Alderman Jim Puckett opened the meeting with an invocation followed by the pledge of allegiance.

The Journal of Proceedings for the regular meeting of May 11, 2020 was approved as submitted by the city clerk on a motion by Alderman Little. Second by Alderman Schlensker. Motion carried. 10 Ayes (Aldermen Puckett, Little, Pruitt, Frykman, Peterson, Holmes, Schlensker, Allton, Warden, Jacobson) Received a note from Jim and Carolyn Young, thanking Alderman Doug Allton and Zoning Officer Andrew Quintanilla for make their neighborhood a better place to live. Placed on file. Received a notice from the Illinois Commerce Commission of a hearing regarding Commonwealth Edison, to be held May 19, 2020, in the offices of the Commission, Chicago, IL. Placed on file. Mayor Jury announced that city offices will be closed Friday, May 22, and Monday, May 25, 2020 in observance of Memorial Day. The council meeting will be held Tuesday, May 26, 2020 at 6:00 p.m. Alderman Jacobson presented the Water Department bills dated May 11, 2020 in the amount of $90,103.854, and moved that they be paid. Second by Alderman Peterson. Motion carried. 10 Ayes (Aldermen Puckett, Little, Pruitt, Frykman, Peterson, Holmes, Schlensker, Allton, Warden, Jacobson) Alderman Jacobson presented the General Fund bills dated May 11, 2020 in the amount of $408,580.21, and moved that they be paid. Second by Alderman Peterson. Motion carried. 10 Ayes (Aldermen Puckett, Little, Pruitt, Frykman, Peterson, Holmes, Schlensker, Allton, Warden, Jacobson) Alderman Allton presented the Police Department Report dated May 18, 2020, to be placed on file. Alderman Schlensker presented the Street Department Report dated May 18, 2020; presented the Water Department Report dated May 18, 2020, to be placed on file. Alderman Schlensker of the Public Works Committee presented the Water Department list of bills dated May 18, 2020 in the amount of $277,503.26, for consideration at next week’s city council meeting. Alderman Peterson of the Codes and Regulations Committee announced that a committee meeting will be held Tuesday, May 26, 2020, following city council. Alderman Jacobson presented the following resolution authorizing the Mayor to execute an amendment to the City’s contract for fire and EMS services with Paramedic Services of Illinois, Inc. WHEREAS, the City has determined that it is in the best interests of the health, safety and welfare of the community to provide for enhanced fire and EMS protection for the City; and WHEREAS, the City has previously entered into a contract with Paramedic Services of Illinois, Inc. to provide personnel to the Fire Department; and WHEREAS, the City has negotiated with Paramedic Services of Illinois, Inc. to enter into amending the existing contract to increase the number of trained personnel provided to the City and to alter the administrative structure so as to reduce costs to the City overall from that originally budgeted. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and the City Council of the City of Loves Park, County of Winnebago and County of Boone, Illinois, that by the adoption of this resolution, that the Mayor and the City Council hereby agree as follows:
1. The above recitals are hereby incorporated into this Resolution as if fully stated herein.
2. The Mayor is authorized to sign an amendment to the contract with Paramedic Services of Illinois, Inc. for the provision of additional personnel to the City and to revise the scope of services in a form substantially similar to that attached hereto.
3. Should any provision of this Resolution be declared invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect any of the other provisions of this Resolution.
4. This Resolution shall be in full force and effect from and after its passage and approval.
Second by Alderman Peterson. Motion carried. 10 Ayes (Aldermen Puckett, Little, Pruitt, Frykman, Peterson, Holmes, Schlensker, Allton, Warden, Jacobson) RESOLUTION NO. 20-033 Alderman Schlensker presented for first reading an ordinance providing for no parking on Briar Patch Lane from Harlem Road to Parks Edge, and moved to waive the reading of the ordinance as all aldermen have been provided copies. Second by Alderman Jacobson. Motion carried. 10 Ayes (Aldermen Puckett, Little, Pruitt, Frykman, Peterson, Holmes, Schlensker, Allton, Warden, Jacobson) ORDINANCE NO. 4341-20 Alderman Jacobson moved that the meeting be adjourned. I. Call to Order – the meeting was called to order by Alderman Peterson, Chairman at 7:03 PM.
Committee Members Present – Alderman Little, Alderman Warden. Alderman Puckett. Also in Attendance – City Clerk Bob Burden, Dan Lane
II. The minutes of the April 6, 2020 meeting were approved upon a motion by Alderman Warden, second by Alderman Little. Vote 4 – 0 to approve.

A. Special Event Permit application from Dan Lane for a farm market to be held at 6401 N. Second St. from May 1 – October 31.

ORDINANCE No. 2020-
AN ORDINANCE AMENDING THE LOVES PARK CODE OF ORDINANCES TO
ALLOW FOR THE CREATION, EXPANSION AND REGULATION OF OUTDOOR
SEATING FOR BARS AND RESTAURANTS
WHEREAS, Coronavirus Disease 2019 (COVID-19) is a novel severe acute respiratory
illness that the World Health Organization declared a Public Health Emergency of International
Concern on January 30, 2020, and the United States Secretary of Health and Human Services
declared presents a public health emergency on January 27, 2020; and
WHEREAS, Due to COVID-19, on April 30, 2020 the Governor of the State of Illinois
declared a stay at home order that did not permitted bars and restaurants to have indoor or outdoor
seating; and
WHEREAS, the Governor of Illinois has announced that bars and restaurants will be
permitted to have outdoor seating starting May 29, 2020; and
WHEREAS, pursuant to 65 ILCS 5/1-2-1, the City of Loves Park, Illinois, an Illinois
municipal corporation (“City”), is authorized and empowered to adopt and enforce local
ordinances; and
WHEREAS, the City is authorized by law to exercise any power and perform and function
pertaining to its government and affairs for the protection of the public health, safety, morals, and
welfare; and
WHEREAS, the City desires to help bars and restaurants expand their outdoor seating
options by temporarily modifying City ordinances related to outdoor seating and liquor sales until
the end of the COVID-19 pandemic or when the restrictions on social distancing in bars and
restaurants are lifted, whichever first occurs; and
WHEREAS, the City of Loves Park Director of Community Development, Steve
Thompson, (“Director”) shall have the authority to develop rules and regulations governing how
bars and restaurants can expand their outdoor seating spaces; and
WHEREAS, the Director shall coordinate with the Loves Park Police Chief and Loves
Park Fire Chief to develop guidelines governing outdoor seating during the COVID-19 Pandemic;
and
WHEREAS the City has determined the amendments set forth in this Ordinance are in the
best interest of the City and its residents and that the Ordinance will help bar and restaurant owners
and patrons during this pandemic as well as improving the economic condition of the community
as a whole.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LOVES PARK, WINNEBAGO AND BOONE COUNTIES, ILLINOIS AS FOLLOWS:

1. The above recitals are incorporated by reference herein and made a part hereof.
2. That any Loves Park City Ordinances that relate to outdoor seating for restaurants and bars
are hereby suspended and the Director shall have the authority to approve temporary
outdoor seating spaces or expansions of exiting outdoor seating spaces until earlier of when
the authority is revoked by City Council or the COVID-19 Pandemic ends.
3. The Director’s authority shall include, but not be limited to, the authority to establish
regulations and guidelines that govern new and existing outdoor seating spaces. The
Director may revoke a bar or restaurant’s ability to have outdoor seating if the business is
not following applicable City, County or State regulations.
4. All restaurants and bars who seek to create a new outdoor seating space or expand their
current space must contact the Director for approval of any new outdoor seating space
and/or expansion of any existing outdoor seating space. Parking lots may be used for
outdoor seating spaces.
5. Nothing in this Ordinance is intended to alter, in any manner, any rules or regulations of
the Winnebago County Health Department relating to food safety.
6. The provisions of the Loves Park Liquor Code are temporarily amended to coincide with
the foregoing regulations to allow for the serving of alcoholic beverages within the
expanded seating area by any restaurant that has a valid liquor license.
7. All other provisions of the Code and any City Ordinances or Resolutions shall remain in
effect as previously enacted except that those Ordinances, Resolutions or parts thereof in
conflict with the provisions of this Ordinance are hereby suspended during the applicability
of this Ordinance.
8. This Ordinance shall be in full force and effect from and after its passage, approval, and
publication in pamphlet form as provided by law.
