    INTRODUCTION

    The security situation in the country during the first eight months was characterized

    by a significant decrease in all categories of crime in 2010 that saw the national crime

    trends decreased by 5% or 3293 cases as compared to the same period in 2009.

    The country experienced decreased cases of theft of stock, breaking, vehicle and other

    thefts, other offences against persons, criminal damage, theft by servant, dangerous

    drugs, robbery, homicide, and stealing while increases were noted in offences against

    morality and economic crimes.

    During the same period the country underwent a historical event on constitution

    amendment which was the first of its kind in the country since independence (1963)

    on 4th August 2010. During the referendum exercise no major incidents were recorded

    with the election being held peacefully. On 27th August the new constitution was

    promulgated at Uhuru Park with dignitaries and foreign leaders attending andKenyans in attendance. Adequate security was provided that ensured safety during

    the celebrations.

    During the same period police recovered 128 rifles, 60 pistols, 10 toy pistols and

    36,458 ammunitions in normal police operations. In addition the forceful

    disarmament operation that began in the month of April resulted in the recovery of

    1064 firearms and 3078 ammunitions.

    CAUSES OF INCREASE IN CRIME

    The trend of crime and insecurity have been orchestrated by, among others,

    proliferation of small arms and light weapons, inequitable distribution of resources,

    Organized crimes, high unemployment rate, drug and substance abuse, high illiteracy

    levels and sophistication of technology.

    TRENDS OF CRIME

    Amongst all the Province Nyanza Province recorded the greatest improvement in

    security both with 14 % reduction in reported crime followed by; Eastern 10%,

    Central 9%, Western 7% Coast 6%, and Rift Valley 6%. Increases were noted in

    Nairobi Province and North Eastern Province which recorded an increase of28% and

    15% respectively.

    Decreases

    The decrease in crime cases were noted in the following categories;

    In the monthly crime trend comparative figures decreases were noted in the following

    months;- April 662 Cases or 10%, March 523 cases or 8%, February 379 cases or

    6%, August 261 Cases or 5%, January 289 cases or 4% , June 181 cases or 3% and

    October 80 cases or 1%. Increase was noted in May 252 cases or 5% and September

    51 cases or 1%.

    SUMMARY OF SERIOUS CRIMES

    a) Narok. On 1/02/2010 illegal firearms and ammunitions were recovered within

    Narok town at the premises of businessman Munir Haroon Ishmael a Kenyan

    of Asian origin. Previously a cache of arms had been recovered from the same

    premises on 7/12/2009. Several suspects were arraigned in court and

    31,211assorted ammunitions recovered.

    b) Kilifi: On 15/2/2010 at 4.00am at Mariakani along Mombasa-Nairobi road,

    highway patrol officers arrested several suspects who were trafficking bhang

    within lochab yard. They found a trailer loaded with 14 sacks, a Toyota corolla

    loaded with 8 sacks, and another Toyota loaded with 8 sacks all weighing 728

    kgs with a market value of kshs.1, 456,000.They were arrested and charged in

    court.

    c) Kawangware: On 11/03/2010 at 1.30 am along Naivasha road within

    Kawangware, near K-REP Bank Boda Boda and Taxi operators clashed over

    business. AP officers at Kawangware DCs Office received information and

    proceeded to the scene and fatally shot seven people. Later it was established

    that the dead were Taxi drivers within Kawangware. The following day residents

    held demonstrations protest the killings. On 12/03/2010 seven administration

    police officers were arrested and arraigned in court for the offence of murder.

    Case is pending before court.

    d) Uhuru Park: On 13/06/2010 at 1900 hrs, church clergy from different

    denominations held a crusade at Uhuru park grounds. As they were winding up

    unknown device exploded. As a result six people died while seventy two were

    injured and admitted at Kenyatta National hospital. The motive is yet to be

    established. Case is pending under investigation.

    e) Kenyatta National Hospital: On 13/09/2010 at 1620 hrs at Kenyatta national

    hospital, police officers arrested two people after they were found in possession

    of green nylon bag containing male genital organs .One of the suspect arrested

    was an employee of the said hospital as a mortuary attendant and his

    accomplice was an employee of Lona funeral services. The suspects were

    arraigned at Kibera Law courts and released on Ksh 50,000 bail. The case is

    pending before court.

    f) Mbeere: On 6/11/2010 at 2240hrs at Coconut bar, Wakyai bar and

    Thashrek bar within Siakago Township, No. 88068862 Apc Peter Karanja

    from Siakago AP Camp surrendered himself to Siakago police station

    while armed with G3 Rifle with empty magazine after shooting dead eight

    members of public and two Administration police officers who had

    rushed out for rescue. The motive of the killing was that the AP had

    contracted HIV Aids from his girlfriend whom he was looking for at the

    said bars but she had escaped. Scene visited, ten dead bodies found with

    bullet wounds, 16 spent cartridges of 7.62mm recovered and bodies

    removed to Mbeere Hospital Mortuary awaiting postmortem and

    identification. Recovered from the suspect was one G3 Rifle S/NO. FMP

    403933 with empty Magazine. Case is pending before court.

    LAND AND ETHNIC CONFLICTS

    a) Modogashe: On 14.2.2010 at 1300hrs at Skanska village, Elan location

    Lagdera district tension arose over the construction of a proposed primary

    school. The two Clans, Afua and Rer-Ali clashed at a water point after a dispute

    erupted when Rer-Ali clan stopped the animals of Afua clan from taking water.

    As a result eight people from both clans sustained injuries and were rushed to

    Modagashe district hospital where one died while undergoing treatment. Police

    arrested 8 suspects of the inter clan clashes among them six were injured. The

    Provincial administration held a baraza to address the dispute. Case is pending

    before court.

    b) Tharaka: On 28/2/2010 at about 9.00am at Marimanthi area within the

    disputed Tharaka/Tigania border, a group of about 300 Tharaka youth armed

    with bows and arrows attacked an IDP camp with about 38 families. They

    demolished 4 toilets and made away with 8 goats and food stuff and attacked

    an Administration police camp at Thagata Primary school. As a result one

    person sustained gunshot wounds. Later the youth regrouped and went to Mzee

    Murithis home at night and killed the old man, his son, his daughter in law and

    a relative and burnt down two houses in the compound. An operation was

    carried out and over 60 people were arrested and charged before a court of law.

    Calm has since been restored.

    c) Kilgoris: On 13/03/10 at around 1700 hrs at Tarakwet area, skirmishes

    erupted between the Maasai and the Kipsigis communities. Police patrol team

    in the area rushed to the scene and established that several grass thatched

    houses had been razed down by arsonists suspected to be Maasai targeting

    Kipsigis homesteads. The motive of the clashes was a boundary dispute

    between the two communities at Tarakwet area. Police officers were deployed in

    the area to restore law and order.

    d) Garissa. On the 5/10/10 at 1200hrs at Bulla Audha and Bulla Tawakal , a

    land dispute occurred leading to a clash between Abdiwak and Abdalla clans.

    As a result three people were killed and six homesteads torched. Police officers

    visited the scene and restored calm.The three bodies were removed to Garissa

    general hospital. Case is pending under investigations.

    ORGANIZED CRIME

    Since the enactment of The Prevention of Organized Crimes Act 2010 the Police are

    conducting an operation throughout the country to crackdown on members of the

    outlawed mungiki sect members. Their unlawful activities led to the two day strike by

    matatu operators in Kayole who were protesting the over the illegal collection of funds

    in order to operate. The Prevention of Organized crimes act 2010 enacted recently has

    stringent sentences that will go a long way in deterring young people engaging in

    organized crime. Several suspects have been arrested and arraigned in court and

    charged.

    Notable incidents perpetrated by organized crime groups include;-

    a) Nyamira: On 21/09/2010 at unknown time at Ikuruma village, four bodies

    were discovered with their heads chopped off after being subjected to mob

    injustice by suspected members of public suspected to be Sungu Sungu. The

    police later established that one of the suspects had been previously charged

    and released for the offence of robbery with violence that led to the death of

    Rev.Michael Nyakundi of a PAG church on the 20th September 2010. The other

    three are suspected to be his accomplice. Police officers visited the scene and

    efforts are being made to arrest the suspects. Case is pending under

    investigation.

    b) Karuri: On 25/09/2010 at Ndenderu area within Ndenderu area, fifty two

    suspected mungiki adherents who were in a mini bus were arrested by police

    officers on patrol. The suspects were travelling to Ol-kalau for peace meeting

    that was to be held by Maina Njenga alleged former leader of the sect. The

    suspects were detained at Tigoni police station and were between the ages of 25

    and 35 yrs and one lady aged 20 yrs. An assortment of the sects paranarphalia

    i.e 3.3kgs of traditional tobacco, 24 head caps, the sects flag e.tc was recovered

    from the bus and kept at Tigoni Police station. Case is pending before court.

    KIDNAPPING

    During the year there has been a reduction in kidnapping incidents in urban areas

    which mainly targeted businessmen, women and children. Police officers have

    conducted several operations where victims were rescued and suspects arrested and

    charged in court. Notable incidents included;-

    a) Gigiri: On 21/2/2010 a Canadian National who had been kidnapped within

    international school of Kenya was risqu by police officers in Kamunya village in

    Gatundu after a fierce exchange of fire with abductors, two of the abductors

    were killed and arrested.

    ILLICIT BREW

    Over the years Kenya has been grappling with sale of illicit brew that has resulted in

    the death of several citizens. However with the enactment of the Alcoholic Drinks

    Control Act 2010 that is expected to streamline the regulation, advertisement, sale

    and location of licence brewers and retailers. It is expected that such incidents will be

    a thing of the past as the act will deal with health problems associated with alcoholic

    drinks. Notable incidents recorded include;-

    a)

    Shauri-Moyo: On 9/04/2010 at 1430 hrs, area Chief reported that people haddied after taking unknown illicit brew and others had been taken to hospital.

    Police officers visited the scene whereby ten (10) were confirmed dead and seven

    (7) admitted and later discharged. Police have intensified patrols to crackdown

    illicit brew within the country where over 304,300 litres ofkangara and 4,800

    litres ofchangaawere netted. More than 900 suspects have been arrested and

    charged in court.

    b) Kibera: On 27/07/2010 at 1530hrs fifteen people were confirmed dead

    after taking lethal brew (Methanol) at Kibera-Laini Saba. Nine others

    were treated and discharged from Kenyatta National Hospital and

    Mbagathi District Hospital respectively. Crackdown on illicit brew has

    been intensified and so far seventy six people were arrested and charged

    before court for the offence of brewing and consuming changaa within

    Kibera slums alone. The Crackdown on illicit brew in various parts of the

    country is also ongoing.

    c) Ngobit: On 10/8/2010 at unknown time at Kakai Village, six men were

    confirmed dead after drinking illicit brew. It was later established that they had

    consumed lethal brew branded country walkerdistilled by Dunscate Distillers

    company located in Ruiru.Police officers visited the scene and managed to

    arrest a distiller and distributer of the lethal brew. Case is pending before court.

    THEFT OF CASH ON TRANSIT

    a) Mombasa: On 12/2/2010 at 1415 hrs at Barclays Bank Nkrumah Road

    Mombasa, AP officers on escort duties stood sentry while other G4S personnel

    went into the bank to collect money. After collecting the money, the car carrying

    the money with G4S personnel sped to unknown destination leaving the officers

    behind. The motor vehicle was later found abandoned at NEMA offices with two

    boxes, with 514,000 Euros and 2570 Swiss Francs all amounting to cash Kshs

    63,945,300 million. Several suspects have arraigned. Over Kshs 80 million has

    been recovered. Case is pending before court.

    b) Nairobi: On 01/10/2010 at 1144 hrs, at Co-operative Bank building along

    Haille Sellasie Avenue, a group of four men; two dressed in G4S uniform, one in

    AP uniform armed with a G3 rifle and the other in civilian arrived at the bank in

    Mitsubishi van with G4S Logo escorted by a Toyota fielder chase car. They

    presented themselves in order to collect Kshs. 80 Million as per the notice

    already served to the bank by the genuine G4S Company. On verification of the

    documents presented, they fraudulently collected the money and sped off. Upon

    reaching Matubuto road within Kilimani division they abandoned the van and

    escaped in another motor vehicle to unknown destination. At 2.00pm the

    genuine G4S company officers arrived at the Bank to collect the money but the

    bank personnel, informed them the money had already been collected. Police

    officers launched investigations whereby nine people were arrested for stealing

    the money and arraigned in court. Case is pending before court.

    DISARMAMENT OPERATIONS IN RIFT VALLEY AND EASTERN PROVINCES

    Due to the previously rampant cattle rustling and cattle raids witnessed in Isiolo,

    Laikipia West, Samburu and Tigania East Districts, a security operation was launched

    on 15/11/2009 to mop out illegal firearms in possession of civilians and KPRs

    reservist who in the District who have been taking sides alongside their kin during

    cattle raids. Phase1 which was voluntary surrender of firearms led to the recovery of

    1191 arms, 14722 ammunitions and 2678 livestock.

    On 24/3/2010 2,545 illegal firearms which had been recovered from previous

    disarmament exercise were burnt in a ceremony at Uhuru Gardens. Senior

    government officials presided over the exercise. Forceful Disarmament exercise is

    planned to commence along the Kenya- Uganda border in due course.

    Phase 2, the Forceful disarmament operations started in April this year and so far the

    exercises have proved successful with total of1064 arms and 3078 ammunition have

    been registered. So far the breakdown of recovery is as follows;

    OPERATION GOOD HOPE MOYALE SOLOLO AND WAJIR NORTH DISTRICT

    The Operation commenced on 25/10/2010, that was necessitated after continuous

    into the Ethiopian Territory by elements suspected to be members of Oromo Liberation

    Front (O.L.F.) from Ethiopia ostensibly from the Kenyan side. O.L.F fighters have over

    the years wedged war against the Ethiopian Government and continue to commit

    atrocities against innocent public. An operation to flush them out is currently ongoing

    in Moyale Sololo and Wajir North District and so far the following recoveries and

    arrests have been made.

    SECURITY OPERATIONS AGAINST ALIENS

    Since the beginning of the year Police conducted operations against Aliens unlawfully

    present in the country which was sparked of by presence of the controversial

    Jamaican Muslim cleric Sheikh Ibrahim Abdallah Al-Faisal who had been heldpending deportation to his country. The operations since since January have led to the

    arrest of3,557 aliens among them 2,407 Somalis, 801 and 182 Tanzanians. 1028

    Arrests were made in North eastern, 681 in Eastern, 610 in Nairobi, 507 in Coast,

    334 in Rift valley, 219 in central and 138 in Nyanza. All the aliens were arrested,

    taken to court; fined and repatriated. Investigations from arrested Ethiopians reveal

    that most of them were on transit to South Africa.

    ARREST OF PIRATES /AL-QAEDA SUSPECTS

    Lunga Lunga: On 25/9/2010 at 23.30 pm, Moses Oloo of immigration officeL/Lunga border reported that while on duty, he was approached by one Arab namely

    Salim Awadth Salim alias Babaye a Kenyan aged 38 who requested for a temporary

    passport to travel to Tanzania. Upon verification, he was found to be on the list of Al-

    Qaeda suspects list which is in the immigration system. Police were informed and

    arrested him along with Mbwana Twahally and Ahmed Kimwagh who is of Tanzania

    national. All detained and are being interrogated at L/Lunga police station. Case is

    pending under investigations.

    TRAFFIC ACCIDENTS

    During the period under review, the total traffic accidents increased by 0.4 %

    with a total of7,895 accidents recorded in 2010 as compared to 7,862 in

    2009. Among these were 2213 fatal accidents which resulted in 2570 fatalities.

    In the same period, motorists were fined a total of Kshs 434,727,590/=.

    BORDER SECURITY

    Kenyan borders have experienced border incursions by armed militia form Sudan,

    Ethiopia and Somalia. This has prompted the beefing up of security along the borders

    to provide security and deter the influx of illegal aliens. Along the Kenya- Somali

    border the Al-Shabbab militia which is fighting the Transitional Government of Somlia

    poses a serious security threat.

    The security deployment at the Kenyan borders within Somalia, Ethiopia, Sudan,

    Tanzania and Uganda remains in place to counter any influx of illegal aliens.

    During the period under review, the following notable incidents were reported along

    the Kenya-Ethiopia, Kenya-Sudan and KenyaSomalia borders.

    Kenya Ethiopia Border

    a) Lake Turkana: On 22/01/10 at about 1030hrs, around the shores of Lake

    Turkana about 15 armed Merilles from Ethiopia had crossed the lake and

    attacked fishermen who were proceeding to the lake for fishing activities.

    During incident the three people among them a policeman were shot dead.

    b) Kibish: On 8/2/2010 at about 1630hrs a group of Nyangaton Tribesmen from

    Ethiopia raided Kenyan Turkana herdsmen along the Kenya Ethiopia border.

    The herdsmen repulsed them after an exchange of fire as a result of which two

    locals and Six Ethiopian Nyangaton were killed. Calm has since been restored

    in the area.

    c) Lokitaung: On 26/02/10 in the afternoon, a group of Merrile tribesmencrossed the border with the intention of raiding animals. They encountered GSU

    officers on patrol and attacked them, as a result one C.I Vincent Lengoiboni was

    shot dead. On 1/3/2010 a Peace meeting between the Kenyan and Ethiopian

    Authorities was held and the G-3 rifle and uniform of the slain police officer

    handed over. Security officers have been deployed and are patrolling.

    d) Todenyang: On 3/3/2010 at 1220hrs gun shots were heard coming from

    South East of the camp near Tedenyang Manyatta. Police officers visited the

    scene and established that Turkana fishermen were attacked by the Merriles

    from Ethiopia which resulted in the death of two locals shot dead. The officers

    pursued them and killed two of the attacking gang.

    e) Lokichogio: On 29/9/2010 at unknown time at Ejem Loluka Manyatta about

    hundred people believed to be Toposa tribesmen from southern Sudan attacked

    the Manyatta and stole four hundred heads of cattle. A gun fight ensued

    between the locals and the raiders whereby eight people were shot dead while

    thirty heads of cattle died during the incident. Police officers visited the scene

    and the victims were rushed to Lopiding sub- district hospital. Later police

    tracked and recovered two hundred heads of cattle which were later returned to

    the owners. Case is pending under investigations.

    f) Turkana North: On 1/10/2010 at 1400hrs at Kakuayeu area within Kokuro in

    Turkana, Merille herdsmen and Turkana herdsmen held a peace meeting under

    a tree. During the meeting one Merille rose up and opened fire at the gathering

    killing five people and fled across the border. The peace committee followed up

    the matter with Ethiopian Authorities and the suspect was arrested in Ethiopia.

    Kenya Sudan Border

    a) On 23/01/10 at 1000hrs within Gababa area, security officers on patrol along

    Lokichogio to Nadapar road were ambushed by a gang of about 15 men armed

    with AK.47 rifles. The gang shot in discriminately at the officers who responded

    by killing one bandit of Toposa from southern Sudan. An AK-47 rifle s/no. UH-

    4184-2000 with 7rds of 7.62mm special was recovered. A land cruiser reg. no.

    GK A194G had its wind screen and right hand side mirror shattered. Nocasualties on the police side. The body removed to Lopiding sub-district

    hospital mortuary. Case is pending under investigations.

    b) Turkana North: On 14/02/10 at around 09.00 hrs at Ngabara area along

    Nadapal -Lokichogio road, A Kenya Army lorry ferrying officers heading to

    Lokichogio from Nadapal Army patrol base was attacked by a group of Bandits

    believed to be Toposas from southern Sudan. The bandits hit the motor vehicle

    with a Rocket propelled grenade (RPG). During the incident two soldiers officers

    were killed on the spot and twelve others injured and were flown to Moi Forces

    memorial hospital.

    Kenya Uganda border

    a) Turkana south: On 23/4/2010 at 0930hrs at Kamagoro hills, an helicopter

    from Uganda launched two attacks by firing 11 missiles. As a result a 15 year

    old boy was slightly injured and six heads of cattle killed. Scene was visited and

    spent missiles and cartridges were collected for examination. The area was

    patrolled but the motive of the attack is yet to be established. Case is pending

    under investigation.

    Kenya- Somali Border

    a) Liboi: On 19/10/2010 at 0645 hrs at Harehare border, officers of GSU

    Recce Company were on patrol along the border when they intercepted

    four people armed with rifles dressed in jungle and civilian attires. Upon

    being challenged to identify themselves, they opened fire at the officers

    who fired back fatally injuring one of the thugs and seriously wounded

    one of them. No. 82727 Pc Edward Mbui sustained a gunshot injury on

    his left jaw and left shoulder. The injured officer was flown to KNH

    Nairobi for treatment. Case is pending under investigation.

    b) Malindi: On 30/10/2010 at about 6.00pm at Ngomeni area, Police

    officers arrested five suspected pirates all of Somali origin. A search was

    conducted and a satellite mobile phone namely Thuraya was recovered.

    On the same date, 3 other suspected Somali pirates were arrested of the

    coast of Lamu. Case is pending before court.
