3 INTRODUCTION

3.1 The Idlewells Market (called the Market hereafter) in Sutton-in-Ashfield is managed by Ashfield District Council. The Council have a lease from Idlewells Shopping Centre to operate the Market.

3.2 The Market was fully refurbished in 2017 and includes a food court with a central communal seating area. The entrances and stall layout were improved to lead shoppers round the Market from the outside. The floor surfaces have been renewed and energy efficient LED lighting has been introduced to create a modern retail environment. Wifi is available to all customers and traders.

3.3 Traders within the Market are offered a licence (“the Licence”) which allows the Council to make Management Regulations for the efficient operation of the Market. These regulations are published in the form of this Traders’ Handbook. The regulations and the handbook are subject to alteration or amendment by the Council to take account of any developments in the Shopping Centre, in the Market or as changes in legislation occur.

3.4 The regulations in this handbook have been prepared for the benefit of all Licensees in the Market. In return for compliance Licensees shall be treated with courtesy and respect by the Council, given support and encouragement to develop their business and benefit from the promotion of the Market. All Licensees are entitled to the benefit of these regulations and their enforcement.

3.5 These regulations should be read in conjunction with the Licence, and in the event of conflict the Licence shall prevail. These regulations shall apply to every stall except where otherwise stated.

4 EVIDENCE OF IDENTITY

4.1 The Licensee shall provide evidence of identity (e.g. a passport), 2 no. passport size photos, evidence of the right to work in the UK, proof of residence, i.e. a recent utility bill, VAT registration document (if appropriate) company registration document (if appropriate) and confirmation of insurance cover (see requirements below). Comparable information shall be provided for any manager appointed to run a stall. Original documents must be provided.

4.2 A list of the Licensee’s key holders is maintained by the Council. Nominated key holders are required to be able to attend call outs in the event of an emergency such as fire or intruder alarm activations. The Licensee must inform the Council of any changes; including holiday relief, as they occur.

4.3 The Council will store your data securely in accordance with the provisions of the Data Protection Act 1998. However, the Council participates in the Cabinet Office's National Fraud Initiative which is a data matching exercise to assist in the prevention and detection of fraud. The Council is required to provide particular sets of data to the Minister for the Cabinet Office for matching for each exercise. The use of data by the Cabinet Office in a data matching exercise is carried out with statutory authority under Part 6 of the Local Audit and Accountability Act 2014.  It does not require the consent of the individuals concerned under the Data Protection Act 1998.

5 EXTENT OF THE PROPERTY

5.1 The Property is defined in the Licence and the Licensee shall conduct their business from within the property (called the Stall hereafter). Licensees may not display products beyond the ‘standing out’ area marked in floor studs 500mm from the Stall but all fixtures, fittings and goods must be temporary and relocated to the Stall at the end of the Trading Hours. The ‘standing out’ area does not form part of the Stall.

6 DESIGNATED HOURS FOR TRADER ACCESS AND TRADING HOURS

6.1 Access to the Market is available for Traders during the Designated Hours from 6.30 a.m. to 6.00 p.m. Monday to Saturday.

6.2 Subject to variation at the Council’s discretion for late night or Christmas trading etc. the Market’s Trading Hours are:

Monday 9.00 a.m. to 5.00 p.m.Tuesday 9.00 a.m. to 5.00 p.m.Wednesday 9.00 a.m. to 5.00 p.m.Thursday 9.00 a.m. to 5.00 p.m.Friday 8.30 a.m. to 5.00 p.m.Saturday 8.30 a.m. to 5.00 p.m.

6.3 The Trading Hours may be changed at the Council’s discretion e.g. to reflect a change in public shopping patterns.

6.4 Licensees shall ensure their stalls are stocked, staffed and open for trade with a proper display during all the Trading Hours. Licensees selling fresh food or flowers are permitted to start clearing the stall one hour before the end of the Trading Hours but they shall not vacate the stall until the end of the Trading Hours.

6.5 On occasion the Licensee may be unable to operate their stall(s). In that instance the Licensee shall notify Market Management the reasons why and seek consent not to open and trade on the dates and times notified.

6.6 No trucks, barrows or other forms of carriage shall be permitted in the public aisles between the hours of 9.30 a.m. and 4.30 p.m.

6.7 In the event of persistent non-compliance; the Council, at its discretion, has the right to terminate the licence agreement.

7 PERMITTED USE

7.1 Licensees shall restrict their permitted use to the sale of goods and services identified within their Licence. Should a Licensee wish to introduce a new line then they should apply to the Market Management for a variation which they may grant, at their absolute discretion.

7.2 Disputes over permitted use shall be advised to the Market Management who will adjudicate. Licensees in breach will be formally notified and the Licensee must remove the offending products from the stall immediately. The Council reserve the right to terminate the licence agreement in the event of persistent non‐compliance.

8 PAYMENT OF LICENCE FEES

8.1 Licensees shall pay all licence fees monthly in advance by direct debit to the Council’s nominated bank account, together with all and any VAT due upon same.

8.2 In addition the Licensee shall reimburse to the Council within 14 days of demand any charges for electricity, water and/or gas supplies etc. specific to the stall.

8.3 Successful Licensees will be required to pay a deposit equivalent to two months licence fee. The deposit will be held as security for the observance of the Licensees obligations and must be maintained by the Licensee during the Licence Period.

8.4 Late payment of fees shall attract interest payments. The calculation and handling of the fees are contained in the licence agreement.

8.5 The Licensee will be responsible for the payment of any Business Rates.

9 REQUIREMENTS FOR INSURANCE

9.1 The Licensee shall maintain valid insurance cover at all times for a minimum of £5,000,000 third party (public) and products liability. A copy of the Licensee’s current public liability insurance certificate shall be supplied to the Market Management.

9.2 Responsibility for all stock, personal effects, fixtures and fittings shall lie with the Licensee and the Council accepts no responsibility for liability in the

event of any claim for the above. Licensees are recommended to obtain adequate insurance to cover against theft, fire, damage etc.

9.3 Licensees shall not do or allow to be done any act that might render the Council’s insurances void or voidable.

10 STALL DESIGN GUIDE

10.1 General Design Principles

Create interest – first impressions count. Keep it simple – allow the product range to speak. Make use of variations in height to give a sense of volume. Lighting effects are essential and can be used to draw the customer in. Think about materials that compliment your product range, will wear

well and be easily cleaned. Use colour to add interest although a neutral backdrop may be more

appropriate if you have colourful stock. Your sign board should be clear and attractive and must contain the

name of the proprietor and contact details for the stall.

10.2 Stall Layout

The layout of your stall is important in creating a pleasant and friendly shopping space for your customers. Creating an area for shoppers to browse will increase the likelihood of making a sale. Effective separation of the space in to sales areas, display regions and customer browse points is important in promoting and enhancing your business. For fashion retail you may want to think about viewing space and a changing room.

Back of house areas should be sufficient to contain any stock requirements you may have and for the storage of waste.

10.3 Lighting and Ambience

Lighting is the most effective tool in enhancing the environment of your stall. Light, airy environments will be more welcoming to shoppers and make the space feel more open. Low level lighting and spotlights can bring attention to displays to attract potential customers to the stall. All lighting must have an efficiency exceeding 25 lumens per watt of energy and/or be an LED installation, which will be approved as part of your stall design submission.

10.4 Shopfront Signage

Signage designs should be imaginative and unique ‐ variety is welcome provided the materials are of high quality construction and well‐executed. Flat ‘perspex’ sheets with applied vinyl lettering or backlit perspex lightboxes are not acceptable. Signage should extend to all facades visible from the public walkway.

Signage should have ‘depth’ e.g. by using a traditional signwritten timber board which stands‐off the cladding or individual letters built-up to create depth and then standing-off the cladding. Cut‐out logos which also stand‐off are also welcome. Typefaces should be individual and varied in font size. ’Handwritten’ typefaces are preferable.

Signage may be illuminated either by halo illumination or face-mounted halogen spot etc illumination shining back onto the signage. Local switching should be provided from the distribution board within the stall. All illumination must be LV or 240v’. The signage should be ‘bold’ i.e. stretch across the full extent of the fascia boards and need not be constrained within the fascia panel.

Consideration will be given to a single hanging sign on the stall fascia provided the dimensions are modest and the panel is a pierced design rather than a solid signwritten panel.

Drawings indicating the dimensions, colours, materials, method of fixing, etc. should be submitted for the Council’s approval prior to installation.

10.5 Food Catering Stalls

Stalls designated for the cooking or warming of food will be supplied with 1 electric heater and 1 grease trap, these two elements must be installed during the fit out process and maintained by the licensee.

Licensees must submit their stall and signage designs for prior approval by the Council.

11 STALL ALTERATIONS

11.1 No alteration to the structure or services supplying a stall shall be made except with the express permission of the Council. Licensees shall ensure their stall remains in good order and condition and shall remain responsible for its repair and maintenance.

11.2 Before any permitted maintenance or alterations are undertaken the Licensee’s contractors should provide to the Market Management appropriate risk assessments, method statements and proof of insurance. Any hot works shall be identified and notified in advance to the Market Management. A Hot Work Permit will be required from the Idlewells Shopping Centre who will require at least 48 hours’ notice.

11.3 The Idlewells Shopping Centre issue ‘Instructions and rules for contractors’ and these are available on request.

12 COMPLIANCE WITH REGULATIONS

12.1 Licensees shall ascertain and comply with all statutory legislation, regulations, instruments and byelaws pertaining to their business, including (but not limited to) the Health & Safety at Work etc. Act, Employment legislation and Hygiene and Food Safety legislation. Licensees shall ensure all their staff, servants and agents acting upon their behalf complies with same.

12.2 Licensees shall comply with any fresh food operating guide and health & safety guide issued by the Council and shall afford full co-operation with duly authorised environmental health and/or food safety officers and trading standards officers.

12.3 Licensees should not do anything which causes any obstruction in or damage to any sink, drain, sewer, gutter, gully, pipe, channel, watercourse or duct in the Stall or in the Market, nor discharge therein any oil or grease or any deleterious, objectionable, dangerous, poisonous or explosive matter or substance and in the event of such an act, the Council reserves the right to levy the cost of repair, clearance or replacement of the same against the Licensee which shall be payable immediately.

12.4 Licensees should not interfere with or obstruct or attach anything to any ducting, sprinkler pipes, drainage pipes, wiring or conduits and not without the consent in writing of the Market Management to interfere with or obstruct or attach anything to:

any pillar or support of the Market located within the Stall, or any part of the external structure of the Stall and not to interfere with or

obstruct or attach anything to the internal structure of the stall.

12.5 Licensees must comply with all directions issued by the Council or their nominated representatives.

12.6 The Licensee shall not place or leave anything in the Market Common Parts or otherwise obstruct them and will indemnify the Council against any damage or injury that may arise by reason of the Licensee’s breach of these covenants including but not limited to the costs of the removal of the obstruction.

12.7 The Licensee should notify the Market Management of any defect in or want of repair to the Stall, which does or might reasonably give rise to an obligation or duty on the part of the Council.

12.8 Smoking is not permitted on any part of the Idlewells Shopping Centre property (including the market) or in the Service Yards. This includes the use of e-cigarettes.

13 SERVICING AND DELIVERIES

13.1 The Market may only be serviced from Service Yard D, accessed off Market Street. The service entrance and yard is common area for the Idlewells Shopping Centre and is managed by them. The Service Yard is for the use of vehicles delivering or collecting goods only and should not be obstructed in any way. Delivery vehicles must only be parked in the service yard for so long as is necessary to load or unload deliveries.

13.2 Should it be necessary to leave delivery vehicles unattended, the vehicle must display a clear indication of the driver’s location. The driver must never leave his vehicle and go off site.

13.3 The parking of private cars and goods vehicles is not permitted in the service entrance and yard. Vehicles which are so parked will be liable to incur a fine from the Idlewells Shopping Centre and would also be a breach of these regulations.

13.4 The use of naked lights or the transfer of fuel is expressly prohibited anywhere within the loading bay area for fire safety reasons.

14 GENERAL REQUIREMENTS

14.1 Licensees shall clearly display on their Stall(s) a sign indicating their name, stall number and business address in clearly legible letters no less than 50mm high.

14.2 The Licensee will not store or sell from the Stall any combustible materials without the prior written permission of the Council whose consent may be withheld or granted subject to appropriate conditions. The Licensee must provide a written fire risk assessment in relation to the combustible materials, their storage and their sale, which will be reviewed at least annually.

14.3 No animals or birds shall be brought into the Market.

14.4 Stalls and displays shall be presented in a clean and tidy manner.

14.5 Licensees shall be neatly dressed and well presented.

14.6 Licensees and their staff shall be polite and courteous to all members of the public, Council staff, Market Management and other Licensees at all times. Licensees shall not use or allow to be used any part of the stall so as to cause annoyance, nuisance or inconvenience to the occupiers of other stalls or users of the Market.

14.7 Licensees and their staff shall take reasonable and proper care in the use of all communal fittings apparatus and facilities, including preparation room(s),

loading bays(s) refuse disposal facilities, toilets and wash hand basins and leave them clean and tidy after use.

14.8 Music or musical instruments shall not be played except at the absolute discretion of the Council and subject to such conditions as the Council deems appropriate, and whose consent may be withdrawn at any time.

14.9 Licensees shall not display any product or literature that in the opinion and at the sole discretion of the Council is offensive or obscene or likely to cause offence. Any direction to remove same shall be complied with immediately.

14.10 Licensees shall not bring or sell or consume alcohol anywhere on the premises

14.11 Licensees shall not install heating apparatus of any kind except with the express prior written consent of the Council and subject to any conditions the Council may impose, which permission may be withdrawn at any time.

14.12 Licensees shall store refuse and waste in a hygienic container within their stall during trading hours and remove same to the communal refuse disposal point and empty their containers in to the most appropriate waste bins.

14.13 After close of trading all stalls shall be thoroughly cleansed and any perishable stock shall be removed from open display into refrigerated overnight storage, or otherwise protected against contamination.

15 TERMINATION OF THE LICENCE

15.1 The Licence may be terminated in a number of ways:

At the expiry of six months’ notice given by either party to the other, or At the expiry of a termination notice served by the Council for a breach

of the licence conditions, or Immediately if the Council or the Idlewells Shopping Centre determine

that it is not practical to open the market or parts of the market for reasons of safety, damage or it is need of repair, or

Immediately if the Idlewells Shopping Centre issue a termination notice to the Council relating to the Market.

15.2 On termination of the Licence the Licensee must remove all of their property; including goods, signage, fixtures and fittings, and make good any alterations made to the stall and undertake all necessary repairs, leaving the stall in good condition.

15.3 At the end of the Licence Period (however the Licence is terminated) the Licensee must ensure that all monies owing to the Council are paid. The Licensee must return all keys and alarm codes for the property to the Council and give vacant possession.

15.4 If the Licensee fails to restore the stall to a good condition the Council may take such steps to refurbish the stall as is reasonable. Such works will become a debt owing to the Council and shall be paid by the Licensee on demand.

15.5 If at the end of the Licence Period any property of the Licensee remains on the stall, the Council may remove it to a safe place. If the Licensee has not collected the property within 14 days such property shall belong to the Council who may sell it and retain the proceeds and the Licensee shall have no interest in such proceeds.

16 GRIEVANCE PROCEDURE

16.1 In the event of a grievance between Licensees or with the Council, the Licensee must contact the Market Management in writing outlining the issue.

16.2 The Market Management will gather relevant facts regarding the cause of the grievance and hold meetings with the parties involved.

16.3 When all of the available facts have been obtained the Market Management will suggest a course of action to resolve the grievance. The action will be issued in writing to each party.

16.4 If required and within 7 working days the Market Management will hold follow up discussions with each party to confirm the course of action is working.

16.5 If the complainant does not agree with the decision they have 14 working days to appeal the findings in writing to a more senior Council Officer for review.

16.6 The senior Council Officer will investigate and issue their findings in writing to the complainant. This decision will be final.

17 FIRE ALARM AND EVACUATION PROCEDURES

17.1 Licensees shall comply with all practice drills and ensure all aisles and escape routes are kept clear of stock and obstructions at all times.

17.2 Licensees shall not interfere with or obscure any fire detection devices, sprinkler heads or escape doors.

17.3 Licensees shall familiarise themselves with the Market fire alarm and emergency evacuation procedures and ensure their staff are likewise instructed.

17.4 The Market and the stalls are covered by an Automatic Fire Detection and alarm system. The AFD system remains live at all times and operates automatically. Handheld extinguisher within a catering stall remains the Licensees responsibility with certification made available upon request.

SUTTON INDOOR MARKETS/ IDLEWELLS SHOPPING CENTRE / DEVONSHIRE SUITE

TRADERS, THEIR EMPLOYEES AND CONTRACTORS GUIDE TO FIRE PROCEDURES

1. The FIRE PLAN has been devised with the main aim of:

A. PROTECTING LIFEB. DIRECTING THE PUBLIC AND STAFF AWAY FROM THE SCENE OF

THE FIRE/INCIDENT IN A SAFE MANNERC. ASSISTING THE EMERGENCY SERVICES

2. FIRE ALARM SYSTEM

A. The fire alarm installed within the Market Hall, Idlewells Shopping Centre and the Devonshire Suite is continuously monitored from the Idlewells Security Control Room, located in the Devonshire Suite, and automatically monitored via a telephone line to a central monitoring station.

B. The system consists of heat and smoke detectors, and call points.

C. The operation of any detector or call point initiates sounders within the Market Hall.

In the Idlewells Centre, Sounders will ring in the shop units, office or area where the fire is detected and the following message is relayed to all common areas via the PA system.

Evacuation of the entire Centre (shops, public areas, Indoor Market, Devonshire offices, car parks and plant rooms) must be implemented

immediately by all traders and Centre staff.

3. FIRE AND EVACUATION PROCEDURE

A. The Fire Services will always arrive at the Devonshire Mall entrance and then will be directed by the Centre staff to the location of the fire. Centre staff maintain radio contact so that all available information is relayed to the Fire Services immediately when they arrive on site.

B. Evacuation procedures will necessitate co-operation between occupiers and Centre staff. In the interests of efficiency and public safety, shop and office managers are asked to designate specific personnel who will act as Marshals in the event of an evacuation. Marshals will ensure that, once cleared from the shop/office premises, members of the public are directed calmly but promptly to the main exits before directing their own staff to the correct Assembly Point.

C. Each trader must ensure that their own staff are familiar with escape routes from the Market Hall and the Centre as well as from their own premises and should undertake suitable training.

4. FIRE EVACUATION BY AREAS

A. Low Mall and adjoining shops.

Evacuate public via Low Street entrance and via Forest Mall.

B. Market Hall, Devonshire Mall and adjoining shops.

Evacuate public via Devonshire Mall entrance and via public toilets exit into Service Yard D. Or via Market Street Fire Exits onto Service Yard D

C. Forest Mall and adjoining shops.

Evacuate public via Forest Mall entrance to Forest Street and, if necessary, via Low Mall to Low Street.

D. Central Square

Evacuate public by most suitable Mall, ideally Devonshire Mall.

E. Devonshire Suite

Evacuate public and staff by the most suitable exit:

a. Fire Exit at rear of Devonshire Suite leading to Level Two of the multi-storey car park and Market Street.

b. Fire exit by Gents toilets leading to Fire Escape in Service Yard D.c. Out of hours staff entrance, bottom of main stairs leading to Service Yard

5. ROLL CALL MEASURES

A. Roll call measures will be required after evacuation is complete.

The Markets Manager or designated representative must report to the Centre Manager or his deputy at Assembly Point “Echo”, corner of Devonshire Square (bus station) and Forest Street and confirm that their premises are cleared of all persons.

B. Following an evacuation, NO PERSON WILL BE ALLOWED TO RETURN TO THE CENTRE UNTIL THE ALL-CLEAR HAS BEEN GIVEN BY THE CENTRE MANAGER OR HIS DEPUTY, IN CONSULTATION WITH THE FIRE OFFICER IN CHARGE. Initially only Traders and their staff will be allowed to re-enter. When all shops or offices are seen to be either manned or secure, only then will the public be readmitted.

6. ASSEMBLY POINTS

All members of staff and the public should be kept at a safe distance away from the exits and entrances.

REMOTE CONTINGENCY EVACUATION ASSEMBLY POINT

The secondary assembly point can be reached by heading from Portland Square up Forest Street and onto Station Road. Sutton Lawn is located on the left hand side after the turning for Albion Road.

7. GENERAL

Fire escape routes should be kept free of obstructions at all times, both within the Market Hall and within individual Traders units. All Traders should be alert to the dangers of obstructed fire escapes and should always take action to have obstructions removed.

8. ALL ALARMS MUST BE TREATED AS EMERGENCY SITUATIONS AND EVACUATION PROCEDURES ADOPTED IMMEDIATELY UNLESS PRIOR NOTIFICATION HAS BEEN ISSUED.

9. NEVER DELAY EVACUATION AND DO NOT ATTEMPT TO RE-ENTER THE BUILDING UNTIL NOTIFIED THAT IT IS SAFE TO DO SO.

10. IN THE EVENT OF AN ALARM YOU WILL BE GIVEN ESSENTIAL INFORMATION AS QUICKLY AS POSSIBLE. DO NOT ATTEMPT TO TELEPHONE FOR DETAILS.

18 BOMB WARNINGS

18.1 In the event of a bomb threat to the Idlewells Centre, the Centre management will initiate the Bomb Warning Procedure. This procedure will include

18.2 Informing the police Informing the Fire Service (if necessary) Informing shop tenants, and Initiating a coordinated search of the public and common areas.

18.3 It is not the policy of the Centre Management to immediately evacuate the Centre upon receipt of a bomb threat. The policy is to commence a low key systematic search of the Centre, but this will be decided by the manner and tone in which the threat was received.

18.4 When carrying out a search of the market and stalls, all people participating in the search procedure should on no account touch any suspicious object and should be particularly alert to ant shopping bag, trolley or packages.

18.5 The Police or Centre Management must be advised of any suspicious object immediately.
