What is Council Tax?Council Tax is charged on all domestic properties. It consists of charges set by Durham County Council and its preceptingbodies (Durham Police and Crime Commissioner, County Durham and Darlington Fire and Rescue Authority, Local Townand Parish Councils and the Charter Trust for the City of Durham).

In general, the residents of a property will be responsible for paying Council Tax whether they own or rent it, provided theyare over 18 years of age. If the property is unoccupied, the owner will still be responsible for paying a charge unless theproperty is exempt.

The Council Tax charge levied by Durham County Council has been increased by 1.99%, shown as a 2.0% increase onyour bill because Council Tax legislation states we must show the figure to one decimal place. This year your bill includes aseparate Adult Social Care precept of 2.0%, in line with Government guidance to cover the rising costs of Adult Social Careservices to vulnerable adults. The Secretary of State for Communities and Local Government has made an offer to adult social care authorities. (“Adultsocial care authorities” are local authorities which have functions under Part 1 of the Care Act 2014, namely county councilsin England, district councils for an area in England for which there is no county council, London borough councils, theCommon Council of the City of London and the Council of the Isles of Scilly.) The offer is the option of an adult social careauthority being able to charge a “precept” of up to 2% on its council tax for the financial year beginning in 2016 withoutholding a referendum, to assist the authority in meeting expenditure on adult social care. Subject to the annual approval ofthe House of Commons, the Secretary of State intends to offer the option of charging this “precept” in relation to eachfinancial year up to and including the financial year 2019-20. In relation to the financial year beginning in 2016 the Secretaryof State has determined (and the House of Commons has approved) a referendum principle of 4% (comprising 2% forexpenditure on adult social care and 2% for other expenditure), for adult social care authorities. These authorities maytherefore set council tax up to this percentage in 2016 without holding a referendum.”

SMS Text Alert It would be helpful if you could provide us with your mobile telephone number should we need to contact you orrequest further information to update your accounts correctly. Communicating with us by text is quicker and moreenvironmentally friendly. It can also avoid us taking unnecessary recovery action which could result in you incurringadditional costs as well as costing the council more in stationery and postage costs.

Manage and pay your Council Tax onlineYou can also view and manage your Council Tax, Business Rates or Housing Benefits accounts using our onlineopen access system. Register for secure access to your Council Tax, Business Rates and Housing BenefitAccounts online. This gives you the ability to view this information at any time without needing to keep track of orstore paper bills.

You can log in at a time that suits you - 24 hours a day, seven days a week. Account details are updated instantly sothe information is always accurate. You can:

• View your Council Tax and Business Rates bills securely rather than getting a bill through the post – this means you will no longer get a paper statement/bill.

• Tell us about any change in your personal details, without having to contact us via the telephone or in person.

• Check your account, including your outstanding balance, future instalments, bill transactions and Housing Benefit payments, if you receive them.

• Link through to pay your Council Tax online.

What does my Council Tax help pay for?Council Tax is not a bill for the services you use, but the money we raise from all households in County Durham helps usfund all of our services.

This year the government have allowed us to increase the council tax charged by an additional 2% to help fund theincreased costs of providing Adult Social Care services. We provide adult social care services for the most vulnerablepeople in our community, including:

• older people

• people with a learning disability

• people with a physical disability

• people with sensory loss

• people with mental health needs

The introduction of the National Living Wage and increase in population means this is an area where we have seensignificant financial pressures. The 2% increase will help us to maintain our current services.

Council Tax valuation bandsYour property is placed in one of eight bands according to its value. This allows us to calculate your Council Tax bill inaccordance with statutory requirements. Properties in Band A pay 6/9ths of the charge levied on Band D properties,whereas properties in Band H pay twice the level of Band D properties.

The valuation is based on the amount your property might have sold for on the open market on 1 April 1991. It is notbased on its current market value. The valuation and allocation of Council Tax Banding is undertaken by the ValuationOffice Agency, which is part of HM Revenue & Customs. Details of all property bands are available on www.gov.uk

If you think that the valuation of your property is wrong, you can appeal if:

• It is within six months of your purchase of the property; or

• The whole, or part, of the property has been demolished; or

• The surroundings of the property have changed.

If you appeal you must continue to pay the instalments shown on your Council Tax bill until a final decision is made. Council Tax appealsAs well as appealing against the band your property has been placed in, you may also appeal about other Council Taxmatters. For example:

• If you do not think you are the person who should pay the bill;

• If you think you should get a discount or reduction which you have been refused;

• If you think your property should be exempt from Council Tax but an exemption has been refused.

An appeal about a Council Tax matter must be made in writing to the address on the front of your Council Tax bill. If yousubmit an appeal you must continue to pay the instalments shown on your Council Tax bill until a final decision is made.

If you make an appeal to us about a Council Tax matter and you are not satisfied with the outcome, we will tell you howyou could make a further appeal to an independent tribunal. Again, you must continue to pay the instalments on yourCouncil Tax bill until the matter is fully concluded.

Are you paying too much Council Tax?Council Tax Reduction (CTR)Whether you are in work, unemployed or retired, the CTR scheme is available to help reduce your Council Tax bill.The amount of CTR, a discount you can get off your bill, depends on how much money you have coming in andany savings. It also depends on the number of people living in your home, their ages and their income. If you areon a low income and have less than £16,000 in savings you may qualify for this discount.

Second Adult Reduction (SAR)If you have another adult living in your home who has a low income, you may be able to reduce your Council Taxbill by claiming SAR for that person. You can claim this even if your income and capital is too high for you toreceive CTR.

How to claimTo apply for a CTR or SAR discount, you can claim online at www.durham.gov.uk/counciltaxreductions or call us on03000 262 000 or call at one of our local access points.

ExemptionsSome properties may be exempt from Council Tax if they are unoccupied for certain reasons, or occupied by certaingroups of people. Examples include;

• A property where all the adult occupiers are students;

• A property where all the adult occupiers are classified as severely mentally impaired;

• A property left unoccupied on the death of the resident;

• A property left unoccupied when the resident has moved to receive or provide care.

DiscountsYou are entitled to a 25% discount if you live on your own. Some people are not counted when we work out howmany people live in your home. For example, anyone under 18, students, apprentices, youth trainees, carers,people in prison and people who are severely mentally impaired. This means you may still get a discount even ifyou don’t live alone.

A 50% discount may apply if any annexe is used by the occupier of the main building or a member of his/her family.

Second Homes and Unoccupied Furnished/ Unfurnished PropertiesOwners of unoccupied, furnished/unfurnished properties and properties identified as second homes will have to pay100% of their Council Tax charge. If the second home is job related in accordance with Council Tax legislation a 50%discount may apply.

Unoccupied and Unfurnished Properties for more than 2 yearsProperties which have been unoccupied and unfurnished for more than 2 years will be subject to a 150% charge, called

Long Term Empty Property Premium. This policy is aimed at encouraging homeowners to return long-term emptyproperties back into use.

Reductions for disabled peopleWe can reduce your Council Tax bill if a disabled person lives in your property and it has at least one of the following:

• A room that is not a bathroom, kitchen or toilet that is mainly used by the disabled person and is essential for their needs;

• An extra bathroom or kitchen that is essential for the disabled person’s needs;

• Extra space inside the property so that the disabled person can use their wheelchair indoors.

Hardship ReliefIn cases of clear financial hardship, a reduction in your Council Tax may be granted by the Council or your paymentcould be deferred. Each case is considered individually against the Council’s Hardship Policy. Please contact theCouncil immediately if you have any difficulties in paying your Council Tax. Paying your Council Tax bill How to payDirect DebitThis is the simplest way to pay and makes life easier - here's why:

• Convenience - forget queues, cheques, stamps, reminder letters, car parking, bus fares.

• Choice - there are a number of payment dates and periods available. You choose.

• Advance notice - details of payments are sent to you in plenty of time to let you raise any query or even cancel. You stay in control.

• Peace of mind – make one phone call or sign one form and your Bank / Building Society does the work. You can forget about it.

• Protection - Direct Debit carries a money back guarantee in the truly unlikely event of an error. You can't lose out.

• Administration - is simpler and costs are lower. Everyone benefits.

Other methods of payment are shown on the back of your bill.

When to payYou have the right to pay your bill by monthly instalments. Normally this is ten payments from April to January but will beless if you get a new bill during the year. There are other instalment options available, contact us for details.

If payment is not made by the instalment due date and you miss paying a further instalment within the year, thenyour right to pay by instalments could be lost. Further non-payment will lead to recovery action being taken,which may include action through the magistrates’ court and additional costs, payable by you being levied. 5

What to do if you can’t pay on timeIt will usually be possible to make alternative arrangements for payment, although we would normally only make onesuch arrangement with you in any one billing year.

If you are unable to pay, contact us at the earliest opportunity to discuss alternative arrangements as this could avoidunneccessary action being taken and further costs being levied. Contact us on 03000 264 000.

Use of personal informationWe may use information you give us to prevent or detect fraud or other crimes. We may also share it with other councilservices or public organisations if they need it to carry out their duties. If you are claiming a discount or an exemption towhich you are not entitled and fail to notify us, this will be discovered as part of these exercises.

If you know of somebody who receives Housing Benefit, Council Tax Reduction or Single Persons Discount to whichthey are not entitled, call us on the number below, text or send an email. • Answer our requests for information or requests to contact us as soon as possible.

• Pay your Council Tax on time to avoid reminders and unnecessary recovery action being taken against you.

• Tell us straightaway if you are having difficulty paying.

• Pay your Council Tax by Direct Debit.

• Sign up to the Open Access service.

The Council’s budgetIn 2016/17 the total amount we plan to spend on services delivered to you (aggregate gross expenditure) is£1,198.730m. After deducting estimated income relating specifically to these services, specific grants and the use ofreserves, the remaining amount (the County Council’s Council Tax Requirement) is £378.775m. Taking into accountGovernment funding within our budget, leaves a County Precept of £197.311m to be raised from Council Tax payers ofwhich £185.798m will be used for County Council services.

Summary of terms used in the leafletRevenue Expenditure is expenditure incurred on regular day-to-day items such as salaries, supplies, payments tocontractors and other expenses of running the Authority.

Gross Expenditure is the total amount the County Council plans to spend.

Net Expenditure is Gross Expenditure minus charges to users of service and specified Government Grants to specificservices.

Capital Investment refers to money used by the council to purchase fixed assets, such as land, machinery, or buildings,or adds value to existing assets.
