2. The Italian context The possibility of having to deal with badtaxpayers is not as high in Italy.That is because the majority of companies arechoosing the prepayment method before deliveringgoods. However the service providers may deal with debtcollection because the payment for these servicesis usually made after their provision. 3. The process of debtcollection in Italy In case the debt is not paid, the creditor is allowed to hirea debt collection agency or a law firm in Italy in order tohave the due amount recovered. The debt collection agencies are often chosen because oftheir experience, while the law firms are chosen because ofthe lawyers very familiarized with the laws related to thesecases. 4. The process of debtcollection in Italy The process of debt collection in Italy iscomposed by two stages: one extrajudicial phase; a judicial phase (in case of failure ofthe first step). 5. The extrajudicialphase This phase usually starts with a request forpayment which has to take place no later thanseven days. If the debt is not paid, a phone call is made andthe debtor is requested to settle the claim. 6. The extrajudicial phase If the first two steps have no success, the agent of thedebt collection agency or the lawyer is requesting thepayment. The debtor is then requested through a second paymentreminder to settle the debt and if the claim is not coveredthis time, a legal warning is delivered. Usually at this point, most of the debtors are paying theirclaims, since they dont want to face a legal procedure. 7. The judicial stage This stage starts with filing a petition to thecompetent court which will issue an order ofpayment within a couple of months. The debtor has a term of 40 days in order to filea counterclaim. If no counterclaim is filed, the decision of thecourt becomes enforceable. 8. The judicial stage The precetto is the first step of the enforcementprocedure. This step consists in a period of 10 days allowedfor trying to seize an asset from the company. The enforcement is applied either on third partiesassets or on a real estate. 9. The judicial stage The assets of the debtor can be seized beforehaving a judgment to be enforced if there areprovisional orders of the judge. If the enforcement fails and there are noassets to cover the debts, a request forbankruptcy can be filed by the creditor. 10.
