WHEREAS, the duties of the Sheriff (Sherif/'s Department) of Sullivan County are vast andneed a neccssary number of quali1ied, well-trained individuals. These employees ml' required tobe loyal honcst citizens that are of good moral character and posses an impeccable personalbackground. It is essential they have the personality, intelligence, integrity, and stamina toexecute the diverse ohligations. They must have good physical and emotion'11 health to pcrlimnthe many and varied tasks which occur on a daily basis. ·r he requirements, ohligations andprocedures required of the Sullivan County Sheriffs Departmcnt are mandated by TennesseeCodc (Document 8-8-20 I, Document 5-7-108, Document 38-3- I(2);

WIl!?REAS, several Sullivan County Commissioners requested the Sullivan ('ountv Sheri ffsDepartment to ascertain pay scales ti·om other law enforcement agencies in tlw immediate andsurrounding area. The Sullivan County Sheritrs Department provided those concernedcommissioners with the attached pay scales. (Johnson City Police Department, j lawkins CoulltySherin's Department, Kingsport City Police Department, City or Bristol, TN PoliceDepartment);

WHFREAS, documents concerning pay scales hy the other agencies Irom immediatc andsurrounding areas, indicate a discrepancy in like pav when compared to those of SulJivan County(pay scales Johnson City Police Dcpartment Hawkins County Sheriff's DepartmcnC KingsportCity Police Department, City of Bristol, TN Police Department);

WHFREAS, efforts for pay raises by the Sullivan County Commission over the past severalyears have bcen consistent, comparison of law enforccment pay scales would indicate thatSullivan County's pay is not competitive with other immediate and surrounding law enforcementagencies (Attachment: Pay Raise Scale for Sullivan Counly);

WHEREAS, recruitment, training, and retaining the best law cn1i)rcement personnel has hecomea competitive market Ii)!' local law enforcement agencies. All too often, once a deputy hasreceived proper academy training, the lure of a hetter salaried position entices that oflicer to seckemployment c1sel\ here for the personalmonctary gain;

WHEREAS, the Gravely School properly which is no longer being utilized by the Sullivan CountyBomd of Education consists of three parcels, two of which havc a elear title to till' properly and ar~

vacant and the third parcel which contains thc actual school building and a modular unit and has areversionary elause: and

WHEREAS, the Sullivan COutlty Board of Education on Decemher 5, 2005 voted to turn over thetwo parcels of Gravely School property which have a clear title to Sullivan County for disposition;and

WHEREAS, Gravely Baptist Church has requested to lease the portion of Gravely School !'nl!Wrlyturned over to the county for disposition for a period of len years with an option to extend th" le:l';C

for an additional ten years and has requested to relocate at no expense to the county the modularunit located on the adjoining parcel upon which the sehaol huilding is located to the subjectproperty ta be leased to Gravely Baptist Church;

NOW THEREFORE BE IT RESOLVED that the Board of County Commissioucrs ofSullivan County, Tenncssce, assembled in Regular Session on the 20"' d;y of Fchrmll]', 200(,hercby authorizes Sullivan County to enter into a ten (lO) year Lease Agrccmcnt with anoption to extend thc Lcasc Agrcement for an additional tcn (10) years with G"avely BaptistChurch for the sum of Onc Dollar ($1.00) for thc two parcels of the Gravely School Propertyturned over to the county for disposition (Deed Book 183A, Page 367 and Dced Book 30e,Page 316), said Lease Agreement to be prepared by thc County Attorney.

WHEREAS, the Sullivan County Board of Commissioners on July 16, 200 I approvedResolution No. 2001-07-073 authorizing the submission of a TEA-21 Grant [Ipplieation to createthe Great Stage Road Museum and Walking Tour: and

WHEREAS, approximately three years passed between the time the application was submittedand the time the money was actually received; and

WHEREAS, during this three year period, the cost of materials increascd significantly duc tocost of inllation. incrcase in fuel cost. Hurricane Katrina, etc.; and

WllEREAS, the original projected cost in 2001 was $1,1 OO,(JOO; howcver, the bids to completethe project at this time are in excess of $2,OtJO,000 wllich includes the Information Center, theOld Sherin's Home and the Rutledge House; and

WHEREAS. the Sullivan County IIistorical Preservation Association. with the county's support.wishes to complete this project which will playa vital role in promoting historical downtownBlountville and the surrounding areas;

AN ACT to amend Tennessee Code Annotated, Title 8, Chapter 21 and Title 47, Chapter 9, relative tofees.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE

SECTION I. Tennessee Code Annotated, Section 8-21-1001, is amended by deleting subsections (b),(c), (d), (e), (t) and (g) and by substituting instead the following language to be designated assubsections (b), (c) and (d):

or instruments filed under the Unifonn Commercial Code, Title 47, Chapters I through 9,ster of each county ofthis State is entitled to demand and receive for such register's services a

ftwo dollars ($2.00) for each instrument recorded or filed in such register's office.

(c) The fees collected pursuant to subsection (b) and the fees collected by the register as a result of the.increase in fees for the filing or recording of Uniform Commercial Code instruments from ten dollars($10.00) to twelve dollars ($12.00) for each such fee charged pursuant to Title 47, Chapter 9, Part 4,shall be allocated by such register'S county for the purchase of computer equipment and software,upgrades to computer equipment and software, and supplies, maintenance and services relating tocomputer equipment and software, for use in the register's office; provided, however, that theexpenditure of these additional fees shall not be earmarked in any county that on the effective date ofthis act was authorized under prior law to charge an additional recording fee of one dollar ($1.00) ortwo dollars ($2.00) for each instrument filed or recorded in the register's office that was not earmarkedfor a particular purpose.

(d) All private act provisions authorizing registration or recording fees to be charged by the countyregister in amounts additional to those authorized by general law are superseded.

(e) The county register shall not be entitled to demand and receive any fees for notices of liens foroverdue child or spousal support or releases of same entered into aCClmputer system with a terminal inthe county register's office by the Department of Human Services pursuant to subdivision (b)(3) ofSection 36-5-901.

SECTION 2. Termessee Code Annotated, Title 47, Chapter 9, Part 4, is amended by deleting thelanguage, figures and symbols "ten dollars ($10.00)" wherever such language appears and substitutinginstead the language, figures and symbols "twelve dollars ($12.00)", and by deleting the followinglanguage wherever it appears:

RESOLUTION To Approvc an Agrccment with Forest Ridge Apartmcnts, Inc. for Paymcnt in Licu

of Taxes

WHEREAS, Forest Ridge Apartments, Inc. d/b/a Forest Ridge Manor is proposing to construct housing at1300 Bloomingdale Pike within the City of Kingsporl for elderly and handicapped persons with financingprovided tbrough the United States Department of I-lousing and Urban Development (HUD); and

WHEREAS, the project is exempt from all personal and real property taxes as long as Forest RidgeApartments, Inc. remains a qualified not-for-profit corporation and there arc unpaid outstanding balanceson the loan provided through HUD; and

WHEREAS, allnual payments in lieu of taxes will be based OIl ten percent (10%) of the shelter relitcollected by the owner; and

WHEREAS, the City of Kingsport has agreed to participate in this agreement for payment in lieu oftaxesalld agrees to confer with the County to determine the percentage of distribution of annual payments;

NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners of SullivanCounty, Tennessee, assembled in Regular Session, hereby approves the County Mayor entering anagreement with Forest Ridgc Apartments, Inc. d/b/a Forest Uidgc Manor at 1300 B100mingdalcPike, Kingsport, Tennessee, to accept annual payments in lieu of taxcs as long as Icorcst HidgeApartments, Inc. remains a qualified not-for-profit corporation and thcre arc unpaid outstandinghalances OIl thc loan providcd throngh BUD.

RESOLUTIO....,. To Approve Sullivan Count}' .Ioining tlU' l\ational Association of Counties(NACO)

WHEREAS, the National Association of Counties has contracted with Carcmark to provide aprescription discount card to provide to their uninsured andunderinsured residents; and

WHEREAS, the prescription discount card provides an average savings of twenty percent (20%)on the cost of prescriptions; and

WHEREAS, the prescription card IS only available to members of National Association ofCounties;

NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners ofSullivan County, Tennessee, assembled in Regular Session, hereby approves appropriating$3070.00, to be appropriated from 39000 Account, to cnable Sullivan County to .join the!"\ational Association of Counties (!"\ACO) to provide the discount prcscription card to thecounty's uninsured and uuderinsured residents, in addition to the ability· to provide othervaluable services offered through NACO. Account codcs to be assigned by the Director ofAccounts and Budgets.

This resolution shall take effect from and after its passage. All resolutions in connict herewilh beand the same rescinded insofar as such conflict exists.
