2 CITY OF RYDE - PROCUREMENT

The ATTACHED report on formal procurement at the City of Ryde, provides information as to Requests for Tender or Requests for Quotation that are currently in the market. The report also outlines those items of procurement (if any) that are to be reported to the next meeting of Council in accordance with the requirements of the Local Government Act and Regulations. This includes all procurement in the bracket of $50k - $150k in value (Request for quotation) or exceeding $150k inc GST (Request for Tenders).

Some of these processes may be marked as being limited to selective respondents. Where this is the case, there has been a publicly advertised Expression of Interest process to establish select respondents or a panel of select respondents that are prequalified to undertake the required works.

4 AUSTRALIAN LOCAL GOVERNMENT WOMEN'S ASSOCIATION PROGRAM - 'EMPOWERING WOMEN IN LOCAL GOVERNMENT'

The Australian Local Government Women’s Association (ALGWA NSW) and the University of Technology Centre for Local Government (UTS: CLG) have partnered to present the ‘Empowering Women in Local Government’ program.

This program has been specifically developed to support women considering nominating as candidates in the 2016 Local Government elections; existing women Councillors and women working within the NSW Local Government sector.

The ‘Empowering Women in Local Government’ program is a UTS:CLG accredited course, which will run over six days commencing Friday 23 October 2015, and will comprise a mix of online and face-to-face learning.

5 MACQUARIE PARK STATION PRECINCT (FORMERLY HERRING ROAD UAP) AND IVANHOE ESTATE

As Councillors will be aware, the State Government announced the Macquarie University Station Precinct on Thursday 24 September 2015. The precinct plan includes:

Delivery of approximately 5,800 dwellings by 2031.

556 new social housing dwellings, at least 128 new affordable housing dwellings and approximately 1900 private dwellings on the Ivanhoe Estate site.

$5m to fund Council nominated embellishment of open space.

NSW Land and Housing Corporation door knocked residences at Ivanhoe Estate on Wednesday 23 September 2015 and held a Tenancy Group Meeting on Thursday 24 September 2015. Residents were advised that they will be relocated over the next three years and Relocation Coordinators will be working to facilitate this process and work through the options with residents.

7 STRATA LIVING IS COMMUNITY LIVING WORKSHOP - UPDATE

Councillors are advised that the Strata Living is Community Living workshop took place on Wednesday, 9 September 2015 at 6pm with approximately 25-30 people in attendance.

The City of Ryde and the Owners Corporation Network (OCN), a consumer advocacy group and Strata Sense, a Sydney based strata management agency, combined to deliver this consumer education workshop aimed at providing people with both the knowledge and skill-base on life in strata apartment living.

This pilot workshop marks the beginning of a series of workshops which are envisaged to be rolled in the near future to build on skills in different areas of strata, and to provide the community with helpful tips and strategies.

The event was co-presented by strata managers Natalie Fitzgerald and Marc Gibson from Strata Sense.

The workshop was very interactive with lots of participation from all parties. The information provided was successfully received with positive feedback given to those who organised the event.

8 COMPLETED PROJECT - NEIGHBOURHOOD CENTRE RENEWAL - QUARRY ROAD, RYDE

The Public Works – Project Development Unit has recently completed the neighbourhood centre renewal project at Quarry Road, Ryde. This project aims to improve the quality of the public domain and assist in promoting the prosperity and enjoyment of this centre. Upgrade works include granite banding, street furniture, bike hoops, car park resurfacing, concrete works and landscaping. Project Details:

9 DRAFT SUBMISSION: PROPOSED CHANGES TO PRE-GATEWAY REVIEW SYSTEM FOR PLANNING PROPOSALS

The Department of Planning and Environment has recommended changes to the pre-Gateway Review system. Currently applicants for Planning Proposals can request a review by the Department where Council does not support the Planning Proposal or if a decision to forward the Proposal for a Gateway Determination is not made within 90 days. The recommended changes are outlined in the “Pre-Gateway Review: Findings and Recommendations Report” and submissions close 14 October 2015. The Pre-Gateway Review – Finding and Recommendations report can be viewed via the link below: http://www.planning.nsw.gov.au/Plans-for-Your-Area/Local-Environmental-Plans/~/media/69E7DCC7E913431EA228BB551CF12DE2.ashx Council officers have prepared a draft response to the proposed changes (Attached) and it is intended that these comments be forwarded to the Department of Planning and Environment before the closing date. The key suggestions include ensuring the strategic focus of the reviews, clarifying the threshold for consideration of pre-Gateway reviews and ensuring changes do not compromise the quality of outcomes. 29 September 2015 Dear Sir/ Madam, Changes to Pre-Gateway Review system Thank you for providing an opportunity to comment on the changes announced to the pre-Gateway Review system. Since 2012 Council has supported 5 planning proposals, two planning proposals have been refused at Gateway and one planning proposal proceeded to Gateway despite Council not supporting the proposal. Five planning proposals are currently pending. Council has been a cooperative partner in the current process and is eager to ensure any changes maintain the integrity of the system. It is in this capacity that Council makes the following comments in relation to the Department’s Findings and Recommendation Report dated September 2015. General principle of pre-gateway reviews The pre-Gateway review process is often perceived as a mechanism for developers to bypass council decisions. From the summary of pre-Gateway reviews 2012-2015 provided on page 5 of the Report, it appears that just 23% of 75 reviews have been refused, with the remainder approved, not yet determined, or withdrawn by the applicant. The legislative basis for pre-gateway reviews is unclear. This process can erode the community’s faith in planning decisions and undermines long term strategic planning. Concern is raised with respect to both the current and amended decision-making process for pre-gateway reviews. Any party responsible for assessing the strategic merit of planning proposals needs to have the right skill base and

resources to assess strategic planning matters. The JRPP historically takes a design perspective, often in-line with its role in determining development applications, rather than taking a strategic overview of the site as it relates to the local government area and Sydney, as is required in for Planning Proposals. It is noted that under the proposed Greater Sydney Commission, the JRPP would be replaced, in either case it is crucial that the body tasked with assessing strategic matters has the requisite strategic focus. Currently, it appears that proposals do not always strictly adhere to the existing strategic merit test. Some proposals are recommended to proceed to a Gateway Determination despite the proposal not being entirely consistent with the relevant local strategy or the Metropolitan or regional strategy. For example, a planning proposal for 20 Waterview Street Putney was recommended by the JRPP to be forwarded for a Gateway Review where it was inconsistent with the IN4 Working Waterfront zoning and did not align with Metropolitan strategy objectives for retaining employment generating land uses. To improve the transparency both within the existing and proposed review process, a detailed assessment of whether the proposal meets each of the strategic merit tests should be made publicly available. In particular, the criteria to justify such decisions should be articulated as should the relative standing of the various strategic documents to be considered. Council agrees with the points made in the ‘Summary of Targeted Consultation Responses’ that “the role of the Department needs to support councils’ strategic work and remove itself from a negotiator role between the proponent, council and the JRPP” and “if a council’s decision is consistent with an approved strategy, then the decision should not be reviewed”. The proposed changes to the pre-Gateway reviews do not address these significant matters. Threshold for consideration of pre-Gateway reviews The Findings and Recommendation report states that these smaller matters currently constitute 65% of all reviews that have proceeded to Gateway. It is noted that currently there is no threshold for pre-Gateway reviews, nor is a threshold proposed to be introduced. City of Ryde’s position is that a threshold should be established, and only matters of state significance or regional strategic merit should be able to proceed to a pre-Gateway review (for example, planning proposals resulting in more than 100 dwellings or a Capital Investment Value of over $30 million). The review process should not be available for local planning matters.

The new strategic focus of reviews The Findings and Recommendation Report proposes to amend the strategic merit test for pre-Gateway reviews to include two new criteria. The first new test “the contemporary nature of the relevant LEP, measured by the time elapsed since the community has been consulted on the zoning of the subject area” is unclear and the appropriateness of this test is questioned. For example:

- An acceptable period of time since the community had been consulted is not

specified. The zoning of some low density residential areas may not have “changed” since the County of Cumberland scheme but may remain the most appropriate zoning for the site.

- Circumstances may exist where an LEP had been amended to reflect the Standard

Instrument template without a comprehensive review of zoning, where the zoning of an area had been considered in a Local Planning Strategy or other study which confirmed the zoning and did not ultimately result in an LEP amendment, or where the LEP built form controls had been amended (e.g. the permissible height or floor space ratio) but not the zoning.

A qualified assessment of this test would require detailed information regarding the local strategic planning history and site context which is currently not reported to the JRPP. This test may become another mechanism for applicants to justify proposals without a strategic basis. The second new test “demonstrable reason for the rezoning or change in planning controls based on changed circumstances since the LEP was made” would need to have some measurable targets. For example, would the provision of a new footpath satisfy the requirement for “new infrastructure” or would the infrastructure need to be more substantial than this? It is unclear whether this test is intended to replace any consideration of the relevant section 117 directions. Further, this test allows proposals to be justified on the basis of changed circumstances “in the public interest”. This should be removed as it is ambiguous and may facilitate the approval of proposals at pre-Gateway stage which do not meet the other defined strategic planning justification tests.

Accepting the RPA role It is City of Ryde Council’s policy not to accept the role as the Relevant Planning Authority (RPA) where the Council has decided not to support the proposal. If this was not the case, the 42 day timeframe would be insufficient within the Council meeting cycle. Council also urges the Department to give submissions due weight in more expanded report templates. Process The removal of the initial merit review by the Department is of concern as proposals will be forwarded straight to the JRPP. While Council welcomes efforts to ensure proposals remain consistent throughout the whole process, amending the process to require council to check whether the proposal is consistent with that submitted within 21 days is devolution of this function to local government. There is uncertainty as to what happens if the proposal differs or if advice is not received back from the council within 21 days and whether the JRPP could continue with its consideration of the proposal unchecked in this instance. Introducing this part of the process without the appropriate clarity and checks could potentially have the effect of inviting applicants to submit a revised proposal which is not the intent of the process and which Council will not have had the opportunity to consider. Greater clarity as to what constitutes “consistency” and what the process is in the case of inconsistency is required, to ensure the Gateway Review process is not used as a mechanism for developers to make changes to proposals and circumvent Council and the community’s consideration of those changes. Consultation before making a decision It is uncertain whether amending the “Guide to preparing planning proposals” and the “Guide to preparing LEPs” to note that in specified circumstances councils consider the benefit of community participation at an early stage prior to making a decision on the merits of a spot rezoning or LEP amendment would result in an extension to the 90 day timeframe for considering planning proposals. While we have no objection to amending the Guides to allow community consultation prior to Council considering the PP, provision should be made for an extension to the 90 day time period to accommodate the consultation period.

Time needed to assess pre-gateway review Many of the proposed changes appear to aim to expedite the process for developers. It is understood that pre-Gateway reviews take approximately 167 days. The Frequently Asked Questions on exhibition state that “changes made through negotiations between the applicant, council, the JRPP and the Department cause delays and uncertainty in the process”. While Council acknowledges the importance of a timely process we are concerned that some of the changes seek to achieve quicker determinations at the expense of consistent, transparent and high-quality planning outcomes. It is feared that this would not only compromise carefully made planning instruments reflecting community expectations, but would also fail to provide developers with the consistency required to proceed with confidence.
