ABOUT DARKINJUNG LOCAL ABORIGINAL LAND COUNCIL

Darkinjung Local Aboriginal Land Council (DLALC) is located on the Central Coast of New South Wales its boundaries stretch from Catherine Hill Bay to the North, Hawkesbury River to the South, Pacific Ocean to the East and Watagan Mountains to the West. The Darkinjung LALC shares its boundaries with Bahtabah LALC, Koompahtoo LALC and Metropolitan LALC which were established around the traditional boundaries of the region. The Darkinjung LALC is positioned within two Local Government Areas (LGA’s) these being Wyong Shire Council and Gosford City Council, with an estimated shared population of over 304,741 and an estimated shared Aboriginal population of over 6,828. (Two Ways Together report 2007) Darkinjung LALC’s goals and strategies for achieving growth and sustainability are documented and communicated throughout the Community Land and Business Plan. To achieve these, the Darkinjung LALC must be highly entrepreneurial, innovative and controlled. The Darkinjung LALC’s commitment to our members and the region are to establish and maintain a strong leadership position in developing our capacity to respond to growth and the communities needs. We will achieve this through the ongoing development of partnerships with Government Agencies, Non Government Organisations, Industry Groups and our community. The following core operational functions of Darkinjung LALC will allow the organisation to focus, develop and grow our business;

VISION STATEMENT

The Darkinjung Local Aboriginal Land Council, in accordance with the stated objectives as provided for in Section 51 of the NSW Aboriginal Land Rights Act, 1983 as amended has developed a set of aims and objectives and a range of services, which the Council can pursue or provide. The Darkinjung Local Aboriginal Land Council is committed to improving, protecting and fostering the best interests of its members and all Aboriginal persons within the Council’s area. The Vision of the Council is to:

Create, maintain and celebrate a culturally affirming, socially strong and healthy community, through maintaining and promoting cultural practices and protocols.

VALUES STATEMENT Darkinjung seeks to operate as a professionally functioning community based organization, one that conducts its business ethically and with the interest and needs of its members and the broader Aboriginal Community as its focus.

Darkinjung aspires to be a lighthouse Aboriginal organization that acknowledges and performs its compliance obligations and is guided by the principle of Aboriginal self determination and the pursuit of social & restorative justice for Aboriginal people.

PURPOSE STATEMENT To develop a sustainable business that builds and strengthens the community through the development of partnerships that inspires and respect Aboriginal traditions and cultural values.

BACKGROUND/HISTORY

Since its creation in 1984, Darkinjung Local Aboriginal Land Council has constantly focused on improving the lives of its members. The Council achieves this objective by implementing policies and procedures through the operational functions of an Aboriginal Land Council, and in accordance with the New South Wales Aboriginal Land Rights Act 1983 (NSW,ALRA,1983). Specifically the Council:

• Provides a focal and information sharing point for Aboriginal issues • Advises government and property owners and managers regarding sites of significance • Supports Culture and Heritage events and celebrations • Claims land under the land Rights Act ‐ today holding near 4, 638 acres, the largest

landholder on the Central Coast • Has assisted in identifying over 7,000 registered Aboriginal sites • Delivers social housing and related services to members • Provides Funeral Fund support to members • Has forged new initiatives in NSW Aboriginal Land Council management • Has a very strong position in land and cash assets.

The design, development and successful implementation of the DLALC Community, Land and Business Plan will enable the Council to move into a new phase of financial and economic growth and development enabling the Council to provide more services to members, particularly those services that will empower the Aboriginal community socially, culturally and financially.

METHODOLOGY

The following planning methodology was adopted in the preparation this Plan: • Planning Committee established including member, staff and Board representation • One to one interviews held with staff of the LALC • Workshops conducted with Board of LALC • 2 major member’s workshops and 4 regional workshops were conducted • All members were sent a needs analysis survey to complete • A community profile survey was distributed throughout local Aboriginal organisations • Draft Plan presented to members for feedback • A review was carried out of:

o DLALC Audit Reports 07/07 to 06/08 o NSWALC Budget submission 2008‐2009 o Recent NSWALC monthly reports o Rent collection reports

QUADRUPLE BOTTOM LINE

To operate as a functional, sustainable and socially responsible business Darkinjung LALC will adopt the following business principles of the Quadruple Bottom Line. There is also an increasing demand for Darkinjung LALC to demonstrate transparency and accountability beyond the domains of financial performance. The quadruple bottom line (QBL) refers to the four elements of social, environmental, financial and governance accountability. In keeping with the Darkinjung LALC’s vision and values the CLBP incorporates the following four elements aligning the Goals and Objectives and identifying the relationship of these business principles with the DLALCs primary functions. 1. Compliance and Operations (Governance) includes financial performance, activities relating to shaping demand for products and services, employee compensation, community contributions and local procurement policies. This seeks to more closely align reporting, underlying management practices and measures of corporate performance with the notion of sustainable development. 2. Culture and Heritage (Environmental) includes impacts made through processes, products or services. These may include land, air, water, flora, fauna, natural resources and human health. 3. Community Development and Partnerships (Social) includes involvement in shaping local, national and international public policy, equality, treatment of minorities, employee issues and members concern. 4. Economic and Business Development (Economic & Financial) includes financial performance, Governance, fiscal management activities relating to developing and sustaining a successful business.

LOCATION

The geographical area (see map below) of the Council has been gazetted by Parliament and is bounded by the Hawkesbury River in the South, the Pacific Ocean in the East, Lake Macquarie in the North and West to the Watagan Mountains. The Darkinjung LALC region is rich in Aboriginal culture and heritage, largely due to the diverse landscapes ranging from vast coastal estuarine to mountainous peaks and fresh waterways. The Landscape is rich in resources of coal, sandstone, flora and fauna and as over 7000 thousand registered Aboriginal sites.

The services are derived from a process utilised to identify the needs and aspirations of the DLALC members and the wider Aboriginal community in the region. GOVERNING BOARD

HUMAN RESOURCES At the time of writing this plan, DLALC is experiencing transitional change with the appointment of new CEO. With the appointment of the CEO an organisational transition strategy will be developed that aligns with the goals and strategies as identified in the CLBP. The functional operational units identified the following key priorities areas. Recruitment of staff to these units will be defined by the strategy once developed. Under this structure, the Darkinjung LALC will seek to expand upon and operate the following operational units: 1. Compliance and Operations 2. Culture and Heritage 3. Economic and Business Development 4. Community Development and Partnerships It is critical to stipulate at this point that Darkinjung LALC will pursue the governance and operational aspects of its functions by observing the following rights and principles:

DEMOGRAPHIC ANALYSIS A demographic overview for the Darkinjung LALC has been established and is derived from information obtained through a member’s survey and other relevant data. The survey generated and supplemented data has been assessed and correlated with Indigenous specific statistics obtained from the Australian Bureau of Statistics relevant to the specific Local Government Areas located within the LALC boundaries (see below table & Appendix). The ABS and Two Ways Together Report on Indicators data is considered to provide a truer picture of Aboriginal demographics in the area, as survey responses may not be statistically accurate. The Darkinjung LALC currently has 592 members, of which 568 are voting members. The membership base represents approximately 9 % of the total Aboriginal population residing within the LALC boundaries, being 6,828. (Two Ways Together Report 2007) Populations

COMMUNITY and STAKEHOLDER SURVEYS and NEEDS ANALYSIS A Needs Analysis Survey consisting of questions targeting member’s needs was distributed by mail to all individuals listed on the membership base. The purpose of the survey was to identify any possible gaps existing between member’s expectations as highlighted in the member’s workshops, and the direction of the board. A copy of the survey is included at Appendix 1. Collated results of the Needs Analysis Survey are presented in the table below. The results of the members Needs Analysis survey revealed strong interest and aspirations in Social/Cultural Activities, Community Activities, Education & Training, and Employment The results helped establish a defined focus and direction for the Board and the operations of the Council. A Community Survey was distributed to all members by mail. In addition the Survey was distributed to various local Aboriginal organisations and community centres so that the Council could gain a more informed understanding of the needs and aspirations of the entire Aboriginal community. The Community Survey questionnaire is provided as Appendix 2. Stakeholders identified needs in most areas of the survey and offered the following specific suggestions:

• More support for Aboriginal children in day care • Cultural days • Male health & wellbeing • Increased engagement in community functions • To be the resource centre where Aboriginal people new to the area can get information on

all Aboriginal services, cultural resources etc.(mainstream services as well) • Greater indigenous participation on community committees • Better links with cancer council ‐ build relationships

GOALS & OBJECTIVES The outcome from this process of workshops and surveys established a priority of needs of the Land Council and the broader Aboriginal community. Further workshops allowed DLALC to identify, and where relevant develop, key goals and strategies in relation to mandatory items under the ALRA. These key goals and strategies in the DLALC plan include:

Appendix 6 LEGISLATIVE FRAMEWORK

The Darkinjung Local Aboriginal Land Council is bound by the key legislative requirements which determine the objects and functions of a Local Aboriginal Land Council as contained in the amended ALRA. The ...LALC is an incorporated body constituted under the ALRA. The ALRA states that the objects of each Local Aboriginal Land Council are to “improve, protect and foster the best interests of all Aboriginal persons within the Council’s area and other persons who are members of the Council”. The functions of the Land Council include:

• Make claims on vacant crown land; • Acquire land and to use, manage, control, hold or dispose of, or otherwise deal with, land vested in

or acquired by the Council; • Protect the interests of Aboriginal persons in its area in relation to the acquisition, management, use,

control and disposal of land; • Take action to protect the culture and heritage of Aboriginal persons in the Council’s area, subject to

any other law; • Promote awareness in the community of the culture and heritage of Aboriginal persons in the

Council’s area; • Prepare and implement, in accordance with the Act, a community, land and business plan; • Manage, in accordance with the Act and consistently with its community, land and business plan, the

investment of any assets of the Council; • Facilitate business enterprise in accordance with the Act, and the regulations, and consistently with

the community, land and business plan; • Directly, or indirectly, provide community benefits under the community benefits scheme; • Provide, acquire, upgrade or extend residential accommodation for Aboriginal persons within its area; • Establish or participate in the establishment of, a trust for the purpose of providing a community

benefits scheme.

The activities of DLALC are also subject to a range of other legislation. Acts that also relate to the day-to-day operations and functions of DLALC include:

ACT IMPACT

Residential Tenancies Act

Establishes rights and obligations of landlords and tenants. Governs LALC rental housing operations

Anti Discrimination Act

Requires equality of opportunity, particularly in employment, irrespective of race, religion, sex, marital status, etc. Certain exemptions are available to LALC where aboriginality is a reasonable condition of employment

Environmental Planning and Assessment Act

Establishes framework under which land is managed and used in NSW. Sets out framework of planning instruments used by the State/Local Govts, including: • State Environmental Planning Policies; • Regional Environmental Plans; • Local Environment Plans; and, • Development Control Plans. Each of these items (plus rules established by Govt agencies) must be complied with if LALC want to use land granted or acquired. This could be establishing a business, developing or selling land or reserving land for cultural purposes

Local Government Act

Establishes role, functions and constraints on Local Govt in NSW. Impacts the LALC in terms of payment of rates, provision of services (parks, library, child care facilities) and approving applications for land development

National Parks and Wildlife Act

Establishment, preservation and management of national parks, historic sites and certain other areas to assist in the protection of certain fauna, native plants and Aboriginal objects Key impact for LALC is the provisions relating to the identification, assessment and management of areas of Aboriginal cultural heritage. This Act sets rules under which LALC undertakes site inspections and prepares reports recommending preservation or consent to destroy

Commonwealth and State Taxation Legislation

LALC is exempt from a range of State and Commonwealth taxes and charges, including: • Stamp duty and vendors duty on property transactions

(automatic); • Land tax (automatic); • Income tax (application to the Australian Tax Office

required); and • Fringe benefit tax (application to the Australian Tax

Office recommended).

The land management activities of LALC are also subject to a range of other legislation. The Native Title Act which is Commonwealth Legislation which impacts on both the land council and the Local Shire Council in matters of land management issues, use of crown land, and the care of local Aboriginal sites of significance. The High Court decision in Mabo V Commonwealth (No 20 175 CLR 1) establishes a legal right within the Australian legal system of a title called native title. Common law rights in Australia are further enhanced for Aboriginal people by native title it provides for collective rights of the native title group. While fishing, hunting and gathering are common law rights enshrined in Australian law for all Aboriginal people the Federal court supports Kamilaroi priorities and the Court may on particular areas support individual rights of Kamilaroi custodial ship of a place of ceremony or of the “dreaming” such as bora rings or the rainbow serpent in waterways over claims made by the land council if such a case arose. . This division of rights is well explained in sections 223 – 235 of the Native Title Act 1993 which describes the Supreme Court sanctioned rights obtained by the traditional owner group as well as allowing for individual rights. The land council is very sensitive to the needs of the Traditional owners of the land and endeavours to work along side the Native Title legislation and the traditional owners to ensure that there is no conflict or barrier created between the native title holders or the members of the land council. Traditional owners can register their interest in land or make a claim for native title at any time, so any land dealings (sale, development etc) of the LALC will consider Native Title requirements at the time. We have been advised there are no current traditional owners on the register for LALC land.
