No. 20� of the California Oregon Power Company--a.nd related
contract�pending before the Secretary of Interior, the
Federal Power Commission, the Oregon Klamath River Commission
and the California Klamath River Commission, the following
Resolution was dra�ed; and on motion by Nelson Bowles, secon-
ded by James Stearns, and unanamously carried, the secretary
was instructed to send it to the Honorable Secretary of Interior
ouglas McKay.
To send a copy to the Oregon Klamath River Connnission.
To send a copy to the California Water Resources Board.
"Resolved that the Honorable Secretary of Interior
Douglas McKay be advis�d that the California Klamath River
Connnission has organized and the members are actively acquaint-c-- ---... ing themselves 'Wi. th their duties and functions 1 as of June 9,
1954; and respectfully request that h�y decision or
action on California Oregon Po er Company's eontract either as

Thank you for your letter of June 14, advising that the California. Klamath River Commission has"' organized, an�sing a rea olution adopted by the Commission concerning the �ensjon o t e contract between the United States and the California Oregon Power Company in connection with the company•s proposed Big Bend No. 2 Development.
As you know, e in the Department of the Interior �trongly �e of water resources development being accomplished in accordance with the desires of' the people involved. For this reason the Department•s ""ul� position in connection with the �al or �vision of the existing contract with the California Oregon Power Company cannot be formulated until we have an adequate ression of the wishes o ose interested in water res ource development in the Klamath River Basin. We are· hopeful that with organization of your Commission having been completed, the State of California will now be in position to make a timely contribution toward a resolution of the problem. ,-.. -- '
As a further step t<nvard early resolution of the matter, the Regional Director of the Bureau of Reclamation at Sacramento, Mr. Clyde H. �pencer, has been µistructed to confer with all groups interested in this matter, including appropriate State agencies, water user organizations �alifornia Oregon Power Company with a view to ascertaining the positi.QD..>of these several groups in order that all points of view may be fully e�res s ed and adequately considered as a predi�ate to a new Link River D"tiiilagreemen� The Commis.sion may, therefore, expect to be contacted by �. S encer. These consultations between Mr. Spencer and the interested groups will, we think, be mutually advantageous both to the Department and to the groups them-
, selves, particularly in view of the relationship of the matter to the report on the land and water resources of the Klamath River Basin and related areas now nearing completion under Mr. Spencer• s direction.
The resolution of this matter has already been held in �e for a considerable period of time. It is expected that Mr. Spencer •sreI?ort and the consUltation in which he is now eng� will be completed in the relatively near future, thus e,nabling a f� solution without undue delay.
I appreciate your kindness in inviting me to attend the joint meeting you are planning in July. Unfortunately, in view of pre-vious commitments during July, including an official visit to laska, it is quite doubtful whether my schedule can be arranged to permit attendance •

-At the regular meeting of the California Klrunath River Commission held
, a major portion of the meeting was given to a review of \....;:,.,..-T
the Bureau 0£ Reclamation's final report on the Upper Klamath River Basin.
The Commission agreed, in principle, with the recommendations of the report, and
feels that the report is quite complete in its study of the Upper Klamath Basin.
The California State Engineer's office has been asked for their opinions
on this rep6rt and the State's own viewpoint on development of the projects
therein contained.
We are in accord with the recommendations of the Bureau's report a.a
follows:
1. The Sec,reta.ry of the piterior tak{!iO)action trl. th respect to:
(a) The d�dication of public lands for homesteading or use for wildlife preservation, or '
(b) Additional Reclamation development, or
( c) ,Extension of the terms of the existing contract between United States and The California Oregon Power Compcny unti the States of Oregon ,and California acting individually or in concert, and the local interests, after reviewing this report, have been af'forded ample opportmtity to identify their desires as to priorities of water and land use in the Upper Klamath River Basin.
2. The Secretary adopt a single long-range program, o:r perhaps ten years duration, for development of the public lands under his administration, which program will give i'ull consideration to preserving the wild£owl potenticill of_ the Upper Klamath River Basin in its present state or will improve it, hile at the same time will afford maximum opportunity for settlers and will place a maximum o:r such land on local tax rolls.
The studies of the California Klamath River Connnission,, the Oregon Klamath
River Commission and the u. s. Bureau of Reclamation are, in the future, to be
integrated into a joint recommendation to the two States• legislatures and the
Hon. Douglas McKay, Secretary of the Interior, and the Congress of the United
States.

Mr .. Murray of his office carefully reviewed the issues between the Bureau and Copco which ere principally in connection with legal matters and water rirhts. More recently we hav met wit the Indian Agency and Tribal Council in an effort to get an adeq· ate exoression of the ".'fishes of those interested in water resource development of th Up er Klamath River Basin.

At the meeting held last Friday, �tober 15th, in the
Reclamation Bureau's offices in Sacramento between representatives
of the Reclamation Service and The California Oregon Power Company,
Mr. c. H. Spencer, Regional Director, stated that he would�
willing to reconnnend to the Secretary of the Interior any negotia-- " tions looking to the extension of the Link River Dam contract of
February 24, 1917�The California Oregon Power Company would
make commitments in __ advance "With _respect· to th�for
i�rigation of lands in the Klamath Ba.sin, including Butte Valley
and the Oklahoma District lands.
It was Mr. Boyle's understanding and mine that in sub-

of water used for said purp�es shall be in the Klamath River at
a point upstream from Ken�.
The �e of this letter is to indicate certain
of the c�nditions upon which The California Oregon Power Company
is prepared to e nter into an agreement with the United States
respecting the operation of Link River Dam as provided in said
contract of February 24, 1917 and unless such an a greement is
made and entered into, The California Oregon Power Company reserves

SEC. 3. In developing �inal plans for the works authorized in
section 2 of this Act, the S_�oretary shall consult with the �e
Eng��rs of Calif o��-and Oreg?l and shall give fulL.consider!lJii.9n to
the !±_�_s._ of such officials as to the works to be constructed. Con-
struction of the works herein author ized shall not be urxlertaken 'lmtil
a report demonstrating their physical and economic feas ibil ity has been
completed and filed with the Congress . In operating the works authorized - · ----· -
h erein, the Secretary shall proce ed in conformance with the water la�
of the States of Oregon and California.
