#002 [25 Pa. Code §127.512(c)(4)]ProperlyRights

This permitdoesnot conveypropertyrights of anysort, oranyexclusiveprivileges.

#003 [25Pa. Code§127.446(a)and (c)JPermit Expiration

This permit is issuedfor afixed termof 5 yearsfrom theeffectivedateshownon page2 of this permit. The termsandconditionsof theexpiredpermit shallautomatically continuependingissuanceof anewTitle Vpermit, providedthepermitteehassubmittedatimely andcompleteapplicationandpaid applicable feesrequiredunder25 Pa.CodeChapter127,SubchapterI andtheDepartmentis unable,throughno fault of thepermittee,to issueor denyanewpermitbeforetheexpirationof thepreviouspermit. An application iscompleteif it containssufficientinformationto beginprocessingtheapplication,hastheapplicablesectionscompletedandhasbeensignedby aresponsibleofficial.

#004 [25Pa. Code§§127.412,127.413, 127.414,127.446(e)& 127.503]Permit Renewal

(a) An applicationfor the renewal oftheTitle V permit shallbesubmittedto theDepartmentat least6 months,andnotmorethan 18months,beforethe expiration dateof this permit. Thepermitteeshallsubmitatimely andcompleteapplicationto the Department’sRegionalAirProgramManager. The renewalapplicationis timely if acompleteapplicationis submittedto theDepartmentwithin the timeframespecffiedin this permit condition.

(b) Theapplicationfor permit renewalshall includethecurrentpermitnumber,theappropriatepermitrenewalfee, a descriptionof anypermitrevisionsandoff-permit changesthatoccurredduringthepermit term,andanyapplicablerequirementsthatwerepromulgatedandnotincorporatedinto thepermit duringthepermit term.

#001 [25 Pa. Code§121.11Definitions

(c) The renewalapplication shallalsoinclude submissionof proofthatthelocal municipalityandcounty,in which the facility is located,havebeennotified in accordancewith 25 Pa.Code§ 127.413. Theapplicationfor renewal oftheTitle V permit shallalsoincludesubmissionofcompliancereviewforms whichhave beenusedby thepermitteeto updateinformationsubmittedin accordancewith either25 Pa.Code§ 127.412(b)or§ 127.4120).

(d) The permittee,uponbecomingawarethat anyrelevantfactswereomittedor incorrectinformation wassubmittedin thepermitapplication,shall submitsuchsupplementaryfactsor correctedinformationduring thepermitrenewalprocess.Thepermitteeshallalsoprovideadditionalinformation asnecessaryto address any requirementsthatbecomeapplicableto thesourceafterthedateacompleterenewalapplicationwassubmittedbut prior to releaseof adraft permit.

#005 [25 Pa. Code§§127.450(a)(4)& 127.464(a)JTransfer of Ownershipor OperationalControl

(a) In accordancewith 25 Pa. Code§ 127.450(a)(4),a changein ownershipor operationalcontrolof thesourceshall betreated asanadministrativeamendmentif:

(1) TheDepartmentdeterminesthatno otherchangein thepermit isnecessary;

(2) A written agreementhasbeen submittedto theDepartmentidentifying thespecificdateof thetransferofpermitresponsibility,coverageandliability betweenthecurrentandthenewpermittee;and

(3) A compliancereviewform hasbeen submittedto theDepartmentandthepermittransferhasbeenapprovedby the Department.

(b)In accordancewith 25 Pa.Code§ 127.464(a),this permitmaynot betransferredto anotherpersonexceptin casesof transfer-of-ownershipwhich aredocumentedandapprovedto thesatisfactionof theDepartment.

#006 [25 Pa. Code§127.513,35 P.S. §4008and §114ofthe CAAJInspection and Entry

(a) Uponpresentationof credentialsandotherdocumentsasmayberequiredby law for inspectionandentrypurposes,thepermitteeshallallow theDepartmentof Environmental Protectionor authorizedrepresentativesof theDepartmentto performthe following:

(1) Enterat reasonabletimes uponthepermittee’spremiseswhereaTitle V source islocatedoremissionsrelatedactivity is conducted,orwhererecordsarekept under theconditionsof this permit;

(2) Haveaccessto andcopyor remove,at reasonabletimes, recordsthatare keptunder theconditionsofthis pennit;

(3) Inspectat reasonabletimes,facilities, equipmentincludingmonitoringandair pollution controlequipment, practices,or operationsregulatedorrequiredunderthis permit;

(4) Sampleor monitor, at reasonable times,substances orparameters,for the purposeof assuringcompliancewith thepermitorapplicablerequirementsasauthorizedby the CleanAir Act, theAirPollutionControlAct, or theregulationspromulgatedundertheActs.

(b) Pursuantto 35 P.S.§ 4008, no personshallhinder,obstruct,preventor interferewith theDepartmentor its personnelin theperformanceof anyduty authorizedundertheAir Pollution ControlAct orregulationsadoptedthereunder.

(c) Nothing in this permitconditionshall limit the ability of theEPAto inspector enter thepremisesof thepermitteein accordance withSection114 or otherapplicableprovisionsof the CleanAir Act.

#007 [25 Pa. Code § §127.25, 127.444, & 127.512(c)(1)]ComplianceRequirements

(a) Theperinittee shallcomplywith theconditionsof this permit.Noncompliancewith this permitconstitutesaviolation of the CleanAirAct andtheAir Pollution ControlAct andis groundsfor oneor moreofthefollowing:

(1) Enforcementaction

(2) Permit termination,revocationand reissuanceor modification

(3) Denialof apermit renewalapplication

(b) A personmaynot causeor permittheoperationof asource,whichis subjectto 25 Pa.CodeArticle III, unlessthe source(s)andaircleaningdevicesidentified intheapplicationfor theplanapprovalandoperatingpermit andtheplan approvalissuedto thesourceareoperatedand maintainedin accordancewith specificationsin the applicationsandtheconditionsin theplanapprovalandoperatingpermitissuedby the

Department.A personmaynotcauseorpermit theoperationof an aircontaminationsourcesubjectto 25 Pa. CodeChapter127 in amannerinconsistentwith goodoperatingpractices.

(c) For purposesof Sub-condition(b) of this permitcondition,thespecifications inapplicationsfor planapprovalsandoperatingpermitsarethephysical configurationsandengineeringdesigndetailswhich theDepartmentdeterminesareessentialfor thepernhittee’scompliancewiththeapplicablerequirementsin this Title V permit. Nothing inthissub-condition shallbe construedto createanindependentaffinnativeduty uponthepermittecto obtainapredeterminationfrom theDepartmentfor physical configurationor engineeringdesigndetailchangesmadebythepermittee.

#008 [25 Pa. Code§127. 512(c)(2)JNeed to Haltor Reduce Activity Nota Defense

It shallnot be a defensefor apermittee inanenforcementactionthatit would havebeen necessaryto halt or reducethepermittedactivity inorderto maintaincompliancewith theconditionsofthis permit.

#009 [25 Pa. Code§§127.411(d)& 127.512(c)(5)JDuty to Provide Information

(a) Thepermitteeshall furnish to theDepartment,within areasonabletime, informationthat theDepartment mayrequestin writing to determinewhethercauseexistsfor modiI~ring,revokingandreissuing,orterminatingthepermit, or to determinecompliancewith thepermit.

(b) Uponrequest,thepermittee shallalsofurnish to theDepartmentcopiesof recordsthatthepermitteeis requiredto keepby this permit,or for informationclaimed tobe confidential,thepermitteemayfurnishsuchrecordsdirectly to theAdministratorof EPA alongwith aclaim ofconfidentiality.

#010 [25 Pa. Code § §127.463, 127.512(c) (3)& 127.542]ReopeningandRevisingthe Title V Permitfor Cause

(a) This Title V permitmaybemodified, revoked,reopenedandreissuedor terminatedfor cause. Thefiling of arequestby thepermitteefor apermitmodification,revocationandreissuance,or termination,or of anotification ofplanned changesor anticipated noncompliancedoesnotstaya permit condition.

(b) This permit may bereopened,revisedandreissuedprior toexpiration ofthepermitunderoneor moreofthe following circumstances:

(1) Additional applicablerequirementsundertheCleanAir Act ortheAir Pollution ControlAct becomeapplicableto aTitle V facilitywith aremainingpermittermof 3 ormoreyearsprior to the expirationdateofthis permit. Thepermitrevision shallbecompletedwithin 18monthsafterpromulgationof theapplicablerequirement. No suchrevisionis requiredif theeffectivedateof therequirementis laterthanthe expiration dateof this permit, unlesstheoriginal permitorits termsandconditionshasbeenextended.

(2) Additional requirements,including excessemissionsrequirements,becomeapplicableto an affected sourceundertheacidrainprogram.Upon approvalby theAdministratorof EPA, excessemissionsoffset plansfor an affectedsourceshallbe incorporated intothepermit.

(3) TheDepartmentor theEPA determinesthatthis permitcontainsamaterialmistakeor inaccuratestatementsweremadein establishingtheemissionsstandards orothertermsor conditionsof this permit.

(4) TheDepartmentor theAdministratorof EPA determinesthat thepermitmust berevisedor revokedto assurecompliancewith theapplicablerequirements.

(c) Proceedings torevisethis permit shall follow thesameprocedureswhich applyto initial pennitissuanceandshallaffectonly thosepartsof this permitfor which causeto reviseexists. Therevisionshallbemadeasexpeditiouslyaspracticable.

(d) Regardlessofwhethera revision ismadein accordancewith (b)(1)above,thepermitteeshall meettheapplicablestandardsor regulationspromulgatedunder theCleanAir Act within the time frame requiredbystandardsorregulations.

#011 [25 Pa. Code§127.5431Reopening a Title VPermitfor Cause byEPA

As requiredby theCleanAir Act andregulationsadoptedthereunder,thispermitmaybemodified, reopenedandreissued,revokedor terminatedforcauseby EPA in accordancewith proceduresspecifiedin 25 Pa.Code§127.543.

Whenpermitmodfficationsduringtheterm of this permitdo not qualifyasminor permitmodificationsor administrativeamendments,thepermitteeshall submitanapplicationfor significantTitle V permitmodificationsin accordancewith 25 Pa. Code§ 127.541.

#013 [25 Pa. Code§§121.1& 127.462]Minor OperatingPermit Modifications

(a) The permitteemaymakeminor operatingpermitmodifications(asdefinedin 25 Pa. Code§ 121.1)in accordancewith 25 Pa. Code§ 127.462.

(b) Unlessprecludedby theCleanAir Act or theregulationsthereunder,thepermitshielddescribedin 25 Pa. Code§ 127.516(relatingto permitshield) shall extendto anoperationalflexibility changeauthorizedby25 Pa.Code§ 127.462.

#014 [25 Pa. Code§127.450]AdministrativeOperatingPermit Modifications

(a) Thepermitteemayrequestadministrativeoperatingpermit amendments,asdefinedin 25 Pa.Code§ 127.450(a),accordingto proceduresspecifiedin § 127.450. Administrative amendmentsarenot authorizedfor anyamendmentprecludedby theCleanAir Act or the regulationsthereunderfrom being processedasan administrativeamendment.

(b) Upontakingfinal actiongrantinga requestfor anadministrativepermit amendmentin accordancewith § 127.450(c),theDepartmentwillallow coverageunder25 Pa.Code§ 127.516(relatingto permitshield)for administrativepermit amendmentswhichmeettherelevant requirementsof 25 Pa.CodeArticle III, unlessprecludedby the CleanAir Act or theregulationsthereunder.

#015 [25 Pa. Code§127.512(b)]SeverabilityClause

Theprovisionsof this permit areseverable,andif anyprovision ofthispermit is determinedby theEnvironmentalHearingBoardor acourtofcompetentjurisdiction to be invalid or unenforceable,suchadeterminationwill not affect theremaining provisionsof this permit.

#012 [25 Pa. Code§127.541]Significant OperatingPermitModifications

(a) The permitteeshall payfees totheDepartmentin accordancewiththeapplicablefeeschedulesin 25 Pa.CodeChapter127,SubchapterI(relatingto planapprovalandoperatingpermit fees).

(b) EmissionFees. The permitteeshall, on or beforeSeptember1st ofeachyear, payapplicableannualTitle V emissionfeesfor emissionsoccurringin theprevious calendar yearasspecifiedin 25 Pa.Code§127.705. Thepermitteeis not requiredto pay anemissionfee foremissionsof morethan4,000tonsof eachregulatedpollutantemittedfrom thefacility.

(c) As usedin this permitcondition,theterm “regulatedpollutant” isdefinedas aVOC, each pollutantregulatedunderSections111 and 112 oftheCleanAir Act andeachpollutant for whichaNational AmbientAirQuality Standardhasbeenpromulgated,exceptthatcarbonmonoxideisexcluded.

(d) Late Payment. Late paymentof emissionfeeswill subjectthepermitteeto thepenaltiesprescribedin 25 Pa. Code§ 127.707andmayresult in thesuspensionor terminationof theTitle V permit. Thepermitteeshall payapenaltyof fifty percent(50%) of thefeeamount,plusintereston thefeeamountcomputedin accordance with26 U.S.C.A.§6621(a)(2) from thedatethe emissionfeeshouldhavebeenpaid inaccordancewith thetime framespecifiedin 25 Pa. Code§ 127.705(c).

(e) Thepermitteeshall pay anannualoperatingpermit administrationfee according tothe feeschedule establishedin 25 Pa. Code§ 127.704(c)if thefacility, identified in subparagraph(iv) of thedefinition of theterm“Title V facility” in 25 Pa.Code§ 121.1,is subjectto Title VaftertheEPA Administratorcompletesarulemaking requiringregulationofthosesourcesunderTitle V of theClean AirAct.

(f) This permitcondition doesnotapplyto aTitle V facility whichqua]ifies forexemptionfrom emissionfeesunder35 P.S.§ 4006.3(f).

#017 [25 Pa. Code §§127.14(b) & 12 7.449]Authorizationfor DeMinimis Emission In creases

(a) This permit authorizesdeminirnis emissionincreasesfrom aneworexistingsourcein accordancewith 25 Pa. Code§§ 127.14and 127.449without theneedfor aplanapprovalor prior issuanceof apermitmodification.The permitteeshallprovidetheDepartmentwith 7 daysprior written noticebefore commencinganyde miniinis emissionsincrease.

#016 [25 Pa. Code § §127. 704, 127.705 & 127.7071Fee Payment

Thewrittennoticeshall:

(1) Identify anddescribethepollutantsthatwill beemittedas aresultof thedeminimis emissionsincrease.

(2) Provideemissionratesexpressed intons peryearandin termsnecessaryto establishcomplianceconsistent withanyapplicablerequirement.

TheDepartment maydisapproveor conditionde mininiis emissionincreasesat anytime.

(b) Exceptasprovidedbelow in (c) and(d) of tliis permitcondition,thepermitteeis authorizedduringthe termof this permitto makedemininiis emissionincreases(expressedin tonsperyear)up to thefollowing amountswithout theneedfor aplan approvalor prior issuanceof apermitmodification:

(1) Fourtonsof carbonmonoxide froma singlesourceduringthetermof thepermit and20 tonsof carbon monoxideat thefacility duringthe termofthepermit.

(2) Oneton of NOx from asingle sourceduring thetermof thepermitand5 tonsof NOx at thefacility duringthetermof thepermit.

(3) Oneandsix-tenthstonsof theoxidesof sulfur from asinglesource duringthe term of thepermitand8.0 tonsof oxidesof sulfur atthefacility duringthe termof thepermit.

(4) Six-tenthsof aton of PM10 from asinglesourceduringthetermof thepermit and3.0 tonsof PMLO at thefacility duringthetermof thepennit. This shall includeemissionsof apollutant regulatedunderSection112 of theCleanAir Act unlessprecludedby theCleanAirAct or 25 Pa.CodeArticle III.

(5) Oneton ofVOCs from asinglesourceduringtheterm ofthepermit and5.0 tonsofVOCs at thefacility duringthe termof thepermit. This shall includeemissionsof apollutantregulatedunderSection112 of theCleanAir Act unlessprecludedby theCleanAir Act or25 Pa. CodeArticle III.

(c) The permitteeis authorizedto install the following minor sourceswithout theneedfor aplanapproval:

(1) Air conditioningorventilationsystemsnot designedto removepollutantsgeneratedorreleasedfrom othersources.

(2) Combustionunits ratedat 2,500,000or less Btuper hourofheatinput.

(3) Combustionunitswith aratedcapacityoflessthan 10,000,000Btu perhourheat inputfueledby naturalgassuppliedby apublicutility, liquified petroleumgasorby commercialfuel oils which areNo.2 or lighter, viscositylessthanor equalto 5.82c St. andwhich meetthesulfur content requirementsof 25 Pa.Code§ 123.22(relatingtocombustionunits). For purposesof this permit, commercial fueloilshall bevirgin oil which hasno reprocessed,recycledorwaste materialadded.

(4) Spaceheaterswhich heatby directheattransfer.

(5) Laboratoryequipmentusedexclusivelyfor chemicalorphysicalanalysis.

(d) This permitdoesnotauthorizedeminimis emissionincreasesif theemissionsincreasewould causeoneormoreof the following:

(1) Increasetheemissionsof apollutant regulatedunderSection112oftheCleanAir Act exceptasauthorizedin Subparagraphs(b)(4) and(5) ofthis permitcondition.

(2) Subjectthe facility to thepreventionof significantdeteriorationrequirementsin 25 Pa. CodeChapter127,SubchapterDand/orthenewsourcereviewrequirementsin SubchapterE.

(3) Violate anyapplicablerequirementof theAir Pollution ControlAct, theCleanAir Act, or theregulationspromulgatedundereitheroftheacts.

(4) Changeswhich aremodificationsunderanyprovision ofTitle Iof theCleanAir Act andemissionincreaseswhich would exceedtheallowableemissionslevel (expressesas a rate ofemissionsor in termsof total emissions)under theTitle V permit.

(e) Unlessprecludedby theCleanAir Act or theregulationsthereunder,thepermitshielddescribedin 25 Pa.Code§ 127.516 (relatingto permitshield)appliesto de minimis emissionincreasesandthe installationofminor sourcesmadepursuantto this permit condition.

(it) Emissionsauthorizedunderthis permit conditionshallbe includedin themonitoring, recordkeepingandreportingrequirementsof thispermit.

(g) Exceptfor demininctisemissionincreasesallowedunderthis permit,

25 Pa. Code§ 127.449,or sourcesandphysicalchangesmeetingtherequirementsof 25 Pa.Code§ 127.14, thepermitteeis prohibitedfrommakingphysicalchangesor engagingin activitiesthatarenotspecificallyauthorizedunderthis permitwithout firstapplyingfor aplanapproval.In accordancewith § 127.14(b),aplanapprovalis notrequiredfor theconstruction,modification,reactivation,orinstallationof thesourcescreatingthedeminimis emissionsincrease.

(h) The permitteemaynot meetde minimis emissionthresholdlevelsbyoffsettingemissionincreasesordecreasesat thefacility.

#018 [25 Pa. Code§§127.lla& 127.215]ReactivationofSources

Thepermitteemayreactivateasourceat thefacility thathasbeenoutofoperationor productionfor at leastoneyear,but lessthanor equalto 5 years, ifthesourceis reactivatedin accordance withtherequirementsof 25 Pa.Code§§ 127.lla and 127.215. Thereactivatedsourcewill not beconsideredanewsource.

#019 [25 Pa. Code§§121.9& 127.216]Circumvention

(a) The owner ofthisTitle V facility, or anyotherperson,maynotcircumventthenewsourcereviewrequirementsof 25 Pa.CodeChapter127, -

SubchapterE by causingor allowing apatternof ownershipordevelopment,including thephasing,staging,delayingor engaginginincremental construction,overageographicareaof afacility which,exceptfor thepatternof ownershipor development, would otherwiserequireapermitorsubmissionof aplanapprovalapplication.

(b) No personmay permittheuseof adevice,stackheightwhich exceedsgood engineeringpracticestackheight, dispersiontechniqueor othertechniquewhich, without resultingin reductionof thetotal amountofair contaminantsemitted,concealsor dilutesan emissionof aircontaminantswhich would otherwisebein violation of this permit, theAir PollutionControlAct or theregulations promulgatedthereunder,exceptthatwith prior approvalof theDepartment,thedeviceortechniquemay beusedfor control of malodors.

(a) Reports,test data,monitoringdata,notificationsandrequestsforrenewal ofthepermit shall besubmittedto the:

(d) Unlessotherwiserequiredby theCleanAir Act or regulationsadoptedthereunder,aresponsibleofficial of the facility shall certify thatbasedon information andbeliefformedafterreasonableinquiry, thestatementsandinformationin thedocumentsaretrue, accurate,andcomplete.

#021 [25 Pa. Code §127.441(c) & Chapter 139; § §114(a)(3),504(b)ofthe CAAJSampling, Testingand Monitoring Procedures

(a) The permitteeshallperformall applicableemissionsmonitoringandanalysis proceduresor testmethods,including proceduresandmethodsunderSections1 14(a)(3)or 504(b) of theCleanAir Act.

(b) The permitteeshallcomply with themonitoring, recordkeepingorreportingrequirementsof 25 Pa.CodeChapter139 andtheotherapplicablerequirementsof 25 Pa.CodeArticle III andadditionalrequirementsrelatedto monitoring, reportingandrecordkeeping requiredby theCleanAir Act andtheregulationsthereunderincluding themonitoringrequirementsof 40 CFRPart64, if applicable.

(c) Unlessalternativemethodologyis requiredby theCleanAir Act and

#020 [25 Pa.Code§§127.402(d)& 127.513(1)]Submissions

regulationsadoptedthereunder,sampling,testingandmonitoringrequiredby or usedby thepermittee todemonstratecompliance withany applicableregulationor permit conditionshallbe conductedin accordancewith therequirementsof 25 Pa.CodeChapter139.

#022 [25 Pa. Code §§127.511 & Chapter 135]Recordkeeping Requirements

(a) The permitteeshall maintainandmakeavailable,uponrequestby theDepartment,thefollowing recordsof monitoredinformation:

(1) The date,place(as definedin thepermit) andtime ofsamplingor measurements.

(2) Thedatestheanalyseswereperformed.

(3) Thecompanyor entity thatperformedtheanalyses.

(4) Theanalytical techniquesor methodsused.

(5) Theresultsof theanalyses.

(6) The operatingconditionsasexistingatthetime of samplingor measurement.

(b) The permittee shallretainrecordsof therequiredmonitoringdataandsupportinginformationfor at leastfive (5) yearsfrom thedateofthemonitoring, sample,measurement,report orapplication. Supportinginformationincludesthecalibrationdataandmaintenancerecordsandoriginal strip-chartrecordingsfor continuousmonitoringinstrumentation,andcopiesof reports requiredby thepermit.

(c) The permitteeshallmaintainandmakeavailableto theDepartmentupon request,recordsincluding computerizedrecordsthatmaybenecessaryto complywith thereporting,recordkeepingandemissionstatementrequirementsin 25 Pa.CodeChapter135(relatingto reportingof sources).In accordancewith 25 Pa.CodeChapter135, § 135.5,suchrecordsmayinclude recordsof production,fuel usage, maintenanceofproductionor pollution controlequipmentor other informationdeterminedby theDepartmentto be necessaryfor identificationandquantificationof potentialand actualair contaminantemissions. Ifdirectrecordkeepingis not possibleorpractical, sufficient recordsshall bekeptto providetheneededinformationby indirectmeans.

(a) Thepermitteeshall complywith theapplicablereportingrequirementsofthis Title V penmtincluding SectionsC andD, theCleanAir Act and the regulationsthereunder,theAir Pollution ControlAct and25 Pa. CodeArticle III including Chapters127, 135 and 139.

(b) Pursuantto 25 Pa. Code§ 127.511(c),the reportingrequirementsfortheTitle V facility shall includethe following:

(1) Submittalofreportsof requiredmonitoringat leasteverysixmonths. Thereports shallinclude instancesof deviations(asdefinedin25 Pa. Code§121.1)from therequirementsof this Title V permit.

(2) Thepermitteeshall reportdeviations(asdefinedin 25 Pa.Code§ 121.1)from permit requirements withinthe timeframesspecifiedinthis permit. Thereportingof deviationsshall includetheprobablecauseof thedeviationsandcorrectiveactionsor preventivemeasurestaken, exceptthatsourceswith continuous emission monitoringsystemsshall report accordingto theprotocolestablishedandapprovedby theDepartmentfor thesource.

(c) Thepermitteeshall submitreportsto theDepartmentcontaininginformationtheDepartmentmayprescriberelativeto theoperationandmaintenanceof any air contamination source.

(d) Everyreportsubmittedto theDepartmentunderthis permitconditionshall complywith thesubmissionproceduresspecifiedin Condition #020(relating to submissions)of this permit.

(e) Any records,reportsor informationobtainedby theDepartmentorreferredto in apublic hearing shallbemade availableto thepublic bytheDepartmentexceptfor suchrecords,reportsor informationfor whichthepermitteehasshowncausethat thedocumentsshouldbe consideredconfidentialandprotectedfrom disclosureto the public underSection4013.2of theAir PollutionControlAct consistentwith Sections112(d)and114(c) of theClean AirAct, or25Pa. Code§ 127.411(d).Thepermitteemaynot requestaclaimof confidentialityfor anyemissionsdatageneratedfor theTitle V facility.

(a) Within oneyearfrom thedateof issuanceof theTitle V permitandeach yearthereafter,thepermittee shallsubmitto theDepartmentand

source,currentlyandover thereportingperiod.

(5) Whethercompliance wascontinuousor intermittent.

(6) OtherfactstheDepartmentmayrequireto determinethecompliancestatusof a source.

(b) The compliancecertfficatiionsha]1be submittedto theDepartmentandEPA iii accordancewith thesubmissionrequirementsspecifiedinpermitcondition#020 ofthis section.

#025 [25Pa. Code§127.31Operational Flexibility

(6) Section127.462 (relatingto minor operatingpermit amendments)

(7) SubchapterH (relating to generalplanapprovalsandoperatingpermits)

(b) Unlessprecludedby the CleanAir Act or theregulationsadoptedthereunder,thepermitshield authorizedunder25 Pa.Code§ 127.516shall extend tooperationalflexibility changesmadeat this Title Vfacility pursuantto this permitcondition andotherapplicableoperationalflexibility termsand conditionsof this permit.

#026 [25Pa. Code§§127.441(d),127.512(i)and40 CER Part 68]RiskManagement

(a) If requiredby Section112(r) of theCleanAir Act, thepermitteeshalldevelopandimplementan accidentalreleaseprogramconsistentwithrequirementsof theCleanAir Act, 40 CFRPart68 (relatingto chemicalaccidentpreventionprovisions)andtheChemicalSafetyInformation,SiteSecurityandFuels RegulatoryReviewAct(P.L. 106-40).

(b) Thepermitteeshall prepare andimplementaRisk ManagementPlan(RMP)which meetstherequirementsof Section112(r) of theCleanAirAct, 40 CFRPart68 andtheChemicalSafetyInformation,SiteSecurityandFuels RegulatoryReviewAct whena regulatedsubstancelisted in 40CFR§ 68.130is presentin aprocessin morethanthe listedthresholdquantityat theTitle V facility. Thepermitteeshall prepare andimplementtheRMP according tothe following scheduleandrequirements:

(1) Thepermitteeshall submit thefirst RMP to acentralpointspecifiedby EPA no later thanthe latestof the following:

(i) June21, 1999;

(ii) Threeyearsafterthedateon whicharegulatedsubstanceis

first listed under§ 68.130; or

(iii) The dateon which aregulatedsubstanceis first present

aboveathresholdquantityin a process.

(2) The permitteeshallsubmit anyadditionalrelevantinformationrequestedby theDepartmentor EPA concerningtheRMP and shallmakesubsequentsubmissionsof RiVIPs in accordancewith 40 CFR§ 68.190.

(3) The permitteeshall certify that theRMP is accurate andcompletein accordancewith therequirementsof 40 CFRPart68, including achecklistaddressingtherequired elementsof acompleteRMP.

I I(c) As usedin this permitcondition, theterm “process”shallbe asdefinedin 40 CFR§ 68.3. Theterm “process”meansanyactivityinvolving aregulatedsubstanceincluding any use,storage,manufacturing, handling,or on-site movementof suchsubstancesoranycombinationof theseactivities. For purposesofthis definition, anygroupofvesselsthatareinterconnected,or separatevesselsthat arelocatedsuchthataregulatedsubstancecouldbeinvolved in apotentialrelease,shallbe considereda singleprocess.

(d) If theTitle V facility is subjectto 40 CFR Part68, as partof thecertificationrequiredunderthis permit, thepermitteeshall:

(1) Submitacomplianceschedulefor satisfyingtherequirements40CFRPart68 by thedatespecffiedin 40 CFR§ 68.10(a);or

(2) Certify that theTitle V facility is in compliancewith allrequirementsof 40 CFRPart68 includingthe registrationandsubmissionof theRMP.

(e) If theTitle V facility is subjectto 40 CFRPart68, thepermitteeshallmaintainrecordssupportingthe implementationof an accidentalrelease programfor five yearsin accordancewith 40 CFR§ 68.200.

(1) WhentheTitle V facility is subjectto theaccidentalreleaseprogramrequirementsof Section112(r) ofthe CleanAir Act and40 CFRPart68, appropriateenforcementactionwill be takenby theDepartmentif:

(1) Thepermittee failsto registerand submit the EMP or a revisedplanpursuantto 40 CFRPart68.

(2), Thepennitteefails to submitacompliancescheduleor includeastatementin thecompliancecertfficationrequiredunderCondition#24ofSectionB of this Title V permit that theTitle V facility is incompliancewith therequirementsof Section112(r) of theCleanAir Act,40 CFRPart 68, and25 Pa.Code§ 127.512(i).

#027 [25Pa. Code§ 127.512(e)]ApprovedEconomic IncentivesandEmission TradingPrograms

No permit revisionshall be requiredunderapprovedeconomic incentives,marketablepermits, emissionstradingand othersimilar programsorprocessesfor changesthatareprovidedfor in this Title V permit.

(a) The permittee’s compliancewith theconditionsofthis permit shallbe deemed incompliancewith applicablerequirements(as definedin 25Pa.Code§121.1) as ofthedateof permitissuanceif either of thefollowing applies:

(1) The applicablerequirementsareincludedandarespecificallyidentified inthis permit.

(2) TheDepartmentspecificallyidentifiesin thepermitotherrequirementsthat arenot applicable tothepermittedfacility.

(b) Nothing in25 Pa.Code§ 127.516 or theTitle V permitshall alteror affectthe following:

(1) TheprovisionsofSection303 of theCleanAir Act, includingtheauthorityof theAdministratorof theEPA providedthereunder.

(2) The liability of thepermitteefor aviolation of anapplicablerequirement priorto the time of permitissuance.

(3) The applicablerequirementsof theacid rain program,consistentwith Section408(a)of theCleanAir Act.

(4) The ability of theEPA to obtaininformation from thepermitteeunderSection114 of theCleanAir Act.

(c) Unlessprecludedby theCleanAir Act or regulationsthereunder,final actionby theDepartmenton minoror significantpermitmodifications,andoperationalflexibility changesshallbe covered bythepermit shield. Upontakingfinal actiongrantingarequestfor anadministrativepermitamendment,theDepartmentwill allow coverageoftheamendmentby thepermit shield in § 127.516for administrativeamendmentswhich meettherelevantrequirementsof 25 Pa. CodeArticleIII.

(d) Thepermit shield authorizedunder§ 127.516is in effect for thepermit termsandconditionsin thisTitle V permit, includingadministrative operatingpermit amendmentsandminor operatingpermitmodifications.

I. RESTRICTIONS.

(6) Openburning operations.

(7) Sourcesand classesof sources otherthan thoseidentified inparagraphs(1)-(6), for which theoperatorhasobtainedadeterminationfrom theDepartmentthat fugitive emissions fromthesource,afterappropriatecontrol, meetthe following requirements:

(i) theemissionsareof minorsignificancewith respecttocausingair pollution; and

(ii) theemissionsarenot preventingor interferingwith theattainmentor maintenanceof anyambientair quality standard.

(b) An applicationform for requestinga determinationundereither“~subsection(a)(9) or 129.15(c)is availablefrom theDepartment.Inreviewingtheseapplications,theDepartment may requirethe applicanttosupplyinformationincluding, but not limited to, adescriptionofproposed controlmeasures,characteristicsof emissions,quantityofemissions,andambientair quality dataandanalysisshowingtheimpactofthesourceon ambientair quality. The applicantshallbe requiredtodemonstratethat the~requirementsof subsections(a)(9) and(c) and 123.2(relating to fugitive particulatematter)or of the requirementsof129.15(c)havebeensatisfied. Uponsuchdemonstration,theDepartmentwill issueadetermination,in writing, eitherasan operatingpermitcondition, for thosesourcessubjectto permitrequirementsunder theact, or asan ordercontainingappropriateconditionsandlimitations.

(c) A personresponsiblefor anysourcespecifiedin subsections(a)(1) -- (6) or (7) shall takeall reasonableactionsto preventparticulatematterfrom becomingairborne.Theseactionsshall include,but not be limitedto, the following:

(1) Use,wherepossible,ofwateror chemicalsfor control of dustin thedemolitionofbuildingsorstructures,constructionoperations,thegradingof roads,or theclearing ofland.

(2) Application ofasphalt,oil, wateror suitablechemicalson dirtroads,materialstockpilesandothersurfaceswhich maygive rise toairbornedusts.

(3) Pavingandmaintenanceof roadways.

(4) Promptremovalofearthor othermaterialfrom pavedstreetsontowhich earthorothermaterialhasbeentransportedby trucking orearthmovingequipment,erosionby water, or othermeans.

(2) Subsection(a) notwithstanding,clearingandgrubbing wastesmay beburnedin abasinsubjectto thefollowing requirements:

(i) Air curtain destructorsshallbeusedwhenburningclearingandgrubbingwastes.

(ii) Eachproposeduseof air curtaindestructorsshallbereviewedandapprovedby theDepartmentin writing with respecttoequipmentarrangement,designandexistingenvironmentalconditions priorto commencementof burning.Proposalsapprovedunderthis subparagraphneednotobtainplanapprovalor operatingpermitsunderChapter127(relatingto constructionmodification, reactivationandoperationofsources).

(iii) Approval foruseof an air curtaindestructorat one sitemay begrantedfor a specified periodnot to exceed3 months,but maybeextendedfor additional limited periodsupon further approvalby theDepartment.

(iv) The Department reservestheright to rescindapprovalgrantedif adeterminationby theDepartment indicatesthat an airpollutionproblemexists.

(3) Subsection(b) notwithstandingclearingandgrubbingwastesmaybeburnedoutsideof an airbasin,subjectto thefollowing limitations:

(i) Upon receiptof acomplaintor determinationby theDepartmentthat an air pollutionproblemexists,theDepartmentmayorderthat theopenburningceaseor complywith subsection(b) of this section.

(ii) Authorizationfor openburningunderthis paragraphdoesnot applyto clearingandgrubbingwastestransportedfrom an airbasinfor disposal outsideof an airbasin.

(4) During anair pollution episode,openburningis limited byChapter137 (relatingto air pollutionepisodes)andshallceaseasspecifiedin suchchapter.

II. TESTING REQUIREMENTS.#011 [25 Pa. Code§127.441]Operatingpermit termsandconditions.

The owner/operator shallutilize aportableanalyzerto measureemissionrateson an annualbasis(for NOx, VOC, andCO) for sourceswith ratedgrossheat inputsbetween20-50MMBTU/Hr andwhich operate750hoursormoreper 12 consecutivemonthperiod.

III. MONITORING REQUIREMENTS.#012 [25 Pa. Code§123.43]Measuring techniques

Visible emissions maybe measuredusing eitherof the following:

(1) A deviceapprovedby theDepartmentandmaintainedto provideaccurateopacitymeasurements.

(2) Observers,trainedandqualified to measureplumeopacitywith thenakedeye orwith theaid of anydevicesapprovedby theDepartment.

To coincidewith presumptivePACT, sourceswith ratedgrossheatinputsof lessthan20 mmbtu/hrwould qualify for no direct emissionsourcemeasurement.At aminimum, themostcurrentAP-42emission factorsalongwith recordsfo fuel consumptionshallbeusedto calculateandverifyemissionrates. This is theacceptable methodfor naturalgasandoil-fired sources.

IV. RECORDKEEPING REQUIREMENTS.#014 [25 Pa. Code §127.12b]Plan approval terms and conditions.All VOC andHAP emissionsfrom thesprayboothsshallbedeterminedandrecorded. Theserecordsshall be maintainedfor a minimumof two yearsat the facility.

#015 [25 Pa. Code§127.441]Operatingpermit termsand conditions.

The owner/operator shall,at aminimum, verify compliancewith theSulfurOxideslimitation of 500partspermi]lion by compilingandmaintainingrecordsof fuel usage,throughput,operation schedule,andthemostrecentandappropriateAP-42emission factors.

Code §127.441]Operatingpermit termsand conditions.In accordancewith OperatingPermit56-307-00iF, Condition#6, ‘Theowner/operatorshall keepdaily recordsof steelproductionfrom thefollowing: EAF/LMS, OxygenConverter,and InductionFurnace.Theserecordsshall bekept on site for aperiod of two yearsandbe madeavailableto theDepartmentupon request.”

#017 [25Pa. Code§135.21]Emission statements

(a) The Owner/Operatorshall submitby March 1 of eachyearasourcereportfor thepreceding calendaryear. Thereport shall includeinformationfor all previously reportedsources, newsourceswhich werefirst operatedduringtheproceedingcalendar yearandsourcesmodffiedduringthesameperiod whichwerenotpreviouslyreported.

(b) The sourceowneror operatormayrequestan extensionof time fromtheDepartmentfor the filing of a source report,andtheDepartmentmaygranttheextensionfor reasonablecause.

V. REPORTING REQUIREMENTS.#018 [25 Pa. Code§127.441]Operatingpermit termsandconditions.[a]The permitteeshall reportto theDepartmenteachmalfunctionthatoccursat theTitle V facffity. As definedin 40 CFR60.2andincorporatedby referencein 25 Pa.CodeChapter122,ama]functionmeansanysudden,infrequent,andnot reasonably preventablefailure of airpollution controlequipement,processequipmentor aprocessto operatein anormalor usualmanner. Failuresthatarecausedin partby poormaintenanceor carelessoperationarenotmalfunctions.

[bi Whenthema]functionposesanimminentand substantialdangerto thepublichealthandsafetyor potentialharmto theenvironment,thenotification shallbe submittedto theDepartmentno later thanonehouraftertheincident.

[ci Unlessotherwiserequiredby speefficreportingrequirements,anymalfunctionthat is not subjectto thenoticerequirementsof subsection[bi of this permitconditionshall be reportedto the Departmentwithin24 hours[or thenextbusinessday] of discoveryof themalfunction.

[11The permitteeshallnotify theRegional AirProgram Managerwithin4 hours[or thenextbusinessday] of becomingaware oftheoccurrenceofexcess emissions whichlast for morethan4 hoursandwhich resultfrom amalfunction,abreakdwonof processor control equipmentor anyabnormalcondition.

The noticeshalldescribe the:

(i) nameandlocationof the facility.

(ii) natureandcauseof themalfunctionor breakdown;

(iii) time whenthe malfunctionor brekdownwas firstobserved;

(iv) expecteddurationof excess emissions;and

(v) estimatedrateof emissions.

[21The permitteeshallnotify theDepartmentimmediatelywhen

correctivemeasureshavebeenaccomplished.

[3] Subsequentto themalfunction, thepermitteeshallsubmitafull

report on themalfunctionto theDepartment within15 days, if requested.

[4] Thepermitteeshallsubmitreportson the operationandmaintenanceof thesourceto theRegional AirProgramManagerat suchintervalsandin suchform anddetailasmayberequiredby theDepartment. Informationrequiredin thereportsmayinclude,but is notlimited to, processweightrates,firing rates,hoursof operation,andmaintenance schedules.

#019 [25 Pa. Code§135.3]Reporting

(a) The ownerand/oroperatorshall submitby March 1 of eachyearasourcereportfor theprecedingcalendaryear.The report shall includeinformationfor all previously reportedsources,newsourceswhich werefirst operatedduring theproceedingcalendaryearand sourcesmodffiedduringthesameperiodwhich werenotpreviouslyreported.

(c) A personresponsiblefor theoperation ofa sourceidentifiedinsubsection(a) andlocatedin acountyclassifiedin subsection(b) asrequiringastandbyplan shall preparestandbyplansfor reducingtheemissionof air contaminantsfrom thatsourceduringalert, warningandemergencylevels.Theplansshallbe designedto reduceor eliminatetheemissions ofair contaminantsin accordancewith the objectivesin137.11-137.14(relating to level actions).Theplansshallbe in writingonforms publishedanddistributedby theDepartmentandshall identifytheapproximateamountof reductionof variousair contaminantsandadescriptionof themaimerin which thereductionswill beachieved.

(d) If theDepartmentdeterminesthatastandbyplandoesnotprovidefor effectivelyachievingtheobjectivesin 137.11-137.14,theDepartmentmaydisapprovetheplan, stateits reasonsfor the disapprovalandeitherorderthepreparationof anamendedplanwithin atime periodspecifiedin theorderor issue,by order,aplan to replacethedisapprovedplan.

(d) In conductingtheperformancetestsrequiredin 60.8, theowneroroperatorshall useasreferencemethodsandproceduresthe testmethodsin appendixA of this part or othermethodsandproceduresasspecifiedin this section,exceptasprovidedin 60.8(b).

(3) Any combinationof thecriteriaofparagraphs(h)(1) and(h)(2) ofthis section.

(i) Whereemissionsfrom anyEAF(s) or AOD vessel(s)arecombinedwithemissionsfrom facilities not subjectto theprovisionsofthis subpart,determinationsofcompliance with60.272a(a)(3)will only bebaseduponemissionsoriginatingfrom theaffectedfacility(ies).

(j) Unlessthepresenceof inclementweather makesconcurrenttestinginfeasible,theowneror operatorshallconduct concurrentlytheperformancetestsrequiredunder60.8 to demonstratecompliancewith60.272a(a)(1),(2), and(3) of this subpart.

(c) A continuousmonitoringsystemfor themeasurementofopacity isnot requiredon modular, multiple-stack,negative-pressureorpositive-pressurefabric filters if observationsof theopacityof thevisibleemissionsfrom thecontroldeviceareperformedby acertifiedvisible emissionobserverasfollows: Visible emissionobservationsareconductedat leastonceperday whenthefurnaceis operatingin themeltingandrefining period.Theseobservationsshall betakeninaccordancewith Method 9, and, for at leastthree6-minuteperiods,theopacityshallbe recordedfor anypoint(s)wherevisible emissionsareobserved.Whereit is possibleto determinethatanumberofvisibleemissionsites relateto only oneincidentofthevisible emissions,onlyonesetof three6-minuteobservationswill be required.In this case,Method9 observationsmustbemadefor thesite ofhighestopacitythatdirectly relatesto thecause(or location)of visibleemissions observedduring asingle incident. Recordsshall be maintainedof any 6-minuteaveragethat is in excessof theemissionlimit specifiedin 60.272a(a)of this subpart.

motoramperesanddamperpositionon aonce-per-shiftbasis;or (2)install, calibrate,andmaintainamonitoringdevicethatcontinuouslyrecordsthevolumetric flow ratethrougheach separatelyductedhood.Themonitoringdevice(s)may beinstalledin anyappropriate locationin theexhaustductsuchthat reproducibleflow ratemonitoringwill result.Theflow ratemonitoringdevice(s)shall haveanaccuracyof 10 percentoverits normaloperatingrangeandshall becalibratedaccordingto themanufacturer’sinstructions.TheAdministratormayrequiretheowneroroperatorto demonstratetheaccuracyof themonitoringdevice(s)relativeto Methods1 and2 of appendixA of thispart.

(c) When theowneror operatorof anaffectedfacility is requiredtodemonstratecompliancewith thestandardsunder60.272a(a)(3)and atanyothertime theAdministrator may requirethat (undersection114 of theAct, asamended)eitherthecontrol systemfan motor amperesandalldamperpositionsor thevolumetric flow ratethrough eachseparatelyductedhood shallbe determinedduring all periodsin which ahoodisoperatedfor thepurposeof capturing emissionsfrom theaffectedfacility subjectto paragraph(b)(1) or (b)(2) of this section.Theowneror operatormay petitiontheAdministratorfor reestablishmentof theseparameterswhenevertheowneror operatorcandemonstrateto theAdministrator’ssatisfactionthattheaffectedfacility operatingconditionsuponwhich theparameterswerepreviouslyestablishedarenolonger applicable.Thevaluesoftheseparametersasdeterminedduringthemost recentdemonstrationof complianceshallbe maintainedat theappropriatelevel for eachapplicableperiod. Operationat otherthanbaselinevaluesmaybe subjectto therequirementsof paragraph276a(c).

(d) The owneror operatorshall performmonthly operationalstatusinspectionsof theequipmentthatis importantto theperfonnanceof thetotal capturesystem(i.e., pressuresensors, dampers,anddamperswitches).This inspectionshall includeobservationsof thephysicalappearanceofthe equipment(e.g.,presenceofholesin ductworkorhoods,flow constrictions causedby dentsor accumulateddustinductwork, andfan erosion).Any deficienciesshallbe notedandpropermaintenanceperformed.

(e) The owneror operatormay petitiontheAdministratorto approveanyalternativeto monthly operationalstatusinspectionsthatwillprovideacontinuousrecordof theoperationof each emissioncapturesystem.

(g) Whentheowneror operatorof an EAF controlledby aDEC isrequiredto demonstratecompliancewith thestandardunder60.272a(a)(3)of this subpart,and atanyothertime theAdministrator mayrequire(undersection114 of the CleanAir Act, asamended),the pressurein thefreespaceinside the furnaceshall be determinedduringthemelting and

refining period(s)usingthemonitoringdevicerequiredunderparagraph(I) ofthis section. The owneror operatormay petitiontheAdministratorfor reestablishmentof the 15-minuteintegratedaverageofthepressurewhenevertheowneror operatorcandemonstrateto theAdministrator’ssatisfactionthat theEAF operatingconditionsuponwhich the pressureswerepreviouslyestablishedareno longerapplicable.The pressuredeterminedduringthemost recent demonstrationof complianceshall bemaintainedat all times whentheEM’ is operatingin ameltdownandrefining period. Operationat higherpressuresmaybeconsideredby theAdministratorto beunacceptableoperationandmaintenanceof theaffectedfacffity.

(h) During anyperformancetestrequiredunder60.8, andfor anyreportthereofrequiredby 60.275a(d)ofthis subpart,or to determinecompliancewith 60.272a(a)(3)ofthis subpart,theowneror operatorshall monitorthe following informationfor all heatscovered bythetest:

(1) Chargeweightsandmaterials,andtapweightsandmaterials;

(2) Heattimes, includingstartandstoptimes, andalog of processoperation,including periodsof no operationduringtestingandthepressureinside anEM’ whendirect-shellevacuation controlsystemsareused;

(3) Control deviceoperationlog; and

(4) Continuousmonitor orReferenceMethod9 data.

(5) A notification ofthe dateuponwhich demonstrationof thecontinuous monitoring systemperformancecommencesin accordancewith60.13(c).Notification shallbepostmarkednot lessthan30 daysprior tosuchdate.

(6) A notificationof the anticipateddatefor conductingtheopacityobservationsrequiredby 60.11(e)(1) of this part.The notificationshallalsoinclude,if appropriate,arequestfor theAdministratorto provideavisible emissionsreaderduring aperformancetest.The notification

shall be postmarkednot lessthan30 daysprior to suchdate.

(1) The magnitudeof excess emissionscomputedin accordance with60.13(h),anyconversionfactor(s)used,andthedateandtime ofcommencementandcompletion ofeachtime periodof excess emissions.Theprocessoperatingtime duringthereportingperiod.

(2) Specificidentificationof eachperiodof excessemissionsthatoccurs duringstartups,shutdowns,and malfunctionsof theaffectedfacility. The nature andcauseof anymalfunction(if known), thecorrectiveactiontakenorpreventativemeasuresadopted.

(3) The dateandtime identifying eachperiodduringwhich thecontinuous monitoringsystemwas inoperative exceptfor zeroand spanchecksandthenatureof thesystem repairsor adjustments.

(4) Whenno excessemissions haveoccurredor thecontinuousmonitoringsystem(s)havenotbeeninoperative,repaired,or adjusted,suchinformationshallbe statedin thereport.

(d) Thesummaryreportform shall containtheinformationandbe inthe formatshownin figure 1 unlessotherwisespecifiedby theAdministrator.Onesummaryreportform shallbe submittedfor eachpollutantmonitoredat eachaffectedfacility.

(1) If the total durationof excessemissions forthereportingperiodis lessthan 1 percentof thetotal operatingtime for thereportingperiodandCMS downtimefor thereportingperiod islessthan5 percentof thetotal operatingtime for thereportingperiod,only the summaryreportform shallbesubmitted andtheexcessemissionreportdescribedin 60.7(c)neednotbe submitted unlessrequestedby theAdministrator.
