7 Proficiency testing organisation
• After the proficiency testing we can offer you reference materials
• Possibility to perform a bilateral proficiency testing (bPT)
• A precise planning and organisation of each proficiency testing round
• 2 weeks before we will dispatch the samples you will get an announcement with the proficiency testing details
• All materials send out are in line with a homogeneity test and stability test; therefore we reserve the right to purchase the sample and engage the testing take through external qualified subcontractors
• After receiving the samples you will have a period of 4 weeks for analysing
• Mail back the results via internet by using our result sheets in an Excel file or fill out our result sheets online in ODIN
• At the latest 3 weeks after the deadline you will get the report (optional by login in ODIN, as hardcopy by regular mail or as pdf-file by e-mail) incl. participation certificate with overview of your lab performance

Your terms and conditions:
You have participated in the regular DRRR-proficiency testing and you would like to verify your performance. The report of this proficiency testing is not older than ten weeks. You register within these ten weeks for the bPT and the performance is confirmed by the DRRR. The testing period is dependent on the technical factors (parameter, matrix etc.) and will be agreed individually*. When this time is over after the sample shipment and you do not have sent us your results in this time, we can not evaluate your results and issue a certificate for you.(* normally not longer than 1 - 2 weeks)The bPT is not in the scope of accreditation of the DRRR. The realization of the bPT depends on the availability of the material.

You are not satisfied with your laboratory performance: What can you do?
New: The bilateral proficiency testing (bPT)!
Due to your showed laboratory performance you have been asked by the accreditation body, the monitoring authority or your customer to initiate measures to improve your laboratory performance.These measures are often connected with considerable efforts in the laboratory and you only have a short time frame. In many cases the proof of a successful measure processing, by participation in a new proficiency testing round, is only possible in the following year. Until now it does not exist a possibility for a spontaneous performance review to equalize a previous unsatisfactory proficiency testing result.
You can book and perform individually and flexibly the bilateral proficiency testing during a determined time period.You receive a proficiency testing sample for analyzing. You submit the results of the testing. After that you will get your proof of performance as a z’-score calculation in the form of a certificate within 1 - 2 weeks.
The performance evaluation refers to the previous regular proficiency testing, so that you can connect the bPT to the regular proficiency testing round. The used sample material is derived from a previous proficiency testing round and provides the possibility of a comparable performance evaluation with the regular proficiency testing.

The inspectors of the DRRR-team are represent in different national and international committees and working groups. Thus we ensure that the DRRR quality assurance systems are available for new and up-to-date questions in all cases, if the laboratories start to establish the routine method. Due to the intensive professional exchange in the committees, it is ensured that the proficiency testing design is conformed to the new developments and the laboratories have the highest possible benefits in a participation in the proficiency testing.
By using our market-leading statistical evaluation, additional information such as laboratory uncertainty and various scattering of each laboraotires can be presented.

DRRR-Reference materials are essential for the chemical, physical, microbiological and sensory analytics as well as for the quality assurance. Standards for the accreditation of testing and calibration laboratories demand the using of reference materials.The use of reference materials (RM) and certified reference materials (CRM) is an important procedure to avoid mistakes in the lab routine.

IR-SeminarThe IR-seminar explains how to analyze different kind of food by IR spectroscopy. Furthermore specific peculiarties for the IR calibartion of selected food will be discussed. The specific peculiarties of the calibration will be explained intensify. How to calibrate? When you have to update the calibration? What is the cause of measurement problems?
Sensory seminarThe importance of the sensory in the food stuff industry will be explained and clarified in practice. The current state of new tastes is presented. Furthermore the participant will be enabling to apply the sensory testing methods. The use of sensory methods will be explained and on the basis of various sensory materials implemented.
User-Workshop
Typical questions in the chemical and microbiological analysis of food, especially dairy products are presented and possible solutions will be demonstrated.
Furthermore efficient ways to increase the laboratory quality will be presented. The seminar is accompanied by the practical experience of users.
Statistics seminar for beginners
This seminar presents the Binomial-, Poisson- and Normal distribution and the application of them. Problem cases and the classis misinterpretation due to a false outlier treatment by the application of the Normal distribution are shown.
Statistics seminar for advanced learners
This seminar presents the Shapiro-Wilk-Test, qui²-adaptation test, Median and MAD (Median absolute deviation) and their application. Furthermore the participants will be informed about the robust standard deviation after Q-method and the robust average after Hampel.
A lot of space for the exchanging of knowledge and experience is provided at the User-Workshop. Therefore some experts are available as contact persons.
The sensory measurement uncertainty of each participant will be determined at a practical example.

Das Deutsche Referenzbüro für Ringversuche und Referenzmaterialien GmbH (im folgenden DRRR genannt) für frei vereinbarte Dienstleistungen, insbesondere Prüfungs-, Schulungs- und Gutachtertätigkeiten und Referenzmaterialien.
§ 1 Allgemeine BestimmungenDer Auftraggeber erkennt die zum Zeitpunkt der Auftragserteilung jeweils gültigen Allgemeinen Geschäftsbedingungen und Preislisten an. Abweichende Geschäftsbedingungen einzelner Auftraggeber können grundsätzlich nicht anerkannt werden. Nebenabreden, Zusagen und sonstige Erklärungen der Mitarbeiter des DRRR sind nur dann bindend, wenn sie vom DRRR ausdrücklich schriftlich bestätigt werden. Dies gilt auch für Änderungen dieser Klausel. Die Unwirksamkeit einzelner Bestimmungen dieses Vertrages oder seiner Bestandteile lässt die Wirksamkeit der übrigen Regelungen unberührt. Die Vertragspartner sind im Rahmen des Zumutbaren nach Treu und Glauben verpflichtet, eine unwirksame Bestimmung durch eine ihrem wirtschaftlichen Erfolg gleichkommende wirksame Regelung zu ersetzen, sofern dadurch keine wesentliche Änderung des Vertragsinhaltes herbeigeführt wird; das gleiche gilt, falls ein regelungsbedürftiger Sachverhalt nicht ausdrücklich geregelt ist.
§ 2 Durchführung des AuftragesDie vom DRRR angenommenen Aufträge werden durchgeführt bzw. Gutachten werden nach den anerkannten Regeln der Technik und – soweit nicht entgegenstehende Abmachungen schriftlich vereinbart sind – in der beim DRRR üblichen Handhabung erstellt. Keine Verantwortung wird für die Richtigkeit der den Prüfungen zugrunde liegenden Sicherheitsprogramme oder Sicherheitsvorschriften übernommen, sofern nicht ausdrücklich und schriftlich etwas anderes vereinbart wurde. Der Umfang der Arbeiten des DRRR wird bei Erteilung des Auftrages schriftlich festgelegt. Ergeben sich bei der ordnungsgemäßen Durchführung des Auftrages Änderungen oder Erweiterungen des festgelegten Auftragsumfanges, sind diese vor Durchführung schriftlich zu vereinbaren. Falls ein Festhalten am Vertrag im Hinblick auf die Änderungen oder Erweiterungen ihm nicht mehr zugemutet werden kann hat der Auftraggeber in diesem Fall das Recht, vom Vertrag zurückzutreten. Der Auftraggeber hat jedoch nach § 649 BGB die vereinbarte Vergütung oder mangels Vereinbarung eine angemessene Vergütung zu bezahlen.Mit Erstellung der jeweiligen Abschlußberichte oder Gutachten gelten die vertraglichen Leistungen des DRRR als erbracht.Eine Seminaranmeldung kann bis 6 Wochen kostenfrei zurückgetreten werden, danach werden die Teilnehmerkosten je nach Aufwand dem Kunden in Rechnung gestellt.

§ 4 Gewährleistung und HaftungDie Unversehrtheit des Probenmaterials auf eine definierte Beschaffenheit wird bei Auslandsversand nur bis zum ersten Grenzübertritt garantiert.Sicherheitshinweis: Bei Versand von Materialien der Risikogruppe 2 muss dem DRRR ein Schreiben des Empfängers vorliegen, dass dieser für den Umgang mit gefährlichen Materialien (z.B. pathogenen Keimen) zugelassen ist.Die Gewährleistung des DRRR umfasst nur die ihm gemäß § 2 ausdrücklich in Auftrag gegebenen Leistungen.Eine Gewähr für die Ordnungsmäßigkeit und das Funktionieren der betreffenden Gesamtanlage, Messgeräte oder Materialien, zu der die begutachteten oder geprüften Proben gehören, wird damit nicht übernommen; insbesondere trägt das DRRR keine Verantwortung für Verpackung, Materialauswahl und Bau der untersuchten Anlagen, Messgeräte oder Baugruppen, soweit diese Fragen nicht ausdrücklich Gegenstand des Auftrages sind.Auch im letzten Falle werden die Gewährleistungspflicht und die rechtliche Verantwortung des Herstellers weder eingeschränkt noch übernommen. Die Gewährleistungspflicht des DRRR beschränkt sich auf die Nachbesserung eines Fehlers oder Mangels oder bei Fehlen einer zugesicherten Eigenschaft auf die Herbeiführung dieser Eigenschaft innerhalb einer angemessenen Frist. Schlägt die Nachbesserung oder Herbeiführung der Eigenschaft fehl, d. h., wird sie unmöglich oder dem Auftraggeber unzumutbar oder vom DRRR verweigert oder ungebührlich verzögert, ist der Auftraggeber nach seiner Wahl berechtigt, Herabsetzung der Vergütung oder Rückgängigmachung des Vertrages zu verlangen.Bei fehlerhaften Ringversuchen oder Referenzmaterialien übernimmt das DRRR keine Haftung für entstandene Arbeitsleistungen des Kunden.Eine Haftung von bestimmten Eigenschaften, insbesondere dafür, dass die Leistung für die Zwecke des Auftraggebers geeignet ist, übernimmt das DRRR nur, wenn eine entsprechende Zusicherung der betreffenden Eigenschaften erfolgt ist. Eine Haftung für Mangelfolgeschäden aus positiver Vertragsverletzung aufgrund zugesicherter Eigenschaften ist ausgeschlossen, sofern die Zusicherung nicht gerade vor solchen Folgeschäden schützen sollte. Schadenersatzansprüche des Auftraggebers aus §§ 463, 635 BGB wegen Fehlens zugesicherter Eigenschaften bleiben unberührt.Beruht ein Fehler oder Mangel, der kein Fehlen einer zugesicherten Eigenschaft darstellt, auf einem vom DRRR zu vertretenden Umstand, so haftet das DRRR für einen dem Auftraggeber hierdurch entstandenen Schaden nur je Auftrag bis zu einem Betrag der maximal dem Wert des nach § 2 vereinbarten Auftrag entspricht.Die Verwendung der Materialien darf nur für den entsprechenden wissenschaftlichen Verwendungszweck durch ausgebildetes qualifiziertes Personal erfolgen. Das DRRR ist in keinem Fall für gebrauchte, ungebrauchte oder unbrauchbare Proben verantwortlich und zuständig.Die Proben sind ausschließlich für analytische Zwecke bestimmt. Das DRRR übernimmt keine Haftung, wenn die Proben nicht für die bestimmten analytischen Zwecke eingesetzt werden.Alle Materialien sind definitiv nicht für den menschlichen Verzehr geeignet, es sei denn es handelt sich um Sensorikmaterialien.Die orale Aufnahme der nicht für sensorische Zwecke bestimmten Materialien kann zu Gesundheitsschäden führen.Bei sensorischen Materialien ist selbstverantwortlich zu prüfen, ob die Prüfpersonen die Materialien auch im Hinblick auf Allergien testen können. Die Inhaltsstoffe der sensorischen Materialien sind deklariert. Sämtliche Proben und Verpackungs-Materialien sind Eigentum des DRRR. Proben, die für zerstörungsfreie Prüfungen eingestzt werden, und damit im Rahmen der Ringversuchsuntersuchung keiner Zerstörung unterliegen, können vom DRRR auf Verlangen wieder zurückgefordert werden. Die Versandkosten für den Rücktransport , sofern die Materialien zurück gefordert werden, werden vom DRRR getragen.Die analytischen Eigenschaften des Materials werden nur dann garantiert, wenn entsprechend den vom DRRR festgelegten Transport-, Lager, – und Verwendungsbedingungen vorgegangen wird.Für gefrorene Proben garantiert das DRRR nur in sofern die im Datenblatt ausgewiesenen Materialeigenschaften, als dass die Proben vorschriftsmäßig behandelt werden. Für gefrorene Proben, die in Länder außerhalb der EU geliefert werden, können wir die Probeneigenschaften nur bis zur ersten Zollabfertigungsstelle an der jeweiligen EU-Grenze garantieren.
§ 5 Ausschluss weitergehender Haftung und AnsprücheDie Gefahr (Transport- und Vergütungsgefahr) geht auf den Besteller über, sobald die Ware das DRRR verlassen hat, gleichgültig ob mit eigenen oder fremden Transportmitteln.Schadensersatzansprüche des Auftraggebers sind ausgeschlossen. Dies gilt nicht bei Vorsatz, grober Fahrlässigkeit, Verletzung wesentlicher Vertragspflichten des DRRR oder des Fehlens schriftlich zugesicherter Eigenschaften.Alle weiteren Ansprüche des Auftraggebers für unmittelbaren und mittelbaren Schaden – gleich aus welchem Rechtsgrund – insbesondere Ansprüche auf Schadenersatz wegen positiver Vertragsverletzung oder aus unerlaubter Handlung und auf Ersatz von Schäden, die nicht an dem Auftragsgegenstand selbst entstanden sind, sind ausgeschlossen. Unabhängig davon ist der Auftraggeber verpflichtet, die üblichen Versicherungen gegen unmittelbare und mittelbare Schäden abzuschließen.

Für Referenzmaterialien, die im Namen unserer Kooperationspartner verkauft werden, gelten hinsichtlich der Haftung und Gewährleistung folgende Bedingungen:Die Haftung unserer Kooperationspartner, seine gesetzlichen Vertreter und Erfüllungsgehilfen werden beschränkt auf Fälle von Vorsatz, grober Fahrlässigkeit, Fehlen einer zugesicherten Eigenschaft und Verletzung einer Pflicht, bei deren Nichteinhaltung der Vertragszweck gefährdet wäre. Die Haftung wird für nachgewiesene Schäden aufgrund grob fahrlässiger Verhaltensweisen auf die Höhe der Vertragsvergütung beschränkt, für Folgeschäden wird keine Haftung übernommen. Die Haftung beschränkt sich auf die Verwendung der Referenzmaterialien für die im jeweiligen Zertifikat beschriebenen Zwecke.Unserer Kooperationspartner gewährleisten die Anwendung wissenschaftlicher Sorgfalt sowie die Einhaltung der anerkannten Regeln der Technik. Unsere Kooperationspartner sind berechtigt, auftretende Mängel nachzubessern. Bei Fehlschlagen der Nachbesserung ist der Auftraggeber berechtigt, nach seiner Wahl Herabsetzung der Vergütung oder Rückgängigmachung des Vertrages zu verlangen. Weitergehende Gewährleistungsansprüche sind ausgeschlossen.Die Gewährleistung wird begrenzt auf das angegebene Haltbarkeitsdatum der Referenzmaterialien.Dies gilt für: ieLab, TGZ AQS Baden-Württemberg
Die Preise sind Euro-Preise, wenn nicht anders angegeben, und verstehen sich ohne Umsatzsteuer. Diese wird zum jeweils gültigen Satz entsprechend den jeweils geltenden steuerrechtlichen Vorschriften gesondert in Rechnung gestellt.Die Waren bleiben bis zur vollständigen Bezahlung durch den Kunden Eigentum des DRRR.Für die Berechnung der Leistungen gelten die Entgelte nach dem jeweils gültigen Leistungsverzeichnis des DRRR, soweit nicht schriftlich ausdrücklich ein Festpreis oder eine andere Bemessungsgrundlage vereinbart ist. Bei Fehlen eines gültigen Leistungsverzeichnisses sind in jedem Fall einzelvertragliche Regelungen zu treffen.Kostenvorschüsse können verlangt werden. Ebenso können Teilrechnungen entsprechend den erbrachten Leistungen gestellt werden. Teilrechnungen müssen nicht als solche gekennzeichnet sein. Der Erhalt einer Rechnung bedeutet nicht, dass das DRRR den Auftrag vollständig abgerechnet hat.Die Entgelte sind sofort nach Rechnungslegung, spätestens bis zu dem in der Rechnung ausgedruckten Termin zur Zahlung fällig (8 Tage netto, ohne Abzug). Es sei denn es wurde eine andere Regelung getroffen. Bei späterer Zahlung werden für den offenen Rechnungsbetrag Verzugszinsen für den Zeitraum zwischen Fälligkeit und Geldeingang in Höhe von 2% über EURIBOR in Rechnung gestellt.Beanstandungen der Rechnungen des DRRR sind innerhalb einer Ausschlussfrist von 14 Tagen nach Erhalt der Rechnung schriftlich begründet mitzuteilen.
§ 7 Geheimhaltung und UrheberrechtDas DRRR behält sich die Urheberrechte an den von ihm erstellten Gutachten, Prüfungsergebnisse, Berechnungen u. ä. vor.Das DRRR und seine Mitarbeiter dürfen Geschäfts- und Betriebsverhältnisse, die bei der Ausübung der Tätigkeit zur Kenntnis gelangen, nicht unbefugt offenbaren oder verwerten.Von schriftlichen Unterlagen, die dem DRRR zur Einsicht überlassen und die für die Durchführung des Auftrags von Bedeutung sind, darf das DRRR Abschriften zu ihren Akten nehmen.Bei der Zustellung des Ringversuchsberichts und des Laborcodes via E-Mail kann keine Garantie über die Sicherstellung der Vertraulichkeit gewährt werden.
§ 8 Gerichtsstand, Erfüllungsort, anzuwendendes RechtGerichtsstand für die Geltendmachung von Ansprüchen für beide Vertragspartner ist Kempten, sofern die Voraussetzungen gemäß § 38 Zivilprozessordnung vorliegen. Dies gilt insbesondere im Mahnverfahren.Erfüllungsort für alle sich aus dem Vertrag ergebenden Verpflichtungen ist Kempten, der Sitz des Auftragnehmers.Das Vertragsverhältnis und alle Rechtsbeziehungen unterliegen ausschließlich dem zwischen inländischen Vertragspartnern geltenden Recht der Bundesrepublik Deutschland unter Ausschluss des Einheitlichen Gesetzes über den Kauf beweglicher Sachen und des Übereinkommens der Vereinten Nationen über Verträge im internationalen Warenkauf.
