We held a well

attended public

forum on Thursday

5th March to

discuss the marine protected areas

process and our attempts to obtain a

satisfactory outcome for our community.

We appreciate the efforts that so

many people made to hear about this

important matter.

You have probably noticed a significant

change in my public comments

about marine parks. This has been

generated by meaningful discussions

with Minister Jay Weatherill and staff

from the Department of Environment

and Heritage. They have demonstrated

a willingness to listen, to try to give

reassurance as to how our community

will be respected during the process

and to work together with us to achieve

good outcomes.

The position of Council in regard to this

issue is still to be determined however it

is fair to say that we are encouraged by

the changes to date including a letter

from Minister Weatherill giving various

assurances.

Whatever decision Council makes will be

reflected in my public comments in future

but it is appropriate to acknowledge the

positive efforts currently being made to

resolve this matter.

Whatever progress may have been made

to date we must remember that there is

still much work to be done. There is at

least another two years of consultation

and hard work to complete this process.

Should Council decide to support the

proposed plan only to find that it fails

to deliver a good outcome there is still

The Masters Games is a fantastic arena

for us to showcase something that is very

precious to us all on the Eyre Peninsula,

that being our love of sport and social

events. In past years we have watched

annual events grow with more and

more visitors returning and rebooking

for the coming year. The Bowls Annual

October competition, Ceduna Golf June

Long Weekend Open, Dirt Circuit State

Titles and the Oysterfest are a few of

the events that we have mastered well.

The Games are now getting close and

we have had an outstanding response

from the community and further afield,

having some participants coming from

as far as Queensland and Perth to

compete.

Many thanks must be given to the

sports clubs for their support and help

in organising and running these events

because without them we would not

have the Masters Games.

You can see around town that a

number of Masters Games signs have

been erected, this is to remind us that

we (Ceduna) are holding the Masters

Games, to also get more support from

passers by and generally advertise this

major event.

On Thursday night 16th April, there will

be a sports dinner, held at the Thevenard

Sports Club from 6.30pm, to welcome

competitors to the Games. The dinner is

a tradition of the Games and takes place

at every Masters held across the state.

The guest speaker will be footy legend,

Russel Ebert, who will have some great

football stories to tell us.

The dinner is being MC’ed by Ceduna

local Ron Redford and is sure to be a

successful night.

Tickets are available for $45pp and are

selling fast. If you would like to attend

the dinner tickets can be purchased from

the Ceduna Council office between 9-

5pm weekdays.

The Games are programmed to

commence on Friday 17th April

highlighted with an open air celebration

overlooking the Ceduna foreshore, it all

kicks off with the traditional participant

parade starting at the Sailing Club and

making its way down to the O’Loughlin

Terrace car park, adjacent the Council

Chambers, followed by a spectacular

aerial display by Chris Sperou to cut the

ribbon and declare the Games open.

Cornsey’s Rock ‘n’ Roll All Stars will be

playing music to get the party started.

An array of wonderful food stalls will

also be available for all to enjoy as the

night’s festivities progress. The official

opening commences from 6.30pm

followed by a VIP/Sponsors welcome

held in the Council Chambers which

is also the registration point for all

competitors.

The following sports are included -

athletics, dirt circuit, badminton,

basketball, cricket, dragon boating,

eight ball, football, golf, lawn bowls,

netball, shotgun and pistol shooting,

sailing, squash, tennis, table tennis,

motor cycling and triathlon. For full

please see/call the Games Co-ordinator

for that event.

Cycling and swimming have been cut

from the program due to sport difficulties

in programming and organising, but

the triathlon is in full swing and is

fast becoming a very popular event

among locals and like minded people

throughout the Eyre Peninsula. We have

run a successful training and come and

try day for the triathlon. Other sports

attracting a lot of attention are lawn

bowls, dragon boating, tennis and golf.

The registration centre will be set up

in the Ceduna Council Chambers,

located at 44 O’Loughlin Terrace, and

will be fully manned throughout the

Games from Thursday 16th April at

12noon. All participants must check

in at this registration centre to receive

the required information to compete in

the Games. We will have merchandise

available for sale and much information

and help that you may require to make

the Games an enjoyable experience.

Due to the longevity, emotions involved,

and the need for a clear direction from

the general public, Council decided

to undertake public consultation to

determine the public’s preferred option.

An information night was held at the

Ceduna Memorial Hall on Monday 16th

March 2009 with both the Ceduna Tidal

Pool Committee and Swimming for the

Future representatives presenting their

proposals to interested members of the

public.

Following the meeting, Council sent out

Information Packs to all electors which

were endorsed by representatives of

both proposals. The Information Packs

contained a Feedback Form asking for

your preference between Option 1,

Option 2, or neither option with the aim

of determining the public’s preferred

option.

Council would like to thank all those

who attended the information night

and who returned the feedback form or

otherwise provided feedback.

Council will consider the public feedback

from the consultation process at its April

Ordinary Council meeting.

CBD Streetscape

After some unavoidable delays in January

due to the heatwave, work in McKenzie

Street is now progressing. New street

trees and guards to McKenzie Street

footpaths are in place. Concrete paving

to the south side of McKenzie Street

has been completed and has also been

completed on the north side to the old

W.C.T. driveway.

A disabled ramp has been constructed to

the Australian Standard at the McKenzie

Street entrance to Spry’s Hardware store.

This will be paved after the handrail has

been fabricated and fitted.

The new roundabout at the intersection

of Poynton and McKenzie Streets has

been constructed as well as the annulus

to the intersection. This has been

designed to allow passenger vehicles to

travel through the roundabout at safe

speed on the asphalt surface, whilst still

allowing sufficient turning area for heavy

vehicles, such as passenger coaches, by

utilising the paved annulus on the inside

of the roundabout. Restricted access

vehicles such as B-doubles and road

trains are not permitted to access these

streets thus the road geometry has

not been designed to allow for these

vehicles.

The next stage of the project to be

constructed is the area at the head of the

jetty. Council has recently received final

drawings for the design to the head of

the jetty and this work will commence

in due course.

Council would like to sincerely thank

everyone for being so patient in regards

to the disruption to normal pedestrian

and traffic movements while the work

has been underway.

Swimming Enclosure

A swimming enclosure in Ceduna has

been discussed in some form or other

for a number of years. The Ceduna

Tidal Pool Committee (formerly Safe

Swimming Enclosure Committee) and

Swimming for the Future have both put

forward proposals to Council for some

form of swimming enclosure.

The two proposals currently being

considered by Council are:

Option 1 - Alexanders Beach Rockwall

Changes to Exempt Development

Ratepayers and members of the public

may have recently heard, or read the

State Governments advertisements with

regard to ‘exempt developments’ as

part of the Governments ‘Development

Review’ process.

However, before making any

assumptions, it would be advisable

to check with Council’s Development

Officer, on the specific exemptions.

Most building work requires assessment

and approval, exempt development,

however, requires no development

assessment or approval at all.

There have always been some forms of

exempt development but fairly restrictive.

The Government has now increased

some of the criteria for these forms of

development, which in the main, includes

minor residential development matters

which are commonly undertaken by

homeowners to improve their property

and their lifestyle.

What is on the exempt development list?

• Sheds (of less than 15m2 floor area

and which meet certain conditions)

• Pergolas (which meet certain

conditions, including not

having a hard roof)

• Decks (which meet certain

conditions, including not being more

than 50cm above the ground)

• Shade sails (to 20m2 and no more

than 3m in height and which

meet certain other conditions)

• Solar panels (with certain conditions)

• Water tanks (less than 10m2 and

which meet certain other conditions)

• Roller doors (which meet

certain conditions)

• Certain fences to 2.1m in height

• Retaining walls to 1m in height

(which meet certain conditions)

Where does exempt development apply?

Exempt development applies in

most residential areas in SA. Exempt

development generally does not apply

in (this varies for different items)

• State Heritage Places

• Stage Heritage Areas

• Local Heritage Places

• Historic (Conservation)

Zones or Policy Areas

• Historic Township Zones

• Flood Zones

• Hills face Zones

What sort of homes does exempt development apply to?

Exempt development applies in relation

to all types of dwellings, be they standard

detached homes, semi-detached homes,

townhouse or even apartments.

It’s important to note though, that

where strata titles or community titles

exist (such as with many townhouse or

group dwellings, like retirement villages)

special approval relating to these titles

may need to be obtained form the

‘body corporate’ to undertake any

development.

Information for Contractors

On the 12th October an information

night was held to advise contractors

of changes in the way Council deals

with contractors. In total 55 attended

the night from 29 local businesses.

Also among those who attended were

a number of Council staff members

including all works supervisors.

Council’s consultants, Roger and

Leanne Palubinski, facilitated the

night and presented information on

Council’s Contractor Management and

Occupational Health Safety Welfare

and Injury Management policies as

well as risk management and job safety

analysis.

Council’s new OHS Contractor

Management policy and procedures help

give direction on OHS&W management

during the application of contracts.

By having this policy in place it allows

Council’s contractors to document all

phases of the contract delivery from

concept to completion and brings the

Council in line with recommendations

from the Local Government Association,

Mutual Liability Scheme and Workers

Compensation Scheme following

Workcover audits of SA Councils last

year.

Contractors are now required to register

their interest. All those who attended the

information session were given forms

which once completed and returned will

allow them to be placed on Council’s

Preferred Contractor’s List.

Those who did not attend who would

like to be placed on the list can obtain

the relevant forms by contacting

Karinne Woollatt or Andy Johns at the

Council Administration Office on 8625

3407 and will be required to undergo

an induction before commencing any

works for Council.

Ceduna Keys

Unfortunately there have been

considerable delays with this project.

One of the reasons is the lengthy change

in ownership of the project from the

Ceduna Marina Development Company

(CMDC) to Umillo Bria and/or Nominees

(new Developer). As part of the process

of transferring ownership, the transfer

and assignment of interest from CMDC

to the new Developer is required under

a number of legal documents.

CMDC previously had a contract

with private landowners to purchase

additional land adjacent to the proposed

site north of the township (Dew’s

property) and the new Developer is

in the process of negotiating with the

landowner.

Another agreement that also requires

the transfer and assignment of interest

from CMDC to the new Developer is

the Ceduna Keys Indigenous Land Use

Agreement with traditional owners and

this has now been secured.

From discussions with the new

Developer, our understanding is that

once the change of ownership of the

project has been finalised, they will be

in a position to release further details of

the project.

In regards to the residential contracts

that were signed with potential

purchasers, these were actually between

the purchaser and CDMC and therefore

are not able to be assigned from CMDC

to the new Developer. If you were a

potential purchaser, and you still wish

to purchase property in this project,

please indicate this to Lifestyle Property

Consultants on the form that they

forwarded to you recently, and they will

pass this onto the new Developer who

we understand, once the ownership of

the project has been settled, are most

research. This award was accepted

by Ann Trewartha on behalf of the

committee.

Congratulations also go to Marilyn

Sullivan who received a Community

Service Award for the event Marilyn’s

Music Muster which raised over $6000

for the Smoky Bay Jetty project.

Unfortunately no nominations were

received for Citizen of the Year. A

number of people on the day commented

on their disappointment that there was

no Citizen of the Year, however we rely

on the community to make nominations

- we know there are potential Citizens

of the Year out there! So please if

you know of anyone deserving, don’t

hesitate to nominate them!

Nominations are generally open for 4-6

weeks between October and November.

Volunteer Awards

Don’t forget nominations will open soon

for our Volunteer Awards which will be

presented during National Volunteers

Week which is 11th - 17th May. Last

year four awards were presented at a

breakfast for all volunteers held at the

SES complex and the morning was a

great success. Further details will be

advertised in the West Coast Sentinel.

Barking Dogs

Council receives a number of complaints

from residents in regards to barking

dogs.

Under the Dog & Cat Management

Act 1995 the person who owns or is

responsible for the control of the dog

is guilty of an offence if the dog (either

alone or together with other dogs,

whether or not in the same ownership)

creates a noise, by barking or otherwise,

which persistently occurs or continues

to such a degree or extent that it

unreasonably interferes with the peace,

comfort or convenience of a person.

To enable Council officers to act on

issues, a written complaint is required

from those persons directly affected.

The complaint will then be assessed by

Council officers.

Council’s General Inspector is an

authorised officer under the Dog & Cat

Management Act 1995 and can issue an

expiation notice of $105 for ‘creating a

nuisance by barking or otherwise’.

Australia Day Awards

2009 Australia Day celebrations were

held on Monday 26th January 2009 on

the foreshore lawns at 8am adjacent the

Ceduna Sailing Club.

Congratulations go to the Community

Event of the Year winner Relay for

Life which raised $23,400 for cancer

keen to communicate with those who

have expressed an interest and who

have signed contracts to purchase

allotments.

The project is still very much alive, and

Council will try and assist the Developers

wherever possible for this project to

proceed to the construction phase.

We will keep the public informed of

the status of the project through our

website and quarterly newsletter, but it

is always best to liaise directly with the

developer.

Calling Volunteers!

Are you interested in being involved in

this year’s Oysterfest? The 19th annual

Oysterfest will be held this year between

1st - 4th October.

The Oysterfest committee is actively

seeking new committee members and

volunteers for a variety of roles, as well

as general helpers, for this year’s event.

So if you think you have something

to contribute please contact Heather

McNarry on 8625 3407.

Also if you don’t have time to volunteer

but still have some ideas you would

like to contribute to improve this years

Oysterfest, or for the 20th anniversary

of the Oysterfest next year, then please

Plastic Bag Ban

Council has been getting enquiries

about the plastic bag ban introduced by

the State Government. Unfortunately in

our region we have missed out on the

television campaign as this is a South

Australian only ban at this stage.

The phase out of plastic bags began on

1st January 2009. The ban will come

into full effect on Monday 4th May

2009. From this point forward fines

will apply to retailers who provide light

weight plastic bags such as those used

by supermarkets.

Heavier plastic bags such as those used

by many boutiques and department

stores are not affected by the ban.

Neither are plastic bags ‘on a roll’ such as

those provided for fruit and vegetables

at the supermarket or compostable bags

that meet the Australia standard.

While this ban is a first for Australia,

other places to ban the plastic bag

include China, India, parts of Africa,

Taiwan and San Francisco. Also many

London Councils are introducing a ban

in 2009, with France and Italy committed

to 2010.

Retailers are required to provide an

alternative bag to the light weight

plastic bag and can charge a fee at

their discretion. Reusable ‘green’ bags

have been available for some time and

can be purchased from various places

locally. The Council, in conjunction with

the CBTA and Zero Waste SA, last year

produced a blue ‘green’ bag which can

be purchased from the Council office.

Friends of the Ceduna Jetty

Council has partnered with Denial Bay &

Smoky Bay residents to install hand rails

on their respective jetties.

It’s now Ceduna’s turn!

Council are now looking for members

from the Ceduna community to assist

with the installation of hand rails to the

first section of the Ceduna jetty.

Any interested people who wish to

help out can contact Heidi Yates at the

Ceduna Council to register their interest

on 8625 3407.

Public Holiday rubbish Collection

Please be advised that for the following

public holidays that fall on a Monday

all usual Monday pick ups (Koonibba,

Dinah Line, Warevilla and commercial)

will occur on the Tuesday of that week:

• Easter Monday - 13th April

• Queens Birthday - 8th June

• Labour Day - 5th October

For Easter Friday - 10th April - pick

ups for Denial Bay, Betts Corner and

Yarilena will be changed to Wednesday

8th April.

Council Staff update

Sport & Recreation Development Officer

This new position has been filled

by Heather McNarry who will assist

Manager Community Development,

Kathy Meier, in the areas of sport,

recreation and event management. You

may remember Heather from her time

last year as an Oysterfest Ambassador.

More recently you may have seen her

face at the Council Office in her role as

Administration Officer.

Replacing Heather in this role is Donna

Halls who comes to us from nearly two

years as Accounts Officer at Ceduna

Koonibba Aboriginal Health Service.

Donna has brought with her extensive

administration, accounting and office

experience and is sure to prove a

valuable member of the team.
