1. Introduction

THIS IS TO CERTIFY THAT:

at the request and on behalf mr. Doug Schindler as boat owner, condition survey was held

upon the sailing boat

MORGAN KETCH 462

S/V “PLANKTON”

registered under USA flag whilst boat was afloat and safely laying on cradle in Marina

Kaštela, Croatia, for the purpose of an examination and ascertaining her compatibility with

regulations applicable to the pleasure boats, check seaworthiness and issuing report as

detailed hereunder.

NOTE: The above vessel specification are taken from the Vessels Certificates founded on board: No measurements or calculations were made by surveyor / surveyors, unless otherwise noted.

3. Inspection Hull and superstructure

Hull is made from GRP, designed with longitudinal and transverse construction as sailing

boat with one engine and keel casted in GRP. Hull hardness test was carried out with

“Barcol” tester Qualitest. Random inspection was carried out with satisfactory result. Hull

hardness in average is above 30 Barcols what is satisfactory.



Hull moisture measurement was carried out two days after hauling. Day of survey was

sunny what enabled me to start after two days drying measuring hull moisture with

nondestructive electronic Moisture meter “Sovereign Marine” to locate & identify areas of

moisture absorption. On some spots where is thick layer of paint is showing alarm on

instrument. On spots where is just gelcoat readings on instrument are found in good order.

Hull was affected with osmosis. Osmosis is old, without new blisters and osmotic leaks.

Opinion of undersigned is that osmosis is not active any more. Probably boat was treated

for osmosis in the past. Hull Barcol hardnes test was performed and readings are

satisfactory. Hull fittings are visual inspected and found healthy. The vessel’s hull and deck

structures were inspected externally and internally (where accessible) and found to be in

good condition. Vertical sides are found in very good condition. New antifouling protection

should be applied. The underwater body did not show evidence of hard grounding,

stranding or similar damaging event. Boat have traditionally heavy rudder which have

slightly bigger clearance, but still within limit. Propeller shaft is found without clearance.

Propeller is found in good order. Zn anodes are found in good order. As fare it can be

ascertained from visual inspection and measurements hull is found in good condition.

Engine

Engine starts on first try and work normally. New engine (Perkins) is installed 1997.

Engine has 3588 running hours. Only visual inspection was carried out. Visual inspection is

satisfactory. Engine is clean and well maintained. Engine bilges are found in good order

and without oil leaks. In engine compartment is installed generator. Generator starts and

works normally under load. In engine compartment upper part are traced various cables,

unprofessionally secured.

Deck

Deck is made from GRP in non-slide execution. On deck are visible several minor stress

cracks. There is some wooden parts on boat deck which need regular maintenance, this is

only cosmetic issue. On deck several places elastic putty need to be replaced. On deck aft



part are situated flat solar panels. Solar panels are found in good condition. Structurally

deck is found in good order.

Cockpit

Cockpit is protected with Bimini and Sprayhood stainless steel constructions. Bimini and

Spray hood canvas are new. In cockpit are located two winches. Winches are found without

clearance. Gangway is stored in forward cabin. Gangway is found in good order. Gunwale

is found undamaged and crack free. In cockpit central part is installed skipper post.

Sails

Boat is equipped with Genoa sail, main sail and fore sail. Random portions were inspected.

Genoa sail and foresail are found in acceptable condition. Main sail need to be replaced.

Sails are safely stored in Lazy bags. Lazy bags are found in good condition.

Mast standing rigging and running rigging

Boat is equipped with two aluminum masts. Both masts have one spreader in the middle.

On forward mast are located two additional winches “Lewmar”, on forward boom are

located one winch “Lewmar” and on aft mast is located another winch “Lewmar”. Mast and

spreaders are found in good condition. On aft mast is situated radar and wind generator.

Standing rigging is found in good condition. Mast foundation and fittings on deck are crack

free. Genoa sail is of furling type. Furling device “Harken” is operational. Running rigging

is found in good order. Boat is equipped with additional storm sail. Storm sail is found in

good condition. Side stays are found without stress cracks. Side stays are found strong.

Fastenings

Boat is equipped with aluminum cleats. All are strong connected to deck and damage free.

Windows and port lights

Side windows are found in good order and leak free. Salon side windows are found in good

order. Deck windows (hatch windows) are found in good order. New elastic putty should

be applied. Aluminum hatches on deck need regular maintenance.



Hand rails and stanchions

Hand rails and stanchions are all find in good order.

Shell openings and shell fittings

The condition of the sea valves and through-hull fittings is good. Hummer test was carried

out. The hose connections are double clipped with stainless steel clips.

Door

Door (boat entrance) is found in good order. Door can be locked against theft. Boat has

possibility to reach forward cabin and aft cabin from deck. Doors can be locked against

theft. Through wooden stairs is entrance to accommodation. Below wooden stairs are

located three “Mastervolt” batteries. On aft port side are located skipper post equipped

VHF Station “ICOM IC – M700PRO”, Signal instrument SCS PTC LINE, “Standard

Horizon” AIS GX 2000, RAYTHEON GPS NAV LORAN, Multi instrument and

RAYTHEON PILOT Raypilot 650. Behind skipper post is situated main switch board

equipped with generator switch, several switches and battery charger/inverter switch. Boat

is equipped with adequate number of nautical charts.

Accommodation

On forward part is situated cabin with matrimonial bed and own sanitary facilities. Toilet is

mechanical type. On salon starboard side is situated U – shaped sofa with wooden table. On

opposite side is located another sofa. Under salon is located water tank and fuel tank. On

salon aft starboard side is located galley. On salon aft port side there is alleyway to aft

cabin. In alleyway is located working table with tools. On aft part are located Owners cabin

with matrimonial bed and access to own sanitary facilities.

Davits, boarding ladders, accesses

Boat is equipped with stainless steel davits. On aft part are located bathing ladders and

wooden platform. Ladders and aft platform are strong.



Bilge and general pumping installations

Bilge is equipped with adequate number of bilge pumps. Boat has two automatic and two

manual bilge pumps.

Fuel installations

Fuel installation is found in accordance to regulations. Boat is equipped with one diesel

tank.

Water installations

Water installation is found in accordance to regulations. Boat is equipped with two water

tanks.

Gas installations

LPG installation is not installed with appropriate regulations. LPG bottles are located on

deck aft part. LPG bottles need to be secured in aft storage with vent to atmosphere.

Ventilation

Boat has only natural ventilation.

Electric installation

Electric installation needs attention. On several places and especially in engine room cables

are naked and need to be safely terminated. On several places are found obsolete wires.

Boat is equipped with three batteries. Batteries are found in good order and without

corroded contacts.



Life saving and fire protection equipment

Life saving equipment consists of:

- Life jackets

- First AID kit

- EPIRB (in service date)

- LIFESLING

- Horseshoe safety ring

- Life raft “Winslow” for 6 persons (in service date)

- Man overboard equipment

- Pyrotechnic is in service date

- Fire extinguishers are out of service date

- SPOT Satellite Personal Tracker

- Dinghy 3.50 m and two outboard engines “Mercury” 4 HP and “Honda” 2.5 HP

Navigational equipment

Navigation equipment consists of: steering wheel, AUTOHELM “Wind”, compass

“Ritchie”, RAYTHEON RADAR/GPS/PLOTTER “Pathfinder” SL70, RAYTHEON

Autopilot “Raypilot” 65, GPS GARMIN “GPSmap 478, VHF “Standard Horizon –

RAM3”, DEPTH “Standard Horizon”, engine indicators (oil pressure, battery volts, water

tank…). Navigating equipment is checked and found in working condition.

Ground tackle and mooring arrangements

Ground tackle consist of electrical anchor winch “LIGHTHOUSE”, main anchor and

galvanized chain. Winch is tested and found in working condition. Boat is equipped with

two spare anchors. Chain locker is found in good order. Anchor, anchor chain and anchor

housing are found in good order. Emergency steering is tested and found in working

condition.



4. Conclusion Boat is fully equipped in accordance with requirements on the Regulations that are

applicable to Pleasure Craft. Did not find any deficiency which could affect her

seaworthiness. Equipment with expiring service or valid date should be renewed/serviced.

Deficiencies find are minor and should be rectified before next season. It is

recommended renewal of osmosis treatment next docking. In general I can say that boat

is old but well maintained.

Survey has been held with the boat afloat and on cradle, without making removals or

opening up of machinery except as stated. This examination therefore is subject to any

conditions which would have been revealed if such procedures had or will be

accomplished.

Predsjednik Trgovačkog suda u Splitu, u postupku imenovanja stalnih sudskihvještaka, temeljem odredbe članka 140.stavak 3. Zakona o sudovima (Narodnenovine" broj:122110-pročišćeni tekst, 27/11 i 130/11) i članka 8. stavak 1. i 2.Pravilnika o stalnim sudskim vještacima ("Narodne novine" broj: 88/08., 8/09.i126/11), dana 29. siječnja 2013. godine

riješio je

I SINIŠA BACALJA, ing. strojarstva iz Splita, Doverska 32a, om:71809148552 ponovno se imenuje stalnim sudskim vještakom za brodostrojarstvoi brodogradnju.

II Stalni sudski vještak se imenuje za vrijeme od 4 (četiri) godine, a po protekutoga roka može biti ponovno imenovan.

Obrazloženje

Siniša Bacalja ing.strojarstva iz Splita, Doverska 32a, je podnio zahtjev zaponovnim imenovanjem za stalnog sudskog vještaka Trgovačkog suda u Splitu zabrodostrojarstvo i brodogradnju, gdje je već ranije imenovan sudskim vještakom uovom sudu rješenjem broj 4 Su-651/08 od 9. veljače 2009. godine. Svom zahtjevu jepriložio uvjerenje da se protiv istog ne vodi istraga i da nije podignuta optužnica kojaje stala na pravnu snagu, policu osiguranja i svjedodžbu o zdravstvenoj sposobnostiradnika.

Nakon pribavljenih podataka propisanih odredbom članka 2. Pravilnika ostalnim sudskim vještacima, te izvoda iz kaznene evidencije Klasa:703-04/13-01/5688, Urbr: 514-05-01-01-13-02-1807465 od 22.01.2013. godine, utvrđeno je daimenovani ispunjava postavljene uvjete, pa je slijedom iznijetog trebalo odlučiti kao uizreci rješenja.
