We offer these comments to the NRC's Notice of Intent to Prepare Waste Confidence EIS.

We appreciate the June 8, 2012 ruling by the District of Columbia Circuit of the U.S. Court of Appeals

ending the Nuclear Regulatory Commission generic denial of the need to consider problems associatedwith the storage and management of highly radioactive irradiated nuclear fuel at reactor sites (finally!)

and make these comments on what the "scope" of this environmental impact statement (EIS) should

include:

1) NRC must assess the overfilling of highly radioactive irradiated nuclear fuel pools as a factor in

catastrophic events, including drain-downs and fires, but also inadvertent criticality and other eventswhere loss of pool integrity results in inability to stabilize cooling within the structure.

2) NRC must compare and contrast the worst-case-scenarios for radioactive releases and healthconsequences from a disruption of current dry storage, fuel pools and "hardened" dry storage. Based

upon this, NRC must examine alternative changes in its regulatory requirements for waste storage on-site since it is easy to forecast, based on existing data, that hardened storage provides a greater margin

of health and safety to the public compared to over-filled pools.

3) NRC should exclude off-site "interim" consolidation of waste storage because the transport

evaluations done to date are not an adequate basis upon which to claim an increase in health, safety or

security. The period of transport (likely decades) must itself be included in the overall evaluation ofincreased health, safety or security, where clearly it will not support such a claim.

4) One of the options that the EIS must include is no further production of this waste; based on no

further licenses, no license extension and expiration of existing licenses. Inclusion of this alternativemust include a consideration of the environmental and health consequences of the production ofnuclear fuel since commercial production of nuclear fuel would be phased out under this alternative, but

not others. NEPA requires that impacts that are tied together by causation be assessed together.

NRC's current activity under the joint jurisdiction of the Court of Appeals and the NationalEnvironmental Policy Act has legal flaws. A letter from plaintiffs in the court case and others sent to the

Commissioners on November 8, 2012 details these flaws. The primary point is that NRC fails to define

the proposed action to be evaluated by the EIS, and therefore it is not possible to define scope. We

additionally support the call for NRC to start over and do this properly.

We need to retire our nuclear power plants

as their current licenses expire. We need to

dispose of all those spent fuel rods safely. I

would rather the U S Navy remanufacture

them to get one new fuel rod out of two

plus spent fuel rods than leave a bunch of

spent fuel rods sitting around in dry cask for

some 3,000 years at all our present nuclear

We need greater public understanding of

the stakes involved in nuclear power and

radioactive waste "management." The NRC

in Louisiana that is swallowing up land,

homes, trees, and leaking natural gas and

oil. Has fracking or the BP oil leak in the

earth and EIS needs to research and

address that before any EIS can be finished.

It is time to move away from nuclear

power. Think how far ahead we'd be if we

invested HALF as much in renewables as we

have in nukes. Wow. We are a crazy

species.

Move On from this toxic insanity. Also too

expensive in many ways.

I have children. We need a safe future for

them. Nukes are the antithesis to safety, as

comment that the radiation loosed into the

biosphere thru radioactive waste can slow

the evolutionary clock to the point that

We not only have radiation sites, we have

places all over where the 55 gallon barrels

have been dumped. They were in open pits

leaking and rusting away. There are also

deep wells, that were used and they are not

working well either. Humans do not really

know how to deal with this. We need to

stop making it. Period.

The potential for a nuclear meltdown is too

more Fukushimas, Chernobyls and Three

Mile Islands. No more new licenses. No

plants isolated from the environment for

the thousands of years that it will remain

deadly, we need to curtail it's production.

It's impossible for anyone to have'confidence' in the safe storage of the most-

toxic of toxic wastes for time frames that

dwarf recorded history. And most of this

waste is stored near water where it is at risk

from rising sea levels or floods. Mankind's

appreciation of such risks is clearly lacking,

and the NRC demonstrates remarkable

hubris in it's "one in a million" analysis of

meltdown risk and "zero liklihood of

It appears that a restart of the San Onofre

Nuclear Generating Station in Southern

California, even at 70% power, would not

be appropriate during the two year time

period in which the NRC is re-writing it's

report on nuclear waste storage and safety.

The court has stated that there is a

moratorium on re-licensing during that

time. We should not have to be guinea pigs

for seeing if the generators will work

properly even though they have been

known to be defective and the fixes, such

as plugging tubes, are questionable! Even

some of the workers at the plant question

whether it would be safe to start up Unit 2

again and especially with quite a few of the

employees at the plant being let go. This is

the plant with the most safety violations in

the US and whistle blowers have not always

the rest of the population from this

unresolved hazard. Or, if you have no

grandchildren, then consider what

happened in Fukushima. Don't believe the

operators' assertion that it cannot happen

here. Earthquakes happen, tsunamis

happen.

We've been waiting for almost 50 years for

the nuclear industry to solve the radioactive

waste storage problem. They haven't done

it and probably can't do it. Make the

industry put up or shut up.

done: The first thing to do to, is to reduce

the amount of nuclear waste needing to be

managed for as long as it is dangerous to

biological life forms. The most obvious and

direct way to do this is to stop making more

nuclear waste. Shut down the factories

making nuclear waste. 2nd Put as much of

the used fuel that has cooled long enough,into high-quality dry.cask storage on-site.

(This should be continued until the reactorsand used fuel pools are empty). 3rd Make

sure that every used fuel pool has electrical

backup in the event of loss of off site

electricity. 4th Identify which nuclearreactors are in the most dangerous

locations: near active earthquake faults,

below dams that could flood the reactor

site, ones sited near high population areas,

etc. Casks from these sites should be

moved to the safest reactor sites. 5th

Initiate a A€-Manhattan ProjectACTM to learn

how to turn nuclear waste into a benign

substance. This is necessary because it is

obvious that there is no way to guard the

waste for the virtual eternity required for

Our current system for storage of spent fuel

All spent fuel rods should be required to be

placed in dry storage casks.

I am particularly concerned about the spent

fuel rods and how they will be contained,

paid for, and kept out of air, water, land

and people.

general, as a systems engineer who has

worked on the Space Shuttle program, I

would like to note that program was

terminated because the design life was

reached, and the government chose not to

do the necessary engineering to extend

that design life. I am appalled to learn that

the NRC had been granting license

extensions for Nuclear plants beyond their

design lifetimes without such design

lifetime extensions. This means that there is

no safety design in effect for these plants,

as any element is subject to potential

failure as being outside its design envelope.

This means that all sorts of unknown parts

are liable to failure due to use beyond their

design life. It is imperative that any plant

license extension be contingent upon such

an engineering review, and replacement of

all elements that cannot be deemed

reliable for the extension period, whether

due to age, wear, radiation exposure, or

any other lifetime-related factor. If such

elements cannot be replaced, the plant

must be shut down and not re licensed.

the NRC should also consider explosions, as

when the titanium fuel rods get above a

certain temperature, which they can easily

do when fuel starts to melt, the melting and

burning titanium steel mixed with water

separates out hydrogen. Such hydrogen

buildup in any containment structure can

explode. This needs to be assessed in terms

of added security and cost for fuel pool

storage. Regarding point 2, add: Hardened

on-site storage (HOSS) is clearly preferable

to pool storage. It is more costly, but some

utilities have converted a small portion of

their pools (e.g., Arizona Public Service has

done a tiny percentage of their spent fuel at

Palo Verde). A big problem is that the

process releases more radiation in the short-

term during construction of the HOSSs. So

that needs to be trapped with filters and

managed -- an added expense which needs

to be calculated and mandated for HOSS

creation. Regarding point 3, add: Any

transport of spent fuel increases

possibilities of black market diversions and

accidents. These reductions in security and

increases in cost for prevention need to be

I don't believe there is any basis to license

and re-license nuclear reactors. The waste

can cause many problems. The reactor can

cause many problems. There are safer and

cheaper alternatives with a lot less

guesswork involved. We are depending on

you to keep us safe and to save our money.

Please don't be responsible for the hurt of

even one individual. You can do a better job

justifying why it is okay to license reactors,

but you can never be very sure that there

won't be disasters as a result of buWilding

and maintaining reactors. Thank you for

on Site Storage (HOSS) at our existing

nuclear power plants.

protecting US either! Please do NOT delay

anymore! You must think we don't

remember....about ALL the 'delays' over

and over - for DECADESH Cleam Up Hanford

ASAP - especially the River, and don't take

We live a few miles from the Oyster Creek

Nuclear Plant, N.J. During Superstorm

Sandy, Oyster Creek lost power from JCP&L.

Back up generators kicked in. Service

pumps in intake canal circulate water to

keep them running. Intake canal flooded.

Reuters reported 6 inches from being

overwhelmed; NRC statement: service

pumps were within 1 ft. of being

submerged. Batteries would kick in; if

batteries die, fuel pool ignites from

overheating sometime within 23 hrs....

.Must stress how close NJ came to a

catastrophe!

The nuclear age needs to end ASAP. It is

killing us all. Generations to come will have

birth defects and other genetic damage.

Enough! NO MORE WASTE until the waste

we have has a solution that does not

involve passing it along to future

generations.

Comments on the NRC's Notice of Intent to Prepare Waste Confidence EIS.

I am grateful for the June 8, 2012 ruling by the District of Columbia Circuit of the U.S. Court ofAppeals ending the Nuclear Regulatory Commission consistent denial of the need to considerproblems associated with the storage and management of highly radioactive irradiated nuclearfuel at reactor sites. This decision was long overdue. I am now making these comments onwhat the "scope" of this environmental impact statement (EIS) should include:

1) NRC must assess the worst-case scenario for each and any storage system dealing withradioactive waste. As we saw in Japan, we cannot determine just what such storage systemsmight undergo in their lifetime. Thus, it is imperative that the assessment deal with theunthinkable scenarios.

2) What happens when some situation makes the storage pool cooling system inoperable? TheNRC must assess this situation and deal with the potential deadly effects of such a catastrophicevent.

3) NRC must examine alternative changes in its regulatory requirements for waste storage on-site since it is easy to forecast, based on existing data, that hardened storage provides a greatermargin of health and safety to the public compared to over-filled pools.

4) NRC should exclude off-site "interim" consolidation of waste storage because the transportevaluations done to date are not an adequate basis upon which to claim an increase in health,safety or security. The period of transport (likely decades) must itself be included in the overallevaluation of increased health, safety or security, where clearly it will not support such a claim.

5) The most important option that the EIS must include is no further production of this waste;based on no further licenses, no license extension and expiration of existing licenses. Inclusionof this alternative must include a consideration of the environmental and health consequencesof the production of nuclear fuel since commercial production of nuclear fuel would be phasedout under this alternative, but not others. NEPA requires that impacts that are tied together bycausation be assessed together.

NRC's current activity under the joint jurisdiction of the Court of Appeals and the NationalEnvironmentally Policy Act is has legal flaws. A primary point is that NRC fails to define theproposed action to be evaluated by the EIS, and therefore it is not possible to define scope. IT istime for the NRC to start over and do this EIS properly.

Underpinning the NRC's radioactive waste policy is the agency's WasteConfidence rule. That rule stated that the NRC had confidence that highlyradioactive irradiated fuel from nuclear reactors would be stored andmanaged safely forever. That confidence gave the NRC the ability to licenseand re-license nuclear reactors. The court has since ruled that the NRC hadno basis to make that assertion.

So the logical path? No place for the waste? Then stop producing the waste!

1) the NRC must assess the overfilling of highly radioactive irradiatednuclear fuel pools as a factor in catastrophic events, including drain-downsand fires, but also inadvertent criticality and other events where loss ofpool integrity results in inability to stabilize cooling within thestructure.

2) NRC must compare and contrast the worst-case-scenarios for radioactivereleases and health consequences from a disruption of current dry storage,fuel pools and "hardened" dry storage. Based upon this, I believe that NRCmust examine alternative changes in its regulatory requirements for wastestorage on-site since it is easy to forecast, based on existing data, thathardened storage provides a greater margin of health and safety to thepublic compared to over-filled pools.
