I, RIZA A. MALATE , 35 years old, married, and a resident of

hereby deposes and says T -T :

1. I am the mother of Rhy a /ae -. /alate, ! years old,

enrolled as a )rade %i1 Pupil at iceo 2el 'erbo2i*ino,

Tacloban City. - machine copy of the birth certificate of

Rhy a /ae -. /alate is hereunto attached and made as an

inte+ral part hereof as Annex “A”

Rhy a /ae -. /alate #ith her cousin -n+elyn -. )on a+a,

asked for my permission to attend the funeral of their

+randmother, the lateRuby - ucena.

3.Because of the assurance of -n+elyn that she #ill be lookin+

and takin+ care of Rhy a /ae, I allo#ed them to +o ahead

of me as I #as also plannin+ of +oin+ there and that theplace of the #ake #as only a fe# houses a#ay. 7hile I #as

on my #ay to the #ake, I heard a commotion at a near

distance, #hich #as follo#ed by shoutin+ and cryin+ so I

hurriedly #ent to the place. 8pon my arri*al, I sa# my

dau+hter lyin+ in the +round, bathe in her o#n blood, #ith

-n+elynhoarsely shoutin+ and cryin+ for help. Tremblin+ and

lost for #ords, I asked -n+elyn #ho #as the culprit of the

crime #hich she ans#ered #ithout hesitation as one named

2ino 9. dela Cru . I asked her #here 2ino is and she

replied, :dumala+annatita; < he has already fled auntie=.

Cryin+ for help, I asked and be++ed the people around us to

help me brin+ my dau+hter to the nearest hospital #hich #as

responded to #ith haste by -lan Burt -ltar and other

relati*es #ho #ere around. The s#orn statement of -lan Burt

&.8pon arri*al at the Tacloban City ospital, 2r. Pia )ome ,

immediately attended my dau+hter and after a thorou+h

e1amination, declared her dead on arri*al. The medico>le+alautopsy report, the "%? death certificate and a certification

from the City Ci*il Re+istrar of Rhy a /ae -. /alate is

hereunto attached and made an inte+ral part of the

complaint as Annex “C” , “ D”, and “E” , respecti*ely

5. 7hile at the hospital, I in@uired -n+elyn if the said 2ino 9.

dela Cru #as the same 2ino 9. dela Cru #ho is our nei+hbor and #ho came to our house earlier that day to

borro# money from me #hich she positi*ely identified as the

A. I denied the re@uest of said 2ino 9. dela Cru because of his notorious character in our nei+hborhood as a drunkard,

refusal to lend money, he mumbled and uttered to me that I
