Some say people up north couldn't get to their bikes forthe snow others are blaming it on the 75th anniversary this year in Sturgis. President (Frank) – Meeting called to order 7:30 PM and conducted the Pledge of Allegiance and moment of si-lence. Opened discussion on insurance for rallies and rides, as well as when we do have a ride that the number of par-ticipants must match the number of riders. Please ensure you use your full name, not your road name/nickname. Inthe future we will have a separate sign in area prior to staging for the rides. If participants are under the age of 18,their parents/guardians must sign. 10 minute time limit for all speakers has be re-introduced.Vice President (Geno) – Announced the State meeting that ABATE will be transitioning from ABATE of FloridaInc. to ABATE of Florida Safety and Education (501c3). NCOM meeting is in May for those who want to attend.This year it will be held in Colorado Springs, CO.

ABATE of Florida supports enhanced penalties for those who injure or kill vulnerable road users.

In 2005, our lobbyist, Doc Reichenbach, was successful in getting an amendment to a bill that changed the following statuesso the word “shall” replaced “may” which means MUST.

318.19 Mandatory hearings for those who are involved in an accident with severe injury or death

318.14 (5) the actual stiffer penalties for those under 318.19. $500 for causing incapacitating injuries, $1000 for causing death.

(The same year, Doc was able to get the apehanger law changed to shoulder height.) After the bill became law, it took a letterto the head 7th circuit court judge to revise the memo dealing with sentencing guidelines, despite DHSMV sending memos to allcircuit courts on new laws. Currently, if judges are aware that an injury or death occurred at all, they usually withhold adjudica-tion if you have a lawyer. In Volusia County reckless driving charges never seem to be used. So now we need more laws. Ourchapter would prefer backing off on enhanced penalties. However, the ABATE state delegation believes that since there is somuch minimum mandatory laws, motorcyclists should get something for themselves. There needs to be something between a$122 ticket and vehicular manslaughter to get the attention of those with poor driving skills. In recent sessions, committeechairmen have sat on this bill.

ABATE of Florida will seek State funding for our Motorcycle Safety and Awareness Program. These funds come froman additional fee paid only by motorcycle registrations under FS 320.08 (1) (c). It was taken out of the budget last year and ve-toed the year before. DHSMV Ridesmart program has been established so this will be a tough sell.

TALLAHASSEE: These are the statues I check bills for:

316.211 (3b) $10000 medical coverage requirements for helmetless riders.

324.021 (1) PD Financial Responsibility exemption for motorcycles routed to 627.732 (3)

627.732 (3) PIP No Fault exemption for motorcycles; “Motor vehicle” means any self-propelled vehicle with four or morewheels

ENHANCED PENALTIES FOR THOSE WHO KILL OR INJURE VULNERABLE ROAD USERS

CS/HB231 Transportation Passidomo; Revises provisions relating to the rights & safety of vulnerable users (includes mo-torcycles) of public rights-of-way; prohibits assault of bicycle riders; revises provisions for careless driving; provides penaltiesfor specified infractions contributing to bodily injury of vulnerable users; requires traffic law & substance abuse educationcourses to include certain instruction; requires driver license examinations to include test of applicant's knowledge of certaintraffic laws; requires driver education courses offered by school district to include certain information.

HB 231 passed successfully out of its first committee (Highway & Water Safety Subcommittee)! Doc was there and was able tospeak in support of the Bill very successfully. ABATE of Florida is supporting this bill.

The penalties are weaker and I think the passing in a no passing zone needs work. Here is the response I received from myState Representative when I contacted him about this bill.

There are many bills files that expand the penalties for using cell phones. I am not including them in my published legislative report.Motorcyclists know texting is the worst form of distracted driving. Eating your French Fries after the drive thru window is also dis-tracting. ABATE of Florida has no position on these bills. We finally got a texting statue last session. Public awareness is being raisedwith interstate message boards and TV commercials. But in the Florida tradition of criminalizing America, there are several bills in-creasing restrictions and fines.

GUN DISCHARGE

I will not be tracking these, but Darrin probably is. At issue is home gun ranges and there are billsto totally restrict this to letting local government decide.SPEED TRAPS

HB421 Traffic Enforcement Agencies and Traffic Citations: Designates counties & municipalities as traffic enforcement agencies;prohibits establishing traffic citation quotas; requires county or municipality to submit report of its traffic citation revenue & its expensesfor operating law enforcement agency during fiscal year to Legislative Auditing Committee.

CS/SB264 Traffic Enforcement Agencies and Traffic Citations: Designating counties and municipalities as traffic enforcementagencies for purposes of the section and prohibiting them from establishing traffic citation quotas; requiring a county or municipalityto submit a report of its traffic citation revenue and its expenses for operating a law enforcement agency during a fiscal year to theLegislative Auditing Committee under certain circumstances, etc.

SENATE BACKS PLAN TO END SPEED TRAPSPointing to a long-running controversy about a speed trap in the small North Florida town of Waldo, a Senate panel Wednesdayapproved a proposal to make clear that local police officers cannot have quotas for writing traffic tickets. Sen. Rob Bradley, aFleming Island Republican who is sponsoring the bill (SB 264), said quotas have long been banned for state law-enforcementofficers. But he said questions remained about whether the ban applied to local police. Along with clearing up that question, thebill would require cities or counties to publicly report if revenue from traffic tickets exceeds 50 percent of the costs of operatingtheir law-enforcement agencies. Such disclosure could indicate whether local governments are relying on tickets to pay for policeservices. "I think the more information, the better,'' Bradley said before the Senate Transportation, Tourism and Economic Devel-opment Appropriations Subcommittee unanimously approved the bill. Waldo, along U.S. 301 near Gainesville, was accused foryears of being a speed trap. The issue ultimately led to the town's police department being disbanded last year after officers saidthey had been placed under a ticket quota. The Florida Police Chiefs Association and the Florida Police Benevolent Associationsignaled support for the bill during Wednesday's meeting. Bradley's district includes Waldo, which now gets police services fromthe Alachua County Sheriff's Office.

BODY CAMERAS. Daytona Beach Police Chief Chitwood likes body cameras; however is this a form of an unfunded mandate? TheFeb legislative report has more details.

SB248 Recording of Law Enforcement Activities Smith: Citing this act as the "Police and Citizen Protection Act"; requiring uni-formed officers assigned primarily to patrol duties to be equipped with body cameras; exempting the recordings of such activities fromspecified provisions relating to the interception of wire, electronic, and oral communications, etc.

HB57 Recording of Law Enforcement Activities Jones, S. and Williams, A. (CO-SPONSORS) Van Zant: Designates act "Police andCitizen Protection Act"; requires uniformed officers assigned to patrol duties to be equipped with body cameras; requires use of suchcameras during specified activities; exempts recordings of such activities from specified provisions relating to interception of wire, elec-tronic, & oral communications.(2) Every uniformed law enforcement officer in this state who is primarily assigned to patrol duties shall

be equipped with a body camera while performing such duties. The camera

SB1186 Transportation Brandes: Providing that certain commercial sponsorship may be displayed on state greenway and trail facili-ties not included within the Shared-Use Nonmotorized Trail Network; requiring the governing body of any independent special dis-trict created to regulate the operation of public vehicles on public highways to consist of a certain number of members; authorizing apublic transit provider to enter into agreements with a transportation network company for the provision of certain transit services,etc. Sometimes things will get tacked on to innocuous bills

SB1162 Driver Licenses: Sachs: Decreasing the fee for the renewal or extension of aClass E driver license or a license restricted to motorcycle use; decreasing the replace-ment fee for a driver license; revising the allocation of such fee; providing that any vet-eran honorably discharged from the Armed Forces who has served at least 1 day duringa wartime period and who is qualified to obtain a driver license under this chapter is ex-empt from all fees required by this section, etc.

H.R. 21 U.S. Rep. Jim Sensenbrenner (R-Wis.) This bill would repeal the U.S. Environmental Protection Agency’s waiver decisionrelated to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent sci-entific analysis of the effects of gasoline containing up to 15 percent ethanol.

Latta (R-OH) has introduced H.R. 861 and Senator Marco Rubio has introduced S 424, and both do the same thing. They order a test to see if awi-fi signal can coexist with the incumbent licensee on the 5850-5925 megahertz (MGh) band. Currently the most popular band for wi-fi is 2.4and the incumbent licensee for the 5805-5925 MGh is vehicles. The license was dedicated for use by vehicles in 1999 by the FCC, before wi-fiwas even available for public use. The Motorcycle Riders Foundation (MRF) is tracking this issue because like all driver assist technology, wefear that this will reduce the amount time drivers spend watching the road. “Technologies that take the actual operators out of the equation arealways worrisome; this is no different. If operators become accustomed to not needing to pay attention for red lights and stop signs, we all knowthat will pose problem for motorcyclists,” said Jeff Hennie Vice President of Government Relations and Public Affairs for the Motorcycle RidersFoundation. The MRF does not currently have a position on this issue. The distracted driving portion of this issue is completely separate fromthis legislation. This legislation simply conducts a technical test to see what's possible with modern technology. The distracted driving issue willalways be part of the discussion as more and more technology is employed by vehicles.

March 11, 2015Congress looks at Vision ZeroVision Zero is the concept that it is possible to drop the fatalities within the road transportation community to zero and that it should be done atall cost. Vision Zero plans are lofty and admirable, but the approach is just not plausible. At the core of Vision Zeros philosophy, life and healthcan never be exchanged for other benefits within the society, rather than the more conventional comparison between costs and benefits, wherea monetary value is placed on life and health, and then that value is used to decide how much money to spend on a road network towards thebenefit of decreasing how much risk. The plan also places human life and health as a priority over mobility and other objectives of the trafficsystem. It also describes how we should build roads with no possibility of a side or frontal impact, and prohibition to use those roads on morevulnerable road users. Another part of plan is speed limits; should the plan be adopted in full American speed limits would plummet to 19 milesper hour in areas where there is contact between pedestrians and cars, and 43 mph for all other roads. The creators envisioned a slow mov-ing, padded fantasyland right at home in a Disney movie, not the real world. Vision Zero began in Sweden in 1997 and has since been adoptedin some part at least by Netherlands and United Kingdom. In the United States some major cities are also adopting the concept; so far NewYork, Portland, and San Francisco are all on board. A lawyer in Boston gives out a law school scholarship in the attempt to get the city to takelook at considering the idea. Last week Congressman Earl Blumenauer (D-OR) introduced H.R. 1274, a bill that would make money availableto local governments to develop and implement Vision Zero plans. A mandatory national helmet law would just be the jumping off point. Makeno mistake that the full implementation of Vision Zero in America would eliminate motorcycling as its known now. Of course it is everyone’s wishthat no one would become injured or killed on our roads. Every life is precious and every American should do all in their power to reduce blood-shed on the roads. But simply slowing every vehicle and prohibiting other “vulnerable” vehicles from the traffic mix, all while padding the road-ways and interior of vehicles and installing cameras everywhere to find the scofflaws, is the stuff of science fiction, not the real world. VisionZero has a blind spot; it does not take into account any budget, financing or the effects on the economy by slowing traffic. Zero fatalities is al-ways the goal, however when you have moving parts operated by human beings traffic safety will always have a component that will never be acontrol for: human behavior. The Motorcycle Riders Foundation will keep you informed on this issue.

LOCALFrom the News-Journal: On Dec. 13, 2014: Katherine Johnson, 82 (DOB 1932), made a left hand turn in front of Robert Clayton, 61, on SR415. Clayton died at the hospital. The newspaper made it a point to say he was not wearing a helmet. NO CHARGES

From the News-Journal: On Dec. 12 2014: Port Orange Police Officer Silvio Portillo, 28 or 27 (depending on which news clipping you look at),hit from behind Andrew McIlvain, 39, on Dunlawton Ave. McIlvain died on Jan 4, 2015.
