SENT BY CERTIFIED MAIL – RETURN RECIEPT REQUESTED May 21, 2015 Mr. David M. Yanofsky Quartz ### Road City, State ZIP RE: DOC-ITA-2014-001055 Dear Mr. Yanofsky: This letter is in response to your Freedom of Information Act (FOIA) request dated March 10, 2015, which was addressed to the Department of Commerce’s (Department) International Trade Administration (ITA). On behalf of Quartz, you sought “copies of the Office of Travel & Tourism Industries’ ‘Air Arrivals I-94 Database Annual Datafile’ from 2014, 2013, 2012, and 2011 and its associated technical documentation.” You also requested “copies of the Office of Travel & Tourism Industries’ ‘U.S. International Air Travel Statistics Report (APIS/I-92) Data files’ from 2014, 2013, 2012, and 2011 and its associated technical documentation.” After consulting with our subject matter experts within ITA, it has been determined that ITA does not maintain the records responsive to your request. Under 15 C.F.R. § 4.3(b), ITA is not required to create or compile a record to satisfy a FOIA request. The FOIA applies only to records in the agency’s possession and control at the time the agency begins its search for responsive records. Please note that the records that you are seeking are maintained by CIC Research, Inc. You may contact them by phone at (858) 637-4000, by fax at (858) 637-4040, or by mail at the following address:
CIC Research, Inc. 8361 Vickers Street San Diego, California 92111-2112
Furthermore, ITA’s National Travel and Tourism Office (NTTO) can facilitate you in obtaining the records you seek. Enclosed with this letter is a form that will allow you to obtain these records through NTTO. In accordance with 15 C.F.R. §§ 4.10(a) and (b), you have the right to appeal this determination within 30 calendar days from the date of this letter. The Department deems appeals arriving
2
after normal business hours (8:30 a.m. to 5:00 p.m., Eastern Time, Monday through Friday) as received on the next normal business day. The appeal must include a copy of the original request, this response, and a statement of the reasons why you consider the Department made this determination in error. Please mail written appeals to the below address:
Assistant General Counsel for Administration U.S. Department of Commerce 1401 Constitution Avenue, N.W. Room 5898-C Washington, D.C. 20230
You may also send an appeal via facsimile to (202) 482-2552, by e-mail to [email protected], or through FOIAonline, if you have a FOIAonline account, at https://foiaonline.regulations.gov. Clearly mark “Freedom of Information Act Appeal” on the facsimile cover sheet, in the e-mail subject line, or on both the appeal letter and envelope. The Department does not provide an opportunity for personal appearance, oral argument, or hearing of an appeal. Thank you for your interest in the ITA. Should you have any questions regarding this response, please contact me at (202) 482-7937 or at [email protected].
Sincerely, Justin Guz
FOIA Officer International Trade Administration

Justin, while this will work for the I-94, the I-92 data is not processed by CIC Research. They use it,but the data is actually processed by a NTTO staff member Richard Champley. When I shared the letter with Richard, he stated we should
DHS sends us raw I-92 data each month and we have worked with OCIO, the Commerce webmastersto create a program to take the raw data and develop the reports we sell. I also thought
For both, we rely upon sales to keep them running. If we gave the data away forfree to one, we would have to do it for all. But, since ITA requires that we charge a fee and work tomake the program funded by sales and appropriated funds, there would be no data to provide andit would also terminate several other programs we have that rely upon this data as well. I have worked with General Law (procedural), DOJ (protecting thereports), and NTTO (accuracy) in developing this response. Attached for your review is the new draft of the FOIA response letter. I knowthat we discussed saying that if we gave this information away, it would hurt our chances of beingable to obtain the information in the future but DOJ recommended that I use the rational that Iincorporated into this letter. After you confirm or edit the letter to make it accurate, is theirsomeone in ITA’s OGC that you recommend reviewing (because of the appeal process, it would be
a conflict of interest to have General Law look at it)? If not, I have a couple people. FOIA EXEMPTIONS (1) - exempts from disclosure classified national security information. (2) - exempts from disclosure records if disclosure would risk the circumvention of a statute, agency regulation, or other legal requirement. (3) - exempts from disclosure information prohibited from disclosure by another statute. An example of such a statute is section 12(c) of the Export Administration Act which protects information concerning export license applications. (4) - exempts from disclosure (1) trade secrets and (2) information which is (a) commercial or financial, (b) obtained from a person and (c) privileged or confidential. This exemption applies only to information submitted from outside the government. Information which has been voluntarily submitted is confidential if it constitutes information which the submitter would not customarily make available to the public. Information which has been compelled to be submitted is confidential if disclosure is likely to: 1) impair the government's ability to obtain necessary information in the future or 2) cause substantial harm to the competitive position of the person from whom the information was obtained. (5) - exempts from disclosure internal Federal government documents which are both pre-decisional and deliberative. In addition, the attorney work-product privilege and the attorney-client privilege have been incorporated into exemption (5). (6) - exempts from disclosure information about individuals, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy, so long as that invasion is not outweighed by a public interest in disclosure. (7) - exempts from disclosure records or information compiled for law enforcement purposes (administration, civil, or criminal.)
