Foreword

By Carl Maynard, Lead Member for Economy, Transport and Environment

In East Sussex our vision is for an industry leading parking service that serves the public, is sensitive to local needs and delivers a professional service to its motorists, residents and traders. Controlled parking enforcement is a key element of our local transport plan, which sets out what we will do to achieve a safe and efficient transport system for East Sussex. It sets us targets to improve public transport use and access to health services, education and employment, and encourage more walking and cycling. As such we aim to operate a transparent parking strategy that supports the economy, regenerates town centres, protects the environment and reduces congestion. Parking can be emotional and contentious for some people and I hope that this report will help to explain this complicated subject, and I am sure it will be of interest to many road users.

A review of the Eastbourne parking scheme is nearing completion. We said we would review the situation after a couple of years of operation and independent reviewer, WSP PB, have been used to undertake this extensive and thorough review. The review includes a number of satellite areas in Rodmill, Hampden Park and Meads at the request of local residents and councillors. In Hastings, the development of the new Jerwood gallery and improvements to the Stade open space, presented us with the opportunity to rethink and relocate coach parking from the Stade to new facilities in Falaise Road and Sea Road. I am pleased with the way that these new arrangements are now bedding in, but we will continue to monitor them next season in case further changes are required. The new parking scheme introduced around Warrior Square has also been a success and as expected it has fully delivered the aims of the scheme for the benefit of residents and businesses. A review of the Lewes District parking scheme began in January. The Lewes parking scheme was first introduced in September 2004 and underwent a review in 2006/7. In more recent times there have been a number of requests for changes and amendments to be made to the parking arrangements both in the town and in the surrounding district. An independent transport consultant, Atkins were asked to carry out this review. The review should reached completion towards the end of 2011.

Chapter 1 - Parking Policy Parking PolicyOur parking policy has been developed to support the Council plan and LTP3, both of which take account of local and national transport goals.Priorities within these plans include:

making our roads safer improving transport access to services improving economic competitiveness and

growth tackling climate change and our carbon

footprint improving safety, health and security providing sustainable transport

opportunities to enhance social inclusion improving quality of life.

Parking management is essential in helping us to achieve these priorities. By using parking controls we improve access for residents, businesses and visitors, keep traffic moving, reduce congestion and provide access safely to those that need it most. You can view our parking policy at our Parking Information Centres in Lewes and Eastbourne or on our website www.eastsussex.gov.uk/roadsandtransport/parking Key changes to policy Working together: throughout the last year we have taken part in a number of

schemes to promote the services available to local residents and a number of safety campaigns around schools.

o School patrols in Eastbourne: during the latter part of 2010 CEOs in Eastbourne, together with PCSOs, carried out joint patrols outside Ocklynge school in Eastbourne. The Patrols helped to raise awareness of dangerous parking, such as: parking on the school zig zags, causing obstructions to traffic, and vehicles hindering sight lines for pupils attempting to cross the road. Parents and guardians were encouraged to park in more sensible positions and letters were also sent home with pupils to encourage support for the campaign.

o Eastbourne and Lewes Quality Street events: these events are organised by and form part of the Lewes District Community Safety Partnership and Eastbourne’s Crime Reduction Partnership. They provide the opportunity for residents and business’ to drop in and find out about services available to them. They also give them the opportunity to raise any concerns they have and to ask questions to the organisations represented. The events are attended by many different organisations, some of those include: the local police, fire and rescue service, local district and borough council street wardens, our CEOs and neighbourhood watch policing teams.

A suggestion which is being trialled is the use of warning notices for a limited

number of contraventions. The first warning notices were issued just before the end of the fourth quarter. Please see page 9 for more information about the use of Warning Notices. At the time of this report we do not have full details about this trial, although, early indications show that this is being well received. We will report full details about this in next year’s annual report.

Suspensions and waivers for charities Following a number of requests it was agreed that these would be provided free of charge to charitable organisations offering a beneficial service to the public, where no alternative parking is available.

New contraventions In May 2010 we began enforcing two new parking contraventions; dropped kerbs and double parking (parking more than 50cm from the kerb). Before beginning enforcement of these restrictions we advertised the changes on our website. Dropped Kerbs The contravention of parking next to a dropped footway applies where a vehicle parks on the road next to a place where the footway, cycle track or verge has been lowered to assist:

pedestrians crossing the carriageway;

cyclists entering or leaving the carriageway; or

vehicles entering or leaving the carriageway across the footway, cycle track or verge.

Parked 50cm or more from the kerb The purpose of this restriction is to help prevent inconsiderate and selfish parking causing congestion and road safety problems. Parking more than 50cm from the edge of the carriageway may not cause problems for smaller vehicles, but can obstruct the passage of ambulances, fire engines, buses, waste collection vehicles and other essential vehicles.

Chapter 2 – Special Events

Bonfire night As is tradition, on November 5 throughout the county the capture of Guy Fawkes is celebrated with fireworks and bonfires. Nowhere in the country is more famous for its celebrations than in Lewes. Parking in Lewes on bonfire night has to be carefully managed to provide space for the residents of Lewes, but at the same time, procession routes must be cleared of vehicles. Pay and display machines are covered up or removed to maintain the safety of spectators, and this also helps to prevent vandalism. On average

o 500 suspensions signs are put up around the town in the days leading up 5 November

o 700 letters are distributed to residents with advice about parking on the night

o 55 pay and display machines are removed from procession routes

o 22 pay and display machines are securely covered up

o 50,000 people are estimated to have attended last year’s event

o £16,000 is spent each year for parking management alone!

In addition to the tasks listed above, a removal vehicle is hired for the afternoon of the event up until 5pm and the parking shop is boarded up overnight. Planning and preparations have begun for bonfire night 2011. Airbourne 12-15 August saw the return of Airbourne, one of the biggest seafront air shows. Flying displays included a special 70-year anniversary display from the Battle of Britain Memorial Flight, wing walkers, Eurofighter Typhoon and the Red Arrows.

As with all large events in Eastbourne we worked with the Borough Council to help make sure the event was a success. Parking space was available for equipment deliveries to the area around the western lawns, including:

o 21 parking bays were suspended for 3 days leading up to the event for the delivery of safety fencing.

o Our parking bays on the seaward side of the seafront were free of charge for all 3 days of the event, this is more than 340 bays.

o CEOs patrolled the town and seafront area providing advice and help to motorists and they also helped to keep the emergency routes clear.

999 Emergency Services Display This free event gives you the chance to see, up close, emergency response vehicles and demonstrations from many of the emergency services involved. They include Sussex Police, who organise the event, East Sussex Fire and Rescue Service, South East Coast Ambulance Service, Maritime and Coastguard Agency and the RNLI (Royal National Lifeboat Institution). Although not as big as Airbourne, 999 is very popular and parking provision is made, including the suspension of 31 bays over the two day event. Tennis The international tennis tournament took place in June last year and, like previous years, the town saw an increase in the number of visitors. CEOs remain on patrol throughout the event to ensure that vehicles are left safely. They also provide help and advice to visitors about where to park, and often give directions to the tennis centre and other local attractions. For the tennis event a number of roads are closed around the venue and 7 bays are suspended free of charge for the shuttle bus. In Hastings, the popularity of various events such as Bank Holiday Motorcycle rally, Carnival, Seafood Festival, Play in the Park, Bonfire etc has seen increased in the number visitors to town year on year. During these events CEOs remain on duty to ensure free flow of traffic and successful event. These events require suspension of Resident and Pay and Display parking bays and distribution of letters to all residents and businesses affected by the event.

Chapter 3 – Customer Focus

During the last quarter of the year the Parking Team began working on a number of different ways to make improvements to the service provided, and to enhance customer service. In this chapter we will tell you about some of the projects we have been working on and their objectives.

Cancellation Policy We have been reviewing this policy to ensure that it meets plain English standards and best practice. We have not been making any large changes to the reasons we would consider the cancellation of a PCN. It is hoped that the review of this policy will help to achieve a uniformed approach across the SE7. Parking Policy and Parking Charter The parking policy and charter is reviewed annually. As with the cancellation policy, focus has been placed on making the policy informative and easier to understand. Customer Focused Enforcement A number of different suggestions are being trialled to help motorists:

understand the reason for parking enforcement; avoid receiving a penalty for parking in contravention; and action to take if a PCN is received.

One of these suggestions has been the amendments made to challenge and appeal forms. The new forms outline the process for challenging the issue of a PCN and the options available, for example: viewing pictures of the contravention on our website, submitting online challenges or how to make payment. It also explains that payments made with a challenge will not be accepted. Warning Notices In March we began trialling the use of warning notices. We have set guidelines for when they may be issued rather than a PCN, examples include: a blue badge time clock set to the wrong time or a blue badge displayed with the wrong side displayed. Using warning notices allows us to notify motorists that they have parked in contravention and that they may have received a PCN for doing so. Instead of having to pay a PCN though, the motorist is advised of their mistake. A record of warning notices is kept so that we can record if a vehicle has had a warning previously. We will only issue one warning notice. If the vehicle is seen again parked in contravention a PCN will be issued and it is very unlikely that a challenge against it would be successful.

A warning notice will never be issued to vehicles parked in a non permitted parking area, for example: on yellow lines or a bus stop, any vehicle parked in a non-permitted place will be issued a PCN.

Permits A full review of the permit documentation has been started with the intention of reducing the amount of paperwork involved in applying for and renewing a parking permit. This includes making sure guidance notes and application forms are written in plain English and can be easily understood and completed. The documentation is also going to be made more consistent across all permit types. It is hoped that the new forms will be ready in time for the main permit renewal period in September and October. Plain English & Letters Letters about PCNs often contain a large amount of technical and legislative information. We will respond to PCN challenges and representations using plain English. Letters from the team should be easy to understand and any action required will be clearly explained. There is still some information which we are required to include and that information will continue to be more technical. Electronic processing The team have recently been able to switch to a paperless process for receiving and responding to PCN challenges and appeals. As well as providing savings on the cost of paper, printer inks, stationery and scanning, there are also many other benefits and efficiencies which can be made. The paperless process commenced on 28 March.

Correspondence, complaints and Freedom of Information Requests In Lewes and Eastbourne the projects mentioned above are in addition to the daily efforts the team make in providing excellent customer service. As well as the PCN challenges detailed in Chapter 6, the parking team have responded to 490 customer contacts. Of these 56 were Freedom of Information requests and 9 were formal complaints. As mentioned in last year’s report, towards the end of the financial year the labels used on pay and display machines were given the Plain English Campaign seal of approval. These labels are now on all of the pay and display machines in Lewes and Eastbourne. You can see a copy of the labels on the next page.

Chapter 4 – Permits Resident Permits The tables and charts in this chapter show the number of different types of permits issued. Resident’s permits - The number of resident’s permits is an annual total which means that they were not all valid at the same time. This is because resident’s permits are available annually, or for periods of 6 and 3 months. The following three charts show the number of residents permits issued by Zone in each town.

Other Permit types There are some differences between the types of permits issued in each area, even though they have similar sounding names. For example, Primary Care Trust (PCT) permits in Lewes and Eastbourne and Primary Care Worker (PCW) permits in Hastings. The PCT permits available in both Eastbourne and Lewes are for the use of doctors, nurses, midwives, health visitors, social workers and carers who provide services to clients in their homes. These are intended for the provision of routine care in non urgent or emergency situations. The PCW permits available in Hastings are only for the provision of emergency or urgent health or social care. PCW permits are not issued for the provision of more general or routine care.

Scratch card permits – the information shown is the number of permits sold each month. This does not mean that all of the permits were all used in that month. Scratch card permits do not have an expiry date and can, therefore, be used at any time in the future after they have been purchased.

Chapter 5 – Enforcement

We are committed to ensuring that our operational processes and enforcement procedures are fair, efficient, and effective. Penalty Charge Notices (PCN) The main purpose of a PCN is to encourage compliance with parking restrictions. The issue of a notice acts as a deterrent to those motorists who contravene regulations and also as a reminder that safe and considerate parking is a requirement for all road users.

We issue a £70 PCN for more serious parking contraventions such as parking in a place that is always prohibited and a £50 PCN for less serious contraventions such as overstaying where parking is permitted. The chart below shows the total number of PCNs issued on-street in Eastbourne, Hastings and Lewes.

Deployment There are 33 Civil Enforcement Officers (CEOs) employed by our enforcement contractor, NSL, in Lewes and Eastbourne. At any one time there are 8 CEOs deployed Monday to Saturday and 6 on a Sunday. There are 16 Civil Enforcement Officers directly employed by Hastings Borough Council, who are deployed on a shift system to cover parking enforcement on 7 days of the week Streets that have parking bays or restrictions within them will be visited by a CEO. The time spent in each street varies depending on the amount of restrictions there are. In Lewes and Eastbourne a total of 1,090 parking bay suspension requests were carried out and 56 in Hastings during 2010/11. Applications are received by the Parking Information Centre and Shop who then put signage in place in advance of the suspension. CEOs will record details of any vehicles parked there when the signs are put up. Suspensions are mainly required for the following reasons: • House removal vehicles • Skips • Filming • Building works • Special events Parking enforcement is also carried out outside of the Controlled Parking Zones. There are mobile units which visit the other areas of the District and Boroughs. These units also provide a fast response where complaints are received. Many restrictions remain in force 24 hours a day, and if required deployment can be arranged to deal with any vehicles that choose to ignore them. The next two tables show the number of bays and lengths of restrictions which our CEOs are required to enforce.

School Keep Clear: Vehicles that park with disregard to the restrictions outside of schools may put at risk the safety of the children and parents that attend them. We operate a rota attending those schools where problems are known to occur on a frequent basis. We also undertake compliance checks on other schools throughout the controlled parking areas.

We aim to ensure that members of the community that have access issues are not hindered by vehicles parking inconsiderately by blocking the route across our busy roads. Many authorities install tactile lowered kerbs to assist the visually impaired and wheelchair users with their day to day access needs. CEO’s will issue PCNs to vehicles that are parked across these essential access points.

Chapter 6 – Penalty Charge Notice Processing Challenges, representations and appeals All Penalty Charge Notices (PCNs) contain details of how to pay and how to make an appeal. East Sussex County Council’s and Hastings Borough’s Notice Processing staff deal with responding to correspondence at all stages of the appeals process. In addition there is information on our website about the appeals process and also information regarding the meaning of the common signs and road markings used to denote parking restrictions: www.eastsussex.gov.uk/roadsandtransport/parking We want our letters to give clear information about the processes. We are committed to adopting a fair, transparent and consistent approach to challenges, representations and appeals against PCNs. The Parking Notice Processing staff will use appropriate discretion in relation to compelling circumstances. When Notice Processing staff receive challenges they aim to respond within 14 days as recommended by the Secretary of State. In fact the vast majority are responded to within one week. We realise for some the worry of having outstanding PCNs does cause concern and therefore we will be sensitive to these needs. The table below shows the number of PCNs issued and the number of challenges representations and appeals received in each area.

The form to make the appeal is included with our rejection letter. The decision by the Adjudicator at the TPT is normally final and unless there has been an error in the interpretation of the law, there is no further way for appeal. Once the Adjudicator has made a decision they will inform the owner of the vehicle and us in writing. Timelines related to PCN Progression If neither payment is made nor correspondence received in connection with a Penalty Charge Notice (PCN) once it has been issued, it will continue to progress automatically following the approximate timescales and stages listed below. Chapter 7 - Financial Information On-Street The financial climate has seen reductions in parking payments, not only in East Sussex, but nationally, this trend which started in 2009/10 has continued into 2010/11. We have worked with NSL Services and Hastings Borough Council to reduce our running costs of the contracts and this has enabled us to make an operational surplus on all three schemes. The top of the table below shows the operating surplus, expenditure incurred against these amounts are shown underneath, this gives you the net operating surplus/(deficit) for the year. Chapter 8 - Off-street parking (car parks)

Off-street car parking in Eastbourne and Hastings is operated by the borough councils. Most off-street car parks in Lewes District are the responsibility of Lewes District Council (LDC), who operate pay and display car parking at 21 car parks. LDC also operates one season-ticket-only car park in Seaford and 16 other off street car parks within the district, which are free of charge. In addition to the car parks, LDC operates a pay upon exit multi storey car park at Newhaven (see Appendix 2 for further car park information). Although the Road Traffic Regulation Act 1984 sets out strict criteria governing the way in which any surplus arising from on-street parking can be spent, the net surplus produced from off-street car parking can be used for specific and general purposes. The cost of resurfacing car parks, replacing parking machines and provision of new parking spaces are examples of specific uses. Using the surplus to contribute towards the overall cost of council services, such as Recreational and Environmental Services are examples of a more general use. Councils have a responsibility to their local taxpayers to obtain a return from the use of all Council assets, including car parks.
