Republic of the Philippines CITY OF DAVAO Office of the City Council COMMITTEE ON RULES, PRIVILEGES, LAWS AND ORDINANCES Background 1. This pertains to an ordinance passed by the Barangay Council of Bunawan, Bunawan District, Davao City, entitled “An Ordinance Approving SK Budget/Development Plan of Barangay BUnawan, Bunawan District, Davao City for Calendar Year for 2014 in Compliance to the Implementing Rules and Regulation of the Republic Act No. 10632, also known as AN ACT TO POSTPONE THE SANGGUNIANG KABATAAN ELECTION ON OCTOBER 28, 2013.” Highlights 2. The pertinent provision of the subject Ordinance is Section 3 therein. It states that the Sangguniang Kabataan Fund is Php 1,058,058.32. This is from the General Fund of Barangay Bunawan which consists of Php 10,580,835.15 in total. This is in consonance with Section 4 of R.A. 10632 also known as “An Act to Postpone the Sangguniang Kabataan Elections on October 28, 2013, Amending for the Purpose R.A. 9340, and for Other Purposes” which provides the following: “Section 4. Use of 10% Sangguniang Kabataan Fund – Until the new set of officials have been duly elected and qualified, the Sangguniang Barangay shall use the Sangguniang Kabataan Fund solely for youth development programs.” 3. From the Sangguniang Kabataan Budget, Php 105,808.53 has been reserved for the conduct of SK Election. The said amount is more than 10% of the SK Fund and, as such, is in line with Section 2 Rule 5 of the Implementing Rules and Regulations of R.A. 10632. Such provision states that the SK Fund is to be allocated for Youth Development Programs and Projects and that 10% of the said fund, but not less than ten thousand (Php 10,000.00), should be reserved for the conduct of the SK Elections. 4. The Ordinance is consistent with our laws and the Committee finds that it suffers no legal infirmities. Background

1. Highlights

2. The pertinent provision of the subject Ordinance is Section 3 therein. It states that the Sangguniang Kabataan Fund is Php 1,058,058.32. This is from the General Fund of Barangay Bunawan which consists of Php 10,580,835.15 in total. 4. The Ordinance is consistent with our laws and the Committee finds that it suffers no legal infirmities.

Recommendation

6. This Committee recommends that a resolution be passed approving the Ordinance passed by the Barangay Council of Bunawan, Bunawan District, Davao City, entitled “An Ordinance Approving SK Budget/Development Plan of Barangay Bunawan, Bunawan District, Davao City for Calendar Year for 2014 in Compliance to the Implementing Rules and Regulation of Republic Act No. 10632, also known as AN ACT TO POSTPONE THE SANGGUNIANG KABATAAN ELECTION ON OCTOBER 28, 2013.”

WHEREAS, pursuant to Section 57 of the Local Government Code on review of Barangay Ordinances by the Sangguniang Panlungsod, paragraph (a):

“Within ten (10) days after its enactment, the Sangguniang Barangay shall furnish copies of all barangay ordinances to the Sangguniang Panlungsod or Sangguniang Bayan concerned for review as to whether the ordinance is consistent with law and city or municipal ordinances.”

WHEREAS, Section 4 of R.A. 10632 also known as “An Act to Postpone the Sangguniang Kabataan Elections on October 28, 2013, Amending for the Purpose R.A. 9340, and for Other Purposes” provides the following:

“Section 4. Use of 10% Sangguniang Kabataan Fund – Until the new set of officials have been duly elected and qualified, the Sangguniang Barangay shall use the Sangguniang Kabataan Fund solely for youth development programs.”

WHEREAS, Section 2 Rule 5 of the Implementing Rules and Regulations of R.A. 10632 states that the SK Fund is to be allocated for Youth Development Programs and Projects and that 10% of the said fund, but not less than ten thousand (Php 10,000.00), should be reserved for the conduct of the SK Elections;WHEREAS, the SK Budget/Development Plan of Barangay Bunawan, Bunawan District, this City for Fiscal Year 2014 is in compliance with the foregoing provisions of law;WHEREAS, after careful perusal and deliberation, the committee recommends the approval of the SK Budget/Development Plans of Barangay Bunawan for Calendar Year 2014NOW THEREFORE, be it resolved as it is hereby resolved that the SK Budget/Development Plan of Barangay Bunawan, Bunawan District, this City, for Calendar Year 2014 be declared operative the same having complied with Republic Act 10632 with its corresponding Implementing Rules and Regulations as well as with Section 333 of The Local Government Code of 1991;

RESOLVED FURTHER, that copies of this Resolution be furnished to the Office of the Secretary to the Sangguniang Panlungsod, City Mayor’s Office, and all other offices/departments concerned, for their information and guidance.Done this______________, Davao City, Philippines.
