April 3-5, 2014 WEA Representative Assembly Spokane Convention Center

Enclosed are guidelines, procedures and required forms for the election and registration of local affiliate delegates and successor delegates to the April 3-5, 2014 WEA Representative Assembly (RA). To ensure the broadest representation of members’ views, locals are encouraged to involve all members in the election process and send a full delegation to the RA.

Registrations are due no later than Feburary 7, 2014.

Please hold your elections and report the names of ALL Delegates and Successors who may possibly attend. Please register all names even if

your local is still assessing how many people to actually send. The Association’s Core Values include respect for diversity. The Association honors the diversity of our communities, and endeavors to achieve participation by a broad and representative spectrum of the membership. The WEA Credentials and Minority Affairs / Human Rights Work Teams are eager to assist you in efforts to actively include all members in RA activities. Please encourage any Delegate or Successor who has special needs to provide the information on the enclosed form to Sharon Closson as soon as possible. Association governing documents require that RA delegate elections be run in a prescribed manner. It is essential that these procedures be followed to ensure that local delegates are seated at the WEA Representative Assembly.

CREDENTIALS GUIDELINES AND PROCEDURES

(Adopted by the WEA Board of Directors at the June 2013 meeting) A. CALENDAR October 1 WEA mails Representative Assembly (RA) delegate guidelines to local

affiliate presidents. Date suggested for local affiliates to open nominations for local affiliate delegates to the WEA Representative Assembly (RA).

Oct 1 – Feb 7 WEA Board and the Minority Affairs/Human Rights and Credentials Work

Team members will support and assist local affiliates to comply with RA delegate guidelines. Locals are encouraged to use enclosed and other available resources to involve members of color in the nominations and elections process. ALL Locals are strongly encouraged to hold an election for delegates and send a full delegation to the WEA RA.

February 7 WEA Local Affiliate Delegate Election Verification/Credential Forms are

due at WEA Federal Way headquarters building by 4:00 p.m. February 21 Credentials Hearings for any locals that remain out of compliance with

ethnic minority / person-of-color participation guidelines per the Standing Rules.

March 3 RA materials and temporary delegate credentials will be mailed to pre-

registered RA delegates and successor delegates.

April 3-5 WEA RA (Spokane Convention Center). B. ETHNIC MINORITY / PERSON-OF-COLOR COMPLIANCE REQUIREMENTS FOR

ELECTION OF LOCAL AFFILIATE DELEGATES TO WEA REPRESENTATIVE ASSEMBLY

1. NEA Bylaws 3-1(g), states:

"It is the policy of the Association to achieve ethnic minority delegate representation at least equal to the proportion of identified ethnic minority populations within the state. Prior to December 1 of each fiscal year, each state affiliate shall submit to the NEA Executive Committee for its approval a legally permissible plan which is designed to achieve a total state and local delegation to the Representative Assembly held that fiscal

year which reflects these ethnic minority proportions." In about October of each year, all locals are requested by WEA to complete a 3-1(g) report. While the 3-1(g) instrument is used specifically to document WEA’s compliance with NEA RA guidelines, it also provides a very useful tool for locals to analyze member involvement. The summaries within the 3-1(g) report should become part of any local’s plan for inclusive diversity.

2. WEA Constitution, ARTICLE X—ETHNIC MINORITY GUARANTEES, states:

“The WEA shall take all reasonable and legally permissible steps to achieve on its elective and appointive bodies ethnic minority representation that is at least proportionate to the ethnic minority population within the state.”

3. WEA Bylaws, ARTICLE III—REPRESENTATIVE ASSEMBLY, Section 5, states: "Delegates to the Representative Assembly shall be elected by secret ballot after open

nominations. The WEA Board shall provide uniform rules and procedures to ensure compliance with the Constitution and Bylaws of the WEA and NEA including those applicable provisions relative to one (1) person, one (1) vote, and ethnic minority representation."

4. LOCAL AFFILIATES SHALL SEEK THE REPRESENTATION OF ETHNIC MINORITY

/ PERSON-OF-COLOR MEMBERS IN THE SAME PROPORTION AS THE STATE POPULATION OR THE POPULATION OF THEIR MEMBERSHIP, WHICHEVER IS GREATER. The proportion of ethnic minorities / persons-of-color in the state population as determined by NEA based on 2010 United States Census data is twenty-eight percent (28%).

Locals that are eligible for three (3) or more WEA RA delegates shall have a goal of at

least one (1) ethnic minority / person-of-color delegate. To be counted as an ethnic minority / person-of-color delegate for purposes of WEA RA representation, a member must have made appropriate personal declaration on his/her official, association membership record.

5. Certification (See Representative Assembly Standing Rules, V. A. “Credentials”)

“A. Credentials

1. Each authorized delegate and successor delegate shall receive a temporary credential card from the WEA office prior to the Assembly provided that the delegate's local affiliate meets one of the following criteria.

(a) The local meets the ethnic minority / people of color requirement meaning the

local affiliate’s delegation is at least proportionate to the ethnic minority / people of color population within the state.

(b) The local has developed, instituted, and submitted a written plan to improve participation of its members of color. Locals making genuine progress toward their goals will be considered in compliance by the Credentials chair with the concurrence with the Minority Affairs/Human Rights chair.

(c) The local was not out of compliance in the preceding year. 2. In the event that ethnic minority / people of color requirements are not met, as

outlined in the preceding Credentials RA Guidelines in V. A. 1., the following procedures will be implemented.

(a) A local in the first year out of compliance will be contacted by WEA

Credentials and assisted by Minority Affairs/Human Relations in developing an Initial Plan for Inclusive Diversity. This plan must be submitted to the Credentials Work Team prior to the delegate registration deadline of the next Representative Assembly.

(b) If in each successive year the local is out of compliance, then the local and

one of the local’s UniServ Council Board Directors will be required to attend a WEA Credentials hearing prior to Representative Assembly before receiving delegate credentials. WEA Credentials may then recommend to RA that the local may be denied the right to participate in RA except:

i. to participate in the election for Association officers; and ii. to vote on increases in membership dues.

3. Replacement and additional temporary credential cards may be obtained at the time of registration at the Assembly in accordance with the procedures prescribed by WEA Credentials.

4. Decisions regarding delegate and successor delegate credentials shall be made

by WEA Credentials.

5. WEA Credentials' decisions may be appealed to the Assembly. A majority of the Assembly delegates present and voting may overrule a WEA Credentials' decision.”

6. Initial or updated plans for inclusive diversity will only be considered by Credentials after

the Local has contacted and consulted with a member of the Minority Affairs/Human Rights Work Team.

7. Ethnic Minority / Person-of-Color participation goals are based on attendance at the RA.

Even if a local does not send a full delegation, at least 28% of the local’s voting delegation must be comprised of members of color during at least one RA business session.

C. CREDENTIALS PROCEDURES FOR THE ELECTION OF WEA REPRESENTATIVE

ASSEMBLY DELEGATES AND SUCCESSOR DELEGATES 1. "Members of the WEA Board shall be the officers of the Assembly and have in addition

to their responsibilities as officers all the rights and responsibilities of elected local affiliate delegates." (See Representative Assembly Standing Rules, II. “Officers”)

2. "UniServ council presidents shall be ex-officio members of the Representative Assembly." (See WEA Constitution, Article V, Section 3)

3. Only those WEA Board members and UniServ council presidents who hold those offices

on the dates of the RA will be afforded RA officer status as listed above. 4. WEA Board Members and UniServ Council Presidents represent WEA – not local

affiliates – at the WEA RA. They are NOT counted towards delegations of their local associations for any representation purpose, including measuring participation by members of color.

5. “Only Active, WEA-Retired, and Student members of the state Association shall be

eligible to be delegates or to vote for the election of delegates and such members shall vote in one (1) affiliated association only. WEA-Retired members shall be eligible to vote for WEA-Retired delegates only.” Active members shall vote for Active delegates only. Student members shall vote for Student delegates only. (See WEA Constitution, Article V, Section 6)

6. Delegates shall be elected by secret ballot after open nominations. Therefore, a

delegate may not be appointed or designated. The ballot shall include a write-in option. One ballot may be used to elect a person to two (2) separate positions such as local president and Representative Assembly delegate. Such ballots must state the following: "The officer elected shall serve as a delegate to the WEA Representative Assembly and delegate status shall not be conditional upon holding the affiliate office.”

7. Separate elections shall not be held, nor shall delegate slots be reserved based on age,

religion, disability, ethnicity, gender, race, or sexual orientation. Unless submitted by the candidate as part of a campaign statement or other designation process open to all candidates, no indicators may appear on a ballot or accompanying materials that identify individual candidates relative to any of these groups.

8. Delegates may be elected by plurality or by majority of vote, whichever is consistent with

local guidelines. 9. The one-(1) person one (1) vote principle applies. Slate voting is prohibited. One (1)

mark or check may not be used on the same ballot to indicate a vote for two (2) or more individuals as a pair or group.

10. An election by secret ballot may be waived and the candidate(s) declared elected if,

following a period of open nominations, the number of candidates is equal to or less than the number of delegate positions to be filled. An affiliate utilizing this provision must have adopted a governing provision or election policy allowing such a practice. This election practice will not generate successor delegates unless the nomination process requires candidates for both regular and successor delegate positions.

11. Delegate Ratio

(a) The number of local affiliate delegates to Representative Assembly shall be based on the membership count on January 15th of the previous membership year.

(b) Each local affiliate is allowed one (1) delegate per each group of sixty (60) members or major fraction thereof.

(c) Each local affiliate is allowed at least one (1) delegate to ensure

representation of smaller units.

(d) For RA delegate allocation purposes, each Student WEA chapter will be considered a distinct local affiliate.

(e) For RA delegate allocation purposes, all of WEA-Retired will be considered

one local affiliate.

(f) If it is determined that Successor Delegates may be seated on the convention floor, each local affiliate is allowed one-third as many successors as delegates. Those locals eligible for one or two delegates shall be eligible for one successor.

12. All successor delegates must be elected according to procedures #4-11 above.

13. Successor delegates may only be registered after the local’s full voting delegation is

filled.

14. Delegates and Successor Delegates may only represent local affiliates in which they are current Members (Active, Retired or Student class membership as appropriate).

15. Challenges as to procedure or interpretation of rules shall be presented in writing to the WEA Executive Committee who shall render a decision in writing. The WEA president shall refer appeals from the decision of the WEA Executive Committee to the WEA Board, whose decision shall be final.

D. PRE-REGISTRATION

1. Local affiliates must return the WEA Local Affiliate Delegate and Successor Delegate Election Verification/Credential Forms to the WEA Office in Federal Way by 4:00 p.m., Friday, February 7, 2014.

2. Assigned WEA staff receive WEA delegate verification/credential forms and appropriate attachments and verify membership, ethnic minority / person-of-color designations and compliance status.

3. If documentation is received by deadline date, confirmation of receipt of delegate

verification forms and appropriate attachments will be sent to local affiliate presidents.

4. WEA staff will contact the WEA Credentials Work Team chairperson and report all local affiliates not in compliance with either ethnic minority / person-of-color goals or date deadline.

5. Temporary Credentials will be issued to pre-registered delegates of locals who meet

ethnic minority / person-of-color compliance goals as set forth herein. These Temporary Credentials must be exchanged for permanent credentials at the on-site WEA Registration desk. Any delegate with a Temporary Credential may register at the designated times.

E. ON-SITE REGISTRATION (See Representative Assembly Standing Rules, V. B. “Registration”) 1. Registration procedures at the Assembly meetings shall be conducted under the

supervision of WEA Credentials. 2. Delegate and successor delegate registration shall begin at least one (1) hour prior to

the beginning of the opening session and continue until the beginning of the final business session.

3. Delegates and successor delegates shall present appropriate Temporary Credentials at

the WEA Registration desk when registering in exchange for a voting credential and identification badge.

4. Priority registration shall be given to those delegates who possess a valid Temporary

Credential. 5. Those delegates who are pre-registered but who are not in possession of their

Temporary Credential may obtain a voting credential and identification badge at registration after furnishing proof of identity and completing another Temporary Credential card.

6. Delegates who are not pre-registered shall bring their local affiliate president or designee

or WEA Board member to the WEA Registration desk. Issuance of credentials to delegates who are not pre-registered shall be at the discretion of WEA Credentials.

7. Voting credentials and identification badges cannot be reissued without the express

authorization of the WEA Credentials Work Team chairperson. Defaced or separated voting credentials are invalid and subject to confiscation by Credentials Work Team members or Officers of the Assembly.

8. All guests who are not pre-registered must either show proof of WEA Membership or be

accompanied by a Delegate or WEA Staff person in order to be issued a badge.

9. To remain on-site at the RA, all persons must have a current, valid badge issued by WEA RA Registration.

10. Successor Delegates (see Representative Assembly Standing Rules, Section IV)

“A. SUCCESSOR DELEGATE AUTHORIZATION An individual may become a successor delegate and take the place of a delegate if:

1. the individual has been elected to serve as a successor as prescribed in the WEA Constitution and Bylaws; and

2. the individual presents the appropriate credential card and is properly registered

prior to participating in the Assembly.

B. SUCCESSOR DELEGATES AND SUBSTITUTION FOR DELEGATES 1. A successor delegate may substitute for a delegate if the delegate is unable to

attend, arrives late, or leaves during the Assembly for any length of time deemed appropriate by the delegate.

2. The delegate shall resume delegate status upon return to the Assembly floor. If a

delegate leaves during the Assembly and a successor delegate is to replace the delegate, the delegate and successor delegate shall report to the registration desk where they will surrender their delegate badges. An "Official Delegate Badge" will be issued to the successor delegate and the delegate shall transfer the voting credential card to the successor delegate. If the original delegate chooses to return to the floor, the process will be reversed.

3. Successor delegates may sit on the floor if the Assembly facility can

accommodate them. A delegate and successor delegate cannot transfer a voting card without going through the process outlined in IV.B.2.”

F. WEA CREDENTIALS WORK TEAM REPORT

1. The WEA Credentials Work Team chairperson shall report to the WEA Representative Assembly the names of any locals who have not met their ethnic minority / person-of-color goals.

2. The WEA Credentials Work Team chairperson or designee shall report to the WEA

Board of Directors the names of any locals who are out of compliance by: (a) Not having met their goal for number of ethnic minority / person-of-color delegates in

attendance at the WEA Representative Assembly, or (c) Having missed the deadline for submission of pre-registration documents.

3. Steps to assist locals who did not meet ethnic minority / person-of-color guidelines will be those listed in the WEA RA Standing Rules and restated in this procedure document. Local leaders should meaningfully engage and collaborate with members of the WEA Minority Affairs / Human Rights Work Team in developing, implementing and revising their plans for inclusive diversity.

4. A WEA Board member will contact local affiliates that have missed the deadline for

submitting the election verification/credential forms for two or more consecutive years.
