    REPUBLIC ACT NO. 1!"1

    AN ACT INSTITUTIN# POLICIES FOR T$E PROTECTION AN% &ELFARE OF%O'ESTIC &OR(ERS

    Be it enacted by the Senate and House of Representatives of the Philippines inongress asse!bled"

    ARTICLE I#ENERAL PRO)ISIONS

    Se*tion 1.Short #itle. This Act shall be known as the "Domestic Workers Act" or"Batas Kasambahay".

    Se*tion +.$eclaration of Policies. It is hereby declared that:

    (a) The tate stron!ly airms labor as a #rimary social orce and is

    committed to res#ect$ #romote$ #rotect and reali%e the &ndamental#rinci#les and ri!hts at work incl&din!$ b&t not limited to$ abolition o childlabor$ elimination o all orms o orced labor$ discrimination in em#loymentand occation$ and traickin! in #ersons$ es#ecially women and children'

    (b) The tate adheres to internationally acce#ted workin! conditions orworkers in !eneral$ and establishes labor standards or domestic workers in#artic&lar$ towards decent em#loyment and income$ enhanced coera!e osocial #rotection$ res#ect or h&man ri!hts and stren!thened social dialo!&e'

    (c) The tate reco!ni%es the need to #rotect the ri!hts o domestic workersa!ainst ab&se$ harassment$ iolence$ economic e#loitation and#erormance o work that is ha%ardo&s to their #hysical and mental health'and

    (d) The tate$ in #rotectin! domestic workers and reco!ni%in! their s#ecialneeds to ens&re sae and health&l workin! conditions$ #romotes !ender*sensitie meas&res in the orm&lation and im#lementation o #olicies and#ro!rams aectin! the local domestic work.

    Se*tion !.overage. This Act a##lies to all domestic workers em#loyed andworkin! within the co&ntry.

    Se*tion ,.$efinition of #er!s. As &sed in this Act$ the term:

    (a)$ebt bondage reers to the renderin! o serice by the domestic woas sec&rity or #ayment or a debt where the len!th and nat&re o sericnot clearly deined or when the al&e o the serice is not reasonably ain the #ayment o the debt.

    (b) $eploy!ent e%penses reers to e#enses that are directly &sed or transer o the domestic worker rom #lace o ori!in to the #lace o workcoerin! the cost o trans#ortation. Adances or loans by the domesticworker are not incl&ded in the deinition o de#loyment e#enses.

    (c) $o!estic wor& reers to work #erormed in or or a ho&sehold orho&seholds.

    (d) $o!estic wor&er or "Kasambahay" reers to any #erson en!a!ed indomestic work within an em#loyment relationshi# s&ch as$ b&t not limitthe ollowin!: !eneral ho&sehel#$ n&rsemaid or "yaya"$ cook$ !ardenerla&ndry #erson$ b&t shall ecl&de any #erson who #erorms domestic wonly occasionally or s#oradically and not on an occational basis.

    The term shall not incl&de children who are &nder oster amily arran!eand are #roided access to ed&cation and !ien an allowance incidented&cation$ i.e. "baon"$ trans#ortation$ school #ro+ects and school actiit

    (e) '!ployer reers to any #erson who en!a!es and controls the serica domestic worker and is #arty to the em#loyment contract.

    () Household reers to the immediate members o the amily or theoccants o the ho&se that are directly #roided serices by the domeworker.

    (!) Private '!ploy!ent (gency )P'(* reers to any indiid&al$ le!itima#artnershi#$ cor#oration or entity licensed to en!a!e in the recr&itment

    #lacement o domestic workers or local em#loyment.

    (h) +or&ing children, as &sed &nder this Act$ reers to domestic workerare iteen (,-) years old and aboe b&t below ei!hteen (,) years old.

    ARTICLE IIRI#$TS AN% PRI)ILE#ES

    Se*tion -.Standard of #reat!ent. The em#loyer or any member o the ho&seholdshall not s&b+ect a domestic worker or "kasambahay" to any kind o ab&se nor inlictany orm o #hysical iolence or harassment or any act tendin! to de!rade the di!nityo a domestic worker.

    Se*tion ".Board, odging and Medical (ttendance. The em#loyer shall #roide orthe basic necessities o the domestic worker to incl&de at least three (/) ade0&ate

    meals a day and h&mane slee#in! arran!ements that ens&re saety.

    The em#loyer shall #roide a##ro#riate rest and assistance to the domestic worker incase o illnesses and in+&ries s&stained d&rin! serice witho&t loss o beneits.

    At no instance shall the em#loyer withdraw or hold in abeyance the #roision o thesebasic necessities as #&nishment or disci#linary action to the domestic worker.

    Se*tion .uarantee of Privacy. 1es#ect or the #riacy o the domestic workershall be !&aranteed at all times and shall etend to all orms o comm&nication and#ersonal eects. This !&arantee e0&ally reco!ni%es that the domestic worker isobli!ed to render satisactory serice at all times.

    Se*tion /.(ccess to /utside o!!unication. The em#loyer shall !rant thedomestic worker access to o&tside comm&nication d&rin! ree time: Provided, That incase o emer!ency$ access to comm&nication shall be !ranted een d&rin! worktime. ho&ld the domestic worker make &se o the em#loyer2s tele#hone or othercomm&nication acilities$ the costs shall be borne by the domestic worker$ &nlesss&ch char!es are waied by the em#loyer.

    Se*tion 0.Right to 'ducation and #raining. The em#loyer shall aord the domesticworker the o##ort&nity to inish basic ed&cation and may allow access to alternatielearnin! systems and$ as ar as #racticable$ hi!her ed&cation or technical andocational trainin!. The em#loyer shall ad+&st the work sched&le o the domesticworker to allow s&ch access to ed&cation or trainin! witho&t ham#erin! the sericesre0&ired by the em#loyer.

    Se*tion 1.Prohibition (gainst Privileged 0nfor!ation. All comm&nication andinormation #ertainin! to the em#loyer or members o the ho&sehold shall be treatedas #riile!ed and conidential$ and shall not be #&blicly disclosed by the domesticworker d&rin! and ater em#loyment. &ch #riile!ed inormation shall beinadmissible in eidence ece#t when the s&it inoles the em#loyer or any membero the ho&sehold in a crime a!ainst #ersons$ #ro#erty$ #ersonal liberty and sec&rity$and chastity.

    ARTICLE IIIPREE'PLO2'ENT

    Se*tion 11.'!ploy!ent ontract. An em#loyment contract shall be eec&teand between the domestic worker and the em#loyer beore the commencementhe serice in a lan!&a!e or dialect &nderstood by both the domestic worker anem#loyer. The domestic worker shall be #roided a co#y o the d&ly si!nedem#loyment contract which m&st incl&de the ollowin!:

    (a) D&ties and res#onsibilities o the domestic worker'

    (b) 3eriod o em#loyment'

    (c) 4om#ensation'

    (d) A&thori%ed ded&ctions'

    (e) 5o&rs o work and #ro#ortionate additional #ayment'

    () 1est days and allowable leaes'

    (!) Board$ lod!in! and medical attention'

    (h) A!reements on de#loyment e#enses$ i any'

    (i) 6oan a!reement'

    (+) Termination o em#loyment' and

    (k) Any other law&l condition a!reed on by both #arties.

    The De#artment o 6abor and 7m#loyment (D867) shall deelo# a modelem#loyment contract or domestic workers which shall$ at all times$ be madeaailable ree o char!e to domestic workers$ em#loyers$ re#resentatieor!ani%ations and the !eneral #&blic. The D867 shall widely disseminate inormto domestic workers and em#loyers on the &se o s&ch model em#loyment con

    In cases where the em#loyment o the domestic worker is acilitated thro&!h a em#loyment a!ency$ the 37A shall kee# a co#y o all em#loyment contracts odomestic workers and shall be made aailable or eriication and ins#ection byD867.

    Se*tion 1+.Pre-'!ploy!ent Re1uire!ent. 3rior to the eec&tion o theem#loyment contract$ the em#loyer may re0&ire the ollowin! rom the domesticworker:

    (a) 9edical certiicate or a health certiicate iss&ed by a local !oernmenthealth oicer'

    (b) Baran!ay and #olice clearance'

    (c) ational B&rea& o Inesti!ation (BI) clearance' and

    (d) D&ly a&thenticated birth certiicate or i not aailable$ any other doc&mentshowin! the a!e o the domestic worker s&ch as oter2s identiication card$ba#tismal record or #ass#ort.

    5oweer$ ection ,;(a)$ (b)$ (c) and (d) shall be standard re0&irements when theem#loyment o the domestic worker is acilitated thro&!h the 37A.

    The cost o the ore!oin! shall be borne by the #ros#ectie em#loyer or a!ency$ asthe case may be.

    Se*tion 1!.Recruit!ent and 2inder3s 2ees. 1e!ardless o whether the domesticworker was hired thro&!h a #riate em#loyment a!ency or a third #arty$ no share in

    the recr&itment or inder2s ees shall be char!ed a!ainst the domestic worker by thesaid #riate em#loyment a!ency or third #arty.

    Se*tion 1,.$eposits for oss or $a!age. It shall be &nlaw&l or the em#loyer orany other #erson to re0&ire a domestic worker to make de#osits rom whichded&ctions shall be made or the reimb&rsement o loss or dama!e to tools$materials$ &rnit&re and e0&i#ment in the ho&sehold.

    Se*tion ++.(ssign!ent to 4onhousehold +or&. o domestic worker shall beassi!ned to work in a commercial$ ind&strial or a!ric&lt&ral enter#rise at a wa!e ratelower than that #roided or a!ric&lt&ral or nona!ric&lt&ral workers. In s&ch cases$ thedomestic worker shall be #aid the a##licable minim&m wa!e.

    Se*tion +!.'%tent of $uty. The domestic worker and the em#loyer may m&t&allya!ree or the ormer to tem#orarily #erorm a task that is o&tside the latter2sho&sehold or the beneit o another ho&sehold. 5oweer$ any liability that will beinc&rred by the domestic worker on acco&nt o s&ch arran!ement shall be borne bythe ori!inal em#loyer. In addition$ s&ch work #erormed o&tside the ho&sehold shallentitle the domestic worker to an additional #ayment o not less than the eistin!minim&m wa!e rate o a domestic worker. It shall be &nlaw&l or the ori!inalem#loyer to char!e any amo&nt rom the said ho&sehold where the serice o thedomestic worker was tem#orarily #erormed.

    Se*tion +,.Mini!u! +age. The minim&m wa!e o domestic workers shall not beless than the ollowin!:

    ARTICLE )POST E'PLO2'ENT

    Se*tion !+.#er!ination of Service. either the domestic worker nor the em#loyermay terminate the contract beore the e#iration o the term ece#t or !ro&nds#roided or in ections // and /= o this Act. I the domestic worker is &n+&stlydismissed$ the domestic worker shall be #aid the com#ensation already earned #l&sthe e0&ialent o iteen (,-) days work by way o indemnity. I the domestic workerleaes witho&t +&stiiable reason$ any &n#aid salary d&e not eceedin! the e0&ialentiteen (,-) days work shall be oreited. In addition$ the em#loyer may recoer romthe domestic worker costs inc&rred related to the de#loyment e#enses$ iany:Provided, That the serice has been terminated within si (?) months rom thedomestic worker2s em#loyment.

    I the d&ration o the domestic serice is not determined either in sti#&lation or by thenat&re o the serice$ the em#loyer or the domestic worker may !ie notice to end theworkin! relationshi# ie (-) days beore the intended termination o the serice.

    The domestic worker and the em#loyer may m&t&ally a!ree on written notice to#re*terminate the contract o em#loyment to end the em#loyment relationshi#.

    Se*tion !!.#er!ination 0nitiated by the $o!estic +or&er. The domestic workermay terminate the em#loyment relationshi# at any time beore the e#iration o thecontract or any o the ollowin! ca&ses:

    (a) Cerbal or emotional ab&se o the domestic worker by the em#loyer or anymember o the ho&sehold'

    (b) Inh&man treatment incl&din! #hysical ab&se o the domestic worker bythe em#loyer or any member o the ho&sehold'

    (c) 4ommission o a crime or oense a!ainst the domestic worker by theem#loyer or any member o the ho&sehold'

    (d) Ciolation by the em#loyer o the terms and conditions o the em#loymentcontract and other standards set orth &nder this law'

    (e) Any disease #re+&dicial to the health o the domestic worker$ theem#loyer$ or members o the ho&sehold' and

    () 8ther ca&ses analo!o&s to the ore!oin!.

    Se*tion !,.#er!ination 0nitiated by the '!ployer. An em#loyer may terminaserices o the domestic worker at any time beore the e#iration o the contracany o the ollowin! ca&ses:

    (a) 9iscond&ct or will&l disobedience by the domestic worker o the laworder o the em#loyer in connection with the ormer2s work'

    (b) @ross or habit&al ne!lect or ineiciency by the domestic worker in t#erormance o d&ties'

    (c) ra&d or will&l breach o the tr&st re#osed by the em#loyer on thedomestic worker'

    (d) 4ommission o a crime or oense by the domestic worker a!ainst t#erson o the em#loyer or any immediate member o the em#loyer2s a

    (e) Ciolation by the domestic worker o the terms and conditions o theem#loyment contract and other standards set orth &nder this law'

    () Any disease #re+&dicial to the health o the domestic worker$ the emor members o the ho&sehold' and

    (!) 8ther ca&ses analo!o&s to the ore!oin!.

    Se*tion !-.'!ploy!ent ertification. #on the seerance o the em#loymerelationshi#$ the em#loyer shall iss&e the domestic worker within ie (-) days re0&est a certiicate o em#loyment indicatin! the nat&re$ d&ration o the sericwork #erormance.

    ARTICLE )IPRI)ATE E'PLO2'ENT A#ENCIES

    Se*tion !".Regulation of Private '!ploy!ent (gencies )P'(s*. The D867 thro&!h a system o licensin! and re!&lation$ ens&re the #rotection o domesticworkers hired thro&!h the 37As.

    The 37A shall be +ointly and seerally liable with the em#loyer or all the wa!es

    wa!e*related beneits$ and other beneits d&e a domestic worker.

    The #roision o 3residential Decree o. ==;$ as amended$ otherwise known a"6abor 4ode o the 3hili##ines"$ on 0&aliications o the 37As with re!ard tonationality$ networth$ owners and oicers$ oice s#ace and other re0&irements$well as nontranserability o license and commission o #rohibited #ractices$ sha##ly.

    In addition$ 37As shall hae the ollowin! res#onsibilities:

    (a) 7ns&re that domestic workers are not char!ed or leied any recr&itmentor #lacement ees'

    (b) 7ns&re that the em#loyment a!reement between the domestic workerand the em#loyer sti#&lates the terms and conditions o em#loyment and allthe beneits #rescribed by this Act'

    (c) 3roide a #re*em#loyment orientation briein! to the domestic worker and

    the em#loyer abo&t their ri!hts and res#onsibilities in accordance with thisAct'

    (d) Kee# co#ies o em#loyment contracts and a!reements #ertainin! torecr&ited domestic workers which shall be made aailable d&rin! ins#ectionsor wheneer re0&ired by the D867 or local !oernment oicials'

    (e) Assist domestic workers with res#ect to com#laints or !rieances a!ainsttheir em#loyers' and

    () 4oo#erate with !oernment a!encies in resc&e o#erations inolin!ab&sed or e#loited domestic workers.

    ARTICLE )IISETTLE'ENT OF %ISPUTES

    Se*tion !.Mechanis! for Settle!ent of $isputes. All labor*related dis#&tes shallbe eleated to the D867 1e!ional 8ice hain! +&risdiction oer the work#lacewitho&t #re+&dice to the ilin! o a ciil or criminal action in a##ro#riate cases. TheD867 1e!ional 8ice shall eha&st all conciliation and mediation eorts beore adecision shall be rendered.

    8rdinary crimes or oenses committed &nder the 1eised 3enal 4ode and others#ecial #enal laws by either #arty shall be iled with the re!&lar co&rts.

    ARTICLE )IIISPECIAL PRO)ISIONS

    Se*tion !/.0nfor!ation Progra!. The D867 shall$ in coordination with the DI6@$the $ the 3hil5ealth and 3a!*IBI@ deelo# and im#lement a contin&o&sinormation dissemination #ro!ram on the #roisions o this Act$ both at the nationaland local leel$ immediately ater the enactment o this law.

    Se*tion !0."Araw ! 9!a Kasambahay". The date on which the 3residena##roe this "Domestic Workers Act" shall be desi!nated as the "Araw n! m!aKasambahay".

    ARTICLE I4PENAL AN% 'ISCELLANEOUS PRO)ISIONS

    Se*tion ,.Penalty. Any iolation o the #roisions o this Act declared &nlawshall be #&nishable with a ine o not less than Ten tho&sand #esos (3,
