Complaint Affidavit of Pepito Begota Pepito Begota (herein petitioner) is of legal age, married and is a resident of Brgy Igbong Barotac Nuevo, Iloilo. He and his wife are one of the owners of a parcel of land covered by Transfer Certificate of Title No. 6310, which land was formally awarded to them as farmer beneficiaries thereof, pursuant to the Comprehensive Agrarian Reform Program of the government. However, even before the land was awarded to them along with distribution of other parcels of land which was formerly owned by F and C Agro-Industrial Corporation until they were formally installed on December 7, 1999. Sometime on August 22, 2000, Pepito and his family along with other beneficiaries were illegally ousted/ejected by a group of armed men of the former owner which constrained the Department of Agrarian Reform Provincial Legal Office to file 42 (forty-two) DARAB cases against them. However, a decision from the complaints filed was rendered in their favor on September 5, 2001 which led to their reinstallation on March 28, 2007, after defendants withdrew their appeal. They have started the cultivation of the entire landholding. However, Pepito and the other beneficiaries were shocked when a group of armed men led by a certain Siaotong whom Pepito later knew as Mariano Siaotong. He entered the property and threatened and intimidated with harm if they would not stop their cultivation of the subject landholding and even went out of their way in destroying their farm. As a consequence in so far as the land awarded to them is concerned, his wife instituted, separately of DARAB CASE for Reinstatement, Ejectment , Declaration of the Rights and Obligations of the Plaintiff as CARP Beneficiary and Damages which they won in a decision dated October 26, 2011 and as a matter of fact, a writ of execution was granted and issued to them. Pepito expresses that nothing has been done until now because he and his family together with the other farmer beneficiaries, who are victims of abuses and oppression, have been illegally and repeatedly ejected, despite the execution of the decision in our case and for emphasis, have been continuously deprived of the subject landholding through force, threat and intimidation by the same persons who are not at all entitled to the possession and cultivation of the lots awarded to them and all these illegal and arbitrary acts are masterminded/headed by no less than Mariano Siaotong, the incumbent Brgy Captain of Barangay Igbong, Barotac Nuevo, Iloilo whose clear and obstinate defiance of the law and as well as stubborn disregard of the decision of the authorities like the DARAB is beyond telling.

In fact just recently, May 30, 2015 at about 7:30 in the morning, Brgy. Captain Mariano Siaotong
