COPYRIGHT AND FAIR USE GUIDELINES FOR STUDENTS

Copyright is a law of the U.S. that protects any work or intellectual property from being used without consent or permission. There is an exception to this law called “fair use”.

FAIR USE refers to a set of guidelines that allows teachers and students to use pieces or parts of another person’s work with permission.Four factors determining fair use

Works that are

considered copyright

protected are writings from

books or magazines,

poems, photos or drawings,

videos, and music, just to name a few.

The GUIDELINES below are for using another person’s work in your classroom presentation,

project, report, or movie:

POEMS

Up to 250 words (or the entire poem if it is less than 250 words• Up to 1000

words, but not more than 10% of the book or article.

SECTIONS FROM BOOKS OR MAGAZINES

POEMS

ROSES ARE RED…

• Up to 250 words (or entire poem if it is less than 250 words)

• No more than 3 poems by the same poet

• No more than 5 poems from the collection of poetry

PHOTOGRAPHS OR DRAWINGS• Up to 5 graphics or

photos from the same person

• No more than 15 images from the same collection

• Images can not be changed

VIDEO

• Up to 3 minutes but no more than 10% of the entire video

• The Video clip may not be changed in any way

MUSIC• Up to 30

seconds but no more than 10% of sheet music

• Up to 30 seconds but not more than 10% of recordings

• The music can not be changed in any way

Fair Use is tricky, just remember: • Use only small pieces of another person’s work and

only use what is necessary.

• Use the work only for personal and educational purposes.

• Do not make a copy of the work and distribute to the masses.

• Do not use the work if it adversely affects the commercial potential of the work.

• Make sure the work is a legally-obtained version.

• If your not sure if the work is legal, get permission from the owner.

REMEMBER, you do not need to get permission

if you follow the fair use guidelines, but always give credit

where credit is due, use a bibliography to cite your source(s).
