We offer these comments to the NRC's Notice of Intent to Prepare Waste Confidence EIS.
We appreciate the June 8, 2012 ruling by the District of Columbia Circuit of the U.S. Court of Appeals
ending the Nuclear Regulatory Commission generic denial of the need to consider problems associatedwith the storage and management of highly radioactive irradiated nuclear fuel at reactor sites (finally!)
and make these comments on what the "scope" of this environmental impact statement (EIS) should
include:
1) NRC must assess the overfilling of highly radioactive irradiated nuclear fuel pools as a factor in
catastrophic events, including drain-downs and fires, but also inadvertent criticality and other eventswhere loss of pool integrity results in inability to stabilize cooling within the structure.
2) NRC must compare and contrast the worst-case-scenarios for radioactive releases and healthconsequences from a disruption of current dry storage, fuel pools and "hardened" dry storage. Based
upon this, NRC must examine alternative changes in its regulatory requirements for waste storage on-site since it is easy to forecast, based on existing data, that hardened storage provides a greater margin
of health and safety to the public compared to over-filled pools.
3) NRC should exclude off-site "interim" consolidation of waste storage because the transport
evaluations done to date are not an adequate basis upon which to claim an increase in health, safety or
security. The period of transport (likely decades) must itself be included in the overall evaluation ofincreased health, safety or security, where clearly it will not support such a claim.
4) One of the options that the EIS must include is no further production of this waste; based on no
further licenses, no license extension and expiration of existing licenses. Inclusion of this alternativemust include a consideration of the environmental and health consequences of the production ofnuclear fuel since commercial production of nuclear fuel would be phased out under this alternative, but
not others. NEPA requires that impacts that are tied together by causation be assessed together.
NRC's current activity under the joint jurisdiction of the Court of Appeals and the NationalEnvironmental Policy Act has legal flaws. A letter from plaintiffs in the court case and others sent to the
Commissioners on November 8, 2012 details these flaws. The primary point is that NRC fails to define
the proposed action to be evaluated by the EIS, and therefore it is not possible to define scope. We
additionally support the call for NRC to start over and do this properly.

We need to retire our nuclear power plants
as their current licenses expire. We need to
dispose of all those spent fuel rods safely. I
would rather the U S Navy remanufacture
them to get one new fuel rod out of two
plus spent fuel rods than leave a bunch of
spent fuel rods sitting around in dry cask for
some 3,000 years at all our present nuclear
power plant sites.Grace

Please stop wasting precious revenue on
dead-end, unsustainable nuclear
technology, and work on renewables.
Climate change is a real, tangible danger - a
recent study suggests that the climate in NE

We need greater public understanding of
the stakes involved in nuclear power and
radioactive waste "management." The NRC
must represent the public interest, not the
special interests of the nuclear energy
industry.
What 10% of this country are you willing to
poison forever when, not if, a nuke fails like
it did in Japan, taking storage with it?little to none

There is an unstable sink hole in 4 locations
in Louisiana that is swallowing up land,
homes, trees, and leaking natural gas and
oil. Has fracking or the BP oil leak in the
Gulf made a much larger liquid area
unstable? What about the Madrid Fault?
There is fracking going on in over 30 states
that could be causing unstability of the
earth and EIS needs to research and
address that before any EIS can be finished.
The industry needs to prove it will not
contaminate and ground water, soil, and air
into perpetuity at any potential site before

Radioactive waste must be isolated for tens

We have no moral right to pass this on to
future generations. We don't need nuclear

It is time to move away from nuclear
power. Think how far ahead we'd be if we
invested HALF as much in renewables as we
have in nukes. Wow. We are a crazy
species.
Move On from this toxic insanity. Also too
expensive in many ways.
I have children. We need a safe future for
them. Nukes are the antithesis to safety, as
witness the accidents in Chernobyl and
Fukushima. ANd the almost accidents in the

As we saw in Fukushima, NO nuclear plant
is designed to withstand the forces of
nature which have been unleased as the
planet has warmed. Denial is not a policy.
Short-term thinking is inadequate to
protect life on our beautiful planet. Think
about the generations of living beings who
will come after you and begin the phase-
out of existing nuclear plants and address
the existing issues surrounding nuclear
waste in a wholehearted manner. And
ensure all spent fuel pools have generator
backup.

Nuclear waste generation is insanity and
must be halted. NO FURTHER PRODUCTION
OF NUCLEAR WASTE !
I live in a small community about 8 miles
directly downwind of the South Texas
Nuclear Project. As these units are
progressively owned my more private
sector businesses rather than the
municipalities that originally built them and
with strictly profit motivated business
tactics, it is more important that ever that
communities such as ours have some form
of real assurance that their waste will not

As demons, we've gone into God's domainand unleashed laws of nature that we haveno command over. These invisible forceswill unleash punishment on all life forms foreons to come. As fools, we have createddifferent levels of demonic science forgreed, power and money... with no regardfor the planetary suffering created. This is atotal violation of sanity, and morality. We have no way to safely dispose of
nuclear waste. Why not?
Nukes are very unsafe, very expensive, and

I have sent in other comments. I stand by
all the comments that I have sent in. The
comments above extend and are additional
to all the other comments that I have sent
into the present rulemaking. I again
comment that the radiation loosed into the
biosphere thru radioactive waste can slow
the evolutionary clock to the point that
humankind goes extinct. This damage to
the human race must be explored before
we reach a crisis in radiactive waste that
Marvin Lewis 19136 PA N/A endangers the entire human race.
Although I agree with item 4 that no new
licenses being issued, I am sure the nuclearindustry would fight this to the death. At
least stop the re-licensing of expired
generators, they have lived out their useful
lives and have generated ample profits for
their owners in that time, to continue torun them means either compromising profit

We are smart enough to power our world

No answer exists to the question of safely
disposing of nuclear waste. Until this
fundamental question is pondered, the
continued production of this waste in
criminally insane.
You must end all nuclear activities and
begin the immediate closure and
decomissioning of all nuclear plant and
waste materials. There is little time to do
this due to runaway global warming and
mass extinctions positive feedbacks. You
are being watched and judged.Frank

The approval of the GE Mark I design

that industry cost concerns totally overrode

It is your duty to think of safety and also,
future generations. We have heard since
1940s that there would be a safe way to
dispose of nuclear waste. There is none,
and scientists know this. Do not make
more.
Events have proven that nuclear facilities
and waste cannot be safely managed when
money is ever a consideration--as it is, as
currently used.Deborah

uncontrollable when it goes wrong. It is an
unnecessary threat to our safety. Climate &
environmental harm is unlikely to be
mitigated. The risk & catastrophic damage
& costs are not worth it. Let's put our
ingenuity, funding & focus on renewable,
clean, safe power sources. NO NUKE.

NRC - You claim to protect people and the
environment - It would be nice if this were
more than a wonderful sounding slogan.
The sad reality seems to be that beyond
protecting your own posteriors you are
protecting the nuclear industry with which
you clearly have a far too cozy relationship.Myla

There are now several industries that
depend upon nuclear waste, especially
tritium, as a raw material for their products,

ServaisNuclear is just not worth the risk of
unmitigatable accidents
We not only have radiation sites, we have
places all over where the 55 gallon barrels
have been dumped. They were in open pits
leaking and rusting away. There are also
deep wells, that were used and they are not
working well either. Humans do not really
know how to deal with this. We need to
stop making it. Period.
Nuclear waste must be kept to the very
minimum required for medical purposes!

It's way past time to stop producing more
radioactive waste until you have a plan in
place to safely store the waste already
piling up on sites near communities all over
the country. You are being arrogant when
you tell us you can store this waste for
thousands of years.
We cannot in good conscience continue to
produce nuclear waste, when there is no
where to store it safely.

I live not far from the waste pools from the
defunct Trojan nuclear power plant. The
assurances we were given as to the
operation of the plant and the disposal of

Nuclear waste is backlogged in the United.
States and must not be produced anymore.
The risks are too high both in terms of the
health of our people and of our
environment. The costs of continued
production of nuclear waste is also breaking
the bank; congress will not put its full will
into cleaning up the waste, for which there
is no true disposal option.Paige

Since there is no safe, realistic way to keep
radioactive waste from nuclear power
plants isolated from the environment for
the thousands of years that it will remain
deadly, we need to curtail it's production.
Meanwhile, open pool storage ofvspent
fuel rods has been shown, in Fukushima, to
be totally inadequate. We need to stop
overfilling storage pools and we need to
move spent fuel rods to dry cask storage as
quick Y as it can be safely done
GET REAL! Do you really really really like
making more radioactive waste? Think
about it. Open your hearts, minds and
professional development to the option
that maybe your destiny is to help stop this
madness and clean up the mess!

Having worked on safety systems in the
nuclear industry, my primary concern is
different than ones outsiders list. There is
tremendous pressure from the
management of for-profit companies to"ship it" when a product deadline
approaches. Systems used in nuclear power

It's impossible for anyone to have'confidence' in the safe storage of the most-
toxic of toxic wastes for time frames that
dwarf recorded history. And most of this
waste is stored near water where it is at risk
from rising sea levels or floods. Mankind's
appreciation of such risks is clearly lacking,
and the NRC demonstrates remarkable
hubris in it's "one in a million" analysis of
meltdown risk and "zero liklihood of
containment leakage' statements. Earth to
NRC: four of 33 GE BWRs have self-
destructed. That's 1 in 8, not 1 in a million.David

Our natural world is rapidly becoming less
stable--megastorms, earthquakes,
tsunamis. At the same time, we are learning
that the safety of our aging nuclear power
plants is perilous, and in many cases
downright faulty. We are no longer in a
position to gamble with the future. We
MUST take immediate action to mitigate
these dangers, and to replace these
facilities with sane, safe, and renewable
sources of energy. Other countries are
doing so (Germany in particular presents a
good model); we should be in the forefront
of this advance, not the antiquated,

The nuclear industry has promised the
public since the 50s to trust them, that they
would soon design ways to deal with
nuclear waste. Nuclear waste continues to
accumulate with no solution in sight. The
public no longer trusts the nuclear industry
on this subject. It is time to regulate them
into submission.

End Nuclear power before it's too late.
Reduce energy consumption and pursue
truly renewable wind and solar power.
These are the only viable solution to our
future energy needs.
The NRC has spent more time protecting
and covering for the mistakes and flaws of
the nuclear industry...It's time to put public
safety first! NO MORE FUKUSHIMASl!
It likely will be shown that the best way to
address nuclear waste is not to produce
any. For a secure nation we need to focus
on more healthful energy solutions.

I pray you will see the wisdom of securing
spent fuel, and that you will institute much
stronger documentation that nuclear power
is or is not needed. Abroad, power from
nuclear is not linked to a thriving economy,

otherwise.JereDarleneSr. SharonjeffjeffRaymondTimothysandraMarycharles

I have been studying the nuclear power
industry for almost half a century. I'm not
convinced that there has been any
significant improvement in the ability to
deal with safety and environmental
concerns. Nor have I seen any proof that
'too cheap to meter' is true. If we invested
in solar what we've dumped into nuclear
power we might be on the path to real
energy independence.

NRC must assess the impact on the spent
pools of many months without power. We
project that a large earthquake in California
would take down the grid for many months,
destroy refineries, disrupt roads and make
deliveries of diesel fuel for backup
generators very difficult, if not impossible.Jim

US taxpayerENOUGH!
Fuel rods which leave contaminants inplace for thousands of years are no way to
replace fossil fuels. Nuclear energy is a
danger to human health and safety. An
accident at Pilgrim where the storage pool
is overfilled with something like
(conservatively) three times the amount it
was designed to store would turn America's
hometown, Plymouth, MA. and Cape Cod
and the surrounding waters into a no-go
zone; destroying ecosystems and human
lives alike.
Your risk assessment software is also in dire
need, or most of your assumptions on #2
will still be vastly underestimated.

inventions offer means of generating
electricity that would be cheaper and less
polluting than nuclear power plants. A
typical 1000-megawatt nuclear power plant
operating at full power for two years
accumulates the radioactive equivalent of
4600 Hiroshima atomic bombs. My website

two dozen methods of neutralizing
radioactve waste that deserve funding for

I have worked since the 70's with Northern
Sun Alliance here in Minneapolis against
nuclear energy. In the 80's with Paul
Wellstone as volunteer coordinator for the
Nuclear Freeze, so I have been aware for a
long time of the what goes into nuclear
energy. I am glad we are making some
program, but the transportation of nuclear
rods for storage, and placing them on
Native American land deeply concerns me,
among other concerns. Please act sensibly,
and use alternative energy sources, before
more problems arise. Thank you for your

It appears that a restart of the San Onofre
Nuclear Generating Station in Southern
California, even at 70% power, would not
be appropriate during the two year time
period in which the NRC is re-writing it's
report on nuclear waste storage and safety.
The court has stated that there is a
moratorium on re-licensing during that
time. We should not have to be guinea pigs
for seeing if the generators will work
properly even though they have been
known to be defective and the fixes, such
as plugging tubes, are questionable! Even
some of the workers at the plant question
whether it would be safe to start up Unit 2
again and especially with quite a few of the
employees at the plant being let go. This is
the plant with the most safety violations in
the US and whistle blowers have not always
felt comfortable coming forward!Karen

Just pretend your grandchildren live close
to some nuclear waste depot. Then protect
the rest of the population from this
unresolved hazard. Or, if you have no
grandchildren, then consider what
happened in Fukushima. Don't believe the
operators' assertion that it cannot happen
here. Earthquakes happen, tsunamis
happen.
We've been waiting for almost 50 years for
the nuclear industry to solve the radioactive
waste storage problem. They haven't done
it and probably can't do it. Make the
industry put up or shut up.
It is time to end ALL nuclear energy plants.

My family have often said that if we could
only find a safe alternative to the
radioactive waste that accumulates from
nuclear generated electricity we would be
closer to supporting nuclear power plants.
There is so much to do and we aren't any
closer to a viable solution other than to
close the aging and dangerous plants

nuclear power plants a viable alternative.

Re: nuclear waste, this is what should be
done: The first thing to do to, is to reduce
the amount of nuclear waste needing to be
managed for as long as it is dangerous to
biological life forms. The most obvious and
direct way to do this is to stop making more
nuclear waste. Shut down the factories
making nuclear waste. 2nd Put as much of
the used fuel that has cooled long enough, into high-quality dry.cask storage on-site.
(This should be continued until the reactorsand used fuel pools are empty). 3rd Make
sure that every used fuel pool has electrical
backup in the event of loss of off site
electricity. 4th Identify which nuclearreactors are in the most dangerous
locations: near active earthquake faults,
below dams that could flood the reactor
site, ones sited near high population areas,
etc. Casks from these sites should be
moved to the safest reactor sites. 5th
Initiate a A€-Manhattan ProjectACTM to learn

NRC, your obligation to American citizens is
to maintain radiological safety, NOT to
enable the nuclear industry. The NRC must
report to the public what actions will
provide the greatest level of safety starting
from the current situation, and must
recommend the future course of action that
will result in the greatest public safety. The
nuclear power industry has presented a
safety problem with no known solution. Therefore, the NRC must issue no more
new and renewal licenses, and mandate
that producers of nuclear waste take every
possible step for containment andprotection. The fact that some companies
will lose money is not the proper concern ofa governmental regulatory organization,
and the citizens of this country are justifiedin demanding that the NRC not take
continued nuclear power generation as agiven. Your mission does not include, as is

At Renewable Power

Our current system for storage of spent fuel
rods is inadequate and dangerous. We
should not continue to produce nuclear
waste period!! We need to seriously
address the real long term radioactive
storage issues.
NRC; keep doing what you are doing. We
need nuclear power because without it we
are doomed to use coal and oil. Renewable
energy cannot make up the 24/7 base load
generation that nuclear provides.
Furthermore lets see how many bogus
signatures we can add to this idiotic
petition.
Additional all spent fuel rods should be
place in dry storage. Each and every nuclear
power plant is a potential terrorist target,
that is unacceptable security risk. Thus
securing all spent fuel rods will reduce the
risk not if, but just when terrorist will target
a nuclear plant.

general, as a systems engineer who has
worked on the Space Shuttle program, I
would like to note that program was
terminated because the design life was
reached, and the government chose not to
do the necessary engineering to extend
that design life. I am appalled to learn that
the NRC had been granting license
extensions for Nuclear plants beyond their
design lifetimes without such design
lifetime extensions. This means that there is
no safety design in effect for these plants,
as any element is subject to potential
failure as being outside its design envelope.
This means that all sorts of unknown parts
are liable to failure due to use beyond their
design life. It is imperative that any plant
license extension be contingent upon such
an engineering review, and replacement of
all elements that cannot be deemed
reliable for the extension period, whether
due to age, wear, radiation exposure, or
any other lifetime-related factor. If such
elements cannot be replaced, the plant
must be shut down and not re licensed.

the NRC should also consider explosions, as
when the titanium fuel rods get above a
certain temperature, which they can easily
do when fuel starts to melt, the melting and
burning titanium steel mixed with water
separates out hydrogen. Such hydrogen
buildup in any containment structure can
explode. This needs to be assessed in terms
of added security and cost for fuel pool
storage. Regarding point 2, add: Hardened
on-site storage (HOSS) is clearly preferable
to pool storage. It is more costly, but some
utilities have converted a small portion of
their pools (e.g., Arizona Public Service has
done a tiny percentage of their spent fuel at
Palo Verde). A big problem is that the
process releases more radiation in the short-
term during construction of the HOSSs. So
that needs to be trapped with filters and
managed -- an added expense which needs
to be calculated and mandated for HOSS
creation. Regarding point 3, add: Any
transport of spent fuel increases
possibilities of black market diversions and
accidents. These reductions in security and
increases in cost for prevention need to be
assessed by the NRC. Regarding point 4,Russell Lowes

I don't believe there is any basis to license
and re-license nuclear reactors. The waste
can cause many problems. The reactor can
cause many problems. There are safer and
cheaper alternatives with a lot less
guesswork involved. We are depending on
you to keep us safe and to save our money.
Please don't be responsible for the hurt of
even one individual. You can do a better job
justifying why it is okay to license reactors,
but you can never be very sure that there
won't be disasters as a result of buWilding
and maintaining reactors. Thank you for
your attention.

It appears that extreme health problems

Comments on the NRC's Notice of Intent to Prepare Waste Confidence EIS.
I am grateful for the June 8, 2012 ruling by the District of Columbia Circuit of the U.S. Court ofAppeals ending the Nuclear Regulatory Commission consistent denial of the need to considerproblems associated with the storage and management of highly radioactive irradiated nuclearfuel at reactor sites. This decision was long overdue. I am now making these comments onwhat the "scope" of this environmental impact statement (EIS) should include:
1) NRC must assess the worst-case scenario for each and any storage system dealing withradioactive waste. As we saw in Japan, we cannot determine just what such storage systemsmight undergo in their lifetime. Thus, it is imperative that the assessment deal with theunthinkable scenarios.
2) What happens when some situation makes the storage pool cooling system inoperable? TheNRC must assess this situation and deal with the potential deadly effects of such a catastrophicevent.
3) NRC must examine alternative changes in its regulatory requirements for waste storage on-site since it is easy to forecast, based on existing data, that hardened storage provides a greatermargin of health and safety to the public compared to over-filled pools.
4) NRC should exclude off-site "interim" consolidation of waste storage because the transportevaluations done to date are not an adequate basis upon which to claim an increase in health, safety or security. The period of transport (likely decades) must itself be included in the overallevaluation of increased health, safety or security, where clearly it will not support such a claim.
5) The most important option that the EIS must include is no further production of this waste;based on no further licenses, no license extension and expiration of existing licenses. Inclusionof this alternative must include a consideration of the environmental and health consequencesof the production of nuclear fuel since commercial production of nuclear fuel would be phasedout under this alternative, but not others. NEPA requires that impacts that are tied together bycausation be assessed together.
NRC's current activity under the joint jurisdiction of the Court of Appeals and the NationalEnvironmentally Policy Act is has legal flaws. A primary point is that NRC fails to define theproposed action to be evaluated by the EIS, and therefore it is not possible to define scope. IT istime for the NRC to start over and do this EIS properly.

Underpinning the NRC's radioactive waste policy is the agency's WasteConfidence rule. That rule stated that the NRC had confidence that highlyradioactive irradiated fuel from nuclear reactors would be stored andmanaged safely forever. That confidence gave the NRC the ability to licenseand re-license nuclear reactors. The court has since ruled that the NRC hadno basis to make that assertion.
So the logical path? No place for the waste? Then stop producing the waste!
I appreciate the June 8, 2012 ruling by the District of Columbia Circuit ofthe U.S. Court of Appeals ending the Nuclear Regulatory Commission genericdenial of the need to consider problems associated with the storage andmanagement of highly radioactive irradiated nuclear fuel at reactor sites(finally!) and make these comments on what the "scope" of this environmentalimpact statement (EIS) should include:
1) the NRC must assess the overfilling of highly radioactive irradiatednuclear fuel pools as a factor in catastrophic events, including drain-downsand fires, but also inadvertent criticality and other events where loss ofpool integrity results in inability to stabilize cooling within thestructure.
2) NRC must compare and contrast the worst-case-scenarios for radioactivereleases and health consequences from a disruption of current dry storage, fuel pools and "hardened" dry storage. Based upon this, I believe that NRCmust examine alternative changes in its regulatory requirements for wastestorage on-site since it is easy to forecast, based on existing data, thathardened storage provides a greater margin of health and safety to thepublic compared to over-filled pools.
3) NRC should exclude off-site a€ecinterimaE consolidation of waste storagebecause the transport evaluations done to date are not an adequate basisupon which to claim an increase in health, safety or security. The period oftransport (likely decades) must itself be included in the overall evaluationof increased health, safety or security, where clearly it will not supportsuch a claim.
4) One of the options that the EIS must include is no further production ofthis waste; based on no further licenses, no license extension andexpiration of existing licenses. Inclusion of this alternative must includea consideration of the environmental and health consequences of theproduction of nuclear fuel since commercial production of nuclear fuel wouldbe phased out under this alternative, but not others. NEPA requires thatimpacts that are tied together by causation be assessed together.
NRC's current activity under the joint jurisdiction of the Court of Appealsand the National Environmental Policy Act has legal flaws. A letter fromplaintiffs in the court case and others sent to the Commissioners onNovember 8, 2012 details these flaws. The primary point is that NRC fails todefine the proposed action to be evaluated by the EIS, and therefore it isnot possible to define scope. I additionally support the call for NRC tostart over and do this properly.
