  • Contractors License Board Minutes of the July 27, 2012 Meeting Page 2 Call to Order: There being a quorum present, Vice Chairperson Lau called the meeting

    to order at 8:37 a.m. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

    Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

    Introductions: Executive Officer Oda introduced and welcomed two new industry Board

    members, Tyrus Kagawa and Kent Matsuzaki. Jo Ann Uchida Takeuchi, Deputy Director of DCCA, also was introduced.

    Deputy Director Takeuchi thanked the Board members for their commitment and willingness to serve on the Board.

    She also stated that last year an orientation for all board chairpersons

    was held where they heard from various agencies, such as OIP, Office of the Attorney General, RICO, and the Ethics Commission. Because it was successful, they want to repeat it again this year and open it to all board members. An exact date has not been set.

    Minutes: Mr. Suehiro pointed out amendments he wished to make to the June 29,

    2012 minutes as follows: Page 7, third paragraph, first sentence with deletions bracketed

    and amendments underlined: “Sam Spencer of Operating Engineers #3, [and] Peter

    Ganaban, Hawaii Laborers Union, and Rodney Capello of Hawaii Electrical Workers voiced their opinion in support of GBI that the “A” is allowed to do this type of work.”

    Page 7, fifth paragraph, replace the second sentence with: “Mr. Suehiro asked whether the county enforces state

    laws. Deputy Attorney General Tam responded that the County does not enforce chapter 444, HRS.”

    It was then moved by Mr. Yamada, seconded by Mr. Lee, and unanimously carried to approve the June 29, 2012 meeting minutes with the above amendments, and executive session minutes as circulated.

    Amendments to Agenda: It was moved by Mr. Suehiro, seconded by Mr. Polischeck, and

Deputy Attorney General Tam explained the differences between

    settlement agreements and recommended orders to the new Board members.

    1. Settlement Agreements

    a. In the Matter of the Contractor’s License of Dale Maron,

    doing business as Dreamland Builders; CLB 2011-129-L

    RICO received a complaint alleging that Dale Maron (“Respondent”) performed poor workmanship on complainant’s residence project, and RICO alleges that Respondent failed to include the requisite contractual provisions, including but not limited to bond and lien rights, and performed work outside the scope of his “B” classification.

    The Board discussed the settlement agreement in which

    Respondent, who does not admit to violating any law or rule, agrees to pay an administrative fine of $1,500.00.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Mochida, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

    b. In the Matter of the Contractors’ Licenses of Helix Electric,

    Inc. and Robert D. Johnson; CLB 2010-500L and CLB 2011-316-L

    RICO received a complaint alleging that Helix Electric, Inc. and Robert D. Johnson (“Respondents”) failed to follow licensing laws

    related to responsible managing employees (Respondent Johnson was not in residence in Hawaii while projects were under construction in Hawaii; contracts were not signed or initialed by Respondent Johnson; and employees were not licensed electricians at the time the work was being performed). Contract prices exceeded $1,000,000.00.

    The Board discussed the settlement agreement in which

    Respondents, who do not admit to violating any law or rule, agree to pay, jointly and severally, a fine in the amount of $87,000.00.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Yamada, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

    2. Board’s Final Orders

    a. In the Matter of the Contractors’ Licenses of Hawaii

    Vertical Transportation, Inc.; Michael K. Tomihara; CLB 2010-366-L

    In November 2011 a petition for disciplinary action was filed against Hawaii Vertical Transportation, Inc. and Michael K. Tomihara (“Respondents”). A hearing was held on April 18, 2012 but Respondents did not appear at the hearing. Respondents, licensed in the C-16 Elevator specialty classification, contracted with the Association of Apartment Owners of Windward Passage (“AOAO”) to perform elevator work at the Windward Passage in Kailua, Hawaii. The AOAO paid Respondents $130,351.46, but two years later the AOAO did not want the elevator modernization work to start until the proposed elevator equipment was installed, tested, and proven at other sites. Hawaii Vertical obtained a performance bond for the project, and placed the $130,351.46 deposit into an escrow account. However, in the meantime, the Internal Revenue Service had taken the AOAO’s deposit to satisfy Hawaii Vertical’s tax obligations, and the money was not available to place in an escrow account. Respondent Michael Tomihara promised to repay said fund and that he would use his personal funds for the repayment if necessary. The president and CEO of Hawaii Vertical filed for personal bankruptcy and included the AOAO and amount paid by the AOAO on her list of creditors.

    The Hearings Officer found that Respondent Hawaii Vertical failed to perform any work on the project or repay the $130,351.46 to the AOAO, or place said funds in an escrow account to be used for payment of the project, which constitutes a violation of HRS sections 444-17(3) and 444-17(13). The Hearings Officer did not find sufficient evidence to support the charge of dishonest, fraudulent, or deceitful acts within the terms of HRS Section 444-17(1). There was no evidence that Mr. Tomihara knew that Hawaii Vertical promised to replenish the escrow account, and there was no evidence that the AOAO took any action, or refrained from any action, on account of any dishonest, fraudulent, or deceitful acts in connection with their meeting when the funds were placed in the escrow account. Under the circumstances and because the funds were originally deposited in an escrow account until seized by the Internal Revenue Service, the Hearings Officer recommended that Hawaii Vertical Transportation, Inc.’s license be revoked and restitution in the sum of $130,351.46, including interest at the statutory rate from December 1, 2006, be paid by Hawaii Vertical Transportation, Inc. to the AOAO. After discussion, it was moved by Mr. Lee, seconded by Mr. Suehiro, and unanimously carried to approve the recommended order as the Board’s Final Order for the above case. b. Tevita S. Lauaki aka Joe Lauaki Uilani’s Custom Masonry & Design aka Stonecrete Hawaii Contractors LLC CLB 2009-385-L On February 24, 2012, the Board issued a Final Order revoking Tevita S. Lauaki and Uilani’s Custom Masonry & Design’s licenses, and ordered payment of a $5,000 fine and $5,750 in restitution for failure to make required disclosures in the homeowner contract, failure to notify the Board of three judgments against them, and engaging in an unfair or deceptive act. On June 19, 2012, Mr. Lauaki submitted a letter to the Board requesting reconsideration of the Board’s Final Order. He stated that he was not aware of the hearing because he was in Tonga, and he disputed the allegation that he did not complete the project and offered explanations for the judgments against him. He is willing to pay the fine and restitution and requests that the Board rescind the revocation of the licenses. Mr. Lauaki stated that he was not able to appear at the Board’s June 2012 meeting. He stated that he has completed the contract

    with the complainant, and called RICO regarding his willingness to pay an outstanding civil fine of $11,800 and restitution of $13,000, but RICO had told him to wait until after he appeared before the Board. After discussion, it was moved by Mr. Lee, seconded by Mr. Suehiro, and unanimously carried to deny Mr. Lauaki’s request for reconsideration of the Board’s previous Final Order revoking Respondent’s licenses.

    Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Vice Chairperson Lau announced that the Board was reconvening to its open meeting at 8:59 a.m.

Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 9:20 a.m., it was moved by Mr. Suehiro, seconded by Mr. Yamada,

    and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Polischeck,

    and unanimously carried to defer Mr. Scott’s application in the “A” classification pending submittal of a project list showing only “A” work.

    The Board explained that he should list broad “A” experience and projects

    that he supervised his own workers (i.e., not subcontractors).

    b. Randy D. Broz, RME Eagle Eye Electric Inc. C-13 Electrical

    Mr. Polischeck, and unanimously carried to defer Mr. Broz’s application in the C-13 classification pending submittal of a list detailing his additional C-13 projects.

    packet. The Committee Reports were taken out of order. 4. Rules Committee:

    None. 5. Investigation Committee: None. 6. Scope of Activity Committee: Gerald Yamada, Chairperson

    Utility Partners of America Utility Partners of America (“UPA”) requests determination that a C-13 Electrical contractor license is not required to perform meter exchanges. On April 24, 2012, they received an informal opinion from the Board of Electricians and Plumbers that meter exchanges do not require a licensed journey worker based on the description provided and assurances that no electrical wiring will be performed, and that Kauai Island Utility Cooperative (“KIUC”) will perform any necessary repairs identified by a UPA technician. Since then, UPA has safely removed and replaced more than 8,000 electric meters. Executive Officer Oda stated that UPA submitted a video for the Board’s review, and Dana Hanson of UPA was here to answer any questions. Mr. Hanson stated that he did not think UPA had a contractor’s license in other states, but will follow up and let the Board know. He stated that UPA only does meter exchange work. Peter Akamu stated that he was speaking as a Board member of the Board of Electricians and Plumbers, and at their last meeting, they had a discussion on whether the correct decision was made to allow UPA to install the meters without licensed electricians. The Board of Electricians and Plumbers will discuss this further at their next meeting.

    Recess: Vice Chairperson Lau called for a short recess at 10:51 a.m. while the video was being set up.

Utility Partners of America” to allow the Board members to view the video on the installation of the smart meters. Dana Hanson stated that he did get clarification from his boss that they do not have contractor licenses in other states, but they do have the electrician’s license in some states where wiring is involved rather than just smart meter installations. Recommendation: The Board confirmed its previous determination that the C-13 Electrical contractor’s license is required to perform the meter exchange work.

    Waterproofing Contractors, Inc. Waterproofing Contractors, Inc. requests clarification on whether the

    following work may be performed under the C-55 Waterproofing classification:

    Repairing wall surfaces, applying waterproofing membranes to

    planters and lanai surfaces, and cleaning and coating the exterior wall surfaces to provide a waterproof envelope for the buildings. Materials used are high acrylic solids content coatings (Sto Corp’s “Lotusan” and “Acryl Plus”). Both products are High Performance Weatherproofing Coatings with well over 50% solids by volume.

    Recommendation: The C-33 Painting and decorating license

    classification is required to perform the above work. Pac Build Pac Build requests determination on whether a “B” General Building

    contractor may bid on and perform a condominium project involving the removal of 10 kitchen countertops and 14 bathroom vanity countertops, and replacing them with prefabricated granite kitchen countertops.

    Recommendation: The “B” General Building contractor may bid on and

    perform the above work. Phone Inquiry A contractor holding the “B” General Building, C-31a Cement concrete,

    C-33 Painting and decorating, and C-55 Waterproofing classifications will be painting the exterior of a high-rise condo. Can this contractor also replace the rubber seal around the windows? Seals will be placed only on the exterior side, and are not part of the surface preparation work for the painting.

    The Board deferred this item for more information before a determination

    Committee Reports: 3. Legislation Committee: Executive Officer Oda stated that two bills passed and became Acts as

    follows: Act 244 – effective July 1, 2012. This Act added the following

    unlicensed contractor offenses to the Hawaii Penal Code: Unlicensed contracting is classified as a misdemeanor. Habitual unlicensed contracting activity (two or more

    convictions within ten years) is a Class C felony. Unlicensed contractor fraud (obtains or controls money

    or property by deception with intent to deprive) in the first degree (value of money or property is $20,000 or more) is a Class B felony; in the second degree (value of money or property is less than $20,000) is a Class C felony.

    Act 260 – effective July 1, 2012. This Act requires subcontractors

    to be paid within ten days after the contractor receives an invoice from the subcontractor, and receives payment from the owner, if the subcontractor’s work is found to be complete and there is no bona fide dispute concerning the subcontractor’s goods or services. The subcontractor is entitled to interest on the unpaid amount at the rate of one and one-half per cent per month from the date payment is due. These requirements do not apply to public work projects.
