Accidental Fracture Purpose of Coverage Subject to the terms of this coverage and to those of the contract, if an Insured Person sustains a Fracture as a result of an Accident, the Insurer undertakes to pay him or her a lump sum based on the table below. The Fracture must be diagnosed within thirty (30) days of the Accident. Limitations For Insured Persons age seventy (70) and older, the lump sum indicated is reduced by fifty percent (50%). The maximum amount payable for multiple Fractures shall be the highest amount payable for any one of the sustained Fractures. The Insured Person cannot be indemnified for a same Injury under this coverage and under a coverage for Accidental Death, Dismemberment or Loss of Use. Accidental FracturePurpose of Coverage

At the date of renewal or at his or her election,the Policyholder may add or change the coveragesthat are part of the insurance.

PremiumsPremiums are payable in advance as of the effectivedate of the contract or the coverage indicated inthe contract. They may be paid on an annual ormonthly basis by pre-authorized debit.

Premiums shall be paid directly to the Insurer or toa representative duly authorized to receive thepayment.

All cheques must be made out to The EXCELLENCELife Insurance Company.

If a cheque or any other bill of exchange given tothe Insurer in payment of an initial premium, is nothonoured upon presentation, the premium isdeemed to be unpaid and any contract that mayhave been issued in respect of that premium paymentis null and void.

Grace PeriodA grace period of thirty (30) days is granted afterthe premium due date for payment of every premiumexcept the first. This contract remains effectiveduring the grace period. If the premium remainsunpaid at the end of the grace period, the contractis automatically terminated and the Insurer’s obligations cease retroactively to the beginning ofthe grace period.

Termination of contractThe entire contract terminates automatically on thedate at which the Insured Person no longer residesin Canada or on which he or she has been out of thecountry for over one hundred and eighty-three(183) days per year.

Day SurgeryMeans surgery performed in a hospital or a serviceaffiliated with a hospital that does not requirehospitalization and for which the Insured Person isdischarged on the same day as the surgery. Notethat day surgery is not considered a hospitalizationunless specifically stipulated.

Dismembermentmeans the complete Loss of a limb or of an external organ.

Fracturemeans the violent rupture of a bone.

Hospitalmeans an acute care hospital centre as defined inthe Act Respecting Health Services and SocialServices or an equivalent legislation in the InsuredPerson’s province of residence, excluding any part ofsuch a hospital centre reserved for long-term care.

“Hospital” does not include mental hospitals, long-termcare hospitals, tuberculosis hospitals, sanitariums,reception centres, nursing homes, retirementhomes, spas, dispensaries or other establishments orparts of establishments whose goal is to providenursing care or rehabilitation.

Hospitalizationmeans occupation of a Hospital room or a stayunder observation in an emergency ward for at leasteighteen (18) consecutive hours.

Injurymeans bodily harm acknowledged by a Physicianand resulting, directly and independently of anyother cause, from an action that is sudden, violentand unforeseeable and from a cause that is externaland unintended by the Insured Person.

Insurermeans L’EXCELLENCE Life Insurance Company.

Lossmeans complete amputation at or above the elbowor the knee, with reference to arms and legs; completeamputation at or above the wrist or the ankle, withreference to hands and feet; complete amputationat or above the distal phalanx, with reference to allthe fingers of one hand; complete amputation ofboth phalanges, with reference to the toes of onefoot; and the total and irrecoverable Loss of sight,with reference to an eye.

With reference to speech, “Loss” means the total and irrecoverable Loss of the ability to utter intelligiblesounds and, with reference to hearing, the total andirrecoverable Loss of the ability to hear with bothears. “Loss of Use” means the total and irrecoverable

Loss of Use of the limb in question provided the Lossis continuous for a period of twelve (12) consecutivemonths and is deemed permanent.

Major Burnmeans a second or third-degree skin burn thatresults in immediate medical consultation requiringtreatment and that causes a Total Disability.

Major Lacerationmeans an external cut that requires treatment by aPhysician and that causes Total Disability.

Physicianmeans a doctor licensed in medicine who is a memberof the Collège des médecins du Québec or an equivalent medical body in the Insured Person’sprovince of residence.

Primary Insuredmeans the person who is insured under this contract.

Total Disability for a person with orwithout remunerative work at thetime of the Accidentmeans the state of disability resulting, directly and independently of any other cause, from an Accident thatresults in Hospitalization, Dismemberment, Fracture,Major Burn or Major Laceration and that is sustainedwhile the Primary Insured is insured under this coverageand requiring continuous medical care, recommended bya Physician, according to the necessary frequency forthat disability and which prevents the Primary Insuredfrom performing the duties of his or her regularoccupation, for a person with remunerative work orfrom attending to most of his or her normal activities of daily living, for a person without remunerative work.

Notice and Evidence ofLossWhen an event gives rise to a claim, within ninety(90) days of that event you must send the Insurersuch information as is necessary to review theclaim. The person who files the claim must providethe Insurer with any information or evidence theInsurer may deem useful.

Failure to file the notice and evidence of losswithin the prescribed timeframes may, wheresuch delay is not beyond the Insured Person’scontrol, result in acceptance of the loss only atthe date of receipt.

Under no circumstances shall a claim be reviewedif a period of three hundred and sixty-five (365)days has elapsed since the date of the event giving rise to benefit entitlement.

Guaranteed PaymentSubject to receipt of a complete file, the Insurerundertakes to indemnify the Insured Person withinseven (7) business days provided the claim respectsthe terms and conditions of the contract.

The business days begin to elapse when the Insurerstamps the documents received and ends when thepayment or the decision is mailed.

Where the Insurer fails to respect the above timeframe,the Insured Person shall be compensated in theamount of thirty dollars ($30) for every businessday the payment is late, to a maximum of seven (7)business days.

Examination and AutopsyThe Insurer reserves the right to require an InsuredPerson to undergo a medical examination or, if heor she is deceased, to request an autopsy subject tothe limits prescribed by law.

Fraud or Attempted FraudAn Insured Person’s entitlement to benefits is automatically revoked if he or she obtains or seeksto obtain directly or indirectly by fraudulent meansany payment of benefits under this contract. Insuch a case, the Insurer shall be exempt from anyobligation under the contract and reserves the rightto require that benefits previously paid be reimbursed. Any fraud or attempted fraud mayresult in resiliation of the contract and no premiumshall be refunded.

SubrogationIf an Insured Person acquires a right of suit againsta physical or legal person with respect to a benefitcovered hereunder, the Insurer is subrogated to therights of the Insured Person. The latter must signand remit all necessary documents to this effectand act as necessary to protect such rights.

Language of ContractThis contract and any documents related heretohave been drawn up in English at the express wishof the Policyholder.

Accidental Death,Dismemberment or Lossof Use

Purpose of CoverageSubject to the terms of this coverage and to thoseof the contract, the Insurer shall pay to the InsuredPerson the amount indicated in the table below inthe event of Accidental Death, Dismemberment orLoss of Use, conditional upon the Insurer receivingevidence it deems satisfactory to the effect that:

a) the Death, Dismemberment or Loss of Useresults, directly and independently of any othercause, from accidental bodily Injury or accidentaldrowning; and

b) the Death, Dismemberment or Loss of Useoccurs within three hundred and sixty-five (365)days of the Accident.

Termination of coverageCoverage for Accidental Dismemberment or Loss ofUse terminates at the seventieth (70th) birthday ofthe Insured Person.

Disability Insurance inthe event of an Accident

Purpose of CoverageSubject to the terms of this coverage and to thoseof the contract, when the Insured Person becomestotally disabled further to an Accident resulting inHospitalization, Dismemberment, Fracture, a MajorBurn or a Major Laceration, the Insurer shall payhim or her a monthly benefit of seven hundred dollars($700), without a waiting period, for a maximum ofseven (7) months.

Recurrent DisabilityAll consecutive periods of Total Disability separatedby less than seven (7) months shall be considered asingle period of disability, unless the subsequentdisability is the result of an Accident entirely separatefrom the first disability and begins only once thePrimary Insured has resumed his or her daily activi-ties, for a person without remunerative work, or hasresumed his or her occupation on an active andcontinuous basis for at least one (1) day, for a per-son with remunerative work. In no case shall totalbenefits resulting from the initial disability and therecurrent disability exceed the maximum period ofseven (7) months.

Loss of Entitlementto Disability BenefitsEntitlement to disability insurance benefits ceasesat the earliest of the following events:

a) upon cessation of Total Disability or the death ofthe Primary Insured; or

b) at the end of the maximum benefit period ofseven (7) months; or

c) upon refusal to undergo a medical examination,to produce evidence of ongoing disability asrequired by the Insurer or to undergo treatmentrecommended by the attending Physician; or

d) performance of remunerative work or work thatshould be remunerated.

LimitationAs of age seventy (70), the monthly benefit isreduced by fifty percent (50%) to three hundredand fifty dollars ($350) per month.

An Insured Person is eligible for insurance at theeffective date of the contract provided he or she iseighteen (18) years of age or over at that date.

General ProvisionsPurpose of the contract

The Insurer undertakes to pay the benefits stipulatedin the contract subject to the conditions, limitationsand exclusions described therein.

Eligibility for InsuranceAn Insured Person is eligible for insurance on theeffective date of the contract provided he or she isunder the age eighty (80) on that date, is aCanadian citizen or a permanent resident, andresides in Canada (Individuals participating in theLive-in Caregiver Program are not required to be aCanadian citizen or permanent resident).

Effective Date of the ContractThe contract takes effect at the reception date of theapplication at the head office of L’EXCELLENCE,provided the application is duly completed and thefirst premium is paid.

RenewalThe Insurer undertakes to renew this insurancefrom year to year until the seventieth (70th)birthday of the Primary Insured, provided therenewal premium is paid within the prescribedtimeframe and the Insured Person resides inCanada. Upon each renewal, the Insurer maymodify the premium for all contracts issued andthe premium will then be equal to the premiumpayable for a similar contract issued by theInsurer and offering the same coverages.

LimitationsAny Loss prior to the effective date of the contract orsustained in a previous Accident shall not be consideredin the payment of this benefit.

The maximum amount payable for all Losses withinthree hundred and sixty-five (365) days of theAccident shall not exceed the maximum sum insuredas indicated in the table above. If, as the result of asingle Accident, an Insured Person sustains severalLosses listed in this coverage, benefits shall bepayable for only one such Loss, that is, the Loss which,under this coverage, represents the highest benefitamount.

The maximum benefit payable for Accidental Death istwenty-five thousand dollars ($25,000) as of age seventy(70).

Hospital Benefit in theevent of an Accident

Purpose of CoverageSubject to the terms of this coverage and to thoseof the contract, the Insurer undertakes to pay a dailybenefit of seventy dollars ($70) when the InsuredPerson is hospitalized for at least eighteen (18)hours as a result of an Accident. For the purposes ofthis contract, where the Insured Person undergoesDay Surgery further to the Accident, theHospitalization period corresponds to a period ofeighteen (18) hours of Hospitalization.

LimitationsThe Hospital Benefit is limited to a lifetime maximumof seven hundred (700) days.

As of age seventy (70), the daily benefit is reducedby fifty percent (50%) to thirty-five dollars ($35)per day.

DefinitionsAccident

means a sudden and unforeseeable event thatcauses, directly and independently of any othercause, bodily Injury resulting exclusively from acause that is external, violent and unintended bythe Insured Person and which requires regular andcontinuous medical care, recommended by aPhysician. If an Accident causes a disability thatbegins over ninety (90) days after the Accident, thedisability shall not be deemed accidental for thepurposes of this contract.

Beneficiarymeans the Primary Insured, the Policyholder or theperson designated by the Policyholder upon application for insurance provided the latter has aninsurable interest in the life or health of the PrimaryInsured.
