For and on behalf of President of India, acting through Chief Medical Superintendent, Hyderabad Division, 2nd Floor Hyderabad Bhavan, Secunderabad invites tenders from reputed contractors for the under mentioned work.

1.1 Name of the work Outsourcing of Collection and Safe disposal of Rubbish/Garbage from the North Lallaguda Railway Colony of HYB Division On Contract Basis for a period of 24 months.

1.2 Estimated cost of Work: ` 61,96,473/-(Rupees Sixty One Lakh Ninety Six Thousands Four Hundred and Seventy Three Only)

2. ELIGIBILITY CRITERIA: The Tenderer should satisfy the following eligibility criteria to participate in the tender.

a) The tenderer should have completed at least one similar single work during the previous 3 financial years and current Year i.e. 2013-2014, 2014-2015, 2015-2016 and 2016-2017 (till date of opening the tender) for a minimum value of 35% of advertised tender value of work.(To this effect, the tenderer should fill Proforma – II at Page No.39 and enclose related attested Experience certificates issued by the Competent Authority as per the clause 10.b of Tender Notice at Page No.8).

b) The Similar Nature of Work means “Collection of Rubbish/Garbage/Solid Waste from Residential Units/Service Buildings of Govt/Semi Govt Organizations by using Tri Cycles or Equivalent mode and transport of the same for Safe/Scientific disposal as per Local Self Govt Rules”.

c) TURN OVER: The firm should have received total contractual payments of minimum 150% of advertised tender value of this work during the previous 3 financial years and current financial year i.e., 2013-2014, 2014-2015, 2015-2016 and 2016-2017 (till date of opening the tender), as per Proforma III in Page No. 40 - 41 (To this effect, the tenderer should produce attested certificates issued by the Competent Authority as per the clause 10.b of Tender Notice at Page No.8 duly certified by Charted Accountant).

d) The Tenderer should have permission either from the GHMC or operator of facility approved by competent authority for final safe/Scientific disposal of the Rubbish/Garbage /Solid waste as per the Local Self Govt. Rules.

Note: The Tender will be rejected if they do not fulfill the above conditions and they do not submit the relevant attested experience certificate and permission letters as required above.

3. COST OF TENDER FORM:

a. The Cost of Prescribed tender forms (non – transferable) is ` 5,000/- by hand. An amount of Rs.500/- extra has to be paid, if required by registered post. In this case, this office will not be responsible for any postal delay. Direct payment will not be entertained in the office of CHIEF MEDICAL SUPERINTENDENT, HYDERABAD DIVISION.

b. The Cost of Tender form shall be paid in cash in Divisional Pay Office, Hyderabad Division or in any of the following forms:

i. Demand draft, Banker Cheques in favour of Senior Divisional Financial Manager Hyderabad executed by State Bank of India or of any of the nationalized banks or by a Scheduled Bank.

ii. Cash remittance towards cost of Tender Form will not be accepted by the Chief Cashier or Divisional Cashier (Pay) after 14:30 Hrs of preceding day of closing of tender/Working day.

iii. Cost of tender form should be deposited under Allocation No.9-365-299.

4. EARNEST MONEY DEPOSIT: The Earnest Money as mentioned at Sl. No 1.3 should be paid in cash in Divisional Pay Office, Hyderabad or in any of the following forms:

(i) FDR (Fixed Deposit Receipt)/ Banker Cheque /Demand draft/ Money Receipt in favour of

Senior Divisional Financial Manager Hyderabad executed by State Bank of India or of any of the nationalized banks or by a Scheduled Bank.

(ii) Forfeiture of EMD: It shall be understood that the tender documents have been sold/issued to the tenderer and the tenderer is permitted to tender in consideration of the stipulation on the part, that after submitting his tender he will not rescind from his offer or modify the terms and conditions there of in a manner not acceptable to the Chief Medical Superintendent, Hyderabad Division of the South Central Railway. Should the Tenderer fail to observe or comply with the said stipulations; the aforesaid amount shall be liable to be forfeited to the Railway.

(iii).No interest shall be paid on the Earnest Money Deposit.

5. EXEMPTION OF PAYMENT OF TENDER FORM COST & EARNEST MONEY DEPOSIT:

In pursuance of the Public Procurement Policy on MSE (Micro and Small Enterprises) Notification No 503, dated23.03.2012, Railway Board has been decided and communicated vide Lr.No:2010/RS(G)/363/1, dated 05.07.2012 & 23.09.2013 and FA&CAO Lr.No: AFX/TOO/CORRES/VOL-II, dated 15.12.2015, the benefits/preferential treatment to eligible MSE’s are as follows. a) Tender sets shall be provided free of cost to MSEs registered with the agencies mentioned in

the notification of Ministry of MSME for the item tendered.

b) MSEs registered with the agencies mentioned in the notification of Ministry of MSME for the item tendered will be exempted from payment of Earnest Money.

c) In tenders, participating MSEs quoting a price within price band of L1 + 15% shall be allowed to supply a portion of the requirement by bringing down their price to L1 price in a situation where L1 price is from someone other than a MSE and such MSEs can be together ordered up to 20% of the total tendered value.

d) MSEs who are interested in availing themselves of these benefits will enclose with their offer the proof of their being MSE registered with any of the agencies mentioned in the notification of Ministry of MSME indicated below.

e) The MSEs must also indicate the terminal validity date of their registration.

f) Failing (d) & (e) above, such offers will not be liable for consideration of benefits detailed in MSE notification of Government of India dated 23.03.2012.

6. AVAILABILITY OF TENDER FORMS:

a) The prescribed tender forms (non-transferable) are obtainable during the period mentioned at Serial No.1.7 above on any working day from the office of the CHIEF MEDICAL SUPERINTENDENT, HYDERABAD DIVISION.

b) The tender documents will also be available in the website at www.scr.indianrailways.gov.in during the period as mentioned at Serial No.1.7 above and same can be downloaded and used as tender documents for submitting the offer. However, Demand Draft in favor of Sr. DFM/HYB.Div. South Central Railway, towards the cost of tender documents shall be enclosed separately in addition to Earnest Money while submitting the tender. Otherwise, the tender will be summarily rejected.

c) Railway administration shall not be responsible for any delay/difficulties/inaccessibility of the downloading facility for any reason whatsoever. In case of any discrepancy between the tender documents downloaded from internet and master copy available in the office, the latter shall prevail and will be binding on the Tenderer(s). No claim on this account shall be entertained.

d) The Tenderer down loading from website shall ensure that they have downloaded all the pages of the Tender Document.

7. Enclosures (Attested Documents to be enclosed):- For evaluation of the tender, the following documents which are mandatory must be submitted by the tenderer along with tender document.

a) Memorandum of articles of Association/Partnership deal in case of company/Partnership firm and Power of Attorney in favour of partner to act for and on behalf of the partnership firm.

b) Tender in the prescribed format obtained from the office or downloaded from the South Central Railway website is only accepted. Tenderers down loading from website shall ensure that they have downloaded all the pages. Tenderer has to sign on each page at the space provided in the Tender Form. For tender forms downloaded from the website, the Cost of Tender Form should be enclosed in the form of DD from any Nationalized Banks/Money Receipt in favour of Sr. Divisional Financial Manager, Hyderabad Division issued by Chief Cashier or Divisional Cashier, Hyderabad Division. (Mandatory)

c) Demand Draft/Banker Cheque/Money Receipt for the Earnest Money deposit as mentioned above should be enclosed. (Mandatory)

d) Full details of the profile of the tendering firm/Tenderer as per Proforma-I.

e) The Tenderer should submit his/their Similar Single nature of past work experience of Last Three Financial Years & Current Year details/works on hand details in the Proforma-II along with the experience certificate in support of their work completed satisfactorily, issued by the competent authority as per clause no.10 (b) of Tender Notice. (Mandatory)

f) Financial and Business capability and actual turnover during the last three financial years duly certified by a Chartered Accountant in Proforma-III should be submitted. (Mandatory).

g) The Details of Plant & Machinery available on hand (OWN) and proposed to be inducted (OWN

& HIRE to be given separately) for subject work to be submitted by the Tenderer as per Proforma-IV. No advances towards Mobilization, Plant & Machinery shall be granted.(Mandatory)

h) Registration under shop & Establishment Act/Registration under Partnership Act or Registration under Companies Act or Co-operative Society Act as the case may be establishing the authorization and nature of Business carried out by the tenderer.

i) Licence from the Labour Commissioner for previous works.(Mandatory)

j) Documents in support of Registered Code Nos. of ESI & EPF Organizations and statements of Monthly contributions of ESI & EPF towards their employees (Mandatory).

k) Documentary proof for payment of wages to their staff through Individual Bank Accounts.(Mandatory)

l).Tender form Annexure – I

NOTE:1. Past Works executed for Government/Semi Govt. Departments/Public Sector Under takings shall only be considered for the above. Such works executed for private organizations/individuals shall not be considered.

2. Attested Copies above documents shall be submitted.

3. Tenderer should note that in the event of non-submitting of any of the above mentioned Mandatory information/documentary evidence, the tenderer shall be considered as invalid and their tender shall be summarily rejected.

8. Quotation Of Rate By Tenderer: The Prospective Tenderers should visit North Lallaguda Railway Colony & understand the nature of work to be done and go through conditions governing the contract such as General Contract Conditions, Tender Conditions and Special conditions for execution of work and all other statutory payments to be made & tipping charges to be paid to the GHMC/operator of facility before quoting the rate.

a. The Tenderer should quote his offer in figures and words affixing the signature with seal wherever necessary.

b. The Tenderer should submit a working sheet on how he able to arrive his offer of quotation with proper justification/rate reasonability.

c. No other payment will be made apart from the quoted /accepted amounts.

d. No separate charges what so ever like electricity charges etc., will be paid by Railways

e. The amount quoted shall include everything to fulfill all statutory obligations such as fair payment of minimum wages, Contributions towards ESI/EPF as applicable from time to time, necessary tax deductions, and any other expenditure, Tenderer thinks so, if any.

9. Rejection of Tender Form:

The Railway Administration reserves the right, to reject the tender(s) without assigning any reason. The offers of the Tenderers shall be summarily rejected if

a) Tender forms submitted without prescribed tender form cost as per the clause no.2 at page no.4.

b) Not deposited the Earnest Money and the draft/receipt are not enclosed.

c) Submission of Tender forms without supportive and valid documents as specified under Sl. No 7 in duly attested Photostat copies.

d) Tender forms received after 11:00Hrs of closing date.

e) Conditional tenders.

f) Tenders containing erasures and alteration of entries made by him without Tenderers attested Signatures.

g) The tenderer gives wrong information in his/their tender or creates/create wrong circumstances misleading the Railway for the acceptance of his/their tender.

h) Non-compliance with any of the conditions set-forth herein & above.

10. Attention to the Tenderers:

a) All the Tenderers are supposed to visit the North Lallaguda Railway Colony and understand the scope of the work before filling up of the tender form. It is deemed that the Tenderer/ person tendering the form have complete idea about the Scope of Work and contract’s terms and conditions.

b) All the Xerox copies of the documents submitted by the Tenderer should have been attested by the Gazetted Officer. All credentials should be authenticated with sufficient documentary evidence (certificates issued by officers in rank not less than Deputy Chief Engineer/ Superintendent Engineer of Government/Semi Govt. Departments/Public Sector Undertaking or Junior Administrative Grade Officers of Central Govt. Departments), The details in respect of items mentioned under Sl. No. 7. (e) Should submit along with the tender form.

c) The onus of establishing the credentials of the Tenderer(s) from the office records or otherwise, does not lie with the Railway. Railway shall evaluate the offer only from the certificates/documents (as referred to above) submitted along with the tender offer.

d) Any certificate/documents submitted after the tender opening shall not be given any credit and shall not be considered.

e) Even if the Tenderer(s) is/are working contractor(s) of the Hyderabad Division also if he/they do not enclose the required certificates his/their offer shall not be considered. However Railway retains the right to verify the documents submitted.

f) If any certificates enclosed by Tenderers are found to be fake/bogus/tampered, such of those agencies, are liable to be black listed for a period of 5 years i.e., such agencies may not be awarded any work for a period of 5 years from the date of opening tender. Joint venture or partnership firms in which such agencies are a party, may also not be awarded any work for this period of 5 years.

g) Any other information required by the Tenderer can be obtained from the office of Chief Medical Superintendent, Hyderabad Division during the working hours on all working days.

h) Should a Tenderer be a retired employee of the Gazetted rank or any other Gazetted officer working before his retirement, whether in the executive or administrative capacity or whether holding a pensionable post or not, in the Medical Department or any department of any of the Railways owned and administered by the President of India for the time being, or should a Tenderer being partnership firm have as one of its partners a retired employee or a retired Gazetted Officer as aforesaid, the full information as to the date of retirement of such employee or Gazetted officer from the said service and in cases where such employee or officer has not retired from Government Service at least two years prior to the date of the submission of the tender as to whether permission for taking such contract, or if the contractor be a partnership Firm or an incorporated company, to become a partner or director as the case may be or to make employment under the contractor has been obtained by the Tenderer or the employee or the officer as the case may be from the President of India or any Officer duly authorized by him in this behalf, shall be clearly stated in writing at the time of submitting the tender/s without information above referred to or a statement to

the effect that no such retired engineer or retired Gazetted officer is so associated with the Tenderer, as the case may be, shall be rejected.

i) Should a Tenderer of contractor being an individual on the list of approved contractors, have a relative employed in Gazetted capacity in the Medical department of the South Central Railway or in the case of a partnership firm or company incorporated under the Indian company law, should a partner or a relative of the partner or a SHARE HOLDER or a relative of a SHARE HOLDER be employed in Gazetted capacity in the Medical Department of the South Central Railway, the authority inviting tenders shall be informed of the fact at the time of submission of tenders failing which the tender may be rejected or if such fact subsequently comes to light the contract may be rescinded in accordance with the provisions in Clause 62 of the General conditions of the contract.

11. PRE-BID MEETING: a). The Tenderer or his official representative is invited to attend a pre-bid meeting which will take

place at the Office of Chief Medical Superintendent, Medical Department, Hyderabad Division, 2nd Floor, Hyderabad Bhavan on 30.05.2017 at 11:30 hrs.

b). The Tenderers are required to submit any question in writing or by E-mail so as to reach to Chief Medical Superintendent not later than 3 (three) days before the date fixed for the meeting. (E-mail: [email protected])

c). The purpose of the meeting will be to clarify issues and to answer supplementary questions on any matter that may be raised at that stage.

d). Minutes of the meeting including the text of the questions raised (without identifying the source of enquiry) and the responses given will be uploaded on SCR website. Any modifications of the Tender Document which may become necessary as a result of the Pre-bid Meeting shall be made exclusively through the issue of an Addendum / Corrigendum and not through the Minutes of the Pre-Bid Meeting. The Minutes of the Meeting as described above and the Addendum / Corrigendum, if any, will be uploaded on SCR website only.

e). Non-attendance at the Pre-bid Meeting will not be a cause for disqualification of a tenderer.

12. SUBMISSION OF TENDER:

a) The Tender/Tenderers, before submission of Tender, may specifically take note of “CORRIGENDUM” issued to the original Tender Notice, if any, through News papers publication. This may confirm in the office of the undersigned also.

b) The tenderer shall clearly specify whether the tender is submitted on his own or on behalf of partnership concern. If the tender submitted on behalf of a partnership Concern, he should submit the certified copy of partnership deed along with the tender and authorization to sign the tender documents on behalf of partnership firm along with the names of all the partners with their full postal address. If the firm is registered under the Indian Partnership Act 1932, the registration number of the firm should also be given. The partner who is signing the tender form should hold Power of Attorney in his favour to act for and on behalf of the partnership firm.

c) If the documents mentioned under 7 (a) are not enclosed along with tender documents, the tender will be treated as having been submitted by individual signing the tender documents.

d) Tenderers should sign on all pages of the tender document in token of acceptance of all terms and conditions and clauses of the Tender.

e) The tender documents along with Earnest Money Deposit shall be enclosed in an envelope addressed to Chief Medical Superintendent, Hyderabad Division duly sealed, super scribing Tender Notice No. Description of work and due date of opening on the cover without fail and it shall be deposited in the special box which is labeled as “Medical Department, Hyderabad Division, allotted for the purpose placed at Tender Hall Old GOC

Compound, Hyderabad Division, South Central Railway by 11:00 hours of tender closing date. Otherwise they are liable to be rejected. The tender box will be sealed at 11:00 Hrs On 16.06.2017 and the same will be opened in the same office at 11:30 Hrs on the date and time as indicated at Serial No.1.9.

f) Tenders will also be accepted by post. However, Railway shall not be responsible for any postal delay.

13. Opening of Tender: a) Tenders will be opened at 11:30 Hrs on the same day, in the presence of Tenderers or

their representatives.

b) In case of any reason, If the date of opening happens to be a BANDH or HOLIDAY, the tender will be opened at the same time on the next working day.

14. Validity of Offer:

a) The offer shall be kept valid for a minimum period of 90 Calendar days from the date of opening of tender.

b) Railway Administration reserves the right to extend the validity of Tender at its discretion, if necessary, within which the Tenderer will not be entitled to rescind or to withdraw his offer. Notwithstanding this, if the Tenderer rescinds his offer within the period stipulated above, the earnest money deposited by him along with the tender shall be liable for forfeiture at the sole discretion of the Railway Authority and in that case the Tenderers shall have no further claim on the amount deposited by him as earnest money.

c) Tenderer will not be permitted to change the substance of their offers after the offers have been opened.

15. Right of the Railway to deal with Tender: The authority for the acceptance of the tender will rest with the Railway. It shall not be obligatory on the said authority to accept the lowest tender or any other tender and no Tenderer(s) shall demand neither any explanation for the cause of rejection of his/their tender nor the Railway to assign reasons for declining to consider or reject any particular tender or tenders. Any other information required by the tenderer can be obtained from the office of CHIEF MEDICAL SUPERINTENDENT, HYDERABAD DIVISION South Central Railway during working hours.

Note: It is hereby brought to the notice of all prospective tenderers that if any change /additions/deletions/alterations are found to be made by them and the same is subsequently detected/noticed at any stage even after award of contract, all necessary action including banning of business would be taken. A. GENERAL CONDITIONS OF CONTRACT:

1. The contract shall be governed by the "General conditions of the contract-2014" of Civil Engineering Works of South Central Railway as amended from time to time, are applicable to this tender. The contractor is deemed to have acquainted with the same and the said Special and General conditions are binding on him.

2. The “Engineer” defined under clause 1.2 of standard General Contract Conditions of Civil Engineering works of S.C.Railway shall be interpreted to replace as Chief Medical Superintendent, Hyderabad Division, Asst. Health Officer, CMS/Office/HYB, Chief Health Inspector, North Lallaguda Railway Colony or any employee entrusted as work executing authority of Medical Department for the implementation of GCC.

3. The special conditions shall prevail over the existing clauses of 63 & 64 of General Conditions of contract of Engineering Department, South Central Railway.

4. Security Deposit:

A. The Security Deposit that is to be recovered from the Contractor shall be 5 % of the contract value and whereas an amount ` 1,23,930/-(Rupees One Lakh Twenty Three Thousands Nine Hundred and Thirty Only) deposited towards Earnest Money Deposit vide DD/BC/MR No. -------- Dated ------------ (valid up to -----------------) issued by ------------------------------------------------Bank------------------------------------- Branch will be retained towards part of security Deposit as per the conditions of Tender. The Balance of Security deposit will be recovered only from the running bills of the contractor @10 % of gross bill amount till it reaches 5 % of the contract value and no other mode of collecting SD like Bank Guarantee, FDR etc., will be accepted towards Security Deposit.

The Security deposit shall be release only after the expiry of the maintenance period and after passing the final bill based on “No Claim Certificate”

After the work is physically completed, security deposit recovered from the running bills of a contractor can be returned to him if he so desires in lieu of FDR/Irrevocable bank guarantee for equivalent amount to be submitted by him.

B. No interest shall be paid on the Security Deposit.

C. Recovery Of Sum Due:

a) In the event of said security deposit being insufficient, the balance of total amount recoverable as the case may be, shall be deducted from any sum due to the contractor under this or any other contract within the Railway Administration limits. Should this amount be insufficient to cover the said full amount recoverable, the contractor shall pay to Railway Administration on demand the balance amount, if any, due to the Railway Administration within 10 days of the demand by Railway Administration.

b) If any amount due to the Contractor is set off against the said security deposit, the contractor shall have to make good they said amount so set off to bring the security deposit to the original value immediately but not later than 10 days.

5. Performance Guarantee: (Revised Clause 16(4) to Indian Railways General Conditions of Contract):

5.1 The successful bidder shall have to submit a Performance Guarantee (PG) within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA) Extension of time for submission of PG beyond 30(thirty) days and up to 60 days from the date of issue of LOA may be given by the Authority who is competent to sign the contract agreement. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days. i.e. from 31st day after the date of issue of LOA. In case the contractor fails to submit the requisite PG even after 60 days from the date of issue of LOA, the contract shall be terminated duly forfeiting EMD and other

dues, if any payable against that contract. The failed contractor shall be debarred from participating in re-tender for that work.

5.2 The Successful bidder shall submit a Performance Guarantee (P.G) in the form of an irrevocable Bank Guarantee amounting to 5% of the Contract Value in any of the following forms as per Proforma – V.

a). A deposit of Cash:

c). Government Securities including State Loan Bonds at 15% below the market value:

d). Deposit Receipt, Pay Order, Demand Drafts and Guarantee Bounds. These forms of Performance Guarantee could be either of the State Bank of India or any of the Nationalized Bank:

e). Guarantee Bound executed or Deposits receipt tendered by all Scheduled Banks:

f). A Deposit in the Post Office savings bank:

g). A deposit in the National savings Certificates:

h). Twelve years National Defence Certificates:

i). Ten years Defence Deposits:

j). National Defence Bonds and

k). Unit Trust Certificate at 5% below market value or at the face value whichever is less.

Also FDR in favor of Sr. Divisional Finance Manager, Hyderabad Division, S.C.Railway, Secunderabad (free from any encumbrance) may be accepted.

1. The prescribed format of Bank Guarantees (BGs) to be accepted from the Contractor is enclosed with the tender documents and it will be verified verbatim on receipt with original document.

2. Bank Guarantees (BGs) to be submitted by the suppliers/ Contractors should be sent directly to the concerned authority by the issuing Bank under Registered Post A.D.

5.3 The Performance Guarantee shall be submitted by the successful bidder after the Letter Of acceptance (LOA) has been issued, but before signing of the contract agreement. This PG shall be initially valid up to the stipulated date of completion plus 60 days beyond that. In case, the time for completion of work gets extended, the contractor shall get the validity of P.G. extended to cover such extended time for completion of work plus 60 days.

5.4 The value of PG to be submitted by the contractor will not change for variation up to 25% (either increase or decrease). In case during the course of execution, value of the contract increases by more than 25% of the original contract value, an additional Performance Guarantee amounting to 5% (five percent) for the excess value over the original contract value shall be deposit by the Contractor. On the other hand, if the Value of Contract decreases by more than 25% of the original Contract Value, Performance Guarantee amounting to 5% (Five percent) of the decrease in the Contract Value Shall be returned to the Contractor. The PG amount in excess of required PG for decreased Contract Value, available with Railway, Shall be returned to Contractor as per their request duly Safe guarding the interest of Railways.

5.5 The Performance Guarantee (PG) shall be released after physical completion of the work based on ’Completion Certificate’ issued by the competent authority stating that the contractor has completed the work in all respects satisfactory. The Security Deposit shall however, be released only after expiry of the maintenance period and after passing the final bill based on ‘No Claim Certificate’ from the contractor.

5.6 Whenever the contract is rescinded the Security Deposit shall be forfeited and the Performance Guarantee shall be encased. The balance work shall be got done independently without risk & cost of the failed contractor. The failed contractor shall be debarred from participating in the tender for executing the balance work. If the failed contractor is a JV or a Partnership firm then every member/partner of such firm shall be debarred form participating in the tender for the balance work in his/her individual capacity or as a partner of any other JV/partnership firm.

5.7 CHIEF MEDICAL SUPERINTENDENT, HYDERABAD DIVISION shall not make a claim under the Performance Guarantee except for amounts to which the President of India is entitled under the contract (not withstanding and /or without prejudice to any other provisions in the contract agreement) in the event of:

(i) Failure by the contractor to extend the validity of the Performance Guarantee as described herein above. In which event the Chief Medical Superintendent/ Hyderabad may claim the full amount of the Performance Guarantee.

(ii) Failure by the contractor to pay President of India any amount due, either as agreed by the contractor or determined under any of the Clauses/Conditions of the Agreement, within 30 days of the service of notice to this effect by Chief Medical Superintendent Hyderabad.

(iii) The Contract being determined or rescinded under provision of the GCC, the Performance Guarantee shall be forfeited in full and shall be absolutely at the disposal.

5.8 Additional Performance Guarantee of 2%: If the tenderer quotes his offer below 10% on the estimated cost of work he has to pay an additional amount of 2 % on estimated cost towards Performance guarantee in addition to above 5% Performance Guarantee.

6. Law governing the Contract: The Contract shall be governed by the law for the time being in force in the Republic of India. The Contractor shall be liable for strict compliance of the provisions of the following Labour laws/ Tax Enactments.

A. Provisions of Contract Labour (Regulation and Abolition) Act, 1970 (GCC 55 – A).

i. The contractor shall comply with the provision of the Contract Labour (Regulation and Abolition) Act, 1970 and the Contract Labour (Regulation and Abolition) Central Rules – 1971 as modified from time to time, wherever applicable and shall also indemnify the Railway from and against any claims under the aforesaid Act and Rules.

ii. The contractor shall obtain a valid license under the aforesaid Act as modified from time to time before the commencement of the work and continue to have a valid license until the completion of the work. Any failure to fulfill the requirement shall attract the penal provision of the Contract arising out of the resultant non – execution of the work.

iii. In respect of all labour directly or indirectly employed in the work for performance of the contract’s part of the contract, the contractor shall comply with or cause to be complied with the provisions of the aforesaid Act and Rules where ever applicable.

iv. In every cases in which, by virtue of the provisions of the aforesaid Act or Rules, the Railway obliged to pay any amount of wages to a workman employed by the contractor in execution of the work or to incur any expenditure on account of the contingent, liability of the Railway due to the contractor’s failure to fulfill his statutory obligations under the aforesaid Act or the Rules the Railway will recover from the contractor, the amount of wages so paid or the amount of expenditure so incurred, and without prejudice to the rights of the Railway under the Section 20, sub section (2), sub section (4) of the aforesaid Act, the Railway shall be at liberty to recover such amount or part thereof by deducting it from the security deposit and/or from any sum due by the Railway to the contractor whether under the contract or otherwise. The Railway shall not be bound to contest any claim made against it under sub section (1) of Section 20 and sub section (4) of Section 21 of the aforesaid Act except on the written request of the contractor and upon his giving to the Railway full security for all costs for which the Railway might become liable in contesting such claim. The decision of the Railway regarding

the amount actually recoverable from the contractor as stated above shall be final and binding on the contactor.

B. Provisions of Minimum Wages Act 1948/ Rules 1950;The Payment of Wages Act, 1936.

i. The Contractor shall be responsible to comply with the provisions of the Payment of Wages Act – 1936 & Rules, Minimum Wages Act – 1948 & Rules.

ii. Display Notice Board at the Work Place showing the minimum rates of Wages fixed, Wage Period, Hours of Work, Date of Payment of Wages, Date of Payment of Unpaid wages, Place of Payment of Wages, Abstract of the Act/Rules made there under, Name & Address of the Concerned Labour Enforcement Officer (Central) in English and Telugu.

iii. The Contractors shall maintain the Register of Muster Roll, Register of Wages, Register of fines, Register of deductions for damages/loss and Register of over Time at the Work place.

C. Provisions of Employees Provident Fund and Miscellaneous Provisions Act – 1952.

The contractor shall comply with the provisions of Para 30 & 36 – B of the Employees Provident Fund scheme, 1952; Para 3 & 4 of Employees’ Pension Scheme, 1955: and Para 7 & 8 of Employees Deposit Linked Insurance Scheme, 1976 as modified from time to time through enactment of Employees Provident Fund & Miscellaneous Provisions Act, 1952 wherever applicable and shall also indemnify the Railway from and against any claims under the aforesaid Act and the Rules.

D. The Contractor should not violate the provisions in relation to various Labour Laws viz, Child Labour (Prohibition and Regulation) Act, Workmen’s Compensation Act, 1923 and shall accept liability for compensation in respect of the persons employed by him while executing the contract.

E. The contractor shall also comply with the Solid waste Management Rules -2016 and guidelines & instructions issued by National Green Tribunal from time to time on final safe disposal of garbage generated from North Lallaguda Railway Colony.

F. The Contractor shall also comply with the guidelines and instructions issued by National Commission for Safai Karmachari Govt. of India and all other provisions of Labour Laws/ Tax Enactments that are applicable to the Contract, besides the provisions mentioned above under Para A, B, C, D, E of SL .No 6 under General Contract Conditions of this Tender.

7. Assignment or Subletting of Contract: The Contractor shall not assign or sublet the contract or any part thereof or allow any person to become interested therein any matter whatsoever without the special permission in writing of the Railway. Any breach of this condition shall entitle the Railway to rescind the Contract under clause 62 of GCC of Engineering Department and also render the contractor liable for payment to the Railway in respect of any loss or damage arising or ensuing from such cancellation. Provided always that execution of the details of the work by petty contractor under the direct and personal supervision of the contractor or his agent shall not be deemed to be subletting under this clause. The permitted subletting of work by the contractor shall not establish any contractual relationship between the sub contractor and the Railway and shall not relieve the contractor of any responsibility under the contract.

8. Representation on works: The contractor shall, when he is not personally present on the site of the work place and keep a responsible agent at the work site during working hours who shall on receiving reasonable notice, present himself to the Chief Health Inspector/NLGD, Asst. Health Officer/HYB Division and orders given by Chief Health Inspector/NLGD, Asst. Health Officer/HYB Division to the agent shall be deemed to have the same force as if they had been given to the contractor. Before absenting himself, the contractor shall furnish the name and address of his agent for the purpose of this clause and failure on the part of the contractor to comply with this provision at any time will entitle the Railway to rescind the contract under clause 62 of GCC of Engineering Department.

9. Deduction Of Income Tax At Source: a). In terms of New section 194 – C inserted by the Finance Act, 1977, in the Income Tax Act 1987,

the Railway shall at the time of arranging payments to the Contractor for carrying out any work (including supply of Labour for carrying out any work) under the contract be entitled to deduct income tax at source on income comprised in the sum of such payment.

b).The deduction towards income tax to be made at source from the payments due to nonresidents shall continue to be governed by section 195 of the Income Tax Act, 1961.

10. Service Tax: The Service tax is exempted In terms of Guidelines issued by FA & CAO letter No: AXP/Service tax dated 15.12.2016.

11. Illegal Gratification:

a. Any bribe, commission, gift or advantage given, promised or offered by or on behalf to the contractor or his partner, agent or servant of anyone on his behalf, to any officer of employee of the Railway, or to any person on his behalf in relation to obtaining or execution of this or any other contractor with the Railway shall, in addition to any criminal liability which he may occur, subject contractor to the rescission of the contract and all other contracts with the Railway and to the Payment of any loss or damage resulting from such decision and the Railway shall be entitled to deduct the amounts so payable from any moneys due to the contractor(s)under this contract or any other contracts with the Railway.

b. The contractor shall not lend or borrow from or have or enter into any monitory dealings or transactions either directly or indirectly with any employee of the Railway and if he shall do so, the Railway shall be entitled forthwith to rescind the contract and all other contracts with the Railway. Any question of dispute as to the commission or any such offence or compensation payable to the Railway under this clause shall be settled by the General Manager of the South Central Railway, in such a manner as he shall consider fit and sufficient and his decision shall be final and conclusive. In the event of rescission of the contract under this clause, the contractor will not be paid any compensation whatsoever except payments for the work done up to the date of rescission.

12. INDEMNIFYING THE RAILWAY ADMINISTRATION:

A. The Railway administration shall not be responsible for any transaction in any manner between contractor and any third party and is not liable for consequential damages or compensation or binding to any conditions what so ever. The contractor shall be responsible to indemnify and hold indemnified the Railway administration in case of any damages claimed for any injury or whatsoever sustained by any third party or Railway personnel of any act of omission or commission by the contractor or his agents or found liable to compensate by any authority or Court of Law.

B. The contractor shall indemnify and hold indemnified the Railway administration against any claims, damages, loss or penalty including costs thereof in case of liability arising out of any accident/fire/any other Natural calamity/incident or loss of life involving manpower deployed by the contractor.

C. The contractor shall indemnify Railway administration against any claims, damages, loss or penalty including costs thereof arising out of any breach or violation of any of the provisions of various Acts enacted by the Central/State Governments such as Contract Labour (regulation & abolition) Act, 1970, Payment of Minimum Wages Act, Workmen Compensation Act, Hours of Employment & Regulation Act, Employment of children Act, EPF, ESI Acts, governing the employees employed by the contractor and Tax enactments, Solid waste management rules, National green tribunal guidelines etc. as applicable from time to time.

13. Right of Railway to determine and terminate the contract: -

A. The Railway shall be entitled to determine and terminate the contract at any time should, in the Railways opinion, the cessation work becomes necessary owing to paucity of funds or fault of contractor or from any other cause whatever, in which case the value of work done to date by the contractor will be paid for in full at the rate specified in the contract duly deducting the penalties as per penalty clauses for undoing part of work if any, Notice (7 days/ 48hours) in writing from the Railway of such determination and the reasons thereof shall be conclusive evidence thereof. Date and time of above written notices are effective from the date of serving the letter to the contractor/local agent/supervisor permitted by the administration.

B. Should the contract be determined under above clause A and the contractor claims payment for expenditure incurred by him in the expectation of completing the whole work, the Railways shall admit and consider such claims as are deemed reasonable and are supported by documents to the satisfaction of the Chief Medical Superintendent, Hyderabad Division The Railways decision on the necessity and propriety of such expenditure shall be final and conclusive.

C. The Contractor shall have no claim to any payment of compensation or otherwise, howsoever on account of any profit or advantage which he might have derived from the execution of the work in full but which he did not derive in consequence of determination of contract.

14. SETTLEMENT OF DISPUTES / ARBITRATION: -

A. The provision of clause 63 & 64 of the General Conditions of Contract will be applicable only for settlement of claims/disputes, for values less than or equal to 20% of the original value (excluding the cost of materials supplied free by Railway) of the contract or 20 % of the actual value of the work done (excluding the value of the work rejected) under the contract, whichever is less. When claims/disputes are of value more than 20% of the value of the original contractor or 20% of the value of the actual work done under the contract whichever is less, the contractor will not be entitled to seek such disputes/claims for reference to Arbitration and the provisions of clause 63 and 64 of the General Conditions of Contract will not be applicable for referring the disputes to be settled through Arbitration. As per clause 64 (3)(a) of GCC, if the total value of the claim is less than Rs.10 Lakhs, the Arbitral Tribunal shall consist of a Sole Arbitrator and if the value is more than Rs.10 Lakhs, the Tribunal shall consist of a panel of three Gazetted Railway Officers appointed by the General Manager.

B. The contractor shall furnish his monthly statement of claims as per clause 43 (1) of General Conditions of Contract. But, the contractor should seek reference to Arbitration to settle the disputes only once, subject to the conditions as per above Para 14 (A). These special conditions shall prevail over the existing clause of 63 & 64 of General Conditions of Contract.

C. JURISDICTION: In respect of any matter pertaining to this contract, the Courts of Law in

Hyderabad/Secunderabad shall have the exclusive jurisdiction.

B. MEANING OF TERMS, DEFINITIONS, AND IMPORTANT INSTRUCTIONS TO TENDERER(S).

1. MEANING OF TERMS & DEFINITIONS: In these General Conditions of Contract the following terms shall have the meanings assigned hereunder except where the context otherwise requires.

a ‘Railway’: Shall mean the President of the Republic of India or the Administrative Officer of the South Central Railway or of the successor Railway authorized to invite Tenders and enter into Contracts for works on his behalf.

b ‘General Manager’ Shall mean the Officer in Administrative charge of whole of South Central Railway and shall mean and include the General Manager of successor Railway.

c ‘Divisional Railway Manager’

Shall mean the Administrative Officer-in-charge of a Hyderabad Division of South Central Railway for the time being.

d ‘Chief Medical Superintendent:

Shall mean the Officer-in-charge of the Medical Department of Hyderabad Division of the South Central Railway for the time being.

e Tenderer: Shall mean the person, the Firm or company who tenders for the works with a view to execute the work on contract with the Railway and shall include their representative, successors and permitted assignees.

f ‘Limited Tenders’: Shall mean tenders invited from all or some Contractors on the approved list of contractors with the Railway.

g ‘Open Tenders’: Shall mean tenders invited in open and public manner and with adequate notice.

h ‘Works’: Shall mean the works contemplated in the schedules set-forth in the tender forms and description of contract and required to be executed according to conditions.

i Specifications: Shall mean the specifications described for works & materials by south central railway issued under the authority of CMS/HYB Division, added, in superseded by special specifications, if any appended to the tender forms.

j ‘Minimum Wages’ Shall mean the wages to be paid to the employees engaged by the Contractor(s) as per the Notification of the Asst. Regional Labour commissioner, Central/State from time to time.

k ‘Labour License’ Shall mean that the license obtained from the Registering /Licensing officer of Ministry of Labour & Employment, Asst. Labour Commissioner, Central/State as per the provisions of Contract Labour (Regulation and Abolition) Act, 1970 and the Contract Labour (Regulation and Abolition) Central Rules – 1971 for the purpose of execution of the work.

l Door to Door Collection

Shall mean attending each unit of Railway Quarters/Service Building for collection of the garbage/House Waste/office Waste etc.

m Service Building Shall mean the offices/Buildings other than Railway quarters defined as ‘Service building’ by the competent authority (Engineering Dept) in the jurisdiction of North Lallaguda Railway Colony.

n Dust Bins Shall mean the Structures provided for collection of garbage/Street sweepings/ other waste generated in the Railway Premises.

o Made available Quarters/Service Buildings/Dustbins

Shall mean the No. of Quarters/Service Buildings/Dust Bins are made available to the contractor daily for collection of garbage/street sweepings/other wastes duly deduction/addition of the No. of Quarters/Service Buildings/ Dust Bins found condemned, temporarily vacated /Locked/demolished/newly constructed.

p ‘Disinfection’ The process of killing of germs/bacteria by Sprinkling of admixture of Bleaching Powder & Lime in 1:4 ratio at the surroundings of dustbins after lifting of garbage/Rubbish from dustbin or from any other place where the garbage/Rubbish is accumulated.

q Disposal of Animal Caracas

Dead bodies of any animal found in the premises of North Lallaguda Railway Colony needs to be disposed off safely and the area should be disinfected with bleaching & Lime Powder.

2. IMPORTANT INSTRUCTIONS TO THE TENDERERS:

A Singular and Plural

Words imparting the singular number shall also include the plural and vice versa where the context so requires.

B Interpretation These Regulations for Tenders and Contractors shall be read in conjunction with the General Conditions of Contract which are referred to herein and shall be subject to modifications, additions or super cession by specifications, if any, annexed to the tender forms.

C Omissions Discrepancies:

Should a Tenderer find discrepancies in, or omission from any of the Tender Forms or should be in doubt as to their meaning, he should at once notify the authority inviting Tenders who may send written instructions to all Tenderers. It shall be understood that every endeavor has been made to avoid any error which can materially affect basis of the tender and the successful Tenderer shall take upon himself and provide for the risk of any error which may subsequently be discovered and shall make no subsequent claim on account thereof.

D Earnest Money (a).The Tenderer shall be required to deposit a sum of ` ` 1,23,930/-(Rupees One Lakh Twenty Three Thousands Nine Hundred and Thirty Only) with the tender as a Earnest money Deposit for the due performance of the stipulation to keep the offer open till such date as might be specified in the tender. It shall be understood that the tender documents have been sold/issued to the Tenderer and the Tenderer is permitted to tender in consideration of the stipulation on the part, that after submitting his tender he will not rescind from his offer or modify the terms and conditions there of in a manner not acceptable to the Chief Medical Superintendent of Hyderabad Division of the South Central Railway. Should the Tenderer fail to observe or comply with the said stipulations; the aforesaid amount shall be liable to be forfeited to the Railway.

(b).If his tender is accepted, his earnest money will be retained as part of Security Deposit for the due and faithful fulfillment of the contract in terms of clause 4 of General Conditions of the Contract.

(c).The Earnest money Deposit of unsuccessful Tenderers will be returned to them within a reasonable time, but the Railway will not be responsible for any loss, damage, or depreciation that may happen to them while in their possession.

E Tenderers who are SEMD holders of Rs.25,000/-

Tenderers who have made lump sum deposit earlier and are standing Earnest Money holders should note that their lump sum deposit will not be adjusted towards the earnest money for this tender. They are also required to deposit separately ` ` 1,23,930/-(Rupees One Lakh Twenty Three Thousands Nine Hundred and Thirty Only)as earnest money for this tender, failing which their tender will not be considered.

F Care in submission of Tender

(a).Before submitting a tender, the Tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered by him during the execution of the works, have been taken into account and that the percentage, rates he enters in the tender forms is/are adequate and all inclusive in accordance with the provisions in clause 37 of the General Conditions of Contract for the completion of works to the entire satisfaction of the Rly. Administration.

(b).When work is tendered for by a firm or company, the tender shall be signed by the individual, legally authorized to enter into commitments on their behalf.

(c). The Railway will not be bound by any power of attorney granted by the Tenderer or by changes in the composition of the firm made subsequent to the execution of the contract. It may, however, recognize such power of attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the contractor.

(d). A Contractor who has not carried out any work so far on this Railway should furnish credentials particulars regarding.

i. His position as an independent contractor ii. His capacity to undertake and carry out works satisfactorily, as

vouched for by a responsible official or firm. iii. His previous experience on works similar to that to be contracted

for, in proof of which original certificates or testimonials may be called for and their genuineness verified, if need be, by reference to the signatories thereof.

iv. His knowledge, from, actual personal investigation, of the resources of the zone or zones in which he offers to work

v. His ability to supervise the work personally or by competent and duly authorized agents.

vi. His financial position.

G Right of Railway to deal with tenders

The Railway reserves the right not to invite tenders for any work or works, to invite open or limited tenders, and when Tenderers are called, to accept a tender in whole or in part or reject any tenders or all tenders without assigning reasons for such action.

H Execution of contract document

(a). The Tenderers, whose tender is accepted, shall be required to appear at the office of the Chief Medical Superintendent, Hyderabad as the case may be, in person or in case of a firm or company, a duly authorized representative shall so appear, to execute the contract documents/ agreement within seven days after receiving notice that the contract document/agreement are ready. Failure to do so shall constitute a breach of the agreement offered by the acceptance of the tender in which case the full value of earnest money deposited accompanying the tender shall stand forfeited without prejudice to any other rights or remedies.

(b). In the event of any Tenderer whose tender is accepted, refuses to execute the contract documents as herein before provided, the Railway may determine that such Tenderer abandoned the contract and there upon his tender and the acceptance thereof shall be treated as cancelled and Railway shall be entitled to forfeit the full amount of the earnest money and to recover the full liquidated damages for such default.

I Form of contract document

Every contract shall be complete in respect of the document it shall constitute not less than 5 copies of the contract documents and one copy given to the contractor.

J Penalty Imposing of fine for not fulfilling the terms and conditions of the Tender Notice/Agreement and for un satisfactory work noticed by the Administration during the execution of the work by the Contractor as per the Penalty clause 15 under Scope of Work & Special Conditions for the execution work of the Tender Notice/Agreement.

C.TENDER CONDITIONS:

1. The Tenderers who have past experience only eligible to quote their offer for this tender and they should submit all the documentary evidences as required as per the clause.No.7 (Enclosures) of Tender Notice.

2. The Contractor should adhere to all the terms and conditions laid down in the tender schedule.

3. The Tenderer/Tenderers shall quote a rate as stipulated in the Tender Form. The quantities shown in the attached schedule are given for guidance and are approximate only and are subject to variation according to the needs of the Railway.

4. The work is for a period of 24 Months (Two years) from the date of commencement of the work.

5. The tender must be accompanied with a required EMD as stipulated in Tender Notice.

6. If a Tenderer expires after submission of his tender or after the acceptance of his tender, the Railway shall deem such tender as cancelled. If a partner of a firm expires after the submission of their tender or after the acceptance of their tender the Railway shall deem such tender as cancelled, unless the firm retains its character.

7. The administration does not agree to pay any Taxes as the case may be in addition to the price quoted. The Tenderers should quote their rates inclusive of all Taxes except service tax.

8. Any notice required to be served by the railway administration shall be deemed to have been served as if it is dispatched to the address of the contractor given in the agreement and by registered post.

9. The contractor shall be held responsible for the loss incurred by the railway administration and damages caused to the property of railways or its agents/licensees permitted by Railway Administration on its premises.

10. In the event of death of the contractor during the contract period, the legal heirs of the deceased viz., wife, son, daughter, widow dependent, daughter-in-law may be allowed to continue the unexpired portion of the contract purely at the discretion and permission of the railway administration on production of legal heir certificate subject to fulfilling the terms and conditions stipulated in the agreement.

11. The Railway administration reserves the right to inspect the work at any time through authorized representatives.

12. The contractor should be accessible round the clock in case of emergency/ necessity to co-ordinate with Railway administration.

13. In submitting his tender, it would be deemed that the Tenderer has kept himself fully informed of the provisions of the “General Conditions of Contract” including all up to date corrections and amendments issued from time to time.

It is HEREBY AGREED that it shall be the duty of the Tenderers to keep himself informed of all corrections, and amendments of the said General Conditions of Contract made up to the date of the execution of these presents and no objections shall be taken by the Tenderer on the ground that he was not aware of such amendments and corrections of the said General Conditions of Contract or to any of them.

14. NEGOTIATION OF RATES: Should the Railway decide to negotiate with a view to bring down the rates, the Tenderer called for negotiations should furnish the following form of declaration before commencement of negotiations.

Y/MD/52/5/NLGD-COL/2017 to be opened on 16.06.2017 my/our original tender shall remain open for acceptance on its original terms and conditions.

I/we also declare that I/we am/are aware that during this negotiation, I/we cannot increase the originally quoted rates against any of the individual items and that in the event of my/our doing so, the same would not be considered at all i.e., reduction in rates during negotiation alone would be considered and for some items if I/we increase the rates, the same would not be considered and in lieu my/our originally quoted rates alone would be considered and my/our offer would be evaluated accordingly. ”

15. Registration with Labour Department :The Tenderer for carrying out any contract work in Telangana/Andhra Pradesh must get themselves registered from the Registering Officer of Ministry of Labour & Employment, Asst. Labour Commissioner, Central Hyderabad/ respective regional office under which the jurisdiction of the Contract work is falls, and submit the same certificate of Registration and obtain Licence from Licensing officer of the Ministry of Labour & Employment, Asst. Labour Commissioner, Central Hyderabad for execution of work and submit the same certificate of Licence before commencement of the work.

16. Partnership Deeds, Power of Attorney Etc.

(a) Partnership: Partnership firm is eligible, if entered into and registered prior to Tender notice. If the experience certificate enclosed/submitted is in the same name and style as the Tenderer, their credentials shall be considered fully i.e., to the extent of work executed by them.

(b) Power of Attorney: The Railway will not be bound by any power of attorney granted by the Tenderer or by changes in the composition of the firm made subsequent to the execution of the contract. It may, however, recognize such power of attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the contractor.

(c) The Tenderer whether sole proprietor, a limited company or a partnership firm, if they want to act through agent or individual partner (s) should submit along with the tender or at a later stage , a power of attorney duly stamped and authenticated by a Notary Public or by Magistrate in favour of the specific person whether he/they be partner (s) of the firm or any other person specifically authorizing him/them to submit the tender, sign the agreement, receive money, witness measurements, sign measurement books, compromise, settle, relinquish any claim(s) preferred by the firm and sign ‘No Claim Certificate” and refer all or any disputes to arbitration.

17. ACCEPTANCE OF TENDER:

(a).The railway may accept a tender for a part of the quantity offered reject any tender without assigning any reason and may not accept the lowest or any tender.

(b). Acceptance of tender will be communicated by a formal acceptance letter (by registered post) of the tender direct to the contractor, which may be deemed to conclude the contract. The delivery period/completion period will be deemed to have commenced from the date of dispatch of this letter.

18. Effect and validity of offer: The Tenderers shall hold the offer open for a minimum period of 90 days from the date of opening of the tender, subject to the period being extended further, if required by mutual agreement from time to time. It is understood that the tender documents having been sold/issued to the Tenderer and the Tenderer is being permitted to tender in consideration of the stipulation on his part that after submitting the tender he will not rescind from his offer or modify the terms and conditions thereof in a manner not acceptable to the Chief Medical Superintendent Hyderabad Division of South Central Railway. Should the Tenderer fail to observe or comply with the foregoing stipulation, the amount deposited as Security for the due performance of the above stipulations shall be forfeited to the Railway. If the tender is accepted, the amount of earnest money will be held as part of the Security Deposit for the due and faithful fulfillment of the contract. The earnest money of the unsuccessful Tenderers will save as herein before provided, be returned to them within a

reasonable time. But the Railway shall not be responsible for any loss or depreciation that may happen to the security for the due performance of the stipulation to keep the offer open for the period specified in the tender documents or to the earnest money while in possession nor be liable to pay interest there on.

19. Execution of Contract Documents: The Tenderer whose tender is accepted shall be required to appear in person at the office of the Chief Medical Superintendent, Hyderabad Division, Hyderabad Bhavan, Secunderabad or in case of firm or corporation, a duly authorized representative shall so appear and execute the contract Documents within 15(Fifteen) days after the receipt of the Letter of Acceptance of the Tender. Failure to do so shall constitute a breach of the Agreement that was effected by the acceptance of the Tender, in which case, the full value of the Earnest Money accompanying the Tender shall stand forfeited without prejudice to any other rights or remedies available to the Railway.

20. AGREEMENT:

A. The successful Tenderer shall execute an agreement in the prescribed form with required number of additional copies thereof before commencement of the contract.

B. The agreement shall at all times be open to revision and amendment by the Railway Administration after giving one month’s notice in writing of such revision or amendment at the end of which time any revision or amendment shall take effect, unless the contractor has objected there to in writing giving 15 days after the receipt of said notice.

C. Subject as otherwise provided in this agreement all notices to be given on behalf of the President of India and all other actions to be taken on his behalf may be given or taken on his behalf by The Chief Medical Superintendent, Hyderabad Division, South Central Railway, Secunderabad.

D. Except otherwise provided here in any agreement, oral or written abandoning the terms thereof shall be of no effect and shall not be valid or binding or enforceable unless and until the same is incorporated in the formal supplementary agreement in writing and signed by both the parties thereof.

21. SUBMISSION OF MONTHLY BILLS:-

A. The contractor has to submit monthly bill in standard format for the work done in triplicate to Chief Health Inspector, North Lallaguda Railway Colony. The same are to be submitted to Chief Medical Superintendent, Hyderabad Division, South Central Railway, after due certification by Chief Health Inspector, NLGD and forwarded through AHO/HYB. After passing by the Chief Medical Superintendent, Hyderabad Division, the bills will be forwarded to Sr. Divisional Financial Manager, Hyderabad Division for payment.

B. Payment in full of such bills subject to audit and deductions which the Government may make in respect of any moneys due to it under the provisions contained in the Agreement such as deduction of penalties without any prejudice as per penalty Clause 15 and payable taxes as applicable from time to time shall be made to the contractor as per the above clause A.

C. Payment of Tipping Charges: In terms of Solid Waste Management Rules -2016, for safe disposal of Garbage/Rubbish, Railway Administration included the cost in the estimate towards tipping charges to be paid by the contractor either to GHMC or to Operator of facility for further processing of Garbage/Rubbish. The Payment of tipping charges will be made to the contractor on reimbursement basis purely on how much quantity of garbage/Rubbish is being handed over to GHMC/Operator of facility @ ` 926/- per ton only. For which contractor has to submit the weight measure voucher in terms of tons on each trip he hands over the garbage to GHMC/Operator of facility. If contractor fails to submit voucher, the equivalent amount estimated on the approximate quantity of garbage/rubbish generated per day from North Lallaguda Railway Colony will be deducted from the corresponding monthly bills for which the contractor claims.

Example: In North Lallaguda Railway Colony, the approximate generation of garbage/ rubbish is 2.6325 tons per day. Then, the amount to be deducted = 2.6325X No. of days in Corresponding months of bill claimed X ` 926/-.

No extra amount will be entertained towards tipping charges on account of extra trips made. The estimated generation of garbage is only approximate, indicative and minimal. There may be variation while execution of the work. Contractor should take care while quoting his offer.

D. The contractor has to submit the following documentary evidence along with the Monthly bill in support of their compliance towards statutory obligations pertains to this contract, otherwise the payment of the bills will not be processed further.

i. The copy of the bank statement showing payment details of the wages of workers for the month or the statement of disbursement of Individual Cheques to the employees duly showing the Cheque number and the amount paid to the individual.

ii. The Contractor should deposit the monthly contribution towards EPF & ESI as per the existing norms into their individual Accounts of his staff opened in the EPF & ESI Organizations respectively. He should download the list of employees from the website of respective organization every month as a proof of payment made. The same should be enclosed to the monthly bills every month along with Vouchers of payment.

iii. For reimbursement of tipping charges, contractor needs to submit the valid documentary evidence/Weight measure voucher along with monthly bill in token of how much quantity of Garbage/Rubbish handed over to GHMC/Operator of facility for safe disposal of Garbage/Rubbish in terms of Solid Waste Management Rules-2016. Without which the equivalent amount will be deducted from the bill as explained above under clause ‘C’.

E. The Contractor should maintain and kept available the registers as required by the work executive for maintaining the schedules of cleaning aspects at North Lallaguda Railway Colony for preparation of Monthly bill.

F. Necessary deductions towards Income Tax etc. shall be effected at source at the time of settlement of monthly bills.

G. The billing cycle will be monthly.

22. Price Variation Clause(PVC):

Since it is a labor –oriented work, PVC will be considered on labor components. As per assessment made in the estimate, labor component for works covered is 47.72% of total estimated value.

Formula:

The amount of variation in prices/rate of labor shall be worked out by the following formula.

For work of Schedule-A

L= W X (LQ-LB) X 47.72%

LB

L = PVC value on labor component.

W = Cross value of work done by Contractor as per on account bills

LB =Rate of wages published by Central Labour Ministry which is applicable at base month. Base Month shall be taken as a month for opening of tender/last negotiation to be held, whichever is later.

23. Variation in Quantities:

The Railway reserves the right to alter the Scope of work. If due to change of scope of work or any other reasons, there be variations, either increase or decrease in quantities, payment will be made only for the actual quantities executed at the accepted rates. If there be sufficient cause the Railway may grant extension of the date of completion suitably.

Such circumstances shall in no way affect or vitiate the contract or alter the character thereof, or entitle the contractor to damages or compensation thereof except as provided for in this contract.

The quantities of each item of work furnished in the Schedule are approximate and are intended for the guidance of Tenderer/Contractor. In actual execution of work there may be some increase in the quantities specified. Such variation up to 25% shall in no degree affect the validity of the contract and it shall be performed by the contractor as provided therein and be subjected to the same conditions, stipulations and obligations originally and expressly included and provided for in specifications and scope of work and the amount to be paid therefore shall be calculated in accordance with accepted schedule rates.

In the event of any reduction in the quantity to be executed for any reasons whatsoever, the contractor shall not be entitled to any compensation but shall be paid only for the actual amount of work done.

For SOR items the limit of 25% would apply to the value of SOR schedule as a whole and not on individual SOR items. However, in case of NS items, the limit of 25% would apply on the individual items irrespective of the manner of quoting the rate.

Individual NS items in contracts shall be operated with variation of plus or minus 25% and payment would make as per the agreement rate.

The limit for varying quantities for minor value items shall be 100% (A minor value item for this purpose is defined as an item whose original agreement value is less than of the total original agreement value).

Execution of quantities beyond 25% of the overall agreement value should not be permitted, and if found necessary, will be executed through fresh tender. If floating a fresh tender is considered not practicable, quantity of that item may be operated in excess of 125% of the agreement quantity (100% i.e., the original quantity + 25% i.e., quantity over and above the original quantity) subject to the following conditions:

a. Quantities, if so decided by Railways to be operated in excess of 125% but up to 140% of the agreement quantity of the concerned item, shall be paid at 98% of the rate awarded for that item.

b. Quantities operated in excess of 140% but up to 150% of the agreement quantity of the concerned item shall be paid at 96% of the rate awarded for that item.

c. Variation in quantities of individual items beyond 150% shall be paid at 96% of the rate awarded for that item in the tender.

d. The variation in quantities as per the above formula will apply only to the individual items of the contract not on the overall contract value.

e. For, execution of quantities beyond 150% of the overall agreement value, if found necessary by Railways, should be only through fresh tenders or by negotiating with the existing contractor, with prior personal concurrence of FA & CAO and approval of General Manager.

No such quantity variation limit shall apply for foundation items.

In case the contractor fails to attend the meeting after being notified to do so or in the event of no settlement being arrived at, the Railway shall be entitled to execute the extra works by other means and the contractor shall have no claim for loss or damage that result from such procedure.

The aspect of vitiation of tender with respect to variation in quantities should be checked and avoided. In the event of any reduction in the quantity to be executed for any reasons what so ever, the contractor shall not be entitled to any compensation but shall be paid only for the actual amount of work done. The contractor is bound to notify the Chief Medical Superintendent, Hyderabad through CHI/NLGD at least seven days before the necessity arises for the execution of any item in excess of 25% of the quantity provided in the agreement. In case the contractor fails to attend the meeting after being notified to do so or in the event of no settlement being arrived at the Railway shall be entitled to execute the extra work by other means and the contractor shall no claim for loss or damage that may result from such procedure.

24. Provision of Accommodation: The Accommodation will be provided subjected to availability as per the extant rules of Railway applicable for execution of Contracts & amended from time to time to keep the Contractor’s stores and for staff to perform their daily activities.

25. Railway Passes: No free Railway passes shall be issued by the Railway to the Contractor or any of his employee/worker. No allowance or any other compensation will be paid by S.C. Rly for the visits of the contractor or his representatives to S.C. Rly’s site and for the time spent by them at S.C. Rly’s site, for performing work covered under this contract.

26. Time Schedule & Extension of Contract period:

a). The time schedule is 24 Months from the date of commencement of the work as per the clause no. 1.5 of Tender notice.

b). The administration reserves to itself, right to extend the contract for a further period beyond the specified date of expiry of the contract up to THREE MONTHS duration of originally agreed contract period or till the finalization of fresh tender whichever is earlier at the same accepted rates.

c). The contractor shall not at any time and on any ground whatsoever during the period of this extension of contract claim any revision or modification of the rates agreed upon for the work allotted.

d). Quantum of payment shall be same for this extended period also. All disputes and differences of any kind whatsoever arising out of or in connection with the contract, whether during the progress of the works or after the completion and whether before or after the determination of the contract shall be referred by the contractor to the Railway and Railway shall return within a reasonable time after their representation made and modify decisions thereon in writing. The decisions, directions, clarifications with respect to any matters the decisions of which is specially provided by these or other special conditions, given and made by the Railway represented by the Chief Medical Superintendent, Hyderabad Division, S C Railway be referred herein after as ‘expected matters’ as per part II(s) and shall be final and binding upon the contractor and shall not be set aside on account of any informality, omission, delay or error in proceedings in or about the same or any other ground or for any other reasons and shall be without appeal.

27. Penal charges: - If Railway Administration is not satisfied with the work of various aspects of cleaning on any day or days, the penal charges will be imposed as per the Sl. No 15 under Scope of work and Special Conditions for execution of work.

28. Failure on the part of the contractor: - In the event of any failure on part of the contractor to fulfill any of the obligations under the contract, it shall be lawful for the railway administration to make alternative arrangements at the risk and cost of the contractor without any notice as may be necessary to provide services of Collection and Safe disposal of Rubbish/Garbage from North Lallaguda Railway Colony and the cost of the making such alternate arrangements/hiring man power will be deducted from the rest of payments to the contractor or shall be deducted from the security deposit.

D. DESCRIPTION/SCOPE OF WORK AND SPECIAL CONDITIONS FOR EXECUTION OF WORK:

1. Name of Work: Outsourcing of Collection and Safe disposal of Rubbish/Garbage from the North Lallaguda Railway Colony of HYB Division On Contract Basis for a period of 24 months. The detailed Scope of Work & Cleaning Schedule is as follows.

Scope of work: Door to door Collection of Garbage from 1359 Quarters & 8 Service Buildings by engaging 6 Persons along with Tricycle Rickshaws daily, Emptying of all dust bins located in the Railway Colony premises & Disposal of the same through transportation by engaging/hiring approximate loading capacity of 3.5 – 4.5 ton of Garbage Vehicle or equivalent capacity of suitable other goods Carriage Vehicles Minimum 23 trips in a month from the Jurisdiction of North Lallaguda Railway Colony either to Designated Municipal Dumping Yard or Operator of facility approved by competent authority. The detailed work is as follows.

4.1. The cleaning work shall be carried out by contractor duly engaging minimum 6 Safaiwalas Providing Weekly Rest to the staff is mandatory and the same should be marked in the Attendance Register by the Contractor. Any short supply of Man power, if found on any particular day other than above will attract the penalty as per penalty clause 15.4.

4.2. In case of exigency the Contractor should deploy additional work force at short notice.

3 Disposal of animal carcass

If any animal found dead, it should be disposed off in a safe manner and the surrounding area should be disinfected by sprinkling of admixture of Bleaching Powder and Lime in the ratio of 1:4.

4.3. The Contractor shall not engage any person below 18 years of age and above 40 years of age. They should be fit physically and mentally for the work as specified in the Tender Notice. While engaging the staff contractor should take advice of the Health Inspector.

4.4. The contractor shall not engage any retired Railway Employee/Gazetted employee of Railway Medical Department or any other Department himself engage in or associate a retired Railway employee/Gazetted employee of Medical Department or any other Department has not completed two years from the date of retirement, in connection with this in any manner whatsoever without obtaining prior permission of the President as per clause 10 h, i , of this Tender Notice at page no.8 &9.

4.5. Railway Administration reserves its right to remove any person at any time, if the person not performs work satisfactorily, behaves mischief or caused to be removed for any other reasons.

4.6. The Bio-Data of persons employed, their residential address and clearance certificate from police station where they reside, stating that they are not involved in any civil or criminal case, should be submitted to the railway authority before commencing the contract. A copy of the same should be submitted to the concerned Health Inspector.

4.7. All the staff should report to the work spot, 15minutes in advance to the schedule time as Prescribed by the Chief Health Inspector.

4.8. The distribution of staff will be done in consultation with the Health Inspector depending upon the workload and local conditions.

4.9. Staff shall be properly trained for cleaning work and operation of equipments.

4.10. Contractor should provide a neat & clean uniform along with Protective gear i.e., Nose mask, Hand gloves, Shoes and jackets with self illuminated stripes to the Safaiwalas. Adequate no of them should be kept available so that the staff are always available in uniform. Not wearing uniform and protective gear will attract penalty as per Penalty Clause 15.10.

4.11. All the staff employed by the contractor should carry/wear laminated photo identity card duly signed by the Contractor shall be pinned/hanged round the neck.

4.12. The Contractor shall conform to all laws, by laws rules and regulations for the time being in force pertaining to the employment of local or imported labor and shall take all necessary precautions to ensure and preserve the health and safety of all employed directly on the works. The Railway Administration shall not be held responsible if the staff employed by him sustains any injury or any incidental illness.

4.13. First Aid facility should be provided by the Contractor. The First Aid Box should be equipped with prescribed contents and keep available to Labour during all times at their work spots.

4.14. The Contractor shall pay to the labour employed by him the wages as per the provisions of the Contract Labour (Regulation and Abolition) Act -1970 and its Rules – 1971 as mentioned under clause no. 6 of General condition of contract of this Tender at page no.15. In terms of the Section 6 of the Payment of Wages Act, 1936, (Act No. IV of 1936) The Contractor shall pay wages to the persons employed therein, either by cheque or be crediting the wages in their Bank Account. Contractor has to make necessary arrangements for payment of the wages as said above from the first month of commencement of the Contract. The Bank statement of credit details of the staff or statement of disbursement Cheques to the staff of previous month should be attached to the next month bill, otherwise the bills will not be passed.

4.15. The Contractor shall issue Monthly Wages slips to all work men showing the details of the gross wages, deductions if any and net wages.

4.16. The Contractor shall also provide weekly rest on staggered basis to all his workers.

4.17. The contractor shall be the employer for his personnel and railway administration will not be held responsible partially/fully for any dispute that may arise between the contractor and the workers.

4.18. The contractor has to note that the services of the Labour will purely be on contract basis and they will not be entitled for regularization of service in Railways at any time.

4.19. The contractor shall take requisite precautions and use his best endeavors to prevent any riotous or unlawful behavior by or amongst his workmen during the contract period. If cleaning work has been stalled due to total tool down of the work/Strike by the workmen suitable penalty will be imposed as per clause 15.7.

5. Supply and Use of Materials:

5.1 . The contractor shall arrange and use the following cleaning materials of the ISI standard quality for cleaning. These are minimum specified against their columns as per the clause no.8 of Special conditions of this Tender.

5.2. Contractor shall use adequate quantities of above materials for execution of the work. Contractor should keep available at any point of time the quantity of material sufficient for One Month as buffer stock in the Store Room and should ensure for proper recoupment of material at regular intervals. Railway Administration reserves its right to inspect the store room at any time, if found any shortage of material will attract penalty as per the clause 15.11.

5.3. Liberal usage of quick lime & bleaching powder in the ratio of 4:1 shall be ensured on the drains and surrounding areas of the dust bins and other areas to prevent obnoxious smell.

5.4. While supplying of the all Cleaning material and gadgets the Contractor shall ensure for quality of materials and Railway Administration has liberty to send the material/gadgets for testing at any time, if it thinks, as per the provisions of clause no. 12 of special conditions of this tender.

6. Contractor’s understanding: It is understood and agreed that the Contractor has, by careful examination, satisfied himself as to the nature and location of the work, Scope of Work, quality and quantity of the materials to be encountered, the character of equipment and facilities needed preliminary to and during the progress of the work, the general and local conditions, the labor conditions prevailing therein and all other matters which can in any way affect the works under the contract.

7. Adherence to specifications and schedule of work: The whole of the works shall be executed in perfect conformity with the specifications and schedule of the contract. If contractor performs any works in a manner contrary to the specifications or schedules or any of them and without such reference to the Chief Medical Superintendent ,Hyderabad Division he shall bear all the costs arising or ensuing thereof and shall be responsible for all loss to the Railway.

8. The figures regarding the extent of Scope of work as mentioned in the schedule are only indicative but not exact. The Material and Cleaning gadgets to be used are minimum specified only, there shall be variation in quantity depending up on the exigency.

9. Modifications to contract to be in writing: In the event of any of the provisions of the contract require to be modified after the contract documents have been signed, the modifications shall be made in writing and signed by the Railway and the Contractor and no work shall proceed under such modifications until this has been done. Any verbal or written arrangements abandoning, modifying, extending, reducing or supplementing the contract or any of the terms thereof shall be deemed conditional and shall not be binding on the Railway unless and until the same is incorporated in a formal instrument and signed by the Railway and the contractor, and till then the Railway shall have the right to repudiate such arrangements. For the purpose of this clause, the powers for modifications to the contract shall entitled by the Chief Medical Superintendent, Hyderabad Division on behalf of the Railway by the order in writing.

10. Instructions of CMS/HYB’s Representative: Any instructions given by the CMS’s Representative i.e., Asst. Health Officer/HYB Division, Health Inspector/NLGD to contractor in connection with the work shall bind the contractor as through it had been given by the CMS/HYB always.

11. Safety of Public: The contractor shall be responsible to take all precautions to ensure the safety of the public whether on public or Railway property and shall post such look out men as may be in the opinion of the Chief Medical Superintendent, Hyderabad Division be required to comply with regulations appertaining to the work.

12. Workmanship and testing: The whole of the works and/or supply of materials specified and provide in the contract or that may be necessary to be done in order to form and complete any part thereof shall be executed in the best and most substantial workman like manner with materials of the best and most approved quality of their respective kinds, agreeable to the particulars contained in or implied by the specifications and as referred to in and represented by the schedule/scope of work or in such other additional particulars, instructions may be found requisite to be given during carrying on of the works and to the entire satisfaction of the CMS/HYB or AHO/HYB or HI/NLGD according to the instructions and directions which the contractors may from time to time receive from the CMS/HYB or AHO/HYB or HI/NLGD. The Materials may be subjected to tests by means of such cleaning material, Gadgets and appliances as the CMS/HYB or AHO/HYB or HI/NLGD may direct and wholly at the expense of the contractor.

13. Special Conditions for Execution of Work:

13.1 The above work shall be carried out by contractor duly engaging minimum 6 Safaiwalas along with 6 Tri cycle Rickshaws distributing them in consultation with the Health Inspector on each day as per the above cleaning schedule.

13.1. Before starting the work, the Contractor or his authorized representative shall report to the Chief Health Inspector/NLGD to receive instructions regarding the work to be carried out on that particular day. For this purpose, If the contractor unable to report personally every day, he can nominate one person as his representative as per the extant rules for execution of work and authorized to sign all the registers and documents pertaining to the contract on behalf of Contractor in writing on or before the commencement of work.

13.2. Door to Door Garbage/house waste has to be collected daily from the approximately 1359 quarters and 8 Service Buildings by engaging 6 Tri – Cycle Rickshaws. Any addition or reduction in the total no. of quarters or service buildings may happen due to the vacation of quarters, condemnation of quarters or temporary locking of quarters or holiday to the service

building or newly constructed units, which are referred as made available quarters/Service Buildings on that particular day.

13.3. The contractor should make necessary arrangements to get the acknowledgement from the at least 25% of made available colony residents/ in–charge of the Service Building in a form of daily feedback sheet after collecting the garbage and the same has to be submitted to the Health Inspector duly mentioning the no. of quarters & Service Buildings made available and no. of Quarters & Service Buildings attended on that particular day. Failing to attend quarters/ Service Buildings will attract the penalty as per the penalty clause 15.1

13.4. Approximate generation of Garbage in the Railway colony from quarters, Service buildings, Colony dust bins and from all other sources will be 2632.5 kgs/2.6325 ton/193 CFT per day. The generated garbage has to be disposed by duly engaging/hiring a loading capacity of approx. 3.5 – 4.5 tons of suitable Vehicle used for transportation of Garbage and approved by Municipal/Transport Authorities Twenty Three Trips in a Month as per the cleaning schedule. If any day the vehicle has not been engaged as per the schedule, penalty will be imposed as per the penalty clause 15.3.

13.5. The No. of trips of Garbage vehicle is estimated on the approximate generation of garbage from the colony and the trips specified are minimum indicative only. In exigency more no. of trips are also to be operated by the contractor at his own cost. No extra payment will be entertained. The ultimate aim is no heaps of garbage should be found in the colony.

13.6. The Garbage should not be dumped in the Railway Colony premises, if found suitably penalized as per penalty clause 15.6.

13.7. The Sweepings at any cost should not be burnt. If found, they will be suitably penalized as per penalty clause 15.9.

13.8. If the Tenderer wants to engage the Vehicle for transportation of the garbage at his own, a valid driving licence holder should only appointed as driver. If he wants to hire the said vehicle he has to ensure about the availability of the valid driving licence with the driver and all other valid documents to run the vehicle.

13.9. Expenditure towards all the repairs, if any, to the tri-cycles/Garbage vehicle shall be borne by the contractor. During the period of breakdown, the contractor has to make alternate arrangements, otherwise the period will be treated as no work done and attracts penalty as per the penalty clause 15.3.

13.10. All the dust bins located in the colony & in Bungalows have to be cleared regularly. After emptying the dust bin the surroundings should be disinfected by sprinkling the admixture of Bleaching powder and lime in the ratio of 1:4 to avoid obnoxious smell and attraction of flies. Deviation will attract the penalty as per the penalty clause 15.5.

13.11. No scope should be given to the overflow of the dust bins and scattering of garbage around the dust bin. At any given point of time no dust bin should be found filled with more than half of the dust bin. Deviation will attract the penalty as per the penalty clause 15.2.

13.12. Final disposing of garbage has to be done as per the norms of Solid waste Management Rules in force. The contractor has to submit self declaration Certificate for every month stating that “The garbage collected from the Railway colony during the Month has been disposed in a proper manner as per the norms of the Solid Waste Management Rules in force” along with the valid documentary evidence/Weight measure vouchers in token of how much quantity of Garbage/Rubbish handed over to GHMC/Operator of facility for safe disposal of Garbage/Rubbish in terms of Solid Waste Management Rules-2016 and the same has to be attached to the monthly bill, otherwise the amount estimated towards tipping charges will not be paid.

13.13. The contractor shall be responsible to comply with all the provisions of the Solid Waste Management Rules in force. The Railway shall not be bound to contest any claim made against aforesaid Rules.

13.14. The Contractor has to execute the work as specified above to the utmost satisfaction of the colony residents and Railway administration. If any unsatisfactory work is found, penalty will be imposed as per the clause of 15.8 and this unsatisfactory performance if continues in-spite of advises of Railway administration, if no improvement founds, the contract will be terminated.

13.15. If any animal found dead in the premises of North Lallaguda Railway Colony or any instructions received from the HI/NLGD regarding disposal of animal carcass, it should be disposed off immediately in a safe hygienic manner and the surrounding area should be disinfected by sprinkling of admixture of Bleaching Powder and Lime in the ratio of 1:4. Failing to do so penalty will be attracted as per penalty clause 15.12.

14. Registers & Reports:

14.1. All the statutory Registers: should be maintained and updated regularly by the contractor as per the provisions of the Labour laws mentioned under clause 6 B iii of General Contact conditions of this Tender at page no.16. And should keep all records accessible to Labour Enforcement Officer/other inspecting officers on their demand.

14.2. Suggestions & Complaint book: should be kept by the Contractor at Health Inspector’s Office to facilitate the residents of the Colony for offering their suggestions / complaints on the execution of door to door garbage collection work. The Contractor should take appropriate corrective action on the complaints / suggestions made by the Colony Residents immediately.

14.3. Stores Register: A ledger of Cleaning Material & Cleaning Gadgets has to be maintained by the Contractor. Health Inspector/any other Railway Officials have the liberty to check the stores register at any time.

14.4. Performance Register has to be daily signed by the Contractor/Contractor’s authorized Representative maintained by the Health inspector which is duly recording of the daily activities done by the Contractor on that particular day.

14.5. Garbage Vehicle Register has to be signed by the contractor/Contractor’s authorized Representative maintained by the Health Inspector to record the no. of trips made in a Month for lifting and transportation of garbage from the North Lallaguda Railway Colony as per the work schedule.

14.6. Daily Feed Back sheet should be maintained by the contractor and submit to the Health Inspector which should contain the details of the No. of Quarters/Service Buildings Made available, No.of Quarters/Service Buildings attended, No. of Quarters/ Service Buildings not attended and should obtain the signatures from the Colony residents at least 25% of the total quarters available on that day.

15. Penalties: If the Railway is not satisfied that the works can be performed by the contractor and in the event of failure on the part of the contractor to perform the work as per the provisions under clauses from 3 to 5 of special conditions for execution of work of this tender and caused to impose penalty for any other reason, the Railway shall be entitled without prejudice to any other right to impose penalty as follows.

Tenderer shall down load corrigendum (if any), print it out, sign and attach it with the main tender document. Tender document not accompanied by the published corrigendum/s is liable to be rejected. The Railway will not be responsible for any postal delays and delay in downloading of tender document from the internet.

6. Tenderer/s are free to download tender document at their own risk and cost, for the purpose of perusal as well as for using the same as tender document for submitting the offer, master copy of the tender document is available in the office of Chief Medical Superintendent/Hyderabad Division, 2nd Floor, Hyderabad Bhavan Opp: to Rail Nilayam Secunderabad. After award of work, an agreement will be drawn, which shall be executed by the successful tender and this agreement will be drawn which shall be executed by the successful tender and this agreement will be prepared based on the master copy of tender document available in the above mentioned office and not based on the tender document submitted by the tenderer. In case, any discrepancy between the tender documents downloaded from the internet and the master copy, later shall prevail and will be binding on the tenderer/s. no claim on this account will be entertained.

7. If any change/addition/deletion is made in the tender document by the Tenderer/Contractor and the same is detected at any stage even after the award of the tender, the tenderer’s full earnest money deposit will be forfeited and contract will be terminated at his/their risk and cost. The tenderer is also liable to be banned from doing business with Railways and/or prosecuted.

8. The following declaration should be given by the tenderer while submitting the tender:

(a) I/We have downloaded the Tender Book from the internet site http://www.scr.indianrailways.gov.in and I/We have not tampered/modified the Tender Books in any manner. In case, if the same is found to be tampered/modified I/We understand that my/our tender will be summarily rejected and full earnest money deposit will be forfeited and I/We are/are liable to be banned from doing business with Railways and/or prosecuted.

(b) I/We enclosed herewith a demand draft/MCR No…………………… dated ……………………. issued by ……………………….. for ` ………………………………….. towards the cost of Tender Book.
