    CHAPTERI

    Preliminary

    1.Shorttitleandextent:-(1)ThisActmaybecalledthePreventionofCorruptionAct,1988.

    2)ItextendstothewholeofIndiaexcepttheStateofJammu&KashmiranditappliesalsotoallCitizensofIndiaoutsideIndia.

    2.Definitions:-InthisAct,unlessthecontextotherwiserequires.-

    (a)Electionmeansanyelection,bywhatevermeansheldunderanylawforthepurposeofselectingmembersofParliamentoranyLegislature,localauthorityorotherpublicauthority;

    (b)PublicDutymeansadutyinthedischargeofwhichtheState,thepublicorthecommunityatlargehasaninterest;

    Explanation,-InthisclauseStateincludesaCorporationestablishedbyorunderaCentral,ProvincialorStateAct,oranauthorityorabodyownedorcontrolledoraidedbytheGovernmentoraGovernmentcompanyasdefinedinSection617oftheCompaniesAct,1956(1of1956);

    (c)PublicServantmeans.-

    (i)anypersonintheserviceorpayoftheGovernmentorremuneratedbytheGovernmentbyfeesorcommissionfortheperformanceofanypublicduty;

    (ii)anypersonintheserviceorpayofalocalauthority;

    (ix)anypersonwhoisthepresident,Secretaryorofotherofficebearerofaregisteredco-operativesocietyengagedinagriculture,industry,tradeorban ing,receivingorhavingreceivedanyfinancialaidfromtheCentralGovernmentoraStateGovernmentorfromanyCorporationestablishedbyorunderaCentral,provincialorStateAct,oranyauthorityorbodyownedorcontrolledoraidedbytheGovernmentoraGovernmentCompanyasdefinedinSection617oftheCompan

    iesAct,1956(1of1956);

    (x)anypersonwhoisaChairman,memberoremployeeofanyServiceCommissionorBoard,bywhatevernamecalled,oramemberofanyselectioncommitteeappointedbysuchCommissionorBoardfortheconductofanyexaminationorma inganyselectiononbehalfofsuchCommissionorBoard;

    (xi)anypersonwhoisaVice-Chancellorormemberofanygoverningbody,professor,reader,lectureroranyotherteacheroremployee,bywhateverdesignationcalled,ofanyUniversityandanypersonwhoseserviceshavebeenavailedofbyaUniversityoranyotherpublicauthorityinconnectionwithholdingorconductingexaminations;

    (xii)anypersonwhoisanofficebeareroranemployeeofaneducational,scientific,social,culturalorotherinstitution,inwhatevermannerestablished,receivingorhavingreceivedanyfinancialassistancefromtheCentralGovernmentoranyStateGovernmentorlocalorotherpublicauthority.

    3.PowertoappointSpecialJudges.(1)TheCentralGovernmentortheStateGovernmentmay,byNotificationintheOfficialGazetteappointasmanyspecialjudgesasmaybenecessaryforsuchareaorareasorforsuchacaseorgroupofcasesasmaybespecifiedinthenotificationtotrythefollowingoffences,namely.

    (a)anyoffencepunishableunderthisAct,and

    (b)anyconspiracytocommitoranyattempttocommitoranyabetmentofanyoftheoffencesspecifiedinclause(a).

    (2)ApersonshallnotbequalifiedforappointmentasaSpecialJudgeunderthisActunlessheisorhasbeenaSessionsJudgeoranadditionalSessionsJudgeoranassistantSessionsJudgeundertheCodeofCriminalProcedure,1973(2of1974)

    4.CasestriablebySpecialJudges.-(1)NotwithstandinganythingcontainedintheCodeofCriminalProcedure1973(2of1974)orinanyotherLawforthetimebeinginforce,theoffencesspecifiedinsub-section(1)ofSection3shallbetriedbytheSpecialJudgesonly.

    (2)Everyoffencespecifiedinsub-section(1)ofSection3shallbetriedbytheSpecialJudgefortheareawithinwhichitwascommitted,orasthecasemayb

    e,bytheSpecialJudgeappointedforthecase,orwheretherearenospecialjudgesthanoneforsucharea,bysuchoneofthemasmaybespecifiedinthisbehalfbytheCentralGovernment.

    (3)Whentryinganycase,aSpecialJudgemayalsotryanoffence,otherthananoffencespecifiedinSection3,withwhichtheaccusedmay,undertheCodeofCriminalProcedure,1973(2of1974),bechargedatthesametrial.

    (4)NotwithstandinganythingcontainedintheCodeofCriminalProcedure,1973(2of1974),aSpecialJudgeshall,asfaraspracticable,holdthetrialofanoffenceonday-to-daybasis.

    5.ProcedureandpowersofSpecialJudge:-(1)ASpecialJudgemayta ecognizan

    ceofoffenceswithouttheaccusedbeingcommittedtohimfortrialand,intryingtheaccusedperson,shallfollowprocedureprescribedbytheCodeofCriminalProcedure,1973(2of1974),forthetrialofWarrantcasesbytheMagistrates.

    (2)ASpecialJudgemay,withaviewtoobtainingtheevidenceofanypersonsupposedtohavebeendirectlyinindirectlyconcernedin,orprivytoanoffence,tenderapardontosuchpersononconditionofhisma ingafullandtruedisclosureofthewholecircumstanceswithinhis

    nowledgerelatingtotheoffenceandtoeveryotherperson,concerned,whetherasPrincipalorabettor,inthecommissionthereofandanypardonsotenderedshall,forthepurposesofsub-sections(1)to(5)ofSection308oftheCodeofCriminalProcedure,1973(2of1974),bedeemedtohavebeentenderedunderSection307ofthatCode.

    (3)Saveasprovidedinsub/section(1)orsub-section(2),theprovisionsoftheCodeofCriminalProcedure1973(2of1974),shall,sofarastheyarenotinconsistentwiththisActappliedtotheproceedingsbeforeaSpecialJudgeandforthepurposesofthesaidprovisions,thecourtoftheSpecialJudgeshallbedeemedtobeaCourtofSessionsandthepersonsconductingaprosecutionbeforeSpecialJudgeshallbedeemedtobeapublicprosecutor.

    (4)Inparticularandwithoutprejudicetothegeneralityoftheprovisionsconta

    inedinsub-section(3),theprovisionsofsections326and475oftheCodeofCriminalProcedure,1973(2of1974,shallsofarasmaybe,appliedtotheproceedingbeforeaspecialjudgeandforthepurposesofthesaidprovisions,aSpecialJudgeshallbedeemedtobeaMagistrate.

    (5)ASpecialJudgemaypassuponanypersonconvictedbyhimanysentenceauthorizedbylawforthepunishmentoftheoffenceofwhichsuchpersonisconvicted.

    6)ASpecialJudge,whiletryinganoffencepunishableunderthisAct,shallexerciseallthepowersandfunctionsexercisablebyaDistrictJudgeundertheCriminalLawAmendmentOrdinance,1944(Ordinance-38of1944).

    6.PowertotrySummarily.-(1)WhereaSpecialJudgetriesanyoffencespecifiedinsub-section(1)ofSection3,allegedtohavebeencommittedbyaPublicServantinrelationtothecontraventionofanyspecialorderreferredtoinsub-section(1)ofSection12-AoftheEssentialCommoditiesAct1955(10of1955),orofanorderreferredtoinclause(a)ofsub-section(2)ofthatSection,than,notwithstandinganythingcontaininginsub-section(1)ofSection5ofthisActorSection260oftheCodeofCriminalProcedure,1973(2of1974)theSpecialJudgeshalltraytheoffenceinasummaryway,andtheprovisionsofsections262to265(bothinclusive)ofthesaidCodeshallasfarasmaybe,applytosuchtrial.

    Providedthat,inthecaseofanyconvictioninasummarytrialunderthissection,itshallbelawfulfortheSpecialJudgetopassaSentenceofimprisonmentforatermnotexceedingoneyear:

    Providedfurtherthatwhenatthecommencementof,orinthecourseof,asummarytrialunderthisSection,itappearstotheSpecialJudgethatthenatureofthecaseissuchthatasentenceofimprisonmentforatermexceedingoneyearmayhavetobepassedorthatitis,foranyotherreason,undesirabletotrythecasesummarily,theSpecialJudgeshall,afterhearingtheparties,recordanordertothateffectandthereafter,recallanywitnesseswhomayhavebeenexaminedandproceedtohearorrehearthecaseinaccordancewiththepr

    ocedureprescribedbythesaidCodeforthetrialofwarrantcasesbyMagistrates.

    (2)NotwithstandinganythingtothecontrarycontainedinthisActorintheCodeofCriminalProcedure,1973(2of1974),thereshallbenoappealbyaconvictedpersoninanycasetriedsummarilyunderthissectioninwhichtheSpecialJudgepassesasentenceofimprisonmentnotexceedingonemonth,andoffinenotexceedingtwothousandrupeeswhetherornotanyorderunderSection452ofthesaidCodeismadeinadditiontosuchsentence,butasappealshallliewhereanysentenceinexcessoftheaforesaidlimitsispassedbytheSpecialJudge.

    OffencesandPenalties

    7.PublicServantta inggratificationotherthanlegalremunerationinrespectofanofficialact.-Whoever,being,orexpectingtobeapublicservantacceptsorobtainsoragrees,toacceptorattemptstoobtainfromanyperson,forhimselforforanyotherperson,anygratificationwhatever,otherthanlegalremunerationasamotiveorrewardfordoingorforbearingtodoanyofficialactorforshowingorforbearingtoshow,intheexerciseofhisofficialfunctions,favourordisfavourtoanypersonorforrenderingorattemptingtorenderanyserviceordis-servicetoanyperson,withtheCentralGovernmentoranyStateGovernmentorParliamentortheLegislatureofanyStateorwithanylocalauthority,corporationorGovernmentCompanyreferredtoinclause(c)ofSection-2,orwithanypublicservant,whethernamedorotherwise,shallbepunishablewithimprisonmentwhichshallbenotlessthan6monthsbutwhichmayextendto5yearsandshallalsobeliabletofine.

    Explanations.-(a)Expectingtobeapublicservant.Ifapersonnotexpectingtobeinofficeobtainsagratificationbydeceivingothersintoabeliefthatheisabouttobeinofficeandthathewillthenservethem,hemaybeguiltyofcheating,butheisnotguiltyoftheoffencedefinedinthissection.

    (b)Gratification.Thewordgratificationisnotrestrictedtopecuniaryratificationsortogratificationsestimableinmoney.

    (c)Legalremuneration.ThewordsLegalremunerationarenotrestrictedoremunerationwhichapublicservantcanlawfullydemand,butincludeallremunerationwhichheispermittedbytheGovernmentortheOrganization,whichheserves,toaccept.

    (d)Amotiveorrewardfordoing.Apersonwhoreceivesagratificationasamotiveorrewardfordoingwhathedoesnotintendorheisnotinapositiontodo,orhasnotdone,comeswithinthisexpression.

    (e)WhereaPublicServantinducesapersonerroneouslytobelievethathisinfluencewiththeGovernmenthasobtainedatitleforthatpersonandthusinducesthatpersontogivethepublicservant,moneyoranyothergratificatio

    nasarewardforthisservice,thepublicservanthascommittedanoffenceunderthissection.

    8.Ta inggratification,inorder,bycorruptorillegalmeans,toinfluencepublicservant.-Whoeveracceptsorobtains,oragreestoaccept,orattemptstoobtain,fromanyperson,forhimselforforanyotherperson,anygratificationwhateverasamotiveorrewardforinducing,bycorruptorillegalmeans,anypublicservant,whethernamedorotherwise,todoorforbeartodoanyofficialact,orintheexerciseoftheofficialfunctionsofsuchpublicservanttoshowfavourordisfavourtoanyperson,ortorenderorattempttorenderanyserviceordis-servicetoanypersonwiththeCentralGovernmentoranyStateGove

    rnmentorParliamentortheLegislatureofanyStateorwithanylocalauthority,corporationorGovernment,Companyreferredtoinclause(c)ofSection-2,orwithanypublicservant,whethernamedorotherwise,shallbepunishablewithimprisonmentforatermwhichshallbenotlessthansixmonthsbutwhichmayextendtofiveyearsandshallalsobeliabletofine.

    9.Ta inggratification,forexerciseofpersonalinfluencewithpublicservant.-Whoeveracceptsorobtains,oragreestoaccept,orattemptstoobtainfroman

    yperson,forhimselforforanyotherperson,anygratificationwhatever,asamotiveorrewardforinducing,bytheexerciseofpersonalinfluence,anypublicservantwhethernamedorotherwisetodoortoforbeartodoanyofficialact,orintheexerciseoftheofficialfunctionsofsuchpublicservanttoshowfavourordisfavourtoanyperson,ortorenderorattempttorenderanyserviceordisservicetoanypersonwiththeCentralGovernmentoranyStateGovernmentorParliamentortheLegislatureofanyStateorwithanylocalauthority,corporationorGovernmentcompanyreferredtoinclause(c)ofSection2,orwithanypublicservant,whethernamedorotherwise,shallbepunishablewithimprisonmentforatermwhichshallbenotlessthansixmonthsbutwhichmayextendtofiveyearsandshallalsobeliabletofine.

    10.PunishmentforabetmentbypublicservantofoffencesdefinedinSection8or9.-Whoever,beingapublicservant,inrespectofwhom,eitheroftheoffencesdefinedinSection8orSection9iscommitted,abetstheoffence,whetherornotthatoffenceiscommittedinconsequenceofthatabetmentshallbepunishablewithimprisonmentforatermwhichshallbenotlesthansixmonthsbutwhichmayextendtofiveyearsandshallalsobeliabletofine.

    11.Publicservantobtainingvaluablethingwithoutconsiderationfrompersoncon

    cernedinproceedingorbusinesstransactedbysuchpublicservant.-Whoever,beingapublicservant,acceptsorobtainsoragreestoacceptorattemptstoobtainforhimself,orforanyotherperson,anyvaluablethingwithoutconsideration,orforaconsiderationwhichhe nowstobeinadequate,fromanypersonwhomhe nowstohavebeenortobe,ortobeli elytobeconcernedinanyproceedingorbusinesstransacted,orabouttobetransactedbysuchpublicservant,orhavinganyconnectionwiththeofficialfunctionsofhimselforofanypublicservanttowhomheissubordinate,orfromanypersonwhomhe nowstobeinterestedinorrelatedtothepersonsoconcerned,shallbepunishablewithimprisonmentforatermwhichshallbenotlesthansixmonthsbutwhichmayextendtofiveyearsandshallalsobeliabletofine.

    12.PunishmentforabetmentofoffencesdefinedinSection7or11.-WhoeverabetsanyoffencepunishableunderSection7orSection11whetherornotthatoffenceiscommittedinconsequenceofthatabetment,shallbepunishablewithimprisonmentforatermwhichshallbenotlessthatsixmonthsbutwhichmayextendtofiveyearsandshallalsobeliabletofine.

    13.Criminalmisconductbyapublicservant.-(1)Apublicservantissaidtocommittheoffenceofcriminalmisconduct.-

    (a)ifhehabituallyacceptsorobtainsoragreestoacceptorattempts

    toobtainfromanypersonforhimselforforanyotherpersonanygratificationotherthanlegalremunerationasamotiveorrewardsuchasismentionedinSection7;or

    (b)ifhehabituallyacceptsorobtainsoragreestoacceptorattemptstoobtainfromanypersonforhimselforforanyotherperson,anyvaluablethingwithoutconsiderationorforaconsiderationwhichhe

    nowstobeinadequatefromanypersonwhomhe nowstohavebeen,ortobe,ortobeli elytobeconcernedinanyproceedingorbusinesstransactedorabouttobetransactedbyhim,orhavinganyconnectionwiththeofficialfunctionsofhimselforofanypu

    blicservanttowhomheissubordinate,orfromanypersonwhomhe nowstobeinterestedinorrelatedtothepersonsoconcerned;or

    (c)ifhedishonestlyorfraudulentlymisappropriatesorotherwiseconvertsforhisownuseanypropertyentrustedtohimorunderhiscontrolasapublicservantorallowsanyotherpersonsotodo;or

    (d)ifhe.-

    (i)bycorruptorillegalmeans,obtainsforhimselforforanyotherpersonanyvaluablethingorpecuniaryadvantage;or

    (ii)byabusinghispositionasapublicservant,obtainsforhimselforforanyotherpersonanyvaluablethingorpecuniaryadvantage;or

    (iii)whileholdingofficeasapublicservantobtainsforanypersonanyvaluablethingorpecuniaryadvantagewithoutanypublicinterest;or

    (e)ifheoranypersononhisbehalf,isinpossessionorhas,atanytimeduringtheperiodofhisoffice,beeninpossessionforwhichthepublicservantcannotsatisfactorilyaccount,ofpecuniaryresourcesorpropertydisproportionatetohis nownsourcesofincome.

    Explanation:-Forthepurposesofthissection, nownsourcesofincome"meansincomereceivedfromanylawfulsourceandsuchreceipthasbeenintimatedinaccordancewiththeprovisionsofanylaw,rulesorordersforthetimebeingapplicabletoapublicservant.

    (2)Anypublicservant,whocommitscriminalmisconductshallbepunishablewithimprisonmentforatermwhichshallbenotlessthanoneyearbutwhichmayextendto7yearsandshallalsobeliabletofine.

    14.HabitualcommittingofoffenceunderSection8,9and12.-whoeverhabitually

    commits.-

    (a)anoffencepunishableunderSection8orSection9;or

    (b)anoffencepunishableunderSection12

    shallbepunishablewithimprisonmentforatermwhichshallbenotlessthantwoyearsbutwhichmayextendto7yearsandshallalsobeliabletofine.

    15.Punishmentforattempt.-Whoeverattemptstocommitanoffencereferredtoinclause(c)orclause(d)ofsub-section(1)ofSection-13shallbepunishable

    withimprisonmentforatermwhichmayextendto3yearsandwithfine.

    16.Matterstobeta enintoconsiderationforfixingfine.-Whereasentenceoffineisimposedundersub-section(2)ofSection13orSection14,theCourtinfixingtheamountofthefineshallta

    eintoconsiderationtheamountorthevalueoftheproperty,ifany,whichtheaccusedpersonhasobtainedbycommittingtheoffenceorwheretheconvictionisforanoffencereferredtoinclause(e)ofsub-section(1)ofSection-13,thepecuniaryresourcesorpropertyrefer

    redtointhatclauseforwhichtheaccusedpersonisunabletoaccountsatisfactorily.

    CHAPTERIV

    InvestigationintocasesundertheAct

    17.Personsauthorizedtoinvestigate.-NotwithstandinganythingcontainedintheCodeofCriminalProcedure,1973(2of1974),noPoliceOfficerbelowtheran :-

    (a)inthecaseoftheDelhiSpecialPoliceEstablishment,ofanInspectorofPolice,

    (b)intheMetropolitanareasofBombay,Calcutta,MadrasandAhmedbadandinanyotherMetropolitanareanotifiedassuchundersub-section(1)ofSection-8oftheCodeofCriminalProcedure1973(2of1974)ofanAssistantCommissionerofPolice.-

    (c)Elsewhere,ofaDeputySuperintendentofPolice,oraPoliceOfficerofequivalentran ,

    shallinvestigateanyoffencepunishableunderthisActwithouttheorderofaMetropolitanMagistrateoraMagistrateoftheFirstClass,asthecasemaybe,orma eanyarresttherefor,withoutawarrant:

    ProvidedthatifaPoliceOfficernotbelowtheran ofanInspectorofPoliceisauthorizedbytheStateGovernmentinthisbehalfbythegeneralorspecialorder,hemayalsoinvestigateanysuchoffencewithouttheorderofaMetropolitanMagistrateoraMagistrateoftheFirstclassasthecasemaybe,orma earrestthereforwithoutawarrant.

    SanctionforProsecutionandotherMiscellaneousProvisions

    19.Previoussanctionnecessaryforprosecution:-(1)NoCourtshallta

    ecognizanceofanoffencepunishableunderSections7,10,11,13and15allegedtohavebeencommittedbyaPublicServantexceptwiththeprevioussanction.-

    (a)inthecaseofapersonwhoisemployedinconnectionwiththeaffairsoftheUnionandisnotremovablefromhisofficesavebyorwiththesanctionoftheCentralGovernment,ofthatGovernment;

    (b)InthecaseofapersonwhoisemployedinconnectionwiththeaffairsofaStateandisnotremovablefromhisofficesavebyorwiththesanctionoftheStateGovernment,ofthatGovernment;

    (c)Inthecaseofanyotherperson,oftheauthoritycompetenttoremovehimfromhisoffice.

    (2)Whereforanyreasonwhatsoeveranydoubtarisesastowhethertheprevioussanctionasrequiredundersub-section(1)shouldbegivenbytheCentralGovernmentortheStateGovernmentoranyotherauthority,suchsanctionshallbegivenbythatGovernmentorauthoritywhichwouldhavebeencompetenttoremovethepublicservantfromhisofficeatthetimewhentheoffencewasallegedtohavebeencommitted.

    (3)NotwithstandinganythingcontainedintheCodeofCriminalProcedure,1973(2of1974).-

    (a)nofinding,sentenceororderpassedbyaSpecialJudgeshallbereversedoralteredbyaCourtinappeal,confirmationorrevisiononthegroundoftheabsenceof,oranyerror,omissionsorirregularityin,thesanctionrequiredundersub-section(1),unless,intheopinionofthatCourt,afailureofJusticehasinfactbeenoccasionedthereby.

    (b)nocourtshallstaytheproceedingsunderthisActonthegroundofanyerror,omissionorirregularityinthesanctiongrantedbytheauthority,unlessitissatisfiedthatsucherror,omission,orirregularityhasresul

    tedinafailureofjustice;

    (c)noCourtshallstaytheproceedingsunderthisActonanyothergroundandnoCourtshallexercisethepowersofrevisioninrelationtoanyinterlocutoryorderpassedinanyinquiry,trial,appealorotherproceedings.

    4.Indeterminingundersub-section(3)whethertheabsenceof,oranyerror,omissionorirregularityin,suchsanctionasoccasionedorresultedinafailureofjusticetheCourtshallhaveregardtothefactwhethertheobjectionscouldandshouldhavebeenraisedatanyearlierstageintheproceedings.

    Explanation.-Forthepurposesofthissection.-

    (a)errorincludescompetencyoftheauthoritytograntsanction;

    (b)asanctionrequiredforprosecutionincludesreferencetoanyrequirementthattheprosecutionshallbeattheinstanceofaspecifiedauthorityorwiththesanctionofaspecifiedpersonoranyrequirementofasimilarnature.

    20.Presumptionwherepublicservantacceptsgratificationotherthanlegalremuneration.-(1)Where,inanytrialofanoffencepunishableunderSection7orSection11orclause(a)orclause(b)ofsub-section(1)ofSection-13itisprovedthatanaccusedpersonhasacceptedorobtainedorhasagreedtoacceptorattemptedtoobtainforhimself,orforanyotherperson,anygratification(otherthanlegalremuneration)oranyvaluablethingfromanyperson,itshallbepresumed,unlessthecontraryisproved,thatheacceptedorobtainedoragreedtoacceptorattemptedtoobtainthatgratificationorthatvaluablething,asthecasemaybe,asamotiveorrewardsuchasismentionedinsection7or,asthecasemaybe,withoutconsiderationorforaconsiderationwhichhe

    nowstobeinadequate.

    (2)WhereinanytrialofanoffencepunishableunderSection12orunderclause(b)ofSection14,itisprovedthatanygratification(otherthanlegalremuneration)oranyvaluablethinghasbeengivenorofferedtobegivenorattemptedtobegivenbyanaccusedperson,itshallbepresumed,unlessthecontraryisproved,thathegaveorofferedtogiveorattemptedtogivethatgratificationorthatvaluablething,asthecasemaybe,asamotiveorrewardsuchasismentionedinsection7,or,asthecasemaybe,withoutconsiderationorforaconsiderationwhichhe nowstobeinadequate.

    (3)Notwithstandinganythingcontainedinsub-sections(1)and(2),theCourtmaydeclinedtodrawthepresumptionreferredtoineitherofthesaidsub-section,ifthegratificationorthingaforesaidis,initsopinionsotrivialthatnoinferenceofcorruptionmayfairlybedrawn.

    21.Accusedpersontobeacompetentwitness.-AnypersonchargedwithanoffencepunishableunderthisAct,shallbeacompetentwitnessforthedefenceandmaygiveevidenceonoathindisproofofthechargesmadeagainsthimoranypersonchargedtogetherwithhimatthesametrial:

    Providedthat.-

    (a)heshallnotbecalledasawitnessexceptathisownrequest;

    (b)hisfailuretogiveevidenceshallnotbemadethesubjectofanycommentbytheprosecutionorgiverisetoanypresumptionagainsthimselforanypersonchargedtogetherwithhimatthesametrial;

    (c)heshallnotbeas ed,andifas edshallnotberequiredtoanswer,anyquestiontendingtoshowthathehascommittedorbeenconvictedofanyoffenceotherthantheoffencewithwhichheischarged,orifofbadcharacter,unless.

    (i)theproofthathehascommittedorbeenconvictedofsuchoffenceisadmissibleevidencetoshowthatheisguiltyoftheoffencewithwhichheischarged,or

    (ii)hehaspersonallyorbyhispleaderas edanyquestionofanywitnessfortheprosecutionwithaviewtoestablishhisowngoodcharacter,orhasgivenevidenceofhisgoodcharacter,orthenatureorconductofthedefenceissuchastoinvolveimputationsonthecharacteroftheprosecutororofanywitnessfortheprosecution,or

    (iii)hehasgivenevidenceagainstanyotherpersonchargedwiththesameoffence.

    22.TheCodeofCriminalProcedure,1973toapplysubjecttocertainmodifications.TheprovisionsoftheCodeofCriminalProcedure,1973(2of1974)shallintheirapplicationtoanyproceedinginrelationtoanoffencepunishableunderthisActhaveeffectasif.

    (a)insub-section(1)Section243,forthewordsTheaccusedshallthenbecalledupon,thewordsTheaccusedshallthenberequiredtogiveinwritingatonceorwithinsuchtimeastheCourtmayallow,alistofpersons(ifany)whomheproposestoexamineashiswitnessesandofthedocuments(ifany)onwhichheproposestorelyandheshallthenbecalleduponhadbeensubstituted;

    (b)insub-section(2)ofSection309,afterthethirdprovisothefollowingprovisohadbeeninserted,namely:-

    ProvidedalsothattheproceedingshallnotbeadjournedorpostponedmerelyonthegroundthatanapplicationunderSection397hasbeenmadebyapartytotheproceeding.

    (c)aftersub-section(2)ofSection317,thefollowingsub-sectionhadbeeninserted,namely.-

    (3)Notwithstandinganythingcontainedinsub-section(1)orsub-section(2),theJudgemayifhethin sfitandforreasonstoberecordedbyhim,proceedwithinquiryortrialintheabsenceoftheaccusedorhispleaderandrecordtheevidenceofanywitnesssubjecttotherightoftheaccusedtorecallthewitnessforcross-examination.

    (d)insub-section(1)ofSection397,beforetheExplanation,thefollowingprovisohadbeeninserted,namely.

    ProvidedthatwherethepowersunderthissectionareexercisedbyaCourtonanapplicationmadebyapartytosuchproceedings,theCourtshallnotordinarily

    callfortherecordoftheproceedings.

    (a)withoutgivingtheotherpartyanopportunityofshowingcausewhytherecordshouldnotbecalledfor;or

    (b)ifitissatisfiedthatanexaminationoftherecordoftheproceedingsmaybemadefromthecertifiedcopies.

    23.ParticularsinachargeinrelationtoanoffenceunderSection13(1)(c).NotwithstandinganythingcontainedintheCodeofCriminalProcedure,1973(2of1974),whenanaccusedischargedwithanoffenceunderclause(c)ofsub-section(1)ofSection13,itshallbesufficienttodescribeinthechargethepropertyinrespectofwhichtheoffenceisallegedtohavebeencommittedandthedates

    betweenwhichtheoffenceisallegedtohavebeencommitted,withoutspecifyingparticularitemsorexactdates,andthechargesoframedshallbedeemedtobeachargeofoneoffencewithinthemeaningofSection219ofthesaidCode:

    Providedthatthetimeincludedbetweenthefirstandlastofsuchdatesshallnotexceedoneyear.

    24.Statementbybribegivernottosubjecthimtoprosecution.Notwithstandinganythingcontainedinanylawforthetimebeinginforce,astatementmadebya

    personinanyproceedingagainstapublicservantforanoffenceunderSections7to11underSection13orSection15,thatheofferedoragreedtoofferanygratification(otherthanlegalremuneration)oranyvaluablethingtothepublicservant,shallnotsubjectsuchpersontoaprosecutionunderSection12.

    25.Military,NavalandAirForceorotherlawnottobeaffected.(1)NothinginthisActshallaffectthejurisdictionexercisableby,ortheprocedureapplicable,to,anyCourtorotherauthorityundertheArmyAct,1950(45of1950)theAirForceAct,1950(46of1950),theNavyAct,1957(62of1957),theBorderSecurityForceAct,1968(47of1968),theCoastGuardAct,1978(30of1978),andtheNationalSecurityGuardAct,1986(47of1986).

    (2)Fortheremovalofdoubts,itisherebydeclaredthatforthepurposesofanysuchlawasisreferredtoinsub-section(1),theCourtofaSpecialJudgeshallbedeemedtobeaCourtofordinarycriminaljustice.

    26.SpecialJudgesappointedunderAct46of1952tobeSpecialJudgesappointedunderthisAct.EverySpecialJudgeappointedundertheCriminalLawAmendmentAct,1952,foranyareaorareasandisholdingofficeonthecommencementofthisActshallbedeemedtobeaSpecialJudgeappointedunderSection3ofthisActforthatareaorareasand,accordingly,onandfromsuchcommencement,everysuchJudgeshallcontinuetodealwithalltheproceedingspendingbeforehimon

    suchcommencementinaccordancewiththeprovisionsifthisAct.

    27.Appealandrevision.SubjecttotheprovisionsofthisAct,theHighCourtmayexercise,sofarastheymaybeapplicable,allthepowersofappealandrevisionconferredbytheCodeofCriminalProcedure,1973(2of1974)onaHighCourtasiftheCourtoftheSpecialJudgewereaCourtofSessiontryingcaseswithinthelocallimitsoftheHighCourt.

    28.Acttobeinadditiontoanyotherlaw.TheprovisionsofthisActshallbei

    nadditionto,andnotinderogationofanyotherlawforthetimebeinginforce,andnothingcontainedhereinshallexemptanypublicservantfromanyproceedingwhichmight,apartfromthisAct,beinstitutedagainsthim.

    29.AmendmentoftheOrdinance38of1944.IntheCriminalLawAmendmentOrdinance,1944.

    (a)insub-section(1)ofSection3,sub-section(1)ofSection9,clause(a)ofSection10,sub-section(1)ofSection11andsub-section(1)ofSection13,forthewordsStateGovernment,wherevertheyoccur,thewordsStateGovernmentor,asthecasemaybe,theCentralGovernmentshallbesubstituted;

    (b)inSection10,inclause(a),forthewordsthreemonths,thewordsoneyearshallbesubstituted;

    (c)intheSchedule.

    30.Repealandsaving.(1)ThePreventionofCorruptionAct,1947,(2of1947)andtheCriminalLawAmendmentAct,1952(46of1952)areherebyrepealed.

    (2)Notwithstandingsuchrepeal,butwithoutprejudicetotheapplicationofSection6oftheGeneralClausesAct,1897(10of1897),anythingdoneoranyactionta enorpurportedtohavebeendoneorta enunderorinpursuance

    oftheActssorepealedshall,insofarasitisnotinconsistentwiththeprovisionsofthisAct,bedeemedtohavebeendoneorta enunderorinpursuanceofthecorrespondingprovisionofthisAct.

    31.OmissionofcertainsectionsofAct45of1860.Sections161to165-A(bothinclusive)oftheIndianPenalCodeshallbeomitted,andSection6oftheGeneralClausesAct,1897(10of1897),shallapplytosuchomissionasifthesaidsectionshadbeenrepealedbyaCentralAct.
