1. Summary of Agenda Item

The Department will present a list of individuals that meet established criteria for initiation of the suspension process for hunting, fishing and trapping license privileges.

• 210 individuals certified by the Human Services Department as being out of compliance with the Parental Responsibility Act [40-5A-1 NMSA 1978]

2. Background Information

Under the Parental Responsibility Act (40-5A-1 NMSA 1978) the Commission is required to suspend the license privileges of obligors not in compliance with a court order for child support.

Commission Rule 19.31.2 NMAC describes the procedures to administer these suspensions.

Agenda Title: Proposal to Amend Miscellaneous Permit Fees Including those for Game Fish Propagation and License Vendor Requirements and Restrictions - 19.30.9 NMAC.

1. Summary of Agenda Item

The Department will present initial proposals to change the structure for miscellaneous fees including those for captive live fish used for propagation and sale, and will discuss modifying license vendor requirements and restrictions established in 19.30.09 NMAC.

2. Background Information

Commission rule 19.30.9 was originally passed more than 20 years ago. The department proposes to repeal this rule and replace it with a new rule 19.30.9 which adjusts some of the fees charged for special use permits to better reflect current administrative costs, and to clarify and update the application and accountability requirements for license vendors in conjunction with the current on-line license sales system.

3. Strategic Plan References and Possible Impacts of Agenda Item

Program Support Objective 2: That through 2018, management and control of the Department’s financial resources, assets, and procurements complies with applicable laws, regulations, and accounting/procurement standards. Proposed changes to outdated elements of this rule will reflect current requirements and costs.

4. Considerations Regarding Duplications and/or Conflicts with Existing Rules or Statutes

17-1-14, 17-3-5, 17-3-7, and 17-3-12 NMSA authorize the Commission to establish permits and set fees, and to prescribe the application and accountability requirements for license vendors.

5. Description and Summary of Public Involvement Process and Results

This initiates the process for public involvement and the department will continue to take public comment on any proposed changes through our website. All input will be reviewed and a summary of the results will be provided to the Commission.

6. Suggested Motion

This is a discussion item and no motion is necessary, unless Commission discretion dictates otherwise.

1. Summary of Agenda Item

The Department will present initial concepts and proposals on big game tagging (19.31.10 NMAC) and harvest reporting (19.30.10 NMAC) to assist in compliance of big game harvest and bag limits.

2. Background Information

Since the inception of the on-line licensing system, some sportsmen have expressed concern that a person could take more than their bag limit allows for the same hunt as the Department only requires harvest reporting at a later time. The Department is exploring ways to address these concerns and to reduce confusion and ensure compliance.

Consideration of potential improvements is consistent with a strategy to implement methods by which hunting (and fishing) opportunity and participation might be increased as identified on page 11 of the Department's Strategic Plan for FY 2013-2018 (Conservation Services Program P717, objective 5, strategy 5.1). Consideration of potential improvements is also consistent with a strategy to evaluate and improve efficiency, quality and effectiveness of the Department's administrative processes as identified on page 25 of the Strategic Plan (Program Support P719 objective 1, strategy 1.2.3).

Agenda Title: Proposal of Administrative Restrictions For A Convicted Felon Taking or Attempting to Take a Game Animal or Bird with a Firearm.

The Department will present initial concepts and proposals on administrative restrictions for convicted felons taking or attempting to take protected wildlife with the use of a firearm.

2. Background Information

A person convicted of a felony, who is prohibited from possessing firearms in New Mexico may still hunt using archery equipment, and is eligible to purchase a hunting license for a hunt code in which archery is a legal type of weapon. This includes “any legal sporting arm” hunts. If a felon then uses a firearm to hunt, he or she could be violating New Mexico criminal law. The Department is exploring options to be able to apply administrative restrictions in the event of this type of activity.

Field Operations Program, Objective 1: That through 2018, hunting, trapping and fishing opportunities and off-highway motor vehicle recreation are maintained through public compliance with rules and laws.

Agenda Title: Final Proposals on Oryx Management Relating to the Security Badged Hunts

1. Summary of Agenda Item

The Department is proposing final amendments for the security badged hunts on White Sands Missile Range found in 19.31.12 (NMAC). The proposal is to change these badged hunts into population management hunts.

2. Background Information

A recent court decision requires the Department to vacate the Terk injunction and allows the Department to award oryx hunt licenses to the State’s license quota to include that 10% of these licenses are reserved for the Guide/Outfitter pool; however, the security badged hunts do not allow for commercial guide participation. These oryx hunts were originally designed to manage oryx in highly secure sites when the quota application was not an issue. The Department’s recommendation to resolve this is to eliminate all non-military security badge hunts and use population management hunts as allowed by rule (19.31.12.11 NMAC).

• Increase in Estancia Valley Sandhill crane harvest to 3/day, 9 in possession. • Require free permit for band-tailed pigeon harvest. • Probable reduction in band-tailed pigeon bag limits from 5 to 2 per day and

decrease in season length from 30 to 14 days. • Adjust regular duck season to end in late January.

This Rule is amended annually to comply with Flyway recommendations and Federal guidelines.

The Department presented a proposal to the Commission at the May 23, 2013 meeting (Agenda Item 9) to begin a process to reintroduce desert bighorn sheep to the Sacramento west side escarpment in GMU 34. The Commission amended this rule (19.31.12 NMAC) on August 22, 2013 to facilitate the reduction of the Barbary sheep population prior to this introduction by opening up the west side of GMU 34 to Over-The-Counter Barbary sheep hunting.

Agenda Title: Review of Commission Properties Previously Approved For Disposal.

1. Summary of Agenda Item

The Department will present a review of Commission properties that were previously approved for disposal because of limited value to wildlife or their habitat.

2. Background Information

In the December 2007 meeting, the Commission approved the Department’s recommendations for property disposal. There were 12 properties discussed for potential action and the Commission unanimously voted to “to direct the Department staff to execute necessary actions to obtain legislative approval or other appropriate approval to dispose of Game Commission properties identified as no longer meeting objectives for habitat restoration and management, wildlife populations, or wildlife-associated recreation.” At a subsequent State Game Commission meeting held on December 13, 2012, in Lordsburg, New Mexico, the Commission reaffirmed the previous approval to dispose of the 12 properties as well as four additional ones. Since the December 2012 approval the Department has had numerous conversations with State Parks, the BLM and the State Land Office regarding prospective property land trades. The Warehouse property in Santa Fe has been leased to the State Forestry Division of Energy, Minerals and Natural Resources to house their Veteran Firefighter Program. The Department is in the process of contracting legal services to work with the Valencia Soil and Water Conservation District in finalizing the separation of ownership of the Rio Abajo property south of Belen, as approved by the Commission at the October 2, 2014 Commission meeting. Additionally, contracted legal services will include realtors to list for sale several of the smaller properties.

Agenda Title: Unstaffed Shooting Ranges

1. Summary of Agenda Item

Many state wildlife agencies own and operate shooting ranges that are unstaffed. These ranges are open to the public for recreational target shooting and sighting-in hunting rifles, shotguns, muzzleloaders and pistols. Dr. Bennett will present the benefits for having such ranges in New Mexico and share his experience in range logistics and development.

Objective 2.1.3 of the Field Operation Program portion of the Strategic Plan is to “Provide skills-based and wildlife conservation educational programs throughout the State” and Objective 9.1.2 of the Conservation Services Program portion of the Strategic Plan is to "Evaluate properties for use as shooting ranges, hunter education, hunting areas and sites for Department programs". This request is consistent with these strateies and objectives.

Agenda Title: Briefing on Quintana et al. v. Barney et al. Case No. D-430-CV_2012-00003

1. Summary of Agenda Item

The suit, Quintana v. Barney involves property which includes a perpetual right-of-way and easement that provides access to Morphy Lake. The Department provides public fishing and assists with management and harvest of fish at the lake. While the Department is the named party, it is the Commission’s property in dispute. The suit is currently set for trial in May of this year, and a settlement or other legal documents may be proposed and may require Commission approval.

2. Background Information

The Commission holds a perpetual right-of-way and easement that provides access to Morphy Lake where the Department provides public fishing and assists with management and harvest of fish. The quiet title suit pending in Court involves property that includes the perpetual right-of-way and easement. The matter commenced in Court on January 24, 2012.

This is not applicable to the State Game Commission as the strategic plan is referring the Department’s strategic plan.
