Conducting State Association Investigations
The Initial Allegation & Reporting Mechanism Used: Telephone In Writing (By Letter or E-mail) In Person
Guidelines for Determining if a Violation has Occurred: Is the initial information fact or fiction? Solicit further written information from the reporting
party. Record all initial information provided. Write down all of
the information provided to you. Provide a copy of the initial information to the Executive
Director/Commissioner. Determine whether or not to take further action.
Conducting an Onsite Investigation: In the initial phone call, get as much information as you
can. If a visit is warranted, determine who will be
interviewed. Along with the Executive Director/Commissioner, identify every individual that needs to be interviewed initially.
Develop a set of initial questions in advance. Determine a definite set of questions that should be asked.
Notify the school(s) involved.
Conducting an Onsite Investigation: We identify the individuals we want to interview
initially. Use two investigators. We always go in pairs – one
person asking questions and one person taking detailed notes.
Determine which staff members from the state office (if applicable) will visit the school(s) involved.
Determine the roles of the staff members during the visit.
If student-athletes are involved, check with the Principal of the school concerning parental permission.
Investigator Dos and Don’ts: The investigator should not:
• Misrepresent their identity.• Violate any laws (state or federal).• Pay for information.• Contact students by telephone without permission of
the student’s parent or guardian or the school administration.
Investigator Dos and Don’ts: The investigator should:
• Be fair and remain objective. • Avoid the perception that you are out to get
them. • Tape record the interview whenever possible
with the permission of the person being interviewed.
• When interviewing students, do so in the presence of a school administrator or parents.
• Be thorough and reduce the number of questions you ask initially.
The Interview Process: Meet where there is very little distraction. Separate individuals being questioned. Begin the interview with less threatening questions. Be careful and ask the right questions. Avoid asking too many direct questions. Ask brief questions and listen carefully to each response. Use
terms like:• Tell me about…• Describe…• Explain…• Do not ask yes or no questions.
The Interview Process: Pause for approximately 4 seconds after the individual stops
speaking. Avoid bringing something up. Remember, they are reading you, and you are sizing them up. Interpret verbal and non-verbal responses – especially at the
beginning of the interview while asking non-threatening questions.
Read non-verbal behavior – Are they comfortable? Are they squirming?
Learn to analyze statements made and think about why something was said.
3 Types of Individuals You Will Interview: Cooperative Non-cooperative Suspects
*Each has his/her own objective.
The Dos and Don’ts of Interviewing: Do not interrupt the person being interviewed. Do Pause. This is the solution to interrupting. Never agree to take statements, “off the record.” Do not take notes sparingly. Do take detailed notes.
Determine Who and What Makes Up Your Case: The majority of the time, the individuals that make your
case are not the ones that you interview during your initial investigation.
They are the ones you find out about while interviewing individuals during the initial inquiry.
The Final Analysis: Compile information following the investigation into a
report. Analyze information and determine if a violation has
occurred. Submit a report to the Executive Director/
Commissioner for review.
The Final Analysis: After the staff meeting, our Executive Director will send a letter to
the Principal of the school involved, outlining our findings. We also call and read the letter to the Principal prior to sending it.
The school is given an opportunity to dispute the findings if they disagree with what is in writing.
If our information is correct and violations have occurred, the school is asked to send back to the Executive Director any disciplinary action the administration at the school has taken to ensure a violation of this type does not occur again.
Many times the administration of the school will take tougher disciplinary action than the state office staff was considering.
No action is taken by our office until the administration at the school has had an opportunity to deal with their own problem.
Disciplinary Action: The Executive Director/Commissioner decides on
penalties and disciplinary action. The Executive Director takes disciplinary action after
receiving the final written response from the school.
