Testator, sick in body but sound of mindand realizing the Uncertainty of the hour ofdeath, dictated said will to Reverend FatherJean Claude Juif, Chaplain at the Yazoo Settlement, Diocese of Quebec, in the presence of the,undersigned witnesses.
Testator recommends his soul to the BlessedTrinity and to the intercession of the VirginMary and all the saints. He declares that hedesires that all his just debts be paid and thatreparation be made for any harm which he may havecaused to anyone.
Testator declares that he has no forcedheirs in Louisiana. He gives and bequeaths tothe Widow Millon all the effects to be found ina certain large wooden chest, and a negro slavewith his clothes~ all as a reward for servicesalready rendered and which may be rendered bysaid Dame Millon. If she shall have returned toFrance, at the time of testator's death, the said

Testator gives to Sr. Baldit, Surgeon atsaid Yazoo Post, two guns with bayonets and agame-pouoh, on oondition that he have prayersoffered for his soul. He further gives to Sr.Raby a case for spectaoles, a few razors and ahone.
Testator gives to Lieutenant Petit for 40livres due him, a bed and (torn). Hegives to Sr. Duplessy for 9 livres due him, twosheets.

His name is Charles Desmercier, EcuyerLaborde, age 32 pr thereabout; that hekilled POntua1 in self-defense withPontuel's g1lll 'after he (Pontue.1) haddmed at acoused and dropped the gUn;'thai> he left the dead man at " Villeaux Chats " at the Point; that):e wasonce arrested at Mobile for theft; thatPontuel repeatedly tried to persuade himto desert, and this is what actually leadto the argument which ended in the killing.

He does not vary in his information, but goesinto more details. For instanoe:
That he owed Pontu&1 40 livres; that Ponbue.L,seeing he could not persuade Laborde to deserthe deliberately started an argument while theywere at Ship Istandl that when they were atCat Island he again tried to make acoused desert by way of Lake Pontohartrain; failing togain his point he grabbed an oar and struckaccused two blows in the stomach, etc; Pontu<Hwent fishing and on his return, agaih beganheckling accused. ThenPontuel aimed a gun' athim saying, " You will be my tenth ", tookaim but the gun did not fire; aocused grabbedit and shot him, leaving the body 'on theground near the water, took a pirogue to oomehere.
