‘nutrition claim’ means any claim which states, suggests or implies that a food has particular beneficial nutritional properties due to:
(a) the energy (calorific value) it
(i) provides;
(ii) provides at a reduced or increased rate; or
(iii) does not provide; and/or
(b) the nutrients or other substances it
(i) contains;
(ii) contains in reduced or increased proportions; or
(iii) does not contain;

There are only 5 approved health claims for
cognitive function at present:
Iodine contributes to normal cognitive function
Iron contributes to normal cognitive function
Water contributes to the maintenance of normal
physical and cognitive functions
Zinc contributes to normal cognitive function
Iron contributes to normal cognitive
development of children

Claims based on new or emerging scientific evidence,
including those submitted with a request for protection of
proprietary data
• Require pre-market authorisation following EFSA
evaluation of scientific dossier
• Maximum time limit of 8 months for a decision by the
Commission
• Approved claims may be used on any product meeting
specified conditions of use….
• Unless data protection granted; in this case the data (and
hence the claim) cannot be used by any other business for
5 years

that states, suggests or implies that the consumption of a food
category, a food or one of its constituents significantly reduces
a risk factor in the development of a human disease

Medicinal Claims
Regulation (EU) No. 1169/2011 prohibits attributing
to any foodstuff the property of preventing,
treating or curing a human disease, or
any reference to such properties
• Medicinal claims remain prohibited for foods
• Regulation 1924/2006 allows disease risk reduction
claims with prior authorisation
• Disease risk reduction claims were prohibited in most
Member States prior to Regulation 1924/2006

Ethics?
• In sports there are a lot of problems with doping to
