peers as meeting or exceeding professional standards of excellence. The program administers the certification exam which rigorously tests a candidates skill and knowledge level. The CMP™ program is run by the CMP™ Governing Board which serves the public interest by developing professional standards in Medicaid Planning through setting and enforcing strict requirements of its certificants. The Board grants the CMP™ certification to successful candidates and upholds the certification as the recognized standard for competent and ethical Medicaid planning throughout the United States. With a growing senior population and longer life expectancies, the public needs to be able to rely on the skill and proficiency of a CMP™ to help navigate the complex and difficult-to-understand long-term care Medicaid program. To become a CMP™, this Candidate Handbook will help guide you through the process of earning the certification and being recognized by the public and by your peers as a qualified member of the Medicaid Planning community.

About the CMP™ Governing Board The CMP™ Governing Board was established as an autonomous subsidiary of the Wealth Preservation Institute (WPI) in 2010 to oversee the development and implementation of the Certified Medicaid Planner™ program. The program’s purpose is to serve the public by providing a recognized standard of knowledge and proficiency among those who provide service relating to Medicaid eligibly planning. With the growth in the aging population of the United States and the increased reliance on the Medicaid system as the single largest source of funding for long-term care expenses, it was the consensus of a great number of practitioners in the Medicaid Planning field that a set of Medicaid Planning standards be established and a system be established for the recognition of competency in Medicaid Planning. THE CMP™ Governing Board is comprised of six members who serve three-year terms. Five of the members are professionals chosen from the Medicaid Planning community for their great understanding and proficiency in Medicaid Planning and related issues. One member is chosen representing the community serviced by Medicaid Planners. The Board is representative of both the planning community and the certificant community. Two of the five professional members must be certified already before election to their seat and the remainder are given within one year from election to their seat to achieve certification.

Non-Discrimination Policy The CMP™ Governing Board is committed to the principle that all persons shall have equal access to programs, facilities, services, and employment without regard to personal characteristics not related to ability, performance, or qualifications as determined by CMP™ Governing Board policy and/or applicable laws.

The CMP™ Governing Board prohibits discrimination, harassment and bullying against any person because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status or any other characteristic protected by law. The CMP™ Governing Board expects that its employees, volunteers, members, and other constituents of the CMP™ Governing Board, when and where ever those individuals are conducting CMP™ Governing Board business or participating in CMP™-related events or activities, shall maintain an environment free of discrimination, including harassment, bullying, or retaliation.

This policy expressly applies to all applicants for certification under the CMP™ program and any applicant who later achieves or maintains certification through the CMP™ program.

Definitions:

Discrimination is defined as treating people differently, either preferentially or with adverse impact, because they have similar characteristics or because they are from specific groups, unless differential treatment is reasonable, essential and directly related to conducting CMP™-related business.

Harassment is one form of discrimination. Harassment is defined as conduct that has the purpose or effect of unreasonably interfering with an individual's participation in CMP™-related activities or creating an intimidating, hostile or offensive environment. Harassment occurs when submission to or rejection of such conduct is made either explicitly or implicitly a term or condition of an individual's participation in CMP™-related activities or used as a basis for decisions affecting that individual’s relationship to the CMP™ Governing Board.

Bullying is one form of harassment. Bullying consists of waging an ongoing and systematic campaign of interpersonal destruction against an individual or group of individuals that a reasonable person would find hostile, offensive and unrelated to a CMP™ Governing Board’s legitimate business interests on the basis of one of the protected classes above. It tends to be an accumulation of many incidences over a long period of time, including treatment which persistently provokes, pressures, frightens, intimidates or otherwise discomforts another person.

Retaliation is defined as punitive actions taken against persons for exercising their employee or other rights under the laws in good faith, reporting violations of the laws to the proper authorities (i.e. “whistle-blowing”) and/or participating in administrative or legal proceedings as a plaintiff, complainant or witness.

The CMP™ Governing Board shall have the primary responsibility for oversight of this policy including resolving complaints of discrimination, harassment, bullying, and retaliation. Any person who believes that he or she has been the victim of illegal discrimination or harassment should contact the CMP™ Governing Board Chairman. If the complaint is against the CMP™ Governing Board Chairman then any other CMP™ Governing Board Member may be informed. All reports of unethical conduct concerning applicants or certificants will be handled according to the CMP™ Governing Board’s disciplinary policy and may be referred to the CMP™ Ethics Council for adjudication.

The CMP™ Governing Board prohibits retaliation and discourages any behavior that might be perceived as retaliatory in nature. Retaliation shall constitute a separate violation and may result in a disciplinary sanction independent of the outcome of a complaint.

Accommodations for Applicants with Disabilities The CMP™ Governing Board is committed to serving applicants with disabilities by providing reasonable accommodations appropriate to the applicant's diagnosis. The CMP™ Governing Board has established policies regarding documentation of an applicant's disability and the process for requesting accommodations, which are available upon request. Testing Accommodations

The current mode of testing applicants for the CMP™ designation is computerized testing. Tests are administered at designated testing sites throughout the U.S. by professional proctors. All requests for accommodations must be received at least two weeks before the scheduled examination date.

If an applicant is currently are entitled receive accommodations due to a professionally diagnosed and documented disability, the applicant may submit documentation to support a request for one of the following:

Additional Time: Extended testing time (50% time extension). Additional Testing Accommodations: For applicants who are unable to use our online portal to

take their examination, the test administrators will make arrangements to accommodate the test-taker, including without limitation providing a reader.

Site-Based Testing Accommodations: Testing sites also provide reasonable physical accommodations based on the nature of their testing facilities. After a testing cite has been chosen, any request for site-based testing accommodations made to and approved by the CMP™ Board will be forwarded to the testing site or can be addressed directly with the testing site per their policy. Examples of possible available accommodations include without limitation: Some examples of exam accommodations based on disability need, may include but are not limited to:

Reduced distraction environment Large print Braille or e-text formatted version of the exam

Exam scribe Exam reader Use of adaptive software (ZoomText, JAWS, Dragon NaturallySpeaking) or hardware

(CCTV, adaptive mice, keyboards, etc.) based on disability need.

Note: Testing centers do not have the authority to grant or deny testing accommodations on their own. All requests for accommodations, including site-based accommodations, must be made to and approved by the CMP™ Board.

There is no additional fee for applicants who require accommodations. The Certified Medicaid Planner™ application materials and examination are offered only in English. Accommodations (including extended time) are not available solely on the basis of limited English proficiency.

The CMP™ Governing Board will treat all information provided by the applicant to support the applicant’s request as confidential and will use it solely to determine your eligibility for accommodations. Details about the applicant’s test accommodations will be shared only with the testing staff and will not be released to anyone else unless so authorized by the applicant.

To Support Requests for Test Accommodations

The timely submission of proper documentation will help avoid delays in decisions related to providing accommodations and other services for candidates with disabilities. Written requests for accommodations will be initially reviewed by CMP™ test administration staff. If the test administration staff determines that some or all of the documentation is missing or inadequate, additional information will be requested. The request may be approved or referred to a specialist for additional guidance. The candidate requesting accommodations can appeal any denial for accommodations to the CMP™ Governing Board using the appeal policy contained in this manual.

Purpose of the CMP™ The purpose of the Certified Medicaid Planner™ program is to serve the public by identifying professionals who meet or exceed the competency standards in the profession of Medicaid Planning. The growing cost of long-term care in the United States, when coupled to longer life expectancies mean that a growing number of people will face a health care crisis. Unfortunately, Medicare is not designed to provide benefits for long-term care. The uninsured often must turn to Medicaid as their source for long-term care financing. With the Baby Boom generation retiring, a larger number of people than ever are facing the prospect of interacting with their state Medicaid agency. The Medicaid system is one of the most complex government systems ever created. The United States Supreme Court once described the Medicaid system as “among the most intricate ever drafted by Congress”, with a “Byzantine construction” that is “almost unintelligible to the uninitiated.”1

To fully utilize the Medicaid system to achieve benefit eligibility, myriad professional disciplines merge to provide the advice and services needed. The purpose of the CMP™ examination and certification program is to ensure that there is a standard for care in the strategies and methodologies that are utilized and cross-discipline understanding of the roles of the various planning professions involved in planning for Medicaid long-term care benefits. The CMP™ program is designed to provide an examination standard and continuing educational requirements for the recognition of a professional as competent and knowledgeable of the rules, processes, procedures and strategies utilized by Medicaid Planners.

Eligibility for the Examination The CMP™ Governing Board has established eligibility standards for an applicant which include both an education requirement and an experience requirement: Education Requirement: A CMP™ can come from a variety of backgrounds, some which require degrees and some which do not. The Board respects the role that formal education and professional development has in developing the finest certificants, but also understands that the nature of Medicaid Planning draws in a number of professional expertise – many of which do not require formal education. To recognize and respect the diversity of backgrounds, the Board has established an education criterion that can be met in one of four major pathways:

PATHWAY 1: ADVANCED DEGREE The education requirement shall be automatically satisfied if the candidate provides proof of the following:

Completion of a Juris Doctorate or its equivalent from a recognized law school;

Completion of a Master’s Degree in Accounting/Accountancy;

Completion of a Master’s Degree in Health Financing; or

Completion of a Master’s Degree in Social Work. PATHWAY 2: BACHELOR OR ASSOCIATE DEGREE + 2 YEARS OF FULL-TIME EXPERIENCE The education requirement shall be automatically satisfied if the candidate provides proof of the following:

Completion of a Bachelor’s Degree; or

Completion of an Associate’s Degree.

AND Two years of full-time experience in one or more of the Medicaid planning fields (described more

fully below), including law, finance, and social work/geriatric care management, within the previous six years.

PATHWAY 3: PROFESSIONAL LICENSE OR CFP® DESIGNATION + 2 YEARS OF FULL-TIME EXPERIENCE The education requirement shall be automatically satisfied if the candidate provides proof of the following:

Holder of an insurance license for life and health insurance lines in one or more state;

Holder of a securities license (e.g., stock broker, independent investment advisor, registered

investment advisor, or Series 3, 7, 6, 63, 65, or 66 ); or

Awarded the Certified Financial Planner® designation and in good standing with the CFP® Board at the time of application.

AND Two years of full-time experience in one or more of the Medicaid planning fields (described more

fully below), including without limitation law, finance, and social work/geriatric care management, within the previous six years.

PATHWAY 4: 4 YEARS OF FULL-TIME EXPERIENCE The education requirement shall be automatically satisfied if the candidate provides proof of the following: Four years of full-time experience in one or more of the Medicaid planning fields, including law,

finance, and social work/geriatric care management, within the previous six years.

Education Review: The CMP™ program staff shall be responsible for reviewing all degrees or work history to determine if the applicant has met the required educational pre-requisites. Where achieving a degree is included in the candidate’s chosen pathway, a copy of the degree or college transcript verifying the degree must be submitted to the program. Upon request of the CMP™ staff, the candidate may be requested to have the school, college or university send a certified copy of the transcript directly to the program. Where experience is included in the candidate’s chosen pathway, the experience will be evaluated along with the experience requirement stated below. Note: Full-time employment is based on working more than thirty-five hours per week. Employment need not be continuous. A candidate with only part-time experience, defined as working less than 35-hours-a-week, needs to have at least four years of part-time experience within the last six years.

The candidate is required to provide sufficient experience history on the candidate application to verify the chosen pathway, if necessary, as well as the experience requirement below. An employer or contact person must be noted on the candidate application for each entry in order for the CMP™ staff to verify the accuracy of the experience claimed in the application. When experience is a requirement of the candidate’s chosen pathway, the CMP™ Board will not consider an application unless the appropriate amount of experience has been achieved. There will be no experience waiver granted for the educational requirement. Experience Requirement: To be a qualified applicant, the applicant must have been working in one of the following fields full-time for a minimum of two years within the six years immediately prior to eligibility for certification:

Medicaid program administration (Medicaid program caseworker/specialist, supervisor, program administrator, etc.).

Law or its equivalent (e.g., lawyer, paralegal, etc.).

Finance or its equivalent (e.g., financial advisor, banker, stock broker, insurance agent or

marketer, funeral counselor, etc.).

Accountant or its equivalent (e.g., Certified Public Accountant, Enrolled Agent, accountant, etc.).

Care management, social work or its equivalent (e.g., geriatric care management, Medicaid specialist, health care financing, long-term care underwriter, nursing home social worker/administrator, etc.).

Note: Full-time employment is based on working more than thirty-five hours per week. Employment need not be continuous. A candidate with only part-time experience, defined as working less than 35-hours-a-week, needs to have at least four years of part-time experience within the last six years. The experience requirement need not be met before the certification examination, but in the event it is not met by the time the examination is successfully passed, then the CMP will not be awarded until such time as the person has fully complied with this requirement. Proof of experience for a sufficient amount of time in each of these areas listed above shall be considered upon staff review as automatic fulfillment of the experience requirement. Proof of experience in a field that may be directly or indirectly related to Medicaid Planning may be sufficient to meet this standard, but will not be automatically considered as such. Any applicant whose work experience does not automatically qualify as fulfillment under this requirement may wish to have his or her work experience reviewed by the Board for equivalency fulfillment. The staff is required forward all requests for experience equivalency to the CMP™ Governing Board for review.

Additional information or documentation, including proof of education or experience may be submitted along with the application or may be forwarded after the application is submitted. The applicant will not be scheduled to take the CMP™ certification exam until all required documentation is provided. Acceptable forms of proof of education include college transcripts and/or degrees. Acceptable forms of proof of experience include proof of employment or licensure in a particular related field. Employment qualifying towards the experience or educational criteria shall be listed on the application and an employer or contact person shall be provided so that the CMP™ staff can verify the candidate’s experience. Once the application, the application fee, and sufficient proof of the educational and experience standards have been met, the applicant will be given instructions on taking the CMP™ certification examination. The initial application must be accompanied by a $450 application fee. The fee can be paid online at: www.cmpboard.org/application-fee.

Examination Study Guide After all the application requirements are met, each candidate is sent a study guide containing 20 sample test questions and the rationale behind the correct answer to each question. The purpose of this guide is to familiarize the candidate with the type of test questions offered on the examination.

The CMP™ Governing Board does not offer, provide or approve of any study courses which lead to obtaining the designation. There is no requirement that any candidate complete a study course before taking the examination.

Examination Policies and Procedures Once the application, the application fee, and sufficient proof of the educational and experience standards have been met (or an experience waiver is granted), the applicant will be notified and given instructions on taking the CMP™ certification examination. The Certification Exam: The CMP™ examination is a 160-question test covering a broad number of Medicaid Planning topics. The test type is multiple-choice. The test is administered at a local testing site by a professional proctor. The candidate can choose from a list of pre-approved testing centers. Most are located a major universities throughout the US. 90% of the population is within a two-hour drive of an approved testing center. If a candidate needs a closer testing center than those pre-approved, a request can be made and additional testing centers may be available. The test is provided to the local testing site and administered by a professional proctor. The test is provided in English. It is a closed-book exam. A test taker will randomly be assigned a version of the exam. If the candidate is re-taking the exam, a different version of the exam will be assigned. Test takers have 3 hours to complete the test unless additional accommodations have been made. Strict security measures are utilized at the testing center to ensure that the applicant is the person taking the exam. Nobody is allowed to take the exam for the applicant. Applicants are required to show a picture ID before their examination is given. Personal items are not permitted in the testing room. Candidates will be required to leave their personal belongings outside the testing room, including your cell phone, PDA, watch, wallet, and/or purse. Before taking the exam, the candidate will be given the CMP™ CERTIFICATION EXAM INSTRUCTIONS AND TEST SECURITY AGREEMENT and required to agree to the security terms before administration of the test. In order to maintain the integrity of the test items, the test administration and the certification program, all candidates must agree to abide by all security procedures before taking the exam. Passing Score: After taking the exam the CMP™ Governing Board will deliver a score report by email. Once enough candidates have taken the most recent version of the exam, an official passing score will be derived by a panel of experts and the Board will notify those who have taken the exam of their passage or failure. Score reports are released only to the candidate, unless the CMP™ staff receives written authorization otherwise from the candidate. Candidates can request a duplicate score report up to a year following the exam.

If a candidate fails the examination, the candidate will have one additional opportunity to take the examination which must be done within six (6) weeks of failing the exam. Otherwise, the candidate must wait six months from the date of your last failed examination and re-apply to take the exam. The CMP™ Governing Board establishes a passing score based upon review of test results through a psychometric process. After a sufficient number of candidates have taken the most recent version of the test instrument, a representative panel of experts is assembled and a panel discussion is led by a psychometrician who then provides an appropriate range for a passing score. The CMP™ Governing Board then sets a passing score within the acceptable range. If a candidate has taken the examination before a passing score has been established, this will delay the official score report. Note: Score reports are delivered to the email address provided on the candidate application. Please only provide an email address where it is acceptable to send your score report. Choosing a Testing Location: The CMP™ certification exam must be taken at a testing center with a certified proctor. This ensures that each candidate undergoes essentially the same testing environment. The CMP™ Board desires to accommodate the candidates by providing testing centers that are conveniently located through the United States. Approximately 90% of the US population is within a 2-hour drive or less of one of the available testing centers. Once a testing location is chosen and the candidate is eligible to take the exam, the CMP™ staff will arrange with the exam cite proctor to have the exam administered. The CMP™ will also generate a confirmation email that will reiterate the date, time and location for the exam. A list of the available testing sites is attached in the Appendix. Also, a geographically searchable list is available on our website at: www.cmpboard.org/locate-a-cmp-testing-center Test Day Experience: When arriving at the test center, candidates should:

arrive approximately 20 minutes prior to the scheduled test administration time; (Note: Candidates who arrive more than 15 minutes after the scheduled testing time will not be admitted; additional time will not be given to accommodate late examinees.)

present their registration confirmation email from CMP™ Governing Board; present a valid form of primary identification (defined below); and

sign the candidate log attesting that they have provided valid identification and sign the test

instructions and security agreement (if not already done), thereby agreeing to keep the contents of the examination confidential.

Wear appropriate clothing. The testing center may be overly cool or warm, so wear a sweater or sweatshirt that can be removed to adjust to the temperature of the facility.

Test Security: CMP™ candidates must present a valid form of primary identification at the testing site before being able to sign the candidate log or have the test administered. There is no exception to this policy. Acceptable forms of primary identification (photograph and signature required) include:

government-issued driver’s license or identification card; passport or passport card; permanent resident visa; and/or military-issued identification card.

Unacceptable forms of primary identification include, but are not limited to:

birth certificates; social security cards; student IDs; employee IDs; and/or marriage certificates.

All identification must be valid and must be an original document. If you fail to bring an acceptable form of identification, you will not be allowed to take the exam. There will be no refund of the examination fee. The following items are NOT PERMITTED into the testing room:

electronic communications equipment such as cellular/mobile phones, pagers, Personal Digital Assistants (PDAs), personal laptop computers, iPad®, tablet computer, Google Glass® or its equivalent;

There are no scheduled breaks during the examination session.

CMP™ candidates will be informed of the locations of the restrooms closest to the testing room and that only restroom breaks are allowed during the examination (i.e., smoking breaks are not permitted). While CMP™ candidates may take as many restroom breaks as needed; each break should not last longer than 10 minutes. Also, when multiple CMP™ candidates are taking the test during the same session, only one candidate will be allowed to leave the testing room at a time. CMP™ candidates will not receive additional time to complete the examination for time lost during a break. Misconduct: The following actions by candidates during the examination will constitute misconduct and result in an automatic dismissal from the examination, cancellation of scores, and forfeiture of examination fees:

Failure to adhere to testing site examination restrictions; Creating a disturbance, being abusive, or being otherwise uncooperative; Bringing restricted materials into the testing area; Using electronic communications equipment such as cellular phones, PDA’s, or pagers; Gaining unauthorized admission into the examination testing area; Attempting to take the examination for another individual; Possessing books, notes, or other resources and study aids; Attempting to remove, or removing scratch paper from the testing site; Recording or attempting to record examination questions or making notes; Giving help or receiving help or being suspected of doing so during or after the examination; Eating, drinking, and smoking are prohibited in the testing sites; and Discussing test questions, topic areas or scenarios, or possible answers, either during or after

the test administration, with any other person(s) which include any program administrators or other examinees or potential candidates.

Appeals to the CMP™ Governing Board Any decision concerning candidate eligibility (i.e., education or experience sufficiency or equivalency) can be appealed to the CMP™ Governing Board. Additionally, any concerns regarding a failing examination score can also be addressed to the CMP™ Governing Board. The examination questions are multiple choice and computer scored so as to eliminate any discretion or bias in the administration of the exam. However, the CMP™ Governing Board may grant extensions of time in which to take the re-test if a candidate fails based upon the applicant’s extenuating circumstances. Additionally, a candidate can appeal an adverse examination based upon testing experience factors. The pre-approved test facilities have the best possible testing environment to take an exam, but the Board recognizes that not all testing experiences are ideal. Proctors and test facility staff will work to resolve any issue that would cause the candidate from having a disparate testing environment; however, not all situations or problems can be solved at the time of testing. Test experience appeals should be based on conditions which are reported to the proctor and recorded in a form provided the proctor for test taking irregularities. Appeals can be made based upon experience for items not memorialized at the time of the exam, but greater weight will be given to situations which have been reported in a timely fashion. Any applicant who wishes to submit an appeal can do so in writing by mailing a written request to the CMP™ Board, Attn: Candidate Appeals 20325 Center Ridge Road Ste. PH-815, Rocky River, OH 44116. Confidentiality of Candidate Information

The CMP™ Governing Board is committed to protecting confidential and/or proprietary information related to applicants; candidates; certificants; and the examination development, maintenance, and administration process.

Confidential materials include, but are not limited to: an individual’s application status, personal applicant/certificant information, exam development documentation (including role delineation study reports, technical reports, and cut score studies), exam items and answers, exam forms, and individual exam scores.

Confidential Candidate Information Candidates for the CMP™ designation are required to submit an application and supporting documentation which contain personal information. Extensive physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. Personal information is accessible only by staff and the CMP™ Governing Board. All CMP™ Governing Board agents, consultants and contractors with access to personal information are also bound to adhere to this policy.

Once an applicant has passed the CMP™ certification exam and has complied with all other application criteria, the applicant receives the Certified Medicaid Planner™ designation. During the duration of the retention of that designation (and thereafter) the CMP™ Governing Board may provide some of the applicant’s information either displayed on its website in printed directories or otherwise communicated:

Whether the applicant/certificant has ever been certified by CMP™ Governing Board, the date of that certification, and, if not currently certified, the date on which certification lapsed or was otherwise terminated.

Any past and/or current public disciplinary actions against the applicant/certificant by CMP™ Governing Board.

The business name, address and phone number, fax number, email addresses and websites of the certificant.

The date the certificant’s current CMP™ certification is up for renewal.

From time to time CMP™ Governing Board may provide information other than that listed above, including but not limited to social security numbers, to government and self-regulatory organizations, to allow for the proper identification of person(s) associated with the requesting agency. However, the CMP™ Governing Board reserves the right to deny any requests for information.

The CMP™ Governing Board may release information on the rare occasions when we are required to do so by law, are involved in a lawsuit or in order to enforce agreements. The CMP™ Governing Board reserves the right, at any time, to add to, change, update, or modify this policy and may require CMP™ certificants to consent to those changes.

All information regarding a candidate/certificant’s exam scores and all other personal information submitted by candidates/certificants to the CMP™ program is kept confidential and is not released to any third party without the expressed written consent of the candidate/certificant, unless required by law.

A candidate may give written consent to the CMP™ Governing Board naming a third party to whom exam results may be mailed.

Certified individuals may elect to have their names withheld from publication in the online directory of certificants. Regardless of this election, The CMP™ Governing Board verifies the certification status of any individual upon request. This verification includes whether the individual is currently certified or not. Application status, or whether or not an individual has taken or re-taken the exam, is not released.

Required Certification Renewal Renewal Requirements Once an applicant has been certified as a CMP™, the certificant must meet the CMP™ Governing Board’s renewal standards to maintain that certification and hold himself or herself out the public as a CMP™. These standards are set to ensure that a candidate continues to enhance their knowledge and skills in all key areas of Medicaid planning through ongoing professional development activities. The renewal requirements include:

Paying the annual certification fee;

Submit a properly completed application for re-certification (every 3 years); and

Complete 20 hours of continuing education accepted by the CMP™ Governing Board, including 18 hours in the Major Medicaid Planning areas and 2 hours of Medicaid Planning Ethics.

Continuing Education To enhance professional development, each CMP™ must complete 20 hours of continuing education within the 3 years after receiving their certification and in every subsequent 3-year period thereafter. Of the 20 hours required, 2 hours must be devoted to continuing education on ethics. Of the 18 credit hours of non-ethics continuing education coursework, the courses should include at least 2 hours of each of the following subject-matter domains:

Major Medicaid Planning Domains:

Medicaid Structure – laws, rules, and procedures (Area I);

Trusts – creation, implementation, use and taxation (Area II);

Financial Services – Annuities and life insurance (Area III); and

Medicaid Advocacy – Fair Hearings, Administrative Appeals, Courts (Area IV). The Board does not provide continuing education courses. Continuing education can be provided by anyone and the Board does not support, endorse or give preference to courses provided by any one particular company or organization. A certificant is required to provide a certificate of attendance which indicates the subject matter and the amount of hours of instruction. A syllabus or course outline may also be provided as proof of attendance, along with contact information for the presenter who can verify that the CMP™ attended the program and answer any questions regarding course content. Renewal Notice The CMP™ Governing Board will send all certificants a notice six months prior to the deadline for filing the re-certification application. The notice will include the total amount of hours on record at that time

CMP™ Ethical Principles A primary objective of the CMP™ Governing Board is the setting and enforcing of a consistent standard of ethics in the practice of Medicaid Planning. A high level of ethical awareness, understanding and practice is expected of all applicants and all certificants. To achieve that objective, the CMP™ Governing Board created the CMP™ Ethics Council which has formulated the CMP™ Ethical Principles, a series of ethical principles and rules of professional responsibility that all applicants and certificants must agree to uphold. All applicants and certificants are required to act in such a way as to be consistent with the philosophy and mission of the CMP™ Governing Board. All applicants, as part of the application, must agree to abide by and uphold the highest ethical standards as a requirement for certification eligibility and certification maintenance. Any breach of the ethical standards can also lead to discipline and may involve the revocation of a certificant’s CMP™ designation. To ensure the ongoing commitment to the high standards of ethics set out for CMP™ certificants, each certificant is required to attend 20 hours of continuing education ever three years, including two hours on the ethics of Medicaid Planning. To enforce this policy, the CMP™ Governing Board has a grievance process that is available to the general public relating to unethical conduct (i.e., a violation of the CMP™ Ethics Principles) that can be demonstrably proven. Grievances filed against a certificant are carefully considered since the outcome could have a significant negative affect on the certificant’s career and could lead to disciplinary actions. A copy of the CMP™ Ethical Principals is included in the Appendix.

Disciplinary Policy The CMP™ Governing Board make take disciplinary actions against any certificant awarded the CMP™ designation for a violation of the CMP™ Ethical Principles as laid out by the CMP™ Ethics Council. The CMP™ Governing Board disciplinary policy includes the following steps for the investigation and resolution of any ethical complaint against a certificant:

Filing a Grievance. Anyone may file a grievance against a certificant; however the grievance must be strictly limited to ethical violations by the certificant. Copies of the grievance form will be provided by the CMP™ Board and are found on the CMP™ Board website at: www.cmpboard.org/grievance-form

Investigation. A staff investigation will be initiated by the filing of any grievance and the staff will report the findings of the investigation to the CMP™ Ethics Council. The investigation will provide an opportunity for the certificant to answer and rebut the charges.

Referral to Ethics Council. Any grievance found to have sufficient evidence to establish that

there is probable cause that a certificant has breached the CMP™ Ethical Principles shall be referred to the ethics council.

Hearing. The Ethics Council is authorized to conduct a hearing of the grievance and weigh the

evidence. The hearing committee is required to make a finding and report it finding to the Ethics Council.

Ethics Council Recommendation. If the hearing committee that has heard the grievance decides that there is clear and convincing evidence that a violation of the CMP™ Ethical Principles have been breached by the certificant, then the Ethics Council shall make a recommendation to the CMP™ Governing Board concerning what disciplinary action should be taken against the certificant.

Final Disposition. The CMP™ Governing Board has authority for the final disposition and implementation of any disciplinary action against a certificant. Action may include but is not limited to a temporary suspension of the CMP™ designation, requirement for additional continuing education, fines, and/or full revocation of the designation.

Anyone having their CMP™ designation fully revoked cannot re-apply to regain the designation for six years from the date of revocation and any such application will only be considered after a review of the candidate’s situation and a positive recommendation for admittance by the CMP™ Ethics Council.

APPENDIX – CMP™ Ethical Principles

Preface

As a Certified Medicaid Planner™, we recognize the importance of making known to the profession and to the general public the principles that guide our efforts to provide services to our clients. Ethical dilemmas occur when values are in conflict. The CMP™ Ethical Principles states the core values to which we are committed and embodies responsibilities of the profession in this ever-changing and evolving field. A CMP™ can significantly influence the legal and financial decisions of his or her clients. We are members of a profession explicitly committed to knowledge, intellectual decisions, and have a special obligation to accuracy, presenting information, and Medicaid planning strategies to our clients. Above all, our commitment is to our client and to their best interests.

Core Ethical Principles

The core Medicaid Planning principles are expressed in broad statements to guide ethical decision making. These statements provide a framework to guide a Certified Medicaid Planner™ in the proper conduct as they fulfill their duties to their clients:

I. Certified Medicaid Planners™ provide the highest level of service to their clients; accurate, unbiased and designed to meet the Medicaid Planning objectives of their clients.

II. Certified Medicaid Planners™ protect each client’s right to privacy and confidentiality with respect to information, both personal and financial.

III. Certified Medicaid Planners™ treat colleagues and other professionals with respect, fairness,

and good faith.

IV. Certified Medicaid Planners™ do not advance private interests at the expense of their clients, their colleagues, or other professionals with whom they associate.

V. Certified Medicaid Planners™ distinguish between personal convictions and professional

knowledge, not allowing personal beliefs or biases to interfere with fair representation of the facts.

VI. Certified Medicaid Planners™ strive for excellence in the profession by maintaining and

increasing our own knowledge and skills, by encouraging the professional development of colleagues, and by setting the best interest of our clients as our highest priority.

Rules of Professional Responsibility

The following are the Rules of Professional Responsibility that a Certified Medicaid Planner™ is expected to follow: Rule 1: The Client’s Interests Always Come First When close associations occur between a Certified Medicaid Planner™ and a client, there is almost always an opportunity for a planner to take advantage of a client who does not know as much about the topic as the planner. This rule is more significant for a Certified Medicaid Planner™ than most other types of certified advisors because many of the topics a Certified Medicaid Planner™ learns are unique topics not known by the client or the client’s other advisors. As such, the topics are easier to abuse because of the ignorance of the client and the client’s other advisors and the added credibility a Certified Medicaid Planner™ has with their CMP™ credential. The golden rule the Certified Medicaid Planner™ program is that the client’s interests always come before the interests of the certified advisor. While the golden rule sounds simple, it is rule in practice most constantly violated by non-certified planners.

When it comes to this golden rule, planners who guide themselves by common sense and the goal of always putting the client’s interests in front of advisor’s interests should not run afoul of this rule. If an advisor is honest with the client, always lays out the viable planning options with full disclosure, and gives an objective recommendation, this rule should never be violated.

This rule encompasses the “integrity,” “objectivity,” and “fairness” a Certified Medicaid Planner™ must have in order to be worthy of the Certified Medicaid Planner™ credential. The public will also have a right to expect that anyone who has earned the CMP™ credential and holds him or herself out to be a CMP™ provides planning advice in a manner consistent with this rule.

Rule 2: Confidentiality

Many of the professionals who also seek certification as a CMP™ come from a variety of fields that have inherent confidentiality rules as a condition of receiving their licenses (e.g., attorneys, certified accountants, etc.). Even for those who are not bound by licensure confidentiality requirements, other planners are generally bound by corporate codes of confidentiality and company privacy policies. The purpose of this rule is to apply a general rule concerning the confidentiality of a client’s personal information.

A Certified Medicaid Planner™ will gain the trust of a client and require the client to provide full disclosure of personal assets, liability, income, expenses, family dynamics, and actions or transactions which may cause penalties (i.e., divestment penalties or periods of ineligibility) when construed according to the Medicaid eligibility rules. As a result, a Certified Medicaid Planner™ will learn the most intimate details of a client’s life.

A Certified Medicaid Planner™ must keep all personal and financial information confidential unless a client authorizes otherwise. A violation of this rule is not simple to determine. If a Certified Medicaid Planner™ learns any information not known to the general public and shares that information with someone outside of the confidential relationship, the planner will be in violation of this rule.

As is the case in many professional office settings, a client’s information must be shared with secretaries and other colleagues in the office. A Certified Medicaid Planner™ should adopt a privacy policy for their offices that the staff and other colleagues will not share any client’s information with anyone outside of the office.

Rule 3: Professionalism

A Certified Medicaid Planner™ holds a highly-valued designation that is the only one of its kind and, as such, the CMP™ is held to a higher standard of professionalism than many other credentials may require.

A Certified Medicaid Planner™ has a responsibility to behave with dignity and courtesy to all those who use their services, fellow professionals, and those in related professions. A Certified Medicaid Planner™ also has an obligation to cooperate with fellow planners, advisors and related professionals to enhance and maintain the profession’s public image and to work jointly with other planners, advisors and related professionals to improve the quality of services.

A Certified Medicaid Planner™ has a unique credibility and specialized knowledge on Medicaid Planning topics. As such they come into contact with the public on a regular basis both in their day-to-day practice and as a guest lecturer or speaker on the subject matter. The CMP™ is expected to conduct him or herself in a manner consistent with maintaining the profession’s public image.

Rule 4: Competence

A CMP™ applicant is required to establish competence in order to receive the credential. This competence is quantified by a series of educational and experiential threshold requirements, as well as a thorough examination of the content matter and sworn allegiance to the principles contained in this policy. Beyond the threshold requirements, a CMP™ is also required to maintain continuing education throughout the term of holding the credential. Beyond the formal requirements, it is incumbent upon every CMP™ to not act or recommend action on a topic or area that they have no experience with or have not researched fully. If there is a subject matter area where the CMP™ has neglected study, has forgotten their education or training, or does not have a competent grasp, even though the CMP™ is considered certified and knowledgeable in the subject matter, the CMP™ has duty not to pursue the course of planning or to seek out those in the profession with particular skill in the subject matter area. A Certified Medicaid Planner™ is educated on topics that lend themselves to clients who are facing a health care crisis and need assistance with their Medicaid Planning. These clients expect a certain level of professionalism and diligence by their advisors.

Diligence means that an advisor should act in a timely manner to provide proper planning advice to a client. A Certified Medicaid Planner™ shall make every effort to provide advice in a timely manner, be aware of the critical deadlines in the Medicaid Planning process, and realistically advise the client of the consequences of failing to meet those deadlines. Medicaid Planning is one of the most time-sensitive and time-critical areas of planning and, as such, a CMP™ cannot be a procrastinator and expect to provide the level of service to clients that is expected with the credential.

Additionally, maintaining an open channel of communication about the progress of a Medicaid Planning case is important to the strength of the planner-client relationship. Many complaints from clients can be avoided by simply keeping a client updated on the status of drafting or implementing a plan. A CMP™ should keep clients updated and informed, and perform work in a timely manner. Additionally, a CMP™ should not take on more work than he or she can handle.

Violation

A function of the CMP™ Governing Board and the CMP™ Ethics Council is to provide a mechanism by which the tenants of this document can be enforced amongst those who hold the CMP™ credential. This allows for the program to maintain its ethical integrity and for the public to rely on those credentialed through this program as being worthy of the credential.

All applicants must agree to abide by and uphold the tenants contained within this document as a condition for the receipt and maintenance of their CMP™ credential. Violations could result in disciplinary sanctions, including suspension or revocation of the CMP™ credential.

The CMP™ Governing Board maintains a grievance procedure by which all CMP™ applicants/certificants agree to be bound. The grievance procedure allows for complaints concerning the violation of the CMP™ Ethical Principles to be lodged and investigated and referred to the CMP™ Ethics Council for adjudication. If there is probable cause to believe that a CMP™ has violated the tenants of this document, then the CMP™ Ethics Council adjudicates the matter and makes a formal report and recommendation to the CMP™ Governing Board, depending on the severity of the ethical breach. The CMP™ Governing Board is solely responsible for administering discipline.
