CLEARANCE TO COAL BLOCKS 26th February, 2013 LSQ *24 SHRI NAMA NAGESWARA RAO Will the Minister of COAL be pleased to state:- (a) whether a large number of coal blocks allocated to the public and private sector companies are pending for environment and forest clearance; (b) if so, the details thereof along with the present status of each of these blocks; (c) the quantum of coal production envisaged from these projects and the likely drop in production for want of clearance during the 12th Five Year Plan; (d) whether the Government has taken any initiative to speed up the grant of environment and forest clearances to the coal blocks allocated to the public and private sector companies; and (e) if so, the details thereof? MINISTER OF COAL (SHRI SRI PRAKASH JAYASWAL) (a)to(e): A statement is laid on the Table of the House. STATEMENT REFERRED TO IN ASNWER TO PARTS (A) TO (E) OF THE LOK SABHA STARRED QUESTION NO. 24 FOR REPLY ON 26.02.2013 ASKED BY SHRI NAMA NAGESWARA RAO. (a)&(b): The responsibility of obtaining the Environment and Forest clearance is that of the allocatee company. The Government periodically monitors the progress of development of the blocks. The allocatees submit a status report every quarter. Based on the latest status report received from the Coal Controller Organisation the details of coal blocks where environment and forest clearance are pending is as per Annexure (c): The 12th plan envisages production of 100 million tonnes of coal from the captive blocks in the terminal year 2016-17. The production from captive coal blocks during the current year up to December 2012 is 27.66 million tonnes as against a target of 42.0. As obtaining clearances is a continuous process and production would also depend on land acquisition and other factors, it is not possible to assess any drop in production at this stage. (d)&(e): In order to address the Environmental & Development issues relating to Coal Mining and other Development Projects, Government has constituted a Group of Ministers (GoM) on 3rd February 2011. Based on the decisions of GoM, the Ministry of Environment and Forests (MoEF) has formulated a policy for parallel processing of applications for Environmental Clearance & Forest Clearance (EC & FC); MoEF initiated a proposal to open four Regional offices to ensure timely processing of proposals for forest clearances; MoEF has requested State & UT Governments to strengthen the Nodal Offices with adequate staff and infrastructure; MoEF agreed to initiate action for online processing of EC & FC proposals; MoEF has agreed to consider the enhancement in the production capacity of the existing mines up to 25% without the need for public hearing. Further, GoM has also recommended for evolving an incentive mechanism in terms of special plan grants for State Department of Forest for early processing of forest clearances. Further, in order to expedite the decisions within the Government particularly in case of large projects in the infrastructure sector which are held up due to delays in grant of clearances/approvals by the various authorities, Government has constituted Cabinet Committee on investment in January, 2013. ENVIRONMENTAL CLEARANCE TO POWER PROJECTS 26th February, 2013 LSQ 261 Shri KALIKESH NARAYAN SINGH DEO Will the Minister of COAL be pleased to state:- (a) the details of power projects that which have signed fuel supply agreements with Coal India Limited and have been allotted captive coal blocks but are still awaiting land acquisition and environmental clearance; (b) whether the EGoM has recently cancelled some captive coal blocks allotted to power projects; (c) if so, the details thereof along with the impact thereof; and (d) the alternative arrangements being made by the Government to ensure fuel supply to meet power requirements of the country? MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) Out of 176 coal blocks which stand allocated, 77 blocks are allocated to power sector including for the Ultra Mega Power Projects (UMPPs). 16 coal blocks have come into production. The remaining coal blocks are in different stages of obtaining clearances etc. As reported by the Coal Controller, the land acquisition and Environmental Clearances in respect of 42 coal blocks is pending. (b) & (c): In pursuance of the announcement of the Hon’ble Finance Minister in the budget speech for the year 2012-13, an Inter-Ministerial Group (IMG) headed by Additional Secretary, Ministry of Coal has been constituted on 21.06.2012 to undertake periodic review of the development of coal/lignite blocks allotted by the Government. The IMG took up for review of the 66 cases – 58 cases where the show cause notices were issued consequent to the Review / recommendations by the Review Committee held on 11th & 12th January, 2012 and 08 cases where a decision was taken, on the basis of earlier reviews, to deduct BG and were pending were also taken up.

The IMG recommended de-allocation in respect of 24 coal blocks. The recommendations have been accepted by the Government except incase of UrmaPaharitola coal block. De-allocation letters in respect of 22 coal blocks have been issued and in one block, namely Brahmadiha, the same would be done as per the order of the Hon’ble High Court of Jharkhand in W.P. 6658 of 2012. The details of the above blocks is as per Annexure. (d): The Government has decided to constitute an Inter-Ministerial Committee to consider, inter-alia, on the issues relating to the fuel requirements of the power plants. ILLEGAL MINING OF COAL 26th February, 2013 LSQ 328 DR SANJAY SINH SHRI HARISH CHOUDHARY SHRI RAMKISHUN Will the Minister of COAL be pleased to state:- (a) Whether illegal mining and theft of coal is allegedly being carried out in various coal mines of the country; (b) If so, the amount of revenue loss on this account and the culprits apprehended during each of the last three years and the current year, coal mine-wise; (c) The number of persons reportedly died and injured in each coal mine during illegal mining/theft during the above period;

(d) The action taken or proposed to be taken against the guilty officials involved in illegal mining and theft activities; and (e) The remedial measures taken by the Government to check illegal mining and theft of coal from various coal mines? MINISTER OF STATE FOR COAL (SHRI PRATIK PRAKASH BAPU PATIL) (a)&(b): Illegal mining and theft/pilferage of coal are carried out stealthily and clandestinely. As such, it is not possible to specify the exact quantum of coal stolen and losses incurred on account of illegal mining and theft/pilferage of coal. However, as per raids conducted by security personnel as well as joint raids with the law and order authorities of the concerned State Governments, the quantity of coal recovered & its approximate value and arrests made in subsidiaries of Coal India Limited (CIL) during 2009-10,2010-11,2011-12 and the current year 2012-13 (upto August, 2012) is given as Annexure-A. There are no instances of illegal mining and large scale theft and pilferage reported in Singareni Collieries Company Limited (SCCL). (c) : Since illegal mining and theft/pilferage of coal is carried out stealthily and clandestinely it is not possible to indicate number of deaths and injuries caused to the persons involved in these activities. (d) : As per information received from Coal India Limited and Singareni Collieries Company Limited there are no reports regarding involvement of any official in illegal mining and theft/pilferage activities. (e) : The coal companies in close association with the concerned State/District authorities, has taken several measures to prevent illegal mining and theft/pilferage of coal. The measures include :- (i) Rat holes created by illegal mining are being dozed off and filled up with stone and debris wherever possible. (ii) Trenches have been dug to isolate the illegal mining sites. (iii) Concrete walls have been erected on the mouth of the abandoned mines to control access and to prevent illegal activities in these areas. (iv) Fencing of illegal mining sites and displaying of sign boards mentioning “Dangerous and Prohibited Place”. (v) Dumping of overburden is being done on the outcrop zones. (vi) Erection of barbed-wire/wall fencing around pithead depots, static security manning including deployment of armed guards during the night hours. (vii) Sealing of illegal mining spots is resorted to. Stringent action is taken against transport vehicles caught in the act of theft or pilferage. (viii) Training of existing security personnel, refresher training of CISF personnel and basic training to new recruits in security discipline are arranged for strengthening the security set up. (ix) Engaging of lady security guards for preventing women and children indulging in theft /pilferage of coal. (x) Strengthening of the security discipline by reassessing the requirement of security personnel, horizontal movement of executives with aptitude for security work and inducting qualified security personnel at junior, middle and senior levels. (xi) Ministry of Coal has been urging from time to time the Coal Producing States to check illegal mining. The State Governments were also advised to instruct their State law enforcing authorities to take stringent action under the provisions of the Mines and Minerals (Development and Regulation) Act, 1957 curbing illegal activities.

(xii) Installation of check-post at vulnerable points to check transport documents. (xiii) The coal companies maintain close liaison with the State authorities. (xiv) Committee/task force has been constituted at different level (block level, sub- divisional level, district level, state level) at some subsidiaries of CIL to monitor different aspects of illegal mining. (xv) Regular patrolling is conducted in and around the mine including over burden (OB) dumps. (xvi) Joint patrolling with local police is also being carried out in areas. (xvii) Surprise checks/raids are conducted by flying squads of CISF/security department. (xviii) Surprise re-weighment of coal laden trucks is done, at weighbridges. (xix) Regular FIRs are lodged by the Management of the collieries and CISF with local Thana against the pilferage/theft of coal. A close watch on the activities of criminals is being maintained by CISF, etc.

ACCIDENTS IN COAL MINES 26th February, 2013 LSQ 386 SHRI A.K.S. VIJAYAN Will the Minister of COAL be pleased to state:- (a) the number of accidents including fire accidents that occurred in various coal mines during each of the last three years and the current year, State-wise and colliery-wise; (b) the number of coal mine workers who lost their lives or were seriously injured in mining operations in the country during the said period, State-wise and colliery-wise; (c) the details of cases in which due compensation has so far been paid to the next of kin of those killed and to those seriously injured during the said period along with the nature amount of compensation paid, State- wise and colliery-wise; (d) the time by which all the cases for compensation are likely to be cleared; and (e) the preventive measures taken by the Government to minimise such fatal accidents during coal mining operations? MINISTER OF STATE FOR COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a)&(b): The number fatal accidents and fatalities during last three years from 2010 to 2012 and current year up to Jan, 2013 in CIL’s mine and SCCL, State-wise, Company-wise, and Mine- wise are given in Annexure-1 and the number of serious accidents and serious injuries for the said period, company-wise, and state-wise serious injuries in the said period are given in Annexure – 2. (c): The details of cases in which due compensation has so far been paid to the next of kin of those died in mining accidents as per Workmen (Employee’s) Compensation Act, 1923, Company-wise, State-wise and Mine-wise is given in Annexure -3. (d): Five cases are pending for the year 2012, which are under process. So far as SCCL is concerned compensation for the mine accidents are cleared within a month’s time and Compensation has been paid in all the cases of last three years. Further, Compensation payment for the latest two cases (February, 2013) is under process .Ex-gratia has been paid in both the cases. (e): The following measures are taken to minimize such fatal accidents during coal mining operations:- Each and every fatal accident occurred in mines is enquired into by the officers of DGMS and based on the findings of enquiry, necessary actions are taken against the persons held responsible for the accident. The accidents in mines are analyzed and mines having higher frequency of accidents are identified. Such identified mines are kept on priority for inspections and defects/violations found during the course of inspections are constantly followed up to see that those are removed /complied with. Besides this, DGMS also takes the following measures for improvement of safety conditions in mines:

Issue of guidelines for safe operations in identified thrust areas through circulars.

Generating safety awareness and information dissemination.

Interactions at different fora with a view to promote safety, health and welfare of persons employed in mines.

Introduction of Risk Assessment and Safety Management System, preparation of Safety Management Plan and development of Emergency Response System.

Facilitating introduction of new technology in mining with low risk potential.

Further the Standing Committee on Safety in Coal Mines under the Chairmanship of Minister of Coal also discuss the Safety aspects and directed all the concerned for adhering to the best practices and aim at zero harm to miners.

MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) The Government has allocated 218 coal blocks in total so far. Out of the above 47 coal blocks have been de-allocated. 2 coal blocks were allocated again, and the de-allocation in respect of 3 coal blocks has been withdrawn. Accordingly, 176 coal blocks with reserves of around 40 billion tonnes stand allocated. Royalty is paid to the concerned State Governments after the production commences. The details of the royalty paid during the last 3 years is as under: Year Rs in lakh 2009-10 29058.80 2010-11 29963.26 2011-12 32800.71 (b) Before the introduction of competitive bidding as method of allocation, the coal blocks were allocated to private companies and government companies under the following three processes: (i) Captive dispensation route through Screening Committee The allocation of coal blocks to public/ private parties was done through the mechanism of an inter-Ministerial inter-Governmental body called the Screening Committee. The Screening Committee was chaired by the Secretary (Coal) and has representation from Ministry of Steel, Ministry of Power, Ministry of Industry and Commerce, Ministry of Environment and Forest, Ministry of Railways, Coal India Limited, CIL Subsidiaries, CMPDIL, NLC and the concerned State Governments. Allocations were decided by the Govt. on the recommendations of the Screening Committee taking into account, inter-alia, techno-economic viability of end-use project, state of project preparedness, compatibility in terms of quality and quantity of coal in a block with the requirement of end user and track record of applicant company, recommendations of the State Government and Administrative Ministry concerned etc. Allocations were decided by the Govt. in pursuance of Section 3(3)(a) (iii) of the Coal Mines (Nationalisation) Act, 1973. (ii) Under Government Company dispensation: Under the Govt. Company dispensation route, the list of blocks identified was circulated to all the Central Ministries/ State Governments applications were invited from the State Governments/Central Govt. for Government companies. Under this route, only Government companies are allocated coal blocks both for specified end use and for commercial mining by the government companies where there is no restriction of captive use. Under this arrangement, allocations were determined on the basis of, inter-alia, preference to the States which have not been allocated any coal blocks earlier, priority to the host States in order to encourage value addition within the coal bearing State, past performance of applicants in developing coal blocks, proximity of coal blocks to the proposed end use projects, recommendation / support of State Government concerned etc. Allocation was decided by the Govt. without referring it to the Screening Committee and on the basis of Revised Coal Mining Policy 2001 in pursuance of Section 3(3)(a) (i) of the Coal Mines (Nationalisation) Act, 1973. (iii) Tariff based bidding route: Coal blocks were also earmarked for the power projects to be set up on the basis of tariff based competitive bidding system. Under Tariff Based Bidding route, identified coal blocks were placed at the disposal of the Ministry of Power which determines the linkage of coal blocks with the power projects proposed to be awarded on the basis of Tariff Based Competitive Bidding by calling applications from eligible companies. The Ultra Mega Power Project (UMPP) is awarded to the successful bidder. For power projects to be selected through tariff based bidding, coal blocks are allotted based on the recommendations of the Ministry of Power in pursuance of Section 3(3)(a) (iii) of the Coal Mines (Nationalisation) Act, 1973. The terms and conditions are same as applicable for blocks allocated under the Captive dispensation through Screening Committee route. (c) As per the information provided by Coal Controller Organization coal production has started in 33 coal blocks and production from the captive blocks during 2011-12 was 36.2 million tonnes. (d) &(e): 54 coal blocks have been identified for allocation. Under Rule 4 of the Auction by Competitive Bidding of Coal Mines Rule 2012, the Government has invited applications from the

This implies a growth in coal production of 8% Compounded Average Annual Growth Rate (CAGR) during the 12th Plan period compared to the actual growth of 4.6 (CAGR) in the 11th Plan. (e):The power requirement from coal based Power Plants is estimated around 967 Billion Units (BU). In addition, the Enforcement Authorities of Ministry of Labour& Employment ensure this aspect during their inspections. ENVIRONMENTAL CLEARANCE TO COAL MINES 12th March, 2013 LSQ 2402 SHRI S. SEMMALAI Will the Minister of COAL be pleased to state:- (a) whether it is a fact that several coal mines, both in opencast and underground mines are being run in the country from the time prior to 1992 without any environmental and forest clearance; (b) if so, the details of such coal mines, company and State-wise; and (c) the steps taken by the Government in this regard? MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) & (b): Taken over mines are being operated in Eastern Coalfields Limited (ECL), Bharat Coking Coal Limited (BCCL), Central Coalfields Limited (CCL), Mahanadi Coalfields Limited (MCL) and South Eastern Coalfields Limited (SECL) on the basis of ‘Consents’ obtained from the respective State

Pollution Control Boards under the Air & Water Acts and renewed periodically. No forestry clearance (FC) was needed for these mines at that time. The details of such coalmines are as follows: i) As advised subsequently by Ministry of Environment and Forests (MoEF), ECL has divided 112 mines, which include taken over mines operated on consent to operate & 25 mines with Environmental Clearance (EC), into 13 clusters to obtain EC on cluster basis. Terms of Reference (TORs) for 11 of these clusters have already been obtained (TOR for one cluster no. 4 awaiting at MoEF) and Environmental Impact Assessment (EIA) & Environmental Management Plan (EMPs) are being prepared for holding Public Consultation. Draft EIA & EMPs for 3 clusters, 1, 6 & 9 have been submitted to the concerned State Pollution Control Board (SPCB). Notification for holding of Public Consultation for Cluster No. 9 has already been issued. These mines are located in the state of West Bengal and Jharkhand. ii) BCCL has submitted applications for 17 no. of clusters for all the one hundred and three (103) taken over mines. Out of the 17 clusters, Environmental Clearances for 8 clusters have been received. These clusters are Cluster No. I, II, III, IV, V, VII, X, and XVI having 53 no. of mines. Regarding the status of other clusters, EAC has recommended environmental clearances for no. 8, 9,12,13 and 14 and for cluster no 6 & 11 final EMP has already been submitted to MoEF. For the other two clusters i. e. 15 & 17, final EMP is under preparation. These mines are located in the state of Jharkhand. iii) CCL has eight no. of taken over mines which were being operated on consent to operate in Jharkhand. These mines include Central Saunda underground (UG, Urimari UG, Gidi A-Religara group of mines, Kathara opencast (OC), Argada-Sirka Group,Laiyo UG, Pindra UG/OC, Ara-Sarubera Group. Application for environmental clearance of these mines have been already submitted and these are also at different stages of getting environmental clearances. iv) SECL has three (3) no of mines, namely Manikpur OC, Balgi UG and Dugga OC which are taken over mines and running on consent to operate basis. Manikpur OC and Balgi UG are in Chattisgarh state while Dugga OC is in the state of Madhya Pradesh . Application for environmental clearance for these mines had been submitted and they are in different stages of obtaining environmental clearance. v) MCL has two no. of taken over mines, namely Orient no. 3 UG and Lajkura OC being operated on consent to operate basis. These are located in the state of Odissa. Application for environmental clearance for these mines had been submitted and they are in advanced stages of obtaining environmental clearance. (c): Regular meetings are being organized and held between senior officers of Ministry of Coal (MOC) and MoEF to expedite the process of obtaining Environmental clearances. Subsidiaries of Coal India Ltd are ensuring timely submission of clarifications sought on queries raised and regular follow-up with the concerned authorities of the respective Pollution Control Boards and MoEF. As a positive outcome of the ongoing dialogues between MoC and MoEF, MoEF has issued a new guideline on 19.12.2012 in suppression of earlier guidelines of 15th April 2010 for capacity enhancement (up to 25% with certain conditions). The new guidelines will be applicable to existing coal-mining projects which apply for one time capacity expansion of up to 25% in existing mining operation within the existing mine lease area. Further, nineteen (19) projects/mines of different subsidiaries of CIL have been awarded environmental clearances from January 2013 to till date. USE OF COAL FOR COOKING PURPOSES 19th March, 2013 LSQ 3457 SHRI MADHU KORA Will the Minister of COAL be pleased to state:- (a) whether the Government proposes to supply the inferior variety of coal or coal rejects to common people to be used as cooking fuel;

IMPACT OF MINING ON ENVIRONMENT 19th March, 2013 LSQ 3627 SHRI KALIKESH NARAYAN SINGH DEO Will the Minister of COAL be pleased to state:- (a) whether the Government has undertaken studies to ascertain the impact of mining, processing, end-use and waste disposal of coal on the environment; (b) if so, the details thereof including the impact of mining on groundwater levels, land degradation, air pollution in coal mining areas; (c) the reaction of the Government thereto; and (d) the remedial measures/action plan taken by the Government to address all environmental issues related to coal mining? MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a):Before starting any coal mine / project, the impact on existing environment including processing, end-use and waste disposal of coal due to coal mining projects are assessed by an Environmental Impact Assessment (EIA) study for each mine / project and based on the same Environmental Management Plans (EMP) are prepared which are approved by Ministry of Environment and Forests. (b):The impacts of mining are as follows: Ground water Levels: Ground-water level is affected between 150m to 2oom beyond the active mining area depending upon the strata condition. This is within the mine lease hold area and well within the safety zone of the mine. Depression of ground water level is noticed in the affected zone due to pumping of ground water to keep the working places workable. This is a temporary feature, which continues for two monsoons and gradually water level goes back to original level. After the closure of the mine, ground water level comes back to original. In fact some of the underground and opencast mines after closure are being used as sweet water reservoirs to neighboring population and subsoil recharging sources. Land Degradation: In the case of opencast mines, the overburden, i.e., the rock or soil overlaying the coal seam, are removed before extraction of coal. This overburden is dumped on surface as external dump till the internal dumping spaces are created. Thereafter overburden (OB) is dumped on the mined out & de-

coaled areas as internal dump. In that process the excavated area of an Opencast mine gets degraded. For underground mine, a very limited area near the mine openings is degraded. Air pollution: Air pollution in coalmines is due to the fugitive emission of particulate matter and gases .The mining operations like drilling, blasting, movement of the heavy earth moving machinery on haul roads, collection, transportation and handling of coal, screening, sizing and segregation units are the major sources of such emissions. For under-ground mine, air pollution is due to handling and transportation of coal. (c) & (d):The following corrective measures as per Environmental Management Plan (EMP’s) of the concerned coal project approved by MOEF as well as the EC conditions given by MoEF are taken up:- Air pollution control: Air pollution is being controlled by regular spraying of water on haul & coal transportation roads by fixed as well as portable water sprinklers, Coal Handling Plants, all coal transfer points, coal & overburden (OB) faces, coal stockpiles etc. Other steps include fitting drills with dust collection systems / wet drilling, black topping / concreting of coal transportation roads. Efforts are being made for use of more & more belt conveyors, rail etc. for coal transportation and minimize road transportation to reduce pollution, as per feasibility. Massive trees plantation in and around mines also minimises the impact of air pollution on neighboring areas. Water pollution control: Mine water is being passed through sedimentation pond to arrest sediments and clean runoff is being used for beneficial use such as domestic, industrial & agricultural purpose, after treatment to extent possible, before discharging into natural water courses. Effluents from workshops is passed through Oil & Grease Traps and recycled / reused for dust suppression and for cleaning purposes. In major Mines, Domestic effluents are being treated in Domestic Effluent Treatment Plants and in other mines in septic tanks. Noise pollution control: Noise pollution is controlled through the careful selection of equipment, proper maintenance and insulation. Persons exposed to high noise level are being provided with ear muffs. This is besides tree plantation between work places and residential areas. Ecological damage control: This is being controlled by plantation on physically & biologically reclaimed mined out areas & on the OB dump areas, plantation in & around mines, road sides, township / residential areas, available vacant spaces and implementation of conservation plan for protection of flora & fauna as per EC. This is apart from the payment made for compensatory afforestation to Forest departments. In addition the environmental protection measures are taken in compliance to condition of consent to operate from respective State Pollution Control Boards. Regular monitoring of various environmental attributes are carried out as per Environment (Protection) Act, 1986 to assess the efficacy of environmental protection measures taken and if required additional measures are taken to keep the various environmental attributes within the prescribed limits of the Regulatory Agencies. Health protection Coal India Limited has specific Schemes to protect the health of the people living in and around the coal mining areas/belts. As per the Corporate Social Responsibility Scheme of CIL there is a separate fund allocated @ Rs.5/- per tonne of coal production of last year and the said entire fund is year-marked for expenses towards well being of the people living in and around he coal mining areas/belts and in the state in which projects are situated. From the said fund a lumsum provision is made for project/schemes for the benefit of Tribal Population in the CSR Policy of Coal India Limited. As per

Policy out of total CSR Budget, 8% of the Budget is allocated separately and exclusively in the Annual Plan for undertaking welfare activities for the development of Scheduled Tribes Population. VIOLATION OF ENVIRONMENTAL LAWS 23rd April, 2013 LSQ 4692 SHRI BAL KUMAR PATEL SHRI KACHHADIA NARANBHAI Will the Minister of COAL be pleased to state:- (a) whether the Government/Ministry has received reports of non-processing of the proposals for environmental and forest clearance by the State Governments/coal companies and not launching prosecution against company officials involved in violation of environmental laws at the project sites in various States including in Lajkura Expansion Phase I and Belpahar Expansion, both falling in Jharsuguda, Odisha; (b) if so, the details thereof during each of the last three years and the current year, State/company-wise; and (c): the punitive action taken by the Government in each complaint along with the reasons for pendency of complaints, if any? MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) to (c): Applications for forestry clearances (FC) are submitted to concerned state Govt. authorities for necessary processing leading to final approval of the proposal for such projects where forest land is involved. Similarly, environmental clearance (EC) proposals, in prescribed formats are submitted to Ministry of Environment and Forests (MoEF) for Terms of Reference (TOR) and then draft Environmental Management Plan (EMP) is submitted to concerned state authorities for further necessary actions on completion of public hearing. During last three years, Stage-II forestry clearance has been obtained for 21 forestry proposals wherein the average pendency was about 7 years. Similarly 65 environmental proposals were given final clearance during last three years wherein average pendency was about 3 years. As on date 187 forestry proposals are awaiting clearance at various levels. Out of these, 137 proposals are awaiting clearances at state level and balance 50 proposals are awaiting clearance at MOEF level. Similarly, 54 Environmental clearance proposals are awaiting clearance at various levels. Out of which 10 are awaiting for TOR at MOEF level, 13 proposals are waiting for public consultation at State level, 16 proposals are waiting for Expert Appraisal Committee (EAC) meeting and 15 proposals are waiting for final clearance both at MOEF level. In view of delays in obtaining clearances, in some cases, in the National interest to meet rising coal demand, coal production was enhanced beyond the sanctioned EC capacity in a few projects pending clearances. However, MOEF has written to state authorities to initiate action against officials of such projects. MINISTER OF STATE FOR COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a)to(c) : The impact and effect due to coal mining on coal mining including the people living in the neighbouring areas are assessed by an Environment Impact Assessment (EIA) study and Demographic profile study in the nearby villages for each project and based on the same, Environmental Management Plans (EMP) dealing with various pollution mitigation measures to be undertaken to reduce the effect and impact of pollution on the people living in the neighbouring areas are prepared. To assess the effectiveness of the Environmental Management, regular monitoring of various environmental attributes are carried out as per Environment (Protection) Act, 1986 to assess the efficacy of environmental protection measures taken and if required additional measures are taken to keep the various environmental attributes within the prescribed limits of the Regulatory Agencies. Further mine closure plans are mandatory and are integral part of mining plans and government has issued detailed guidelines for preparation of mine closure plan and mine owners have to deposit specified amount in a fixed deposit escrow account in a scheduled bank and coal controller is the authority to ensure proper mine closure and release of amount to the mine owners on satisfactory implementation of mine closure plans as per the guidelines. As regards illegal mining Govt. of Jharkhand had engaged Indian School of Mines University (ISMU), Dhanbad and ZavierLabour Relations Institute (XLRI), Jamshedpur for conducting a study on “Illegal mining in Jharkhand and mitigation measures”. ISMU, Dhanbad and XLRI, Jamshedpur has submitted their study report in the year 2008. Further a work-order has been issued to ISMU, Dhanbad on 18.02.2013 to undertake a study to assess the extent of illegal mining in the lease-hold area of Eastern Coalfields Limited (ECL), Bharat Coking Coal Limited (BCCL) and Central Coalfields Limited (CCL) and suggest corrective measures.

MINISTER OF STATE FOR COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a)&(b): Government is aware about the reported accidents in South Garo Hills district of Meghalaya. There were news in local newspapers that on 06.07.2012 at Nengkol, in Rongsa Awe of Nangalbibra, South Garo Hills District, Meghalaya, an accident occurred due to flooding in a coal mine in which 15 persons were apprehended to have been killed. The following authorities/agencies conducted search and rescue operations including investigations into the accident: 1. National Disaster Response Force; 2. State Police Personnel; 3. State Officials of the Directorate of Mineral Resources; 4. Team of officials of the Directorate General of Mines Safety, Guwahati Region; 5. Officials of the State Labour Department. A Magisterial enquiry was also conducted by the 1st Class Magistrate, South Garo Hills District, Meghalaya. According to the reports, there was no report of missing labourers filed with the police and during search and rescue operations, they did not find any victims alive or dead inside the mine. Further, Government of Meghalaya, have not received any claim for compensation The number of fatal accidents in Assam and Meghalaya during the last three years, as per records with Directorate General of Mines Safety (DGMS), is given below: Year Assam Meghalaya 2010 1 0 2011 2 0 2012 1 0 (c)to(f): Issue of applicability of laws relating to regulation of mining activities was examined in the context of special status under the Sixth Schedule of the Constitution of India as claimed by Govt. of Meghalaya. The Ministry of Home Affairs has informed that no such notification has been issued by the President of India for non-application of the Mines Act, 1952 and the Child Labour (Prohibition and Regulation) Act, 1986 in the State of Meghalaya. However, this was to be confirmed by the State Govt. of Meghalaya and Ministry of Law and Justice. The replies of State Govt. of Meghalaya and Ministry of Law and Justice has not been received. After completion of enquiries, statutory/legal actions as deem fit including prosecution against the persons found responsible for the accidents are taken. (d) The following compensation, relief etc. to the family of deceased who died in any mine accident arising out of and in course of employment. 1. Payment of compensation under Employee’s Compensation Act - 2009 2. Employment is offered to the dependent of deceased departmental employee. In case there is no eligible person for employment, monetary compensation per month is paid to the family of the deceased in lieu of employment. 3. Rs. 5 Lakhs is paid to the dependent of deceased departmental employee as a special relief / ex-gratia, which is in addition to the amount payable under the Employee Compensation Act-1923. 4. Immediate payment of lump sum amount (generally Rs 20,000) is paid to the family of deceased for funeral, transport expenses etc. 5. Monetary benefits under Life Cover Scheme (LCS) of Rs 1,12,800/ w.e.f. 1.2.2012 as per NCWA-IX. 6. Ex-gratia amount of Rs 84,600/ in case of death or permanent total disablement resulting on account of accident arising out of and in course of employment w.e.f1.2.2012 as per NCWA-IX. 7. Gratuity on the basis of the length of service (maximum ceiling Rs, 10, 00,000). Other benefits like P.F as per CMPF rule, Pension as per CMPS, 1998, Encashment of EL etc. In case of serious bodily injury/disablement the following compensation is being paid by coal companies: I. An employee who is disabled due to accident arising out of and during the course of employment will get full basic wages and dearness allowance from the date of accident till employee is declared fit by the Company’s Medical Officer. The disabled employee will have to remain under treatment of Company’s Medical Officer or in a hospital approved /referred by the company to be entitled to the benefit. II. Compensation under the Workmen (Employee) Compensation Act-1923 is being paid to serious bodily-injured person involved with permanent disability, after due assessment of the percentageof permanent disability by an approved Medical Board. III. Ex-gratia amount of Rs 84,600/ (w.e.f 1.2.2012)as per NCWA-IXis paid to injured employee in case of permanent total disablement resulting on account of accident out of and in course of employment. (e): The following corrective measures are taken by the Government to improve the safety of workers in coal mines: (i) To promote and propagate safety awareness in mines, National Safety Awards (Mines), National Conference on Safety in Mines is organized by DGMS. The recommen- dations of National Conference on Safety in Mines go a long way in enhancing safety of mine workers. (ii) Workers participation and sensitization in matters of safety are ensured through training in safety and by initiatives like celebration of safety week and safety campaigns, etc. (iii) Safety training programmes are organized among Managers and Supervisors for improving safety standards in mines. (iv) Risk Assessment Techniques are being introduced aimed at elimination of risks and to ensure safety of workmen. (v) Standard operating procedures are established to avoid unsafe practices in mines. (vi) A special safety awareness campaign has been launched to increase awareness of mine workers. i.e., ‘Safety is My Responsibility’ and steps have been taken to propagate the same. In addition, Coal India Ltd (CIL) has also taken the following measures to improve standard of safety: 1. CIL has established a structured multi-disciplinary Internal Safety Organization (ISO) to assist the line management at various levels in matters related to Safety.

2. Risk Assessment & Safety Management Plan: CIL has introduced risk assessment based Safety Management Plan in its mines. It is an on-going cyclical process. 3. Safety Audit of the mines is being conducted time to time. 4. For reduction of Roof/Side falls accident # Stress on face mechanization to reduce exposure of workmen in active working zone. # Support Plan based on Rock-mass-rating (RMR) of over-lying roof strata. # Greater use of Roof Bolting for roof support. # Introduction of mechanized drilling by the advanced roof bolting machines. # Introduction of resin capsules particularly for watery seams. # Emphasis on development of indicators for detecting impending load on roof through R&D. # One laboratory has been commissioned at CMPDI, Ranchi for testing of physical and chemical properties of capsules. 6. For reduction of accident at Opencast as well as on Surface of Mine: # Surface miners are being used in several opencast mines of CIL, which are safe and eco-friendly. # Mine-specific Traffic Rules have been framed and circulated. # Code of Practices for HEMM operators, Maintenance staffs & others. # Standard Operating Procedure related to safe operation of various mining operations. # Safety Management Plan based on Risk Assessment for every opencast have been prepared and implemented. # Training of Contractor’s Workers involved in transporting jobs # Introduced Simulation based training for tipper & dumper operators / HEMM operator. 7. Special Safety Drives are conducted periodically to assess the level of compliance of safety norms in each mine. Annual safety fortnight is also conducted once every year for the same purpose. 8. Other safety measures initiated recently: # Special training programme for safety officers and other key mining officials directly engaged in ensuring safety at mine by the SIMTARS, Australia accredited trainers. # Several R&D projects on safety have also been initiated. # High-wall mining has been started at Sharda Opencast Mine of SECL, which is safe mining system. # Spreading knowledge and coal mine safety related information through publication of quarterly safety bulletin from CIL. MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a)and(b): The Government has approved a Master Plan in August, 2009 to address the issues of dealing with fires, rehabilitation of people from endangered areas and for taking up surveys for diversion of surface infrastructure wherever required in the Jharia Coalfield for the leasehold areas of Bharat Coking Coal Limited (BCCL) with an outlay of Rs.7112.11 crore for implementation in ten years’ period, excluding two years of pre-implementation. Jharia Rehabilitation and Development Authority (JRDA) of Government of Jharkhand has been made the nodal agency for rehabilitation of non-BCCL people. Government of India will fund the rehabilitation and provide technical support through BCCL. (c)and(d): Revision of the cost of the Master Plan has not been done. (e): The rehabilitation work has already started and till October, 2013, 1165 non- BCCL families had been shifted to Belgoria Rehabilitation Township. 344 houses have been constructed for BCCL employees and the same have been occupied by the employees of BCCL from the endangered areas. Further, 1152 dwelling units have also been constructed by BCCL for shifting its employees. ADVERSE IMPACT OF COAL MINING ON ENVIRONMENT 17th December, 2013 LSQ 2040 SHRI RAM SUNDAR DAS Will the Minister of COAL be pleased to state:- (a) whether the Government has made any study about the adverse impact of coal mining on the social forestry, environment and health of the people living in an around the coal mining areas/belts; (b) if so, the details thereof; and (c) the remedial steps taken by the Government in this regard? MINISTER OF STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) & (b): Coal mining activities have some impact on social forestry, environment and health of people living in and around the local mining areas / belts. Before commencement/enhancement of production from coal mines, the impact on existing Social forestry and environment due to coal mining project are assessed by an Environment Impact Assessment (EIA) study for each project and based on the same, Environmental Management Plans(EMP) are prepared. EMPs deal with measures to be undertaken to mitigate the impact of pollution, in order to reduce any adverse effect on health of people in & around mine, as per requirement of the project. The EMPs are submitted to Ministry of Environment and Forests (MoEF) for obtaining Environmental Clearance (EC). (c): The following corrective measures as per Environmental Management Plan (EMP’s) of the concerned coal project approved by MOEF as well as the EC conditions given by MoEF are taken up:- Air pollution control: Air pollution is being controlled by regular spraying of water on haul & coal transportation roads by fixed as well as portable water sprinklers, Coal Handling Plants, all coal transfer points, coal & overburden (OB) faces, coal stockpiles etc. Other steps include fitting drills with dust collection systems/wet drilling, black topping/concreting of coal transportation roads. Efforts are being made for use of more & more belt conveyors, rail etc. for coal transportation and minimize road transportation to

reduce pollution, as per feasibility. Massive trees plantation in and around mines also minimises the impact of air pollution on neighboring areas. Water pollution control: Mine water is being passed through sedimentation pond to arrest sediments and clean runoff is being used for beneficial use such as domestic, industrial & agricultural purpose, after treatment to extent possible, before discharging into natural water courses. Effluents from workshops is passed through Oil & Grease Traps and recycled/ reused for dust suppression and for cleaning purposes. In major Mines, Domestic effluents are being treated in Domestic Effluent Treatment Plants and in other mines in septic tanks. Noise pollution control: Noise pollution is controlled through the careful selection of equipment, proper maintenance and insulation. Persons exposed to high noise level are being provided with ear muffs. This is besides tree plantation between work places and residential areas. Ecological damage control: This is being controlled by plantation on physically & biologically reclaimed mined out areas & on the OB dump areas, plantation in & around mines, road sides, township / residential areas, available vacant spaces and implementation of conservation plan for protection of flora & fauna as per EC. This is apart from the payment made for compensatory afforestation to Forest departments. In addition the environmental protection measures are taken in compliance to condition of consent to operate from respective State Pollution Control Boards. Regular monitoring of various environmental attributes are carried out as per Environment (Protection) Act, 1986 to assess the efficacy of environmental protection measures taken and if required additional measures are taken to keep the various environmental attributes within the prescribed limits of the Regulatory Agencies. Health protection Coal India Limited has specific Schemes to protect the health of the people living in and around the coal mining areas/belts. As per the Corporate Social Responsibility Scheme of CIL there is a separate fund allocated @ Rs.5/- per tonne of coal production of last year and the said entire fund is year-marked for expenses towards well being of the people living in and around he coal mining areas/belts and in the state in which projects are situated. From the said fund a lumsum provision is made for project/schemes for the benefit of Tribal Population in the CSR Policy of Coal India Limited. As per Policy out of total CSR Budget, 8% of the Budget is allocated separately and exclusively in the Annual Plan for undertaking welfare activities for the development of Scheduled Tribes Population. DELAY IN COAL PROJECTS DUE TO ENVIRONMENTAL CLEARANCES 11th February, 2014 LSQ 3292 SHRI P. These issues are also addressed by the Ministry of Coal in its meetings with Ministry of Environment & Forests and the concerned State Governments on a regular basis. Further the Project Monitoring Group of the Cabinet Secretariat also takes up the pending issues with the concerned Ministries as well as concerned State Governments with a view to resolve the pending issues and expedite implementation of the projects.

In addition, the Cabinet Committee on Investment (CCI) is also monitoring the implementation of the projects and addressing the procedural delays with a view to resolving the same and expedite implementation of the projects. SAFETY IN COAL MINES 18th February, 2014 LSQ 3944 SHRI AJAY KUMAR Will the Minister of COAL be pleased to state:- (a) whether the Government has issued any instructions to both Government and private coal companies regarding safety of the mine workers; (b) if so, the details thereof; (c) whether the Government has developed any mechanism to ensure that the safety instructions are followed scrupulously by the coal companies; (d) if so, the details thereof and if not, the reasons thereof; and (e) the plans /efforts made by the Government to develop research and development in coal mining in order to bring the latest technology in coal sector in the country with a view to augment coal production and ensure the safety of mine workers? MINISTER OF THE STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a)&(b) The Government have taken the following steps to ensure safety of mine workers in both Government and private coal companies: (i) The matters relating to safety, health and welfare of persons employed in mines are covered under the Mines Act, 1952 and Rules and Regulations made thereunder. (ii) The Coal Mines Regulations, 1957 deal with safety provisions to be adopted in coal mines. (iii) The provisions relating to medical examinations, standards of health and sanitation, employment of persons including welfare amenities are made in the Mines Rules, 1955. (iv) All fatal and serious accidents including dangerous occurrences especially due to roof fall, fires, explosives, gases and many other causes are enquired into by Director General of Mines Safety (DGMS). (v) After completion of enquiries, statutory/legal actions as deem fit including prosecution against the persons found responsible for the accidents are taken. (vi) Accidents are also technically analysed in details and based on findings of such analysis, technical circulars, instructions and guidelines are issued on various causes and failures to improve the standards of safety in mines and prevent recurrences. (vii) In order to make the mine workers and management more aware about the safety and health issues, safety week/fortnight, rescue and first-aid competitions are organized in the mines every year. National Safety Awards are also granted to the mine workers and management each year. (viii) Directives in the form of circulars, guidelines and instructions are being issued by DGMS from time to time, identifying the thrust areas on various subjects to improve safety and health conditions of mine workers.

(c)&(d) To see that the mine management carries out the mining operations in accordance with the safety instructions, officers of Director General of Mines Safety (DGMS) make periodic inspections of mines and conduct enquiries into accidents and complaints. In case of non- compliance or violations observed by the Inspecting officers, notices, prohibitory orders and even prosecutions are launched in appropriate courts of law by DGMS. (e) In order to bring the latest technology in coal sector with a view to augment coal production and ensure the safety and to promote R&D in this regard a Standing Scientific Research Committee (SSRC) under the chairmanship of Secretary (Coal) exists which oversee the R & D projects in coal sector. Following two R&D projects relating to latest technology and safety have been taken up by SSRC recently:- (i) Development of Self Advancing (mobile) Goaf Edge Supports for depillaring operations in underground coal mines. (ii) Integrated communication system to communicate and locate trapped underground miners. Further, the R & D Division of Coal India Limited has taken up following R & D projects. # Construction of quick setting stopping by using expansion foam agent to isolate fire. # Development of notch cutting machine to facilitate construction of stopping in UG. # Eliminating the possibility of ignition of gas and incidences of explosion in UG mines due to electric fault by application of innovative technology of fault diversion. # Studies on determination of free Silica (Alfa-content) in respirable air borne dust in coal mines and preparation of data bank of free Silica and other minerals present in dust as well as in coal. In addition, Coal India Limited (CIL) has also engaged a consultant for the study of modernization and upgradation of CIL mines. COAL BLOCK ALLOCATION IN GREEN BELTS 18th February, 2014 LSQ 3982 SHRI CHANDRAKANT BHAURAO KHAIRE Will the Minister of COAL be pleased to state:- (a) whether the coal blocks situated in the green belts where basic infrastructure like roads and rail connectivity are lacking, have been allotted to the private companies; (b) if so, the details thereof and the reasons therefor; and (c) the steps being taken by the Government to improve the necessary infrastructure for development of these coal blocks? MINISTER OF THE STATE IN THE MINISTRY OF COAL (SHRI PRATIK PRAKASHBAPU PATIL) (a) to (c) Coal blocks are identified on the basis of natural geological formation which could have been situated in the forest area also, lacking basic infrastructure like roads and rail connectivity. The responsibility of development of the allocated coal block and required infrastructure as well as obtaining all necessary statutory clearances, including environment and forest clearances, from the respective authorities entirely rests with the allocatee company.
