    CONDUCT AND ETHICS?/EMPLOYEEBEHAVIOUR IN GOVERNMENT

    Section 1, Article XI, of Philippine Constitution

    Accountability of Public Officers,Public office is a public trust. Public officers andemployees must at all times be accountable to thepeople, serve them with utmost responsibility,integrity, loyalty, and efficiency, act with patriotismand justice, and lead modest lives.

    REPUBLIC ACT No. 6713AN ACT ESTABLISHING A CODE OF CONDUCTAND ETHICAL STANDARDS FOR PUBLICOFFICIALS AND EMPLOYEES, TO UPHOLD THETIME-HONORED PRINCIPLE OF PUBLIC OFFICEBEING A PUBLIC TRUST, GRANTING INCENTIVES

    AND REWARDS FOR EXEMPLARY SERVICE,ENUMERATING PROHIBITED ACTS ANDTRANSACTIONS AND PROVIDING PENALTIESFOR VIOLATIONS THEREOF AND FOR OTHERPURPOSES

    All public officials and employees, whether regular orunder temporary status, are required to file a SALN.-Art. XI Sec. 17 of the 1987 Constitution of theRepublic of the Philippines

    A public officer or employee shall upon assumptionof office and as often thereafter as may be requiredby law, submit a declaration under oath of his assets,liabilities, and net worth. -RA 6713, Sec. 8

    The SALN must be filed:1.Within thirty (30) days after assumption of office;2.On or before April 30, of every year thereafter; and3.Within thirty (30) days after separation from theservice.

    All public officials and employees required under thissection to file the aforestated documents shall also

    execute, within thirty (30) days from the date of theirassumption of office, the necessary authority in favorof the Ombudsman to obtain from all appropriategovernment agencies, including the Bureau of InternalRevenue, such documents as may show their assets,liabilities, net worth, and also their business interestsand financial connections in previous years, including,if possible, the year when they first assumed anyoffice in the Government.

    Identification and disclosure of relatives. Itshall of the duty of every public official or employee toidentify and disclose, to the best of his knowledge andinformation, his relatives in the Government in theform, manner and frequency prescribed by the CivilService Commission.

    What should be found in the SALN?RA 6713, Sec. 8

    A.Real property, its improvements, acquisition costs,assessed value and current fair market value;Personal property and acquisition cost;all other assets such as investments, cash on handor in banks, stocks, bonds, and the like;liabilities, and;allbusiness interests and financial connections.B.Including those of their spouses and of unmarriedchildren under eighteen (18) years of age living intheir households.C.Identification and disclosure of relatives. It shall bethe duty of every public official or employee to identifyand disclose, to the best of his knowledge andinformation, his relatives in the Government in theform, manner and frequency prescribed by the CivilService Commission.

    Accessibility of SALNsSALNs must be available for inspection at reasonablehours.

    SALNs must be available for copying by 10 days afterit has been filed;Any person requesting a copy of a statement shall berequired to pay a reasonable fee to cover the cost ofreproduction and mailing of such statement, as wellas the cost of certification.Any statement filed under this Act shall be availableto the public for a period of ten (10) years after receiptof the statement. After such period, the statementmay be destroyed unless needed in an ongoinginvestigation.

    Who are exempted from filing a SALN?Those who serve in an honorary capacity, laborersand casual or temporary workers.Prohibited actsIt shall be unlawful for any person to obtain or useany statement filed under this Act for:Any purpose contrary to morals or public policy; orAny commercial purpose other than by news andcommunications media for dissemination to thegeneral public.Norms of Conduct
