Dear Ms. Fleming:

I am writing due to serious concerns regarding DeKalb County CoIDIilissionerSharon .Barnes-Sutton. My concerns date back to 2008, and are ongoing. Based on the facts presentedhere, I believe that a Grand Jury Investigation of the commissioner is in order. I am aware thatduring the DeKalb Board of Commissioner's Meeting on January 24, 2010, several DeKalbresidents called for an investigationof Commissioner Barnes-Sutton to be done by the CountyCommission, District Attorney, Solicitor, or the DeKalb County CEO. However, since thispublic call seems not to have been heeded, I respectfully make this formal request that you,District Attorney Gwen Keyes Fleming, impanel a Grand Jury to investigate this matter.

This call for an investigation arises from a long list of questionable and possibly illegalactivities carried out by Ms. Barnes-Sutton. Questions regarding Ms. Barnes-Sutton's residencyas well as campaign finance issues have come to light during her campaign and during her timein office. These issues returned to the forefront when recently it was discovered that there wereseveral outstanding warrants for the commissioner's arrest.

During Ms. Barnes-Sutton's campaign for DeKalb County Commissioner in 2008, aquestion was raised regarding her residency in DeKalb county. In order to qualify as a candidate

. for commissioner from the 4th district of DeKalb County, Ms. Barnes-Sutton had reported thatshe lived at 4624 Randalwood Court, Stone Mountain, DeKalb County, Georgia 30086..However, there was evidence to show that she did not actually reside at that address .

. Specifically, it was observed that the property appeared to be uninhabited and seemed to havebeen unoccupied for an extended p~riod.· A challenge was made, but the DeKalb County Boardof Registration and Elections found that there was enough evidence to show that Ms. Barnes-Sutton did in fact reside at the Dekalb county address. A timely appeal was not made,

During the saine campaign, then-candidate Barnes-Sutton may have violated Georgiarules regarding campaign finance disclosure .. Specifically, Ms. Barnes-Sutton made several large .personal loans to her campaign, but failed to report them in a timely manner. According to opereport, she made severalloans during 2008 which she failed to report Untilwell after the August

5,2008 primary run-off, in Violation of Georgia's campaign finance laws_While Ms. Barnes-Sutton did make acampaign ..disclosure in April 2008, .sbe missed the next four filing deadlinesset by state law. Ms. Barnes-Sutton finally submitted a delinquent disclosure in December 2008,reporting contributions $49,500 in personal loans to her campaign. Interestingly, at the same timethat she was makingthese substantial and unreported donations to her campaign, Ms. Barnes-

· Sutton was experiencing serious personalfiruincial problems. As noted, four warrants wereissued against Ms. Barnes-Sutton out of Gwinnett County for bad checks issued by her in 2007.In 2008, her DeKalb schoolteacher wages were being garnished for an outstanding debt to a carfinancing company. And since 1995, Ms. Barnes-Sutton has been plagued by a number of civiland criminal charges filed against her, including claims for defaults on accounts and severalcriminal charges for bad checks. .

Most recently, on January 10,2010, Ms. Barnes-Sutton was involved in aminor traffic.. accident following which the DeKalb police officers on the scene ran her identification through

the Georgia Crime Information Center database. Upon their search, the officers found fouroutstanding warrants issued out of Gwinneff County for Ms. Barnes-Sutton's arrest. Instead ofarresting her, which would have followed normal procedure, the officers advised Ms. Barnes-Sutton to go directly to the Gwinnett County Sheriff's Office and resolve the matter. Butaccording to a spokeswomari for the Gwinnett Sheriff, Ms. Barnes-Sutton never appeared at the

· sheriff's office. Instead, she went to Costco, the merchant to whom the bad checks were issued,and paid the amount due. She then had the retailer contact a judge, who recalled the warrants.

Ms. Barnes-Sutton chairs the DeKalb County public safety committee, which overseesthe police budget, and also serves on the commission's budget committee, The information set.forth here is intended to show that her ability to handle any budget prudently, professionally, andlegally is in serious question. Specifically, her campaign disclosure violations transcend therealm of the ethical by violating not only the ethical but the legal obligations ofber position aswell. And her January 24; 2010 interaction with the DeKalb police officers implies improprietyin that after being let go in violation of normal protocol, Ms.Bames-Sutton did not go to the ..sheriff's office as instructed but chose to handle the situation asshe saw fit. Ms. Barnes-Suttonseems to have a long historyof bending and breaking the rules, so to speak, to serve herself.That being said, in light of her actions as DeKalb CountyCommissioner, 1 believe that further .review is necessary and a grand Jury investigation warranted. . ..
