About Project Open Voice Project Open Voice is a commitment to broaden the discovery of local content, including public, educational and government (PEG) programming. We seek to address the questions of diverse demand for local content in different communities and the variety of ways to deliver it. Comcast is working in six trial markets to find answers: Peterborough, NH; Medford, MA; Philadelphia, PA; Hialeah, FL; Houston, TX; and Fresno, CA.

Because of Comcast’s commitment to PEG in local communities, they became a focal point for the project. Working with those providers, along with community leaders, non-profits and independent producers, we developed online and OnDemand platforms for all partners to use freely. We will continue to learn & adapt, and encourage you to explore Project Open Voice regularly.

Project Open Voice Introduction Comcast is committed to the creation and delivery of Interactive Broadband products and services that enable people to simplify and enhance their lives. Project Open Voice (POV) is a Comcast initiative designed to strengthen delivery of local content, including Public, Educational and Governmental (PEG) programming.

Specifically, POV is an online and POV OnDemand platform designed to supplement new and existing efforts from PEG providers, independent producers and other sources of local content and events. Critical to each market are the local partnerships with agencies, community organizations, City officials and programmers, who both determined the market requirements so Comcast could provide the technology and tools to address those needs, and will provide the content for the POV platforms.

Through POV, Comcast provides communities with a wonderful opportunity for local organizations, including public, education, and governmental access media to gain web, POV OnDemand, mobile and marketing resources. To provide those services, below we describe what is expected of our Content Partners in a relationship with Comcast through POV.

BELIEFS AND RIGHTS

• We believe that it is important for all of us to treat each other with consideration and respect.

• The behaviors that we demonstrate reflect the attitude of respect and dignity for all. • Our goal is to provide a safe and professional interactive media environment for all

community members • With the restrictions described below understood, no Comcast staff or agent will exercise

editorial control over video content

Therefore, the following standards for Content Partners have been developed. Violation of any one of these standards can result in loss of privileges on Project Open Voice platforms. As such, Comcast and its agents have full authority and discretion to deny access privileges as and when it deems appropriate.

Comcast’s POV websites and POV OnDemand channels are a medium for expression and free speech. No individual will be denied the use of the POV websites on the basis of race, sex, age, physical disability, religion, or political belief. It is hoped that POV Content Partners will utilize this resource as a means to distribute a wide variety of programs.

Comcast or an agent of Comcast will provide training in the use of the POV platform along with technical assistance for ongoing use. Neither the Comcast staff nor agents of Comcast are available to serve as a production crew to make programs or cover events for POV Content Partners.

Comcast reserves the right to review all definitions and policies contained in this, and related, documents and has the discretion to interpret, implement and make changes as deemed necessary.

GROUP INFORMATION & PROCESS

• An entity may become a Content Partner through: a) invitation or b) application through a local POV website

• Content must be: (a) created locally, (b) about the local market or (c) directly related to the local community

• Content Partner must provide at least 3-10 assets, depending on the POV market, within 10 days of receiving training. Assets may include any combination of videos, events, projects, images and interactive media.

• Content Partners are fully responsible for the content of all program material • Content Partners have program rights and privileges as outlined in the Terms of Service,

Community Standards and Privacy Policy • Groups with Public, Educational or Government Access linear channels on the Comcast

cable system will receive dedicated folders on the video-on-demand system in addition to virtual channels on the website

• Public Access – Channel time, available on a first-come, first-served, nondiscriminatory basis, specifically for noncommercial access programming by local residents, non-profit organizations and local, state or federal agencies

• Educational Access – Channel time on linear cable system reserved for noncommercial educational access programming

• Government Access – Channel time reserved for federal, state, and local officials to disseminate information to their constituents via cable television

For all POV Content Partners

• Any video content on POV websites is eligible for POV OnDemand and may be placed in folders that align with the website categories if it meets a minimum level of monthly consumer activity online

• Each month, the most active videos as determined by web and social activity will be placed in POV OnDemand as long as they meet the technical specifications

GENERAL TECHNICAL QUALITY GUIDELINES • Programming must meet minimum technical quality standards. • Video quality must be sufficient to achieve a stable picture during playback. Unstable video

may result in the program being rejected. • Audio quality must be constant and of sufficient level to permit adequate reproduction

during playback • If an abnormal number of production problems with videos, (i.e. poor audio or video), is

observed the Content Partner may be asked to re-apply • POV OnDemand technical specifications will be supplied as needed or requested

CONTENT POLICIES

Adhere to policies – Strict following of all elements of the Content Partner Guidelines, Terms of Service, Privacy Policy and Community Guidelines

Prohibited Material • Political advertising – Message promoting any person who has publicly announced

candidacy by formal declaration and meets the legal qualifications for office • Commercial advertising – Calling public attention to one’s product, service, need,

candidate, etc. for profit-making purposes. Includes solicitation of money for such through text, video or images

• Libel - Written, printed, or character generated statement(s) that damage a person’s reputation. Signs or pictures may also constitute libel

• Obscene material – Material which fits the legal definition of obscene or indecent material under local and state laws

• Slander – A false oral statement that is meant to defame a person’s character • Privacy & publicity – Material that invades privacy or publicity rights, or which may violate

any other local, state or federal law • Property damage & injury- Program material that creates:

o The immediate danger of damage to property or injury to persons o The obstruction of law enforcement or functions or services o The deprivation of any person by threat, threat of force or physical action through

the exercise of a legal right, or o The disturbance of any person in the enjoyment of a legal right; or the creation of a

public nuisance o Lotteries - Lotteries or lottery information except as allowed by FCC regulations.

Lotteries are defined as “any game, contest, or promotion that combines the elements of prize, chance, and consideration.”

Violators may be subject to fines and even criminal penalties for lotteries which are not authorized or otherwise permissible by the state. Exceptions include when conducted by a non-profit or governmental organization

Underwriting and Sponsorship is allowed – Goods, services, or in-kind contributions that aid in developing and improving a program are permitted. Program end credits may include the name of underwriters or sponsors

Ownership – As stated in the Indemnity Letter, Content Partners, by loading content into a Project Open Voice website, is representing that they have ownership of rights to all material and that the content does not violate any copyright, trademarks or other intellectual property.

Disclaimer – Comcast and Comcast agents reserve the right, at their sole discretion, to include the following notice alongside, before and/or after a program: “The views expressed on the following [or “preceding”] program are those of the individual producer and do not necessarily reflect those of Comcast. Comcast is not responsible for the production or quality of the program being cablecast.”

Project Open Voice Community Policy Within the Project Open Voice Web Services the term “Comcast“, “POV” or “we” will refer to Comcast Cable Communications Management, LLC, Comcast Interactive Media, LLC, and their respective subsidiaries, agents, partners and affiliates that own and operate Websites and Internet services on their behalf. The term “you” refers to you as a user of Comcast’s Websites or Internet services described below.

These Terms set forth the terms and conditions through which Comcast will permit you to use the Project Open Voice (“POV”), Comcast-owned and operated websites and services: www.projectopenvoice.com, www.gottalovefresno.com, www.houstonsvoice.com, www.locallookpeterborough.com, www.madeinmedford.com, www.phillyinfocus.com, www.yosoyhialeah.com (the “POV Web Services“)

When you use the POV Web Services, you agree to the terms of this Community Policy as well as the Terms of Service located at www.projectopenvoice.com/terms-of-service/ and the Privacy Statement located at www.projectopenvoice.com/privacy-policy. In addition to these terms and policies, here are specific rules that apply to the community, social media and blog areas of the POV Web Services:

1. We will listen to you and join in the conversations. We will engage in the conversations in this community. However, the comments and opinions appearing in this community are personal opinions and may not necessarily be those of Comcast, its management, employees, agents, partners or affiliates.

2. We moderate this community. We will review all submissions to this community. We may remove comments that violate the policy, off-topic, disrespectful or that receive multiple community flags from other visitors.

3. We want conversations to be polite, on-topic, and respectful. Keep all submissions focused on the topic being discussed. Do not include any content that is, or could reasonably be considered, defamatory, obscene or sexually explicit, illegal or unlawful, threatening, infringing the privacy rights of any person, or infringing the intellectual property rights of any person or entity. If you have any complaints about content on the community, please contact the appropriate group for the site as noted in the About Us section.

4. We want this community to be a safe place to have conversations. We welcome submissions that comply with the policies and terms that apply to this community, but will protect the community from abuse or other similar activities. For example, we may remove submissions from those who submit spam or other unwanted communications and refuse to post submissions from specific Internet protocol (IP) addresses or e-mail addresses. We also may not post comments if they contain certain content in submissions. For example, we may not post some HTML code, links to websites, or e-mail addresses.

5. We respect your privacy. We will ask you to provide a valid e-mail address or log in to the website with your chosen social media information in order to register to make submissions to this community. We will not publish your e-mail address or social media profile URL, but we may use it to contact you directly if we need to communicate with you.

Project Open Voice Web Terms of Service 1. About the Web Services Terms of Service and POV Web Services

Within these Web Services Terms of Service (“Terms“) the term “Comcast” or “we” will refer to Comcast Cable Communications Management, LLC, Comcast Interactive Media, LLC, and their respective subsidiaries and affiliates that own and operate Websites and Internet services on their behalf. The term “you” refers to you as a user of Comcast’s Websites or Internet services described below.

These Terms set forth the terms and conditions through which Comcast will permit you to use the Project Open Voice (“POV”), Comcast-owned and operated websites and services: www.projectopenvoice.com, www.gottalovefresno.com, www.houstonsvoice.com, www.locallookpeterborough.com, www.madeinmedford.com, www.phillyinfocus.com, www.yosoyhialeah.com (the “POV Web Services“).

What is outside the scope of these Terms?

These Terms do not apply to your use of any other products or services provided by Comcast such as XFINITY, Comcast Digital Cable with On Demand, Comcast Digital Voice, and Comcast High Speed Internet. If you subscribe to or use one or more of these services, you can see the terms that apply to the residential versions of these services by visiting http://www.comcast.com/Corporate/Customers/Policies/Policies.html.

These Terms also do not apply to your use of the XFINITY TV Store (xfinitytvstore.comcast.net). Comcast’s use of the information you provide through the XFINITY TV Store is described in the XFINITY TV Store Privacy Policy, available at http://xfinitytvstore.comcast.net/TermsOfUse.aspx. Some of the POV Web Services contain links to other Websites, including Websites of third parties who are acting on our behalf as our agents, suppliers, or providers. These other Websites are not operated by Comcast and have their own terms of service that we encourage you to read before you use them. Other sites that we link to may contain Comcast branding, but these non-Comcast Websites and resources are provided by companies or persons other than Comcast. Examples of these non-Comcast Websites include Websites where you are required to log-in using a username and password other than your username and password for the POV Web Services, such as the Jobs channel and the Dating channel on Comcast.net. These Terms do not apply to those non-POV Web Services. Those sites will have their own terms of use that we encourage you to read before you use them.

2. Accepting These Terms

In order for you to use any of the POV Web Services, you must first agree to abide by the Terms. You can accept these Terms by:

1. Checking the box next to “I have read and agree to the Terms of Service” (or similar language); or

2. Using any of the POV Web Services, in which case you understand and agree that these Terms will apply to your use of those services (or any parts of them).

Before you continue to use the POV Web Services, you should print or save a local copy of the Terms for your records.

3. Registration

In order to use the POV Web Services you may be required to provide information about yourself (such as identification or contact details) as part of the registration process. You agree that any registration information you give to Comcast will be accurate, correct, and current.

4. Prohibited Uses

You specifically agree not to:

• use the POV Web Services to undertake or accomplish any unlawful purpose, including but not limited to, posting, storing, transmitting or disseminating information, data or material which is libelous, obscene, unlawful, threatening or defamatory, or which infringes the intellectual property rights of any person or entity, or which in any way constitutes or encourages conduct that would constitute a criminal offense, or otherwise violate any local, state, federal, or non-U.S. law, order, or regulation;

• post, store, send, transmit, or disseminate on the POV Web Services any information or material which a reasonable person could deem to be unlawful;

• upload, post, publish, transmit, reproduce, create derivative works of, or distribute on the POV Web Services in any way information, software or other material that is protected by copyright or other proprietary right, without obtaining any required permission of the owner;

• post on the POV Web Services unsolicited bulk or commercial messages commonly known as “spam;”

• send very large numbers of copies of the same or substantially similar messages, empty messages, or messages which contain no substantive content, or send very large messages or files that disrupt a blog, newsgroup, chat, or similar feature of the POV Web Services;

• initiate, perpetuate, or in any way participate in any pyramid or other illegal scheme through the POV Web Services;

• participate in the collection of very large numbers of e-mail addresses, screen names, or other identifiers of others (without their prior consent) from the POV Web Services, a practice sometimes known as spidering or harvesting, or participate in the use of software (including “spyware”) designed to facilitate this activity;

• collect responses from unsolicited bulk messages posted on the POV Web Services;

• impersonate any person or entity, engage in sender address falsification, forge anyone else’s digital or manual signature, or perform any other similar fraudulent activity (for example, “phishing”) on the POV Web Services;

• restrict, inhibit, or otherwise interfere with the ability of any other person, regardless of intent, purpose or knowledge, to use or enjoy the POV Web Services (except for tools for safety and security functions such as parental controls, for example), including, without limitation, posting or transmitting any information or software which contains a worm, virus, or other harmful feature, or generating levels of traffic sufficient to impede others’ ability to use, send, or retrieve information;

• register under the name of, nor attempt to use the POV Web Services under the name of, another person;

• allow another person to access the POV Web Services using your credentials; • access (or attempt to access) the POV Web Services through any automated means

(including use of scripts or web crawlers), except through APIs or other interfaces specifically provided for this purpose, or violate the instructions set out in any robots.txt or similar file present within the POV Web Services;

• engage in the systematic retrieval of data or other content from the POV Web Services, except though APIs or other interfaces specifically provided for this purpose, to create or compile, directly or indirectly, a collection, compilation, database or directory, without Comcast’s prior written consent;

• capture, rip, download, or otherwise create a copy of any content that is shown on the POV Web Services without obtaining any required permission of the content owner; or

• take any actions for the purpose of manipulating or distorting, or that may undermine the integrity and accuracy of, any ratings or reviews of any movie or other entertainment program, service or product that may be presented by the Comcast Service.

• attempt to or actually circumvent any method used by Comcast to control access to the Web Services, including, but not limited to, spoofing or otherwise impersonating an IP address for your computer that is not actually assigned to your computer or setting up a proxy or other device that allows others to access the Web Services through it.

If you are a Comcast High Speed Internet customer, you can find the guidelines for acceptable use of the Internet service, including any Comcast email or webmail services, at http://www.comcast.com/Corporate/Customers/Policies/Policies.html.

5. Your Passwords and Unauthorized Use of Your Account

You agree and understand that you are responsible for maintaining the confidentiality of the password(s) you use to access the POV Web Services. Accordingly, you agree that you will be solely responsible to Comcast for all activities that occur under your POV Web Services accounts, and will be responsible for any breach of these Terms caused by these activities. If you become aware of any unauthorized use of your password or of your account, you agree to notify Comcast immediately.

6. Privacy and Your Personal Information

7. Content on the POV Web Services

The POV Web Services will allow you to access information, such as collections of data, video, audio, or other multimedia, and photographs and other static images (the “Content“). This Content may be owned by Comcast, other companies that give Comcast the right to distribute their Content (like movie publishers), or users of the POV Web Services (like you). Comcast grants you a limited license to view the Content and to use the POV Web Services for personal, non-commercial purposes as set forth in these Terms or in a manner that does not require a license. Unless the Content was legally posted by you on the POV Web Services or you use one of the variety of content sharing tools provided by the POV Web Services, you may not distribute copies of the Content in any form (including by e-mail or other electronic means), without prior written permission from its owner except as permitted by law. Of course, you are free to encourage others to access the Content and to tell them how to find it, including using the sharing tools provided by the POV Web Services.

In addition, our Content providers want to remind you that you must not remove, alter, interfere with, or circumvent any copyright, trademark, or other proprietary notices marked on the Content or any digital rights management mechanism, device, or other content protection or access control measure associated with the Content. The copying, downloading, stream capturing, reproduction, duplication, archiving, distribution, uploading, publication, modification, translation, broadcast, performance, display, sale, or transmission of the Content is strictly prohibited unless it is expressly permitted by Comcast in writing or through tools provided by POV Web Services. You may not incorporate the Content into any hardware or software application. This prohibition applies even if you intend to give away the derivative materials free of charge.

You understand that by using the POV Web Services you may be exposed to Content that you may find offensive, indecent or objectionable. In this respect, you use the POV Web Services at your own risk. If you would like to use them, there are commercially available services and software that can limit exposure to material that you may find objectionable. For those who are customers, the Comcast High Speed Internet service provides security information and tools for all users, including parents, at http://security.comcast.net. Some of the tools may require that you be a registered Comcast High Speed Internet user in order to download and use them.

8. User Submissions

Some of the material appearing on the POV Web Services will be provided by users. Comcast does not claim ownership of any material that users submit or post on the POV Web Services. You agree

that you are solely responsible for (and that Comcast has no responsibility to you or to any third party for) any material that you create, transmit, or display while using the POV Web Services, and for the consequences of your actions (including any loss or damage which Comcast may suffer) by doing so. Further, you agree that, with respect to any communication you submit to us for posting on the POV Web Services, you will not: (i) include any content that violates a third party’s copyright or other proprietary or privacy rights; (ii) publish falsehoods or misrepresentations portrayed as fact; (iii) include any advertising or solicitations; or (iv) submit any material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise clearly inappropriate.

If you post any content to the POV Web Services, you hereby grant Comcast and its licensees a worldwide, royalty-free, non-exclusive right and license to use, reproduce, publicly display, publicly perform, modify, sublicense, and distribute the content, on or in connection with the POV Web Services or the promotion of the POV Web Services, and incorporate it in other works, in whole or in part, in any manner. You represent and warrant that you own the content or otherwise have sufficient rights in it to grant to Comcast the license set forth in this section without infringing or violating the rights of any third party. If you remove content that you have posted to the POV Web Services or terminate your POV Web Services account, this license will automatically expire, with a few limited exceptions. Comcast may retain, but will not actively use, copies of your data that were archived in the normal course of Comcast’s database backups. In addition, copies of content that you have shared with other users of the POV Web Services may be retained by Comcast and associated with those other users’ accounts in order to provide them with the POV Web Services. Comcast does not assert any ownership over content that you post to the POV Web Services; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all content you post to the POV Web Services and any intellectual property rights or other proprietary rights associated with the content.

The POV Web Services may also contain links to community forums, bulletin boards, chat rooms, and blogs about the various POV Web Services. Children under the age of 13 should not post in any of the forums, boards, chat rooms, blogs, other editorial sections of the POV Web Services. Participants in these forums, bulletin boards, chat rooms, and blogs are solely responsible for all content that they post there. Comcast retains the right, but not the obligation, to correct any errors or omissions in any of this content, as it may determine in its sole discretion. Comcast further reserve the right to delete or remove any content from the forums or blogs without prior notice or liability. You agree that your participation in these forums, bulletin boards, chat rooms, and blogs will at all times conform with the policy available here: www.projectopenvoice.com/privacy-policy.

Comcast reserves the right, but does not assume any obligation, to review any user submission prior to its display on the POV Web Services using automated tools or manual processes. Comcast may refuse to display or remove any user submission from the POV Web Services for any reason in our sole discretion. However, we will typically only do so when we become aware that the material in question is harmful, clearly illegal, or likely to be considered highly offensive or objectionable to a large segment of our users.

9. Feedback

Comcast welcomes your feedback about the POV Web Services. Comcast asks that you limit your feedback to the POV Web Services. Any communications you send to Comcast are deemed to be submitted on a non-confidential basis and become the sole property of Comcast. Comcast may, in its sole discretion, reproduce, use, publish, modify, disclose, distribute, or otherwise use these communications in any way and for any purpose. All of these uses by Comcast shall be without liability or obligation of any kind to you. These uses may include, for example, use of the content of any of these communications, including any works, marks or names, ideas, inventions, concepts, techniques or know-how disclosed therein, for any purpose without any obligation to compensate the originator of the communications and without liability to that person.

10. Proprietary Rights

You acknowledge and agree that Comcast (or Comcast’s licensors) own all legal right, title, and interest in and to the POV Web Services, including any intellectual property rights which subsist in the POV Web Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist).

Unless you have agreed otherwise in writing with Comcast, nothing in the Terms gives you a right to use any of Comcast’s trade names, trade marks, service marks, logos, domain names, and other distinctive brand features except as permitted by law. If you have been given an explicit right to use any of these brand features in a separate written agreement with Comcast, then you agree that your use of these features shall be in compliance with that agreement, any applicable provisions of the Terms, and Comcast’s brand feature use guidelines as updated from time to time.

Unless you have been expressly authorized to do so in writing by Comcast, you agree that in using the POV Web Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of these marks, names or logos.

11. Linking to the POV Web Services

Comcast welcomes links to the homepages of any of the POV Web Services. You are free to establish a hypertext link to these homepages so long as the link does not state or imply any affiliation, connection, sponsorship, or approval of your site by Comcast. Comcast does not permit framing or inline linking to the POV Web Services or any portions of them.

12. License from Comcast

Comcast gives you a worldwide, non-assignable and non-exclusive license to use the POV Web Services for your personal, non-commercial use on the terms and conditions described in these

13. Discontinuing Use of the POV Web Services and Termination of the Terms; Provisions That Remain in Effect after Termination

The Terms apply to all users of the POV Web Services. Except as described below, depending on whether you are an unregistered user or a registered user, you can discontinue your use of the POV Web Services so that these Terms no longer apply to you.

Unregistered Users

If you use any of the POV Web Services (or parts of those services) that are accessible without registration, you may discontinue use of those services at any time. Doing so will terminate the Terms. If you breach any provision of these Terms or other applicable policies, or for any other reason, Comcast reserves the right to restrict, suspend, or terminate your use of the POV Web Services and terminate the Terms. We may take these actions with or without notice to you. Because unregistered users are generally unknown to us, in most cases we will be unable to give notice of these actions.

Registered Users

If you use any of the POV Web Services (or parts of those services) as a registered user, you may terminate your registered user account at any time. Doing so will delete your account and, because you can no longer use the service associated with that account, terminate the Terms with respect to that service. If you breach any provision of these Terms or other applicable policies, or for any other reason, Comcast reserves the right to restrict, suspend, or terminate your registered user account for any or all of the POV Web Services and terminate the Terms. We may take these actions with or without notice to you. Because registered users are known to us, however, we will generally use reasonable efforts to give notice of these actions.

Sections 8, 10, 13 through 16, and 22 of these Terms will survive termination, and shall continue to apply indefinitely.

14. EXCLUSION OF WARRANTIES

YOU AGREE THAT YOUR USE OF THE POV WEB SERVICES IS AT YOUR SOLE RISK. BECAUSE OF THE NUMBER OF POSSIBLE SOURCES OF INFORMATION AVAILABLE THROUGH THE POV WEB SERVICES, AND THE INHERENT HAZARDS AND UNCERTAINTIES OF ELECTRONIC DISTRIBUTION, THERE MAY BE INTERRUPTIONS, DELAYS, OMISSIONS, INACCURACIES, OR OTHER PROBLEMS WITH THIS INFORMATION. IF YOU RELY ON THE POV WEB SERVICES OR ANY MATERIAL AVAILABLE THROUGH THEM, YOU DO SO AT YOUR OWN RISK. YOU UNDERSTAND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER

THE POV WEB SERVICES ARE PROVIDED TO YOU “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” COMCAST AND ITS AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, USEFULNESS, TIMELINESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH THE POV WEB SERVICES, NOR DO THEY GUARANTEE THAT THE POV WEB SERVICES WILL BE ERROR-FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE POV WEB SERVICES WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

15. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL COMCAST (INCLUDING ITS PARENTS, SUBSIDIARIES, AND AFFILIATES) OR ITS AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES ARISING OUT OF ANY USE OR MISUSE OF THE POV WEB SERVICES, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, EVEN IF ADVISED BEFOREHAND OF THE POSSIBILITY OF THESE DAMAGES, REGARDLESS OF THE FORM OR CAUSE OF ACTION INCLUDING, BUT NOT LIMITED TO, CONTRACT, NEGLIGENCE, AND OTHER TORT ACTIONS. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN THESE STATES, THE LIABILITY OF COMCAST AND ITS AGENTS AND LICENSORS IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE STATE LAW. YOU AGREE THAT THE LIABILITY OF COMCAST (INCLUDING ITS PARENTS, SUBSIDIARIES, AND AFFILIATES) AND ITS AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY CONNECTED TO THE POV WEB SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO COMCAST FOR THE USE OF THE POV WEB SERVICES.

16. Indemnification

You agree to indemnify, defend, and hold harmless Comcast (including its parents, subsidiaries, and affiliates and all of their respective officers, directors, employees, agents, licensors, suppliers and any third-party information providers) against all claims, losses, expenses, damages and costs (including reasonable attorney fees) resulting from any breach of the Terms or unauthorized use of the POV Web Services. Comcast reserves the right, at its election to assume the exclusive defense and control of any matter subject to indemnification by you and you agree to cooperate with Comcast in connection with our defense.

17. Copyright Infringement

Comcast is committed to complying with U.S. copyright and related laws, and requires all users of the POV Web Services to comply with these laws. Accordingly, you may not use the POV Web Services to store any material or content, or disseminate any material or content, in any manner that constitutes an infringement of third party intellectual property rights, including rights granted by U.S. copyright law.

If you are the owner of any copyrighted work and believe your rights under U.S. copyright law have been infringed by any material on the POV Web Services, you may take advantage of certain provisions of the Digital Millennium Copyright Act (the “DMCA“) by sending Comcast’s authorized agent a notification of claimed infringement that satisfies the requirements of the DMCA. Upon Comcast’s receipt of a satisfactory notice of claimed infringement, Comcast will respond expeditiously either directly or indirectly (i) to remove the allegedly infringing work(s) accessible through the POV Web Services or (ii) to disable access to the work(s). It is Comcast’s policy in accordance with the DMCA and other applicable laws to reserve the right to terminate access to the POV Web Services (or any part of those services) for any user who is either found to infringe third party copyright or other intellectual property rights, including repeat infringers, or who Comcast, in its sole discretion, believes is infringing these rights. Comcast may terminate access to the POV Web Services at any time with or without notice for any affected customer or user. If the affected user believes in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then that person may send a counter notification to Comcast. Upon Comcast’s receipt of a counter notification that satisfies the requirements of DMCA, Comcast will provide a copy of the counter notification to the person who sent the original notification of claimed infringement and will follow the DMCA’s procedures with respect to a received counter notification. In all events, you expressly agree that Comcast will not be a party to any disputes or lawsuits regarding alleged copyright infringement.

You acknowledge and agree that Comcast is not responsible for the availability of any of these external sites or resources, and does not endorse any advertising, products or other materials on or available from these Websites or resources. You acknowledge and agree that Comcast is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, these Websites or resources.

19. Changes to the Terms

Comcast reserves the right to change these Terms from time to time consistent with applicable contract laws and principles. When these changes are made, Comcast will make a copy of the updated Terms available at this web page and will also make any updated Terms available to you by e-mail, direct mail, or other reasonable means as selected by Comcast.

Comcast will make the updated Terms available to you before they take effect. You understand and agree that if you use the POV Web Services after the date on which the Terms take effect; Comcast will treat your use as acceptance of the updated Terms.

21. General Legal Terms

The Terms constitute the whole legal agreement between you and Comcast and govern your use of the POV Web Services, and completely replace any prior agreements between you and Comcast in relation to the POV Web Services.

You agree that Comcast may provide you with notices, including those regarding changes to the Terms, by e-mail, regular mail, or postings on the POV Web Services.

You agree that if Comcast does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Comcast has the benefit of under any applicable law), this will not be taken to be a formal waiver of Comcast’s rights and that those rights or remedies will still be available to Comcast.

If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

You acknowledge and agree that each member of the group of companies of which Comcast Corporation is the parent shall be third party beneficiaries to the Terms and that these other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favor of) them. Other than this, no other person or entity shall be third party beneficiaries to the Terms.

The Terms, and your relationship with Comcast under the Terms, shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions. By using the POV Web Services, you consent to the exclusive jurisdiction of the state and federal courts in Philadelphia, Pennsylvania, in all disputes arising out of or relating to the Terms or POV Web Services.

Changes to Comcast’s Business or the Privacy Policy

If Comcast’s business changes—for example, if our company merges with another company or we sell one or more of the Comcast companies that provide the POV Web Services—we may give the new owners of the Web Services your information. If this happens, we will tell you. We will also let you know if the Privacy Policy changes for any other reason, so you can decide whether you want to continue using the Web Services.

1. About the Privacy Policy and the POV Web Services

The Comcast family of companies respects your privacy. Within this Web Services Privacy Policy (“Privacy Policy“) the term “Comcast” or “we” will refer to Comcast Cable Communications Management, LLC, Comcast Interactive Media, LLC, and their respective subsidiaries and affiliates that own and operate Websites and Internet services on their behalf. The term “you” refers to you as a user of Comcast’s Websites or Internet services described below.

The term “Personally Identifiable Information” or “PII” refers to information that identifies a specific person, such as the person’s name, address, email address, or social network login. The term “Non-Personally Identifiable Information” or “non-PII” refers to information that is demographic, aggregated, or does not otherwise identify a specific person, such as a person’s age, gender, ZIP code, or other information when that information is not used with Personally Identifiable Information.

What does this Privacy Policy cover?

This Privacy Policy explains how Comcast will use the information that you provide when you use these Comcast-owned and operated Websites and services: www.projectopenvoice.com, www.gottalovefresno.com, www.houstonsvoice.com, www.locallookpeterborough.com, www.madeinmedford.com, www.phillyinfocus.com, www.yosoyhialeah.com (the “POV Web Services“)

What is outside the scope of this Privacy Policy?

This Privacy Policy does not apply to your use of any other products or services provided by Comcast such as Comcast Digital Cable with On Demand, Comcast Digital Voice, Comcast High Speed Internet, XFINITY TV, XFINITY Voice, or XFINITY Internet. If you subscribe to or use one or more of these services, you can see the privacy policy that applies to the residential versions of these services by visiting http://www.comcast.com/customerprivacy/.

This Privacy Policy also does not apply to Comcast’s use of information provided by you when you sign up for or use the XFINITY TV Store (xfinitytvstore.comcast.net). Comcast’s use of the information you provide through the XFINITY TV Store is described in the XFINITY TV Store Privacy Policy, available at http://xfinitytvstore.comcast.net/PrivacyPolicy.aspx.

Some of the POV Web Services contain links to other Websites, including Websites of third parties who are acting on our behalf as our agents, suppliers, or providers. These other Websites are not operated by Comcast and have their own privacy policies that we encourage you to read before you use them. Other sites that we link to may contain Comcast branding, but these non-Comcast Websites and resources are provided by companies or persons other than Comcast. Examples of these non-Comcast Websites include Websites where you are required to log-in using a username and password other than your username and password for the POV Web Services This Privacy Policy does not apply to those non-POV Web Services. Those sites will have their own policies that we encourage you to read before you use them.

2. Comcast is a Member of TRUSTe

Comcast has been awarded TRUSTe’s Privacy Seal signifying that this Privacy Policy and the practices set forth in it have been reviewed by TRUSTe for compliance with TRUSTe’s program requirements including transparency, accountability and choice regarding the collection and use of your personal information. The TRUSTe program does not cover information that may be collected

3. Collection of Information

All Users

Comcast, or third parties acting on Comcast’s behalf, routinely logs Non-Personally Identifiable Information that is automatically generated when all users visit or use the POV Web Services, as a by-product of the user’s activities (“Web Log Data“). This information includes, but is not limited to, Internet protocol (“IP“) header information that is automatically passed between a user’s computer and the POV Web Services, such as the computer’s IP address, the browser being used at the time, and the URL of the webpage on the POV Web Services that the browser requested. This information may also include details relating to the activities users perform within the POV Web Services, such as what links they click on, in what order they access specific web pages within the POV Web Services, and the search queries they perform on the POV Web Services.

Some of the POV Web Services allow you to store certain details and preferences that help you personalize that service (“Preference Data“). This Non-Personally Identifiable Information may include ZIP code, age and gender. Comcast may store Preference Data in a cookie and place it on your computer. We do this so that you do not have to enter this data every time you return to the POV Web Services. We may also use the Preference Data to deliver other personalized services and features of the POV Web Services.

Registered Users

Comcast asks you to provide certain information when you initially register to use the POV Web Services and then afterwards may ask you to provide additional information when you use certain POV Web Services for the first time. In addition, Comcast also collects information about your use of the POV Web Services as a registered user. This table summarizes the different types of information that we may collect from you when you register for the POV Web Services and use the POV Web Services as a registered user.

• Profile Data o When Collected: The first time you access certain POV Web Services after you have

created an account or subsequently modify your Profile Data o Representative Examples: Additional e-mail addresses, social network username,

lists of people to connect with through certain POV Web Services, and notification preferences

• Activity Data o When Collected: When you log-in to your account and use the POV Web Services o Representative Examples: Flagging or rating content, posting comments, sharing

URLs, and content and data feeds from non-Comcast social networks or services

Collectively, your Registration Data, Profile Data, Activity Data, and any other generally available demographic data about you that Comcast gathers from other sources is referred to as “Your Data.” Your Data does not include information that third parties may independently gather from other Websites about you using their own cookies, as further described in this Privacy Policy.

Most POV Web Services have their own pages where you can manage certain portions of your Registration Data and Profile Data relevant to that specific site.

4. Use of Information

Comcast uses Web Log Data, Preferences Data, and Your Data, including both Personally Identifiable Information and Non-Personally Identifiable Information in both aggregated and individual forms, to provide the POV Web Services and support them. We may process and use this data for purposes consistent with this Privacy Policy including, but not limited to:

• Customize, measure, and improve the POV Web Services, and the content provided through them;

• Enforce our Web Services Terms of Service and detect fraud and other illegal activities; • Let you know about changes to the POV Web Services, the Web Services Terms of Service,

this Privacy Policy, and other terms that apply to our services; and • Update any programs or other tools that we provide in conjunction with the POV Web

Services.

Comcast may use Web Log Data, Preferences Data, and Your Data in these forms for internal business purposes, such as determining how much traffic certain portions of the POV Web Services receive, for license reporting and assessment of service levels, to better understand how the POV Web Services are used, to gauge traffic patterns and determine what types of content and services are most popular with users of the POV Web Services, or determining which search queries are the most popular.

Comcast may also use Web Log Data, Preferences Data, and Your Data to customize the POV Web Services and Services and make them more relevant to you. For example, Comcast may use such data to determine which channels, content, events, discussions or projects to recommend to you.

Comcast may use your Registration Data to verify that you are the person authorized to use the POV Web Services or to manage your account. Comcast may also use your Registration Data to determine whether your Comcast Digital Cable with On Demand subscription allows you to access premium content or services offered through some of the POV Web Services. For example, Comcast may use this subscription information to permit you to access, via one or more of the POV Web Services or certain programming included in your Comcast Digital Cable with On Demand package.

5. Sharing of Information

Comcast uses third parties to assist us in delivering parts of the POV Web Services to you. We may share portions of Your Data with these third parties to the extent necessary for them to provide these services. These companies are acting on Comcast’s behalf and are required, by contract with Comcast, to keep this information confidential and are only authorized to use it for specific purposes. As described in more detail below, Comcast may also provide Non-Personally Identifiable Information elements of Your Data to third parties who deliver ads to you on Comcast’s behalf. Comcast will not provide your Personally Identifiable Information to these advertisers unless you expressly authorize us to do so.

Comcast may also share Web Log Data and Preference Data, which do not contain Personally Identifiable Information, with third parties. For example, Comcast may share traffic data for one of the POV Web Services with a third party that analyzes and publishes Website traffic surveys. Or, Comcast may share Web Log Data and Preference Data with the content providers to the POV Web Services.

Comcast may also share Web Log Data, Preference Data, and Your Data within its internal family of companies solely to provide you with the POV Web Services or other cross-platform services it thinks may be of interest to you.

You may authorize other Internet sites such as Twitter or Facebook to access and publish on their Websites some of Your Data, including your Activity Data. In addition, certain POV Web Services allow you to use your contact lists from Internet sites such as Twitter or Facebook to share portions of Your Data, including your Activity Data, with others. If you provide Comcast with your credentials for this kind of Internet service and use the features of the POV Web Services that share information across these Internet services, or, if one of these Internet service contacts Comcast using your POV Web Services credentials and asks to have access to certain portions of Your Data, Comcast will treat this as your authorization to share such portions of Your Data with that Internet service.

6. Communicating with You

Comcast may use your Registration Data to send you a confirmation e-mail verifying the ownership of the e-mail addresses provided in your Registration Data and to send you service-related communications about the POV Web Services. In addition, Comcast may send you promotional e-mail relating to the POV Web Services for which you have activated your account as permitted by applicable law. You can opt-out from receiving such promotional e-mail by following the instructions contained in the e-mails or individual website.

7. Participating in Blogs and Forums

If you post comments to any of the blogs, forums, or other community sections of the POV Web Services, any information you submit there can be read, collected, or used by other users of the POV Web Services and any PII you post could be used to contact you. We are not responsible for PII you choose to submit through these features.

Children under the age of 13 should not post in any of the blogs, forums, or other editorial sections of the POV Web Services.

8. Security

Comcast uses industry standard approaches to securely store, control access to, and make appropriate use of Your Data, and we require our contractors and other providers to do so as well. However, no security measure is completely effective and Comcast cannot guarantee the complete security of Your Data. If you don’t want Comcast to know any particular information about you, you should not register to use the POV Web Services or include it in anything that you submit or post to Comcast, including posts on the POV Web Services or e-mails to Comcast.

As an additional security precaution, neither Comcast nor any of our authorized service providers will ask you for your Comcast password in an e-mail, over the telephone, or in an online support forum or chat area. Do not give your Comcast password to anyone in an e-mail, over the telephone, or in an online support area.

9. Disclosures of Information

Comcast holds customer privacy in the highest regard and we make every reasonable effort to protect your privacy as described in this Privacy Policy. Nevertheless, we may be required by law to disclose Personally Identifiable Information or other information about you or other users of the POV Web Services. These disclosures may be made with or without your consent, and with or without notice, in compliance with the terms of a subpoena, court order, search warrant, or other valid legal process. We may also disclose information about you or users of the POV Web Services when we believe in good faith that the disclosure of information is necessary to prevent financial loss, address suspected illegal activity, protect our rights or property, or prevent imminent physical harm.

10. Special Note About Children

Comcast does not knowingly collect Personally Identifiable Information from anyone under the age of 13 without first obtaining parental consent. For those portions of the POV Web Services that do collect information from children under the age of 13 after obtaining parental consent, Comcast or its contractors will provide a special notice or other information describing any additional privacy protections that may apply. Children should always get permission from a parent or legal guardian before sending any information about themselves (such as their names, e-mail addresses, and telephone numbers) over the Internet, to Comcast or to anyone else.

11. Your California Privacy Rights

California law permits its residents to request and receive information about a business’ disclosure of certain categories of PII to other companies for their use for direct marketing. If you are a California resident and a user of any of the POV Web Services, you can request a copy of this information from Comcast Interactive Media, LLC by sending e-mail to CIM_Privacy at Comcast dot com or a letter to Comcast Interactive Media, LLC, Attn: California Direct Marketing Information, One Comcast Center, Philadelphia, PA 19103. Please include your name and e-mail address in e-mail requests, and your name and postal address in mail requests.

12. Change of Ownership or Other Business Transaction

In the event Comcast enters into a business transition, such as a merger, acquisition, or the sale of all or part of its assets (a “Business Transition“), Your Data (including PII and non-PII associated with the POV Web Services) will likely be part of the assets transferred.

In this event, we will notify you of any Business Transition. We will also notify you of any subsequent material changes to this Privacy Policy as a result of a Business Transaction and give you the opportunity to opt-out for information that we have collected before, or may collect after, a new Privacy Policy containing material changes takes effect.

13. Changes to this Privacy Policy

Comcast reserves the right to change this Privacy Policy from time to time consistent with applicable privacy laws. When we do change it, we will make a copy of the updated Privacy Policy available to you before it takes effect. If we make material changes to this Privacy Policy, we will also notify you by e-mail, direct mail, or other reasonable methods that we select. In the event of material changes to this Privacy Policy, we will give you the opportunity to opt-out for information that we have collected before, or may collect after, a new Privacy Policy containing material changes takes effect.

You understand and agree that if you use the POV Web Services after the effective date of the updated Privacy Policy, Comcast will consider your use as acceptance of the updated Privacy Policy.

14. International Visitors

Our computer systems are currently based in the United States, so your PII will be processed by us in the United States, where data protection and privacy regulations may be different than other parts of the world, such as the European Union. If you create an online account to use the POV Web Services as a visitor from outside the United States, you will have agreed to the terms of the Privacy Policy and our Web Services Terms of Service and you will have consented to the transfer to and processing of all such information in the United States, which many not offer an equivalent level of protection of that in the European Union or certain other countries.
