Vohra, who is Chairman of the Shri Mata Vaishno Devi Shrine Board, visited Katra today to inspect the progress of the Board's various ongoing major infrastructural develop- ment projects including opera- tionalisation of the 230-bedded Superspeciality Hospital, being established by the Shrine Board at Kakryal. The Governor took stock of the construction and upgradation of the approach roads to SMVDU and the Superspeciality Hospital including Domel-Katra, Panthal-Jhajjar, National Highway-1A to the Superspeciality Hospital, Tikri-Panthal- Katra Road, road from Railway Station, Katra to Shri Mata Vaishno Devi University. The Governor also visited the Shrine Board's Sports Complex at Katra to review pre- paredness for operationalisa- tion. This state-of-the-art Sports Complex has been completed at a cost of about Rs.11 crore. It is pertinent to mention that the Governor's visit to Katra was to take stock of the pre- paredness for the upcoming Prime Minister of India's visit to Katra for inauguration of the Super Speciality Hospital in April this year. Dewan launches online registration, licensing of food business operators Excelsior Correspondent JAMMU, Mar 30: The Health and Medical Education Department through the Drug and Food Control Organization, today launched an online system for issuing licenses and registration certificates to food business operators throughout the State. Parvez Dewan, Advisor to Governor formally launched the system, in the presence of Dr. M. K. Bhandari, Secretary, Health and Medical Education Department (Commissioner Food Safety, J&K). Speaking on the occasion, Parvez Dewan stressed on the need for ensuring that the check of inter- est of health of the consumers, regis- tration and licensing of operators dealing with food items must be undertaken, alongside strengthening the system for better monitoring and testing. He also noted that con- sumers must be made sufficiently aware about consuming healthy, safe and wholesome food. Dr. Bhandari informed that it is for the first time that such an online system of registration and licensing of food business operators has been introduced in the State, which will benefit more than one lakh food business operators including hotels, restaurants, manufacturers, food vendors, hawkers among others. The Department has worked out a detailed mechanism in consulta- tion with Food Safety and Standard Authority of India, National Institute of Smart Governance, Department of Information Technology, J&K for ensuring that the system is available as a convenient model registration to all the Food Business Operators. It shall require the applicant to simply approach the Common Service Centres (KHIDMAT Centres) and submit the details to the CSCs, based on which, the applica- tion would be uploaded on payment of nominal prescribed fee and with- in a stipulated time, the applicant would get a response through SMS alert as well as through email as to the certificate/license having been issued. The same can be secured by the applicant at his discretion from the CSCs or otherwise. Shridhar, General Manager, NISG Hyderabad informed that J&K is the first State in the country to put into place the online registra- tion system based on Common Service Centres. This will surely ensure that the vendors do not find difficulty in approaching the District Officers for securing their certifi- cates/licenses, which was hitherto the case. The system would, inter alia, eliminate inconsistencies, improved transparency and accountability, help in better managing the time lines, ensure streamline reporting and capturing of data base. It may be recalled that the Department had stopped manual registration/licens- ing since 1st March, 2016. Encroachment of stream endangers lives, property in Baramulla Excelsior Correspondent SRINAGAR, Mar 30: A vital stream-cum-flood channel which passes through congested Old Town of North Kashmir's Baramulla district has been encroached over the past two decades by raising illegal struc- tures and as a result it is posing threat to lives and properties of people in times of flood-like sit- uation. Local residents said the Kanli Bagh stream passing through Mohalla Jadeed Baramulla from Sumo Stand to Jhelum river via Masjid Jadeed has been encroached by several influential people since last two decades by taking advantage of turmoil. They said the stream which originally was 22 feet in width has been encroached to 8 feet as illegal structures including a hotel have been raised over it. "As a result the flood waters during rains get directed and enter our houses and commer- cial units causing lot of damage and threat to the life and proper- ty," they said, adding that the matter was also taken up with Deputy Commissioner Baramulla. While admitting the fact that illegal structures have come on the stream during last two decades, the Irrigation and Flood Control Department expressed helplessness. In reply to an RTI application it said that they have been issuing notices to a miscreant who raised a hotel two decades ago on the stream from time to time. "But he misled the depart- ment while showing some Revenue extracts which when got verified from the concerned Revenue Department were of his own land and not of the encroached one," the I&FC Department said. It added that the department has issued a notice to him vide Assistant Executive Engineer's letter no: 1001-03 Dated 15-02-2016 and by Executive Engineer's office vide No: 8247-56 Dated: 22-02- 2016 to remove the illegal stric- ture at his own immediately. "Otherwise the department shall demolish under the provi- sion of Water Regulatory Act 2010 and the expenses what so ever shall have to bear by the encroacher," the IFC Department. A social activist of the Baramulla said that the I&FC Department has been "mute spectator" to the illegal con- structions coming up on the Kanli Bagh stream (nullah) over the past two decades. "This nul- lah was a natural flood channel in Baramulla but the rampant illegal constructions have encroached it and due to this the entire populace of Baramulla are at threat because the rain and flood water don't drain out through this stream," he added. Disbursement of flood relief for houses, Kashmiri traders crosses Rs 1000 cr Excelsior Correspondent JAMMU, Mar 30: As per reports received by the Governor N N Vohra, Rs.1019.64 crore has been disbursed to the flood affect- ed persons by the Deputy Commissioners. Till date Rs. 951.57crore has been disbursed to 155,349 beneficiaries in the case of flood damaged houses while Rs.68.07 crore has been disbursed to 26,330 traders in Kashmir Valley. Gulmarg Hospital lacks facilities for respiratory, ortho patients Excelsior Correspondent SRINAGAR, Mar 30: Located at an altitude of 10, 000 feet, Primary Health Centre (PHC) Gulmarg in North Kashmir's Baramulla district lacks basic medical facilities for patients suffering from respiratory and orthope- dic ailments. Gulmarg, which records heavy snow- fall and below freez- ing point temperature every winter, is thronged by thou- sands of tourists including skiers and other adventure sports lovers. However, scores of tourists, guides and local labourers suffer from respiratory dis- eases due to freezing temperature. Besides, the cases related to orthopedic ailments such as fractures which occur due to slips on snow also come to fore. Given this situa- tion, there should be a hospital equipped with all the facilities with regard to respi- ratory and orthopedic ail- ments. However, the ground situation at PHC Gulmarg is otherwise. Sources said there are two doctors, three para- medics, one X-Ray technician and two sweepers in the hos- pital. "But, no doctor is posted for night duty," they said. The equipments like ECG and X-Ray machines are either defunct or functioning partially. The ECG machine is by and large defunct and the X-ray machine can only per- form X-Rays of arms, knee and leg, said the sources, adding, "but chest X-Rays cannot be performed". Besides, the sources said, the X-Ray technician only per- forms duty for four days in a week and in his absence the machine remains defunct. The new X-Ray plant (300 MA) is non-functional and there is no dentist even as dental chair is available. Sources said there is no facili- ty available for the fracture patients and they are referred to Srinagar's Bone and Joints Hospital. Ironically, the PHC also lacks a four-by-four ambulance. The hospital has also insufficient lighting system. Sources said a generator set is there but that only has capaci- ty to lit bulbs but not to run the other equipments. Sources further added that the accom- modation room for doctors is in shambles. Chief Medical Officer, Baramulla, Dr Bashir Ahmad admitted that there are certain problems in PHC Gulmarg but at the same denied that there is no facility availability for orthopedic patients. He said: "I admit the importance of the PHC Gulmarg and the Government is mulling to upgrade it. "Once the hospital is upgraded we would have all the facilities," he said. The CMO said they have requested the Director Health for four- by-four ambulance. On being asked about the defunct ECG machine, he said: "We had two ECG machines. One is defunct but another is functional." Protest against BSNL, people block road Excelsior Correspondent POONCH, Mar 30: The people from Poonch city including Beopar Mandal and representatives from various political parties and social organizations held strong protest against the BSNL authorities for the total breakdown of services includ- ing internet and mobile phones since last evening. A large number of people of the town including political and social activists besides traders came out on the road at Bus Stand and held strong protest against BSNL authorities. They then moved out- side the main Telephone Exchange and staged their protest for some time. Then they came towards Poonch –Jammu Road and blocked it for about an hour. They shouted loud slogans against Union Telecommunication Minister, Chief General Manager J&K Circle and District Administration as well. They also burnt the effigy of Union Telecommunication Minister. They alleged that due to break down in services, the general public is suffering. There is no bank transactions in Banks since yester- day. People are unable to deposit bills. Students and other cannot fill online forms and the BSNL author- ities do not bother to improve serv- ices. District Magistrate is also not taking cognizance of the matter. Customers are being crushed and are made to deposit bills for the worst ever services. Beopar Mandal Poonch presi- dent Sunil Gupta, Bajrang Dal District president Nishu Gupta, Sourabh Sudan and several others addressed the gathering and warned the BSNL authorities to improve services or get ready to face public action. The movement of vehicles remained suspended for about an hour. Reports from Mendhar and Rajouri said that due to break down BSNL services the public suffered a lot since morning. Even in Rajouri, Mendhar and Surankote towns similar situation is being faced by the general public while Company staff is least bothered. Many telephone exchanges and towers are lying defunct and the BSNL is totally ignoring the public concern. The Governor’s Administration has turned mute spectator, they rued. SVC orders enquiry into timber embezzlement by SDPO Excelsior Correspondent JAMMU, Mar 30: The State Vigilance Commission has directed Additional Deputy Commissioner Reasi for thor- ough enquiry into alleged tim- ber embezzlement and its ille- gal transportation in a police vehicle, allegedly by a senior Police officer posted at Mahore, Reasi. Earlier, while proceeding on a complaint alleging pilferage of timber and its illegal trans- portation in a police vehicle from village Budhan to Jammu by the SDPO Mahore, the State Vigilance Commission had sought full facts and enquiry report from DFO, Mahore, Forest Division Dharmari. The report submitted, revealed that SDPO Mahore had in a case seized one tipper with 1769 sleepers of timber and Saw mill and presented the case before Court of Authorized Officer (DFO Reasi) on 7.5.2015. However, the seized timber was never handed-over to the Forest Department despite number of requests in writing made to the SDPO by the Forest Department. Subsequently, on 19-3-2015, a police vehicle loaded with ille- gal timber was intercepted and seized by the DFO Reasi which was on way from Mahore to Jammu. It further revealed that the said SDPO by abusing his official position, misappropriat- ed the seized timber in conspir- acy with other officials of the Police Station by loading and transporting it in a Police load carrier. The SVC, while taking seri- ous note of illegalities, includ- ing criminal breach of trust, embezzlement of Government property and abuse of official position by the concerned Police Officer, directed ADC Reasi (DVO) to conduct a thorough enquiry into the alleged pilfer- age of timber. The commission has also directed SSP Reasi to appoint a senior officer to assist the Enquiry Officer for carrying out physical verification of tim- ber seized by the Police Station Mahore and submit action taken by the Police Department regarding the use of police vehi- cle for carrying illegal timber towards Jammu and ensure sub- mission of report before the Commission by 21.4.2016. In order to ensure proper disposal of solid waste of the city spread over 115 sq km and inhabited by 15 lakh peo- ple, generating nearly 400 tonnes of solid waste daily, the JMC has identified land at Kot Bhalwal for the new Solid Waste Management Project. The meeting was informed that the plant will be pollution free and will carry modern technology for proper segre- gation and recycling of the waste. The project will have no spill over thereby leading to no negative extremities. The project plan is awaiting Environmental Impact Assessment Report and approval from Union Ministry of Environment, the meeting was told. "In case of further failure, the Commissioner/Secretary will appear in person", the DB directed. 5 yrs imprisonment to labourer for outraging modesty of minor girl Excelsior Correspondent SRINAGAR, Mar 30: The Presiding Officer of Court of Fast Track (Additional Sessions Judge, Pulwama), Virinder Singh Bhou has convicted a labourer for kidnapping and outraging the modesty of a minor girl. According to the prosecution story, on July 14, 2009 a written complaint was lodged with Police Post Kakapora mentioning that a 5- 6 years old girl was kidnapped and sexually assaulted by one Altaf Khan, son of Ghulam Nabi Khan of Kotibugh. Accordingly, a case was regis- tered and after completion of inves- tigation challan was presented in the court of law. After hearing counsel for the accused and Public Prosecutor for the State, Presiding Officer of Court of Fast Track (Additional Sessions Judge, Pulwama), Virinder Singh Bhou convicted the accused under Sections 366 and 354 RPC. On quantum of sentence, the court observed, "the attending cir- cumstances of the case does not warrant full sentence though a child victim of 5/6 years has been kidnapped and convict outraged her modesty but the attending circum- stances does not warrant full sen- tence of the alleged offences". "The convict has three children who are minors and a wife besides him. Moreover, convict is young man and he is labourer by profes- sion and the whole family is dependent upon him. The criminal jurisprudence provides that sen- tence should be commensurate to the gravity of offence committed, but at the same time social status of the convict and dependency on him of the family has to be considered", the court further observed. Accordingly, the court awarded simple imprisonment for five years and fine of Rs 2000 to the convict for the commission of offence under Section 366 RPC. In case of default in payment of fine, the convict shall undergo further simple imprison- ment of one month. The convict was also convicted for the commis- sion of offence under Section 354 RPC and sentenced to undergo sim- ple imprisonment for a period of one year and pay a fine of Rs 1000. In default, the convict shall undergo further simple imprisonment for 15 days. Both the sentences shall run concurrently, the court said. Resignation of Govt employee under compulsion not valid: HC Excelsior Correspondent SRINAGAR, Mar 30: In a sig- nificant judgment the Jammu and Kashmir High Court today declared the resignation submitted by a Government employee under compulsion as invalid and direct- ed the authorities to restore her services. While setting aside the resig- nation of an ReT, Zohra Banoo, submitted before the authorities, the court observed that this kind of resignation is not valid and is arbi- trary and violative of Article 14 & 21 of the Constitution of India. "The order No. ReT/8066-67 dated 26th July, 2010, where under resignation of the petitioner has been accepted by Chief Education Officer, Kargil, men- tion whereof is made in communi- cation No. CEO/SSA/RET/934 dated 08-11-2010, addressed to the Deputy Commissioner, LAHDC, Kargil by respondent- CEO Kargil, is set aside", said Justice MH Attar. Court said that any employee, either working on ad hoc or con- tractual or in any other temporary capacity, cannot be denied sick leave. "It cannot be expected of a human being to continue to remain healthy and able bodied and to continue to discharge his/her duties regularly and with- out any fail", observed Justice Attar while allowing the petition. Court directed the authorities to, take Zohra Banoo back into service and give her posting com- mensurate to her status. "Necessary orders, in this behalf, shall be passed within four weeks from the date copy of this order is served on the respondents", reads the order. Court elaborated and explained the resignation in its true and right perspective and said a resignation is that, which one sub- mits out of his/her own free will and without being compelled by the circumstances to do the same. "The action of the respondents, in not granting leave to the petitioner and in accepting her resignation, which is held to be not voluntary one, is arbitrary and violative of Article 14 & 21 of the Constitution of India, in as much as, the peti- tioner has been deprived of her livelihood as well", court observed while going through the resigna- tion given by the petitioner and accepted it by the authorities. T o be displayed at SPS Museum Srinagar Deptt of Archives retrieves lost sculpture of 18 armed Durga Excelsior Correspondent JAMMU, Mar 30: The Department of Archives Archaeology and Museums of the State Government has retrieved back its lost sculpture of eighteen armed "Durga Mahishasurmardini" from Archaeological Survey of India New Delhi which was stolen from Kashmir over two decades back. After it was stolen from Kashmir the sculpture surfaced in the collection of Linden Museum Stuttgart, Germany and the authorities of ASI New Delhi made hard efforts for its retrieval back to India and on October 5 last year the Prime Minister, Narendra Modhi received the sculpture from German Chancellor Angla Markel during his visit to India and then PM handed it over to the authorities of ASI New Delhi. The Jammu and Kashmir Government deputed a team of departmental experts along with a crew of J&K Police Department to retrieve back rare sculpture belonging to this soil from Archaeological Survey of India and it is now under the custody of Jammu and Kashmir Department of Archives Archaeology and Museums. The Sculpture will be displayed in the new Museum Building SPS Museums Srinagar, which will be soon opened for general public for their education, enjoyment, entertainment, knowl- edge etc. The Department placed on record appreciation for its recovery to the authorities of the Archaeological Survey of India as well as Director General of J&K Police for all cooperation and help for its safe custody to the Department of Archives Archaeology and Museums J&K Govt. Director Archives M S Zahid said that recovery and repatriation of the ancient sculpture is a good news for the art lovers of the State and all efforts will be made for its preservation to posterity. He said the sculpture is a testimony to the fact that Kashmir belonged to rich ancient culture and civilization. WEATHER Release DA, enhance Med Allowance: EJAC Excelsior Correspondent JAMMU, Mar 30: State Government Employees Joint Action Committee (EJAC) has urged upon the State Administration to release 12 % DA and also enhance Medical Allowance of the State employees and pensioners. In a meeting of the Joint Action Committee held here today the sen- ior members Sushil Sudan, Subash Verma and Suresh Sharma strongly criticized the State authorities for not releasing 12 % DA of the State employees which is due from July 2015 and January 2016. They appealed to the State Governor to resolve the pending issues of the employees without any further delay. Besides 12 % DA and enhancement of Med Allowance to Rs 3000 per mont, the other demands projected during meeting included, sanctioning of dislocation allowance to the employees work- ing in rural areas, removal of pay anomalies of clerical cadre, regular- ization of daily wagers/ contractual employees, reorganization and Budgetary support to the PSUs, timely release of salaries/ wages of SSA teachers/ Anganwadi workers and holding of regular DPCs, set- ting up of committee for implemen- tation of 7th Pay Commission in the State, merger of SFC with the Forest Department, declaration of 5 day week to the employees and negotia- tion with the female staff of KGBV which is on hunger strike. They lauded the Govt step for introducing Health Insurance Policy. Prominent among others who attended the meeting included-Yash Pal Mangotra, Mohd Farooq, Maheshwar Sharma, Farooq Mohd, Vinod Sharma, Suman Sharma, Kartar Chand Dubey, Manzoor Ali and Jaswant Singh.

JAMMU, Mar 30: The Healthand Medical Education Departmentthrough the Drug and Food ControlOrganization, today launched anonline system for issuing licensesand registration certificates to foodbusiness operators throughout theState.

Parvez Dewan, Advisor toGovernor formally launched thesystem, in the presence of Dr. M. K.Bhandari, Secretary, Health andMedical Education Department(Commissioner Food Safety, J&K).

Speaking on the occasion,Parvez Dewan stressed on the needfor ensuring that the check of inter-est of health of the consumers, regis-tration and licensing of operatorsdealing with food items must beundertaken, alongside strengtheningthe system for better monitoring andtesting. He also noted that con-sumers must be made sufficientlyaware about consuming healthy,safe and wholesome food.

Dr. Bhandari informed that it isfor the first time that such an onlinesystem of registration and licensingof food business operators has beenintroduced in the State, which willbenefit more than one lakh foodbusiness operators including hotels,restaurants, manufacturers, foodvendors, hawkers among others.

The Department has worked outa detailed mechanism in consulta-tion with Food Safety and StandardAuthority of India, National Instituteof Smart Governance, Departmentof Information Technology, J&K forensuring that the system is available

as a convenient model registration toall the Food Business Operators.

It shall require the applicant tosimply approach the CommonService Centres (KHIDMATCentres) and submit the details to theCSCs, based on which, the applica-tion would be uploaded on paymentof nominal prescribed fee and with-in a stipulated time, the applicantwould get a response through SMSalert as well as through email as to

the certificate/license having beenissued. The same can be secured bythe applicant at his discretion fromthe CSCs or otherwise.

Shridhar, General Manager,NISG Hyderabad informed thatJ&K is the first State in the countryto put into place the online registra-tion system based on CommonService Centres. This will surelyensure that the vendors do not finddifficulty in approaching the DistrictOfficers for securing their certifi-cates/licenses, which was hithertothe case.

The system would, inter alia,

eliminate inconsistencies, improvedtransparency and accountability,help in better managing the timelines, ensure streamline reportingand capturing of data base. It maybe recalled that the Department hadstopped manual registration/licens-ing since 1st March, 2016.

SRINAGAR, Mar 30: A vitalstream-cum-flood channelwhich passes through congestedOld Town of North Kashmir'sBaramulla district has beenencroached over the past twodecades by raising illegal struc-tures and as a result it is posingthreat to lives and properties ofpeople in times of flood-like sit-uation.

Local residents said theKanli Bagh stream passingthrough Mohalla JadeedBaramulla from Sumo Stand toJhelum river via Masjid Jadeedhas been encroached by severalinfluential people since last twodecades by taking advantage ofturmoil.

They said the stream whichoriginally was 22 feet in widthhas been encroached to 8 feet asillegal structures including ahotel have been raised over it."As a result the flood watersduring rains get directed andenter our houses and commer-cial units causing lot of damageand threat to the life and proper-ty," they said, adding that thematter was also taken up withDeputy CommissionerBaramulla.

While admitting the fact thatillegal structures have come onthe stream during last twodecades, the Irrigation andFlood Control Departmentexpressed helplessness. In replyto an RTI application it said that

they have been issuing notices toa miscreant who raised a hoteltwo decades ago on the streamfrom time to time.

"But he misled the depart-ment while showing someRevenue extracts which whengot verified from the concernedRevenue Department were of hisown land and not of theencroached one," the I&FCDepartment said. It added thatthe department has issued anotice to him vide AssistantExecutive Engineer's letter no:1001-03 Dated 15-02-2016 andby Executive Engineer's officevide No: 8247-56 Dated: 22-02-2016 to remove the illegal stric-ture at his own immediately.

"Otherwise the departmentshall demolish under the provi-sion of Water Regulatory Act2010 and the expenses what soever shall have to bear by theencroacher," the IFCDepartment.

A social activist of theBaramulla said that the I&FCDepartment has been "mutespectator" to the illegal con-structions coming up on theKanli Bagh stream (nullah) overthe past two decades. "This nul-lah was a natural flood channelin Baramulla but the rampantillegal constructions haveencroached it and due to this theentire populace of Baramulla areat threat because the rain andflood water don't drain outthrough this stream," he added.

SRINAGAR, Mar 30:Located at an altitude of 10,000 feet, Primary HealthCentre (PHC) Gulmarg inNorth Kashmir's Baramulladistrict lacks basic medicalfacilities for patients sufferingfrom respiratory and orthope-dic ailments.

Gulmarg, whichrecords heavy snow-fall and below freez-ing point temperatureevery winter, isthronged by thou-sands of touristsincluding skiers andother adventuresports lovers.However, scores oftourists, guides andlocal labourers sufferfrom respiratory dis-eases due to freezingtemperature. Besides,the cases related toorthopedic ailmentssuch as fractureswhich occur due toslips on snow alsocome to fore.

Given this situa-tion, there should be ahospital equipped with all thefacilities with regard to respi-ratory and orthopedic ail-ments. However, the groundsituation at PHC Gulmarg isotherwise. Sources said thereare two doctors, three para-medics, one X-Ray technicianand two sweepers in the hos-pital. "But, no doctor is postedfor night duty," they said.

The equipments like ECGand X-Ray machines areeither defunct or functioningpartially. The ECG machine isby and large defunct and theX-ray machine can only per-form X-Rays of arms, kneeand leg, said the sources,adding, "but chest X-Rayscannot be performed".Besides, the sources said, theX-Ray technician only per-forms duty for four days in aweek and in his absence themachine remains defunct.

The new X-Ray plant (300MA) is non-functional andthere is no dentist even as

dental chair is available.Sources said there is no facili-ty available for the fracturepatients and they are referredto Srinagar's Bone and JointsHospital. Ironically, the PHCalso lacks a four-by-fourambulance.

The hospital has also

insufficient lighting system.Sources said a generator set isthere but that only has capaci-ty to lit bulbs but not to runthe other equipments. Sourcesfurther added that the accom-modation room for doctors isin shambles.

Chief Medical Officer,Baramulla, Dr Bashir Ahmadadmitted that there are certainproblems in PHC Gulmarg butat the same denied that thereis no facility availability fororthopedic patients. He said:"I admit the importance of thePHC Gulmarg and theGovernment is mulling toupgrade it.

"Once the hospital isupgraded we would have allthe facilities," he said. TheCMO said they have requestedthe Director Health for four-by-four ambulance. On beingasked about the defunct ECGmachine, he said: "We had twoECG machines. One is defunctbut another is functional."

A large number of people ofthe town including political andsocial activists besides traders cameout on the road at Bus Stand andheld strong protest against BSNLauthorities. They then moved out-side the main Telephone Exchangeand staged their protest for sometime.

Then they came towardsPoonch –Jammu Road and blockedit for about an hour. They shoutedloud slogans against UnionTelecommunication Minister,Chief General Manager J&KCircle and District Administrationas well. They also burnt the effigyof Union TelecommunicationMinister. SVC orders enquiry into timberembezzlement by SDPO

JAMMU, Mar 30: The StateVigilance Commission hasdirected Additional DeputyCommissioner Reasi for thor-ough enquiry into alleged tim-ber embezzlement and its ille-gal transportation in a policevehicle, allegedly by a seniorPolice officer posted at Mahore,Reasi.

Earlier, while proceeding ona complaint alleging pilferageof timber and its illegal trans-portation in a police vehiclefrom village Budhan to Jammuby the SDPO Mahore, the StateVigilance Commission hadsought full facts and enquiryreport from DFO, Mahore,Forest Division Dharmari.

The report submitted,revealed that SDPO Mahore hadin a case seized one tipper with1769 sleepers of timber and

Saw mill and presented the casebefore Court of AuthorizedOfficer (DFO Reasi) on7.5.2015. However, the seizedtimber was never handed-overto the Forest Departmentdespite number of requests inwriting made to the SDPO bythe Forest Department.Subsequently, on 19-3-2015, apolice vehicle loaded with ille-gal timber was intercepted andseized by the DFO Reasi whichwas on way from Mahore toJammu. It further revealed thatthe said SDPO by abusing hisofficial position, misappropriat-ed the seized timber in conspir-acy with other officials of thePolice Station by loading andtransporting it in a Police loadcarrier.

The SVC, while taking seri-ous note of illegalities, includ-ing criminal breach of trust,embezzlement of Governmentproperty and abuse of officialposition by the concerned PoliceOfficer, directed ADC Reasi(DVO) to conduct a thoroughenquiry into the alleged pilfer-age of timber. The commissionhas also directed SSP Reasi toappoint a senior officer to assistthe Enquiry Officer for carryingout physical verification of tim-ber seized by the Police StationMahore and submit action takenby the Police Departmentregarding the use of police vehi-cle for carrying illegal timbertowards Jammu and ensure sub-mission of report before theCommission by 21.4.2016.

In order to ensure properdisposal of solid waste of thecity spread over 115 sq kmand inhabited by 15 lakh peo-ple, generating nearly 400tonnes of solid waste daily,the JMC has identified landat Kot Bhalwal for the newSolid Waste ManagementProject.

The meeting was informedthat the plant will be pollutionfree and will carry moderntechnology for proper segre-gation and recycling of thewaste. The project will haveno spill over thereby leadingto no negative extremities.The project plan is awaitingEnvironmental ImpactAssessment Report andapproval from Union Ministryof Environment, the meetingwas told.

5 yrs imprisonment to labourer foroutraging modesty of minor girlExcelsior Correspondent

SRINAGAR, Mar 30: ThePresiding Officer of Court of FastTrack (Additional Sessions Judge,Pulwama), Virinder Singh Bhou hasconvicted a labourer for kidnappingand outraging the modesty of aminor girl.

According to the prosecutionstory, on July 14, 2009 a writtencomplaint was lodged with PolicePost Kakapora mentioning that a 5-6 years old girl was kidnapped andsexually assaulted by one AltafKhan, son of Ghulam Nabi Khan ofKotibugh.

Accordingly, a case was regis-tered and after completion of inves-tigation challan was presented in thecourt of law.

After hearing counsel for theaccused and Public Prosecutor forthe State, Presiding Officer of Courtof Fast Track (Additional SessionsJudge, Pulwama), Virinder SinghBhou convicted the accused underSections 366 and 354 RPC.

On quantum of sentence, thecourt observed, "the attending cir-cumstances of the case does notwarrant full sentence though achild victim of 5/6 years has beenkidnapped and convict outraged her

modesty but the attending circum-stances does not warrant full sen-tence of the alleged offences".

"The convict has three childrenwho are minors and a wife besideshim. Moreover, convict is youngman and he is labourer by profes-sion and the whole family isdependent upon him. The criminaljurisprudence provides that sen-tence should be commensurate tothe gravity of offence committed,but at the same time social status ofthe convict and dependency on himof the family has to be considered",the court further observed.

Accordingly, the court awardedsimple imprisonment for five yearsand fine of Rs 2000 to the convictfor the commission of offence underSection 366 RPC. In case of defaultin payment of fine, the convict shallundergo further simple imprison-ment of one month. The convictwas also convicted for the commis-sion of offence under Section 354RPC and sentenced to undergo sim-ple imprisonment for a period ofone year and pay a fine of Rs 1000.In default, the convict shall undergofurther simple imprisonment for 15days. Both the sentences shall runconcurrently, the court said.

Resignation of Govt employee undercompulsion not valid: HC

SRINAGAR, Mar 30: In a sig-nificant judgment the Jammu andKashmir High Court todaydeclared the resignation submittedby a Government employee undercompulsion as invalid and direct-ed the authorities to restore herservices.

While setting aside the resig-nation of an ReT, Zohra Banoo,submitted before the authorities,the court observed that this kind ofresignation is not valid and is arbi-trary and violative of Article 14 &21 of the Constitution of India.

"The order No. ReT/8066-67dated 26th July, 2010, whereunder resignation of the petitionerhas been accepted by ChiefEducation Officer, Kargil, men-tion whereof is made in communi-cation No. CEO/SSA/RET/934dated 08-11-2010, addressed tothe Deputy Commissioner,LAHDC, Kargil by respondent-CEO Kargil, is set aside", saidJustice MH Attar.

Court said that any employee,either working on ad hoc or con-tractual or in any other temporarycapacity, cannot be denied sickleave. "It cannot be expected of a

human being to continue toremain healthy and able bodiedand to continue to dischargehis/her duties regularly and with-out any fail", observed JusticeAttar while allowing the petition.

Court directed the authoritiesto, take Zohra Banoo back intoservice and give her posting com-mensurate to her status."Necessary orders, in this behalf,shall be passed within four weeksfrom the date copy of this order isserved on the respondents", readsthe order.

Court elaborated andexplained the resignation in its trueand right perspective and said aresignation is that, which one sub-mits out of his/her own free willand without being compelled bythe circumstances to do the same."The action of the respondents, innot granting leave to the petitionerand in accepting her resignation,which is held to be not voluntaryone, is arbitrary and violative ofArticle 14 & 21 of the Constitutionof India, in as much as, the peti-tioner has been deprived of herlivelihood as well", court observedwhile going through the resigna-tion given by the petitioner andaccepted it by the authorities.

JAMMU, Mar 30: TheDepartment of ArchivesArchaeology and Museums of theState Government has retrievedback its lost sculpture ofeighteen armed "DurgaMahishasurmardini"from ArchaeologicalSurvey of India NewDelhi which was stolenfrom Kashmir over twodecades back. After itwas stolen fromKashmir the sculpturesurfaced in the collectionof Linden MuseumStuttgart, Germany andthe authorities of ASINew Delhi made hardefforts for its retrievalback to India and onOctober 5 last year thePrime Minister,Narendra Modhireceived the sculpturefrom GermanChancellor AnglaMarkel during his visitto India and then PM handed itover to the authorities of ASINew Delhi.

The Jammu and KashmirGovernment deputed a team ofdepartmental experts along with acrew of J&K Police Departmentto retrieve back rare sculpturebelonging to this soil fromArchaeological Survey of Indiaand it is now under the custody ofJammu and Kashmir Departmentof Archives Archaeology andMuseums. The Sculpture will bedisplayed in the new MuseumBuilding SPS Museums Srinagar,

which will be soon opened forgeneral public for their education,enjoyment, entertainment, knowl-edge etc. The Department placedon record appreciation for itsrecovery to the authorities of the

In a meeting of the Joint ActionCommittee held here today the sen-ior members Sushil Sudan, SubashVerma and Suresh Sharma stronglycriticized the State authorities fornot releasing 12 % DA of the Stateemployees which is due from July2015 and January 2016.

They appealed to the StateGovernor to resolve the pendingissues of the employees without anyfurther delay. Besides 12 % DAandenhancement of Med Allowance toRs 3000 per mont, the otherdemands projected during meetingincluded, sanctioning of dislocation

allowance to the employees work-ing in rural areas, removal of payanomalies of clerical cadre, regular-ization of daily wagers/ contractualemployees, reorganization andBudgetary support to the PSUs,timely release of salaries/ wages ofSSA teachers/ Anganwadi workersand holding of regular DPCs, set-ting up of committee for implemen-tation of 7th Pay Commission in theState, merger of SFC with the ForestDepartment, declaration of 5 dayweek to the employees and negotia-tion with the female staff of KGBVwhich is on hunger strike.
