The Mayor then c a l l e d on Miss Anna Banana t o speak b r i e f l y t o the Counci l concerning t h e Banana Olympics. She thanked Counci l f o r t h e support g iven by Counci l f o r these Olympics. She a lso s ta ted t h a t "A Proxy" was look ing f o r a pa r tne r f o r t h e Olympics and "A Proxy" was a costume t o be worn du r ing the Olympics. Olympics are a p u b l i c p a r t i c i p a t i o n event. They w i l l take p lace on J u l y 13th and they are asking as many people as poss ib le t o take p a r t i n them. E. MAYOR'S REPORT:

1. The Mayor s ta ted t h a t the Specia l Committee t h a t had been es tab l i shed t o deal w i t h M r . Conway o f Rian Developments Ltd. and h i s request f o r a d d i t i o n a l reimbursement dea l i ng w i t h cos t shar ing on the rea l ignment of 24th Avenue i n the v i c i n i t y o f 142nd St ree t , t h e Specia l Committee had met w i t h M r . Conway and o thers l a s t week and discussed the mat te r i n d e t a i l w i t h him. He c a l l e d on Alderman Bose as Chairman o f t he Committee, t o r e p o r t on t h i s mat ter .

2. The Mayor s ta ted he wished t o read the following report dealing with the recent discussion tha t had been held in Council dealing with the issuance o f a building permit t o Artex Fabricators Limited on the basis of an instruct ion issued by Alderman Schrenk when she was Acting Mayor:

MAYOR'S REPORT - July 7 , 1980

Over the past few weeks, the composure of our Council has been rankled needlessly by actions tha t were not conducive t o the good government of t h i s Municipality.

In his memorandum of June 1 7 t h , the Municipal So l i c i to r s t a t e s :

" i t is improper f o r a member of Council t o spec i f ica l ly d i r ec t an of f icer or employee of t h i s Corporation t o do o r not t o do something unless the member of Council i s acting on behalf of the whole of Council and has been delegated tha t respons ib i l i ty by resolution properly moved and passed."

In the Municipal S o l i c i t o r ' s report of June 23rd, question #13 s t a t e s :

"13. I s i t mandatory for the Chief Inspector t o re fer a l l applications fo r building permits t o the Advisory Design Panel? The answer i s yes."

Alderman Schrenk, without a d o u b t , superseded Council Policy i n her d i rec t ive of June 6th authorizing the issuance of a building permit.

The Municipal So l i c i to r , in his report of June 1 7 t h re position of Deputy Mayor paragraph numbered 4 s ta tes :

"There i s no provision in the Municipal Act fo r the appointment of a member of Council as a Deputy Mayor."

There never was any d o u b t in my mind tha t t h i s was so. Schrenk objected to being labelled Acting Mayor because of the thea t r ica l connotations and wished t o use the term "Deputy Mayor". To me i t was a matter of semantics and, over the objections of our Clerk, I made no e f f o r t t o intervene.

I am convinced tha t Alderman Schrenk was not acting on the Mayor's behalf or Council 's behalf when she issued the direct ive of June 6th t o the Permits and Licenses Department.

I am certain tha t every member of Council knows t h a t Section 170 does not take e f fec t unless the Mayor cannot be reached by telephone and i s not w i t h i n easy reach of the Municipal Hall. I was readily available by telephone d u r i n g the morning on June 6 t h and I was i n the Mayor's o f f ice a l l afternoon. Alderman Schrenk mistakenly addressed her direct ive t o Permits and Licenses as Deputy Mayor when she was not actually serving i n tha t capacity. I may well have recommended a motion of censor b u t t h a t was done i n a more posit ive way last week when Council voted t o disassociate i t s e l f from statements made i n the newspaper and reaffirm i t s confidence and s u p p o r t of the Advisory Design Panel.

I hope we have a l l learned from the experiences of the p a s t few weeks. Who was most affected? - Most of the mud f e l l on innocent volunteers who d i l igent ly contribute the i r expertise t o a panel that has imneasurably improved the q u a l i t y and beauty of our Commercial and Industrial communities for the past ten years.

All over t h i s municipality this 1980 Council i s being touted as the best ever - as a sensible group t h a t gets things done. I urge you t o show your matuirty and p u t this matter behind us as a lesson learned. Much of the legal advice we have received can help us be a bet ter Council w i t h a c learer understanding of our duties and roles. Let ' s get back t o the task a t hand and represent the people that elected us t o run t h i s Municipality as responsibly and in te l l igent ly as we possibly can.

Alderman Schrenk then stated she wished to make the f o l l o w i n g comnents i n regard t o the report made by the Mayor on t h i s matter. She stated that when she had been appointed Acting Mayor l a s t November u n t i l June 30th, she understood t h a t she was Acting Mayor each morning while i n the Mayor's office. action she had taken on issuing the direct ive t o the Permits & Licenses Department t o issue a building permit for Artex Fabricators L t d . was correct and i n order. She stated t h a t no p lans had been attached t o the rezoning By-law for Artex Fabricators' L t d . property. She claimed t h a t the Municipality w o u l d be open t o a law s u i t if the permit had not been issued. She referred t o the duties of the Mayor as outlined i n the Municipal Act. checked w i t h the B u i l d i n g Department t o see i f the plans were i n order for the permit to be issued. She was advised t h a t they were i n order provided the Development Cost Charges were p a i d . She also referred t o the policy dealing w i t h the Advisory Design Panel. She stated t h a t under th i s policy the Design Panel i s not t o delay the issuance of any b u i l d i n g permits. tha t had been heard i n Court where damages had been awarded because of the w i t h h o l d i n g of b u i l d i n g permits. She also made reference to the report of the Sol ic i tor on the various sections of the Act. claimed she had met a l l the requirements of the Municipal Act and had not abused her powers of Acting Mayor. Any discussion regarding LRT fo r the region must be pursued cautiously and w i t h o u t prejudice t o our ultimate decision whether we wil l support such a project. Before agreeing t o s u p p o r t any alignment fo r LRT we must know very c lear ly what physically is involved and how the project will be financed. The Fire Chief was not recommending closure of t h i s road. A t r a f f i c count had been taken on t h i s section of 2nd Avenue in ear ly June and the t r a f f i c could not be considered as excessive. The Engineer was recommending tha t 2nd Avenue, however, between 172nd S t ree t and 176th S t ree t be designated and posted as a "no heavy truck" route. The Engineer a lso recomnended tha t the R.C.M.P. be forwarded a copy of the pe t i t ion f o r t h e i r action b u t t ha t the road not be closed t o t h r o u g h t r a f f i c .

The Ministry of Highways has advised tha t the raised medians on the King George Highway in t h i s area will be capped with asphalt and not provide for future landscaping. The revised estimated cost of landscaping i s now $106,000.00. The Ministry 's share i s t o be 35% or $23,000.00. The Manager submitted a report from the Engineer dealing with the Interconnection between the New Whalley Pump Stat ion and the Hjor th Road Main.

In October, 1979, the Greater Vancouver Water D i s t r i c t had transferred the Hjorth Road t r u n k main from Pat tu l lo Bridge t o a point near the Whalley Reservoir t o Surrey, b u t had kept a portion of i t f o r t h e i r own use. The Water D i s t r i c t has now agreed t o t ransfer the remaining of t h i s water main t r u n k t o the Municipality. The Water D i s t r i c t , in exchange, has only requested a small right-of-way fo r an i n l e t main t o t h e i r future reservoir.

The Manager, in order t o preserve these unique features , was recommending as follows:-

There i s a ravine th rough the property b u t there i s a f a i r amount o f land t o the east of the ravine tha t could be used f o r industr ia l purposes. Deputy Planner was therefore recommending tha t the Council approve o f t h i s application.

Mrs. Joan Smallwood of 6354 - 184th Street and Mr. Schneider of the Surrey Organization f o r Nuclear Awareness were present in regard t o the recent submission of Mr. Wenman, M.P., t o Council on t h i s matter of a i r r a i d s i rens and a possible nuclear attack. Mrs. Smallwood stated they were present t o counter the information given by Mr. Wenman t o the Council. She referred t o the a r t i c l e t h a t had been submitted t o Council for t he i r information which was an a r t i c l e by Daniel Ellsberg dealing with nuclear weapons. She also referred t o a book tha t had been supplied to members o f Council t h a t had been written by a pediatrician dealing with the e f fec ts t h a t a nuclear bomb would have on the population. Mrs. Smallwood stated that Council's e f fo r t s should be directed towards disarmament rather t h a n through the provision of a i r raid shel ters in case there i s an attack with nuclear weapons.

Mr. Schneider read two pages from the pedia t r ic ian ' s book fo r Council's information. He stated t h a t Council should take every action t o avoid any poss ib i l i ty of a nuclear war occurring. stated t h a t the City Council of New Westminster had voted recently t o support a world wide referendum on disarmament. t h a t Surrey pass a similar resolution and forward i t on t o the Prime Minister.
