Preliminary

Definitions

1. (1) In these regulations, unless the context otherwise indicates - ‘cadet’ includes any army, air or naval cadet and any student officer appointed to a detachment under regulation 54;

(3) In these regulations any reference to -

ORGANIZATION

Composition of Cadet Corps

Cadet Corps Regulations

2. The Cadet Corps established under section fifty-six of the Act shall consist of detachments established in accordance with the provisions of these regulations.

Army, Air, Naval or Composite Detachments

3. (1) A detachment may at its establishment be designated an army, air, naval or composite detachment.

(2) A composite detachment shall consist of either two or three sub-detachments and

any such sub-detachment may be designated an army, air or naval sub-detachment.

4. Every army detachment or sub-detachment shall be formed into platoons and companies, every air detachment or sub-detachment into flights and squadrons and every naval detachment or sub-detachment into platoons and companies, according to an establishment table determined by the Army Chief of Staff, in consultation with the Air or Naval Chief of Staff, as the case may be. 5. Officers of the commandos shall be made available for service with the Cadet Corps and shall be carried on the Unattached List whilst they are so serving.

ESTABLISHMENT, ENROLMENT and DISBANDMENT

Establishment and disbandment of detachments

6. (1) The Commandant General, SADF, may by order of the Minister, establish or disband a detachment at any school or other educational institution.

(2) Whenever any detachment has been disbanded in terms of subregulation (1), the

officer commanding the detachment shall return to the Officer Commanding Command, all arms, ammunition, uniforms, equipment or stores issued to the detachment.

Procedure for Establishment

7. (1) Whenever the establishment of a detachment at any school or other educational institution is under consideration, the headmaster or person in charge of the school or institution concerned shall at the request of the Officer Commanding Command, furnish him with such information relating to the school or institution, as the case may be, in the form set forth in Appendix A to these regulations, and such additional information as such Officer Commanding may require.

(2) Any Officer Commanding Command who has been furnished with information in pursuance of a request made under subregulation (1) shall after making such further inquiries in relation to the matter as he may deem necessary, submit the information obtained by him, to the Army Chief of Staff together with such comments or recommendations as he may wish to make thereon.

(3) In the consideration of such establishment the Army Chief of Staff shall consult the Air or Naval Chief of Staff on any proposal for the establishment of an air, naval or composite detachment, as the case may be. Appointment of Officer Commanding Detachment

8. (1) Upon the establishment of a detachment, or upon a vacancy occurring in the command of a detachment, the Chief of the Army shall, in consultation where necessary with the Head of another Arm of the Service concerned, appoint a suitable officer of the commandos who is serving on the staff of the school or institution concerned as officer commanding the detachment or designate a member of the staff of such school or institution who does not hold commissioned rank for appointment subject to his being commissioned in the commandos, as Officer Commanding the detachment.

(2) Such commanding officer shall be responsible to the Officer Commanding

Command or Group concerned for the training, administration, discipline and efficiency of his detachment.

Enrolment of Cadets

9. Subject to the provisions of section fifty-seven of the Act and regulation 26, every European male scholar or student at a school or other educational institution where a detachment has been established, shall be enrolled as a cadet in that detachment. ***

CADET ADVISORY COUNCILS

Establishment

15. There shall be established in every territorial command a Cadet Advisory Council consisting of members elected thereto or serving thereon in terms of these regulations. Functions of Councils

16. It shall be the function of every council to advise the Officer Commanding Command in relation to the organisation of detachments, cadet camps, courses of instruction or training, competitions or any other matter affecting the Cadet Corps in respect of which the council deems it necessary or expedient to advise that officer or which that officer may refer to it for its advice: Provided that no council shall advise such officer in relation to the expenditure of any moneys in the Cadet Grant Account referred to in regulation 89. Composition of Councils

17. (1) Every Officer Commanding Command shall divide his area into such and so many regions as he may with the approval of the Army Chief of Staff determine, in each of which there shall as far as possible be an equal number of detachments.

(2) The army cadets in each region shall be represented on the council by an officer elected by the officers of the army cadet detachments from among their number.

(3) The air and naval cadets shall be represented respectively by one officer each elected respectively by the officers of the air detachments and sub-detachments, the naval detachments and sub-detachments, as the case may be, from among their number.

(4) The Director or Superintendent-general of Education of the Province Concerned or

a member of his department nominated by him shall be a member of the council.

(5) The Officer Commanding Command shall be the chairman of the Council and shall detail a member of his staff to act as secretary. Nominal Roll of Councils

18. As soon as any council has been properly constituted as provided in regulation 17, the Officer Commanding command shall furnish the Army Chief of Staff with the full names of every member of the council and the designation and number of the detachment in which every such member is serving.

19. Every cadet officer elected in terms of subregulation (2) or (3)of regulation 17 to serve on a council shall hold place as a member of the council for a period of three years from the first day of January of the year in which he was so elected and shall at the expiration of that period be eligible for re-election in accordance with the provisions the one or the other of those subregulations, whichever applicable: Provided that the tenure of office of such member shall terminate as soon as the member concerned ceases to serve with a detachment.

Vacancies on Council

20. Whenever for any reason the office of any member of a council becomes vacant before the expiration of the period for which the member was elected, another serving cadet officer shall be elected in accordance with the provisions of subregulation (2) or (3) of regulation 17, whichever is applicable, to fill the vacancy until the expiration of the period for which the vacating member was elected. Meeting of Councils

21. The meetings of a council shall be convened by the Officer Commanding Command and shall be held at Command Headquarters or such other place as such Officer Commanding Command may determine: Provided that not more than two meetings of a council shall without the prior approval of the Army Chief of Staff, be held in any calendar year.

Agenda for Meetings

22. The Officer Commanding Command shall after consultation with the members of the council prepare an agenda for every meeting of the council and furnish every member thereof and the Army Chief of Staff with a copy of such agenda at least fourteen days prior to the date fixed for the meeting. Minutes to be Kept

23. The secretary of every council shall keep complete minutes of the proceedings at every meeting of the council and as soon as possible after every such meeting, forward a certified copy thereof to the Army Chief of Staff. Attendance at Meetings deemed to be Special Duty

24. Attendance at any meeting of a council by any member thereof other than a member appointed thereto in terms of regulation 17(4), shall, for the purposes of regulations 1(1)(d), 1(1)(e), 6, 7 and 8 of Chapter XVII of the Commando Regu1ations, be deemed to be special duty in terms of regulation 2(5) of Chapter VII thereof.

TRAINING OF CADETS

Liability to undergo Training

25. (1) Every person enrolled as a cadet in a detachment in terms of regulation 9 shall undergo training as a cadet during the period from the first day of January of the year in which he attains the age of twelve years until the last day of December of the year in which he attains the age of seventeen years.

(2) Any such person may subject to the provisions of section fifty-eight of the Act continue to receive training as a cadet until the last day of the year in which he attains the age of twenty years. Exemption from Training

26. (1) Any person liable to undergo cadet training in terms of the provisions of section fifty seven of the Act shall be exempted from such training if –

(a) his parent or guardian has at any time objected thereto in writing addressed to the officer commanding the detachment; or

(b) a registered medical practitioner has certified in writing that he is medically unfit

for cadet training.

(2) The officer commanding the detachment shall furnish any person exempted from training under subregulation (1) with a certificate of exemption in the form set forth in Appendix B to these regulations. ***

28. (1) The language medium of a detachment established at a single medium school, shall be that of the school.

(2) The language medians of a detachment established at a parallel or dual medium school shall alternate monthly between Afrikaans and English. Subjects for Training

29. Cadets shall receive training of training and instruction in drill, small bore rifle shooting and such other military subjects as may be determined by the Commandment-general, SADF. Period of Training

30. Every cadet shall undergo non-continuous training as a cadet for a period of not less than thirty hours in any calendar year.

Equivalent Periods of Training

31. For the purpose of reckoning the period of training referred to in regulation 30 -

(a) any period of twenty four hours or more spent at any camp or bivouac or by naval cadets on a ship of the South African navy, shall be deemed to be equivalent to three hours training;

(b) any army, air or naval exercise of more than three hours’ duration or any period of

more than three but less than twenty-four hours spent by naval cadets on a ship of the South African Navy, shall be deemed to be equivalent to two hours’ training;

(c) the time occupied by any special parade, guard of honour or review shall be

deemed to equivalent to one hours’ training.

Camps, Bivouacs and Army, Air or Naval Exercises

32. (1) No camp, bivouac or army, air or naval exercise shall be held without the approval of the Officer Commanding Command: Provided that the approval of the Chief of the Arm of the Service concerned shall be obtained for the conduct of any camp to be attended by more than one detachment or for the holding of a bivouac or exercise for an air or naval detachment.

(2) No camp of less than eight days duration excluding travelling time to and from the

camp, shall be held without the prior approval of the Head of the Arms of the Service concerned.

(3) No detachment shall hold or participate in more than one calendar year.

(4) Every bivouac or exercise shall be held as near as possible to the headquarters of the detachment concerned

(5) The duration of any bivouac or exercise shall not exceed three days.

Service of Officers in connection with Administration and Training

32A. Service rendered by an officer of the commandos in connection with the administration of a detachment and the training of cadets in terms of these regulations shall be regarded as service in terms of regulation 1 of Chapter VII of the Commando Regulations and the provisions of regulation 31 shall, in respect of such service, not apply to such officers.

33. Any person who has undergone cadet training for a period of three years and has in the opinion of the Officer Commanding Detachment attained a satisfactory standard of efficiency as a cadet may be furnished with a certificate of efficiency in the form set forth in Appendix C to these regulations.

Appointment of Officers

42. (1) An officer of the commandos serving on the staff of a school or other educational institution where a detachment exists may be posted to such detachment for service.

(2) Any person on the staff of a school or other educational institution where a

detachment exists, may, in terms of Chapters XI, XII and XIV of the Commando Regulations, be appointed and posted to such detachment for service, irrespective of whether or not he is a member of a commando.

43. (1) Any person who served as an officer of the Cadet Corps immediately prior to the commencement of the Defence Amendment Act, 1967 and occupied a post in a detachment, may -

(a) if he is holding a substantive commissioned rank on the General List, Citizen Force

(Cadet Section), or on the Reserve, be appointed in the commandos in such substantive rank in terms of section 36 of the Act read with Chapter XII of the Commando Regulations; and

(b) if he is not holding commissioned rank, subject to conferment of commissioned

rank on him, be appointed as an Second Lieutenant in the commandos for service within the Cadet Corps in terms of section 36 of the Act read with Chapter XII of the Commondo Regulations.

(2) The service in the Cadet Corps of every person carried as a cadet officer on the

Unattached List of that Corps immediately prior to the commencement of the Defence Amendment Act, 1967, shall be terminated with effect from the said date of commencement and he may, if he holds commissioned rank on the General List, Citizen Force (Cadet Section), be considered for service in the Citizen Force Reserve in terms or regulation 17 of Chapter III of the Regulations for the Citizen Force.

(3) For the purposes of regulation 3(b) of Chapter XV of the Commando Regulations,

the Chief of the Army may consider any course passed by any person as a cadet officer prior to the commencement of the Defence Amendment Act, 1967, in accordance with the comparative merit of such course, and he may for the purposes of regulation 3(c) of the said chapter, regard service in the Cadet Corps prior to the commencement of the said Act, as service in a commando.

54. (1) Any Officer Commanding Command may whenever he deems it necessary or expedient, on the recommendations of the officer commanding any detachment, appoint any suitable cadet as a student officer in the detachment in which he is a cadet:

56. Any non-commissioned officer may be reduced by be the, officer commanding his detachment to any lower non-commissioned rank to the rank of cadet -

(a) for any neglect of or want of attention to his duties;

(b) if in the opinion of such officer commanding he is unsuited to retain his rank. Voluntary Reversion to Lower Rank

57. Any non-commissioned officer may at his own request and with the approval of the officer commanding his detachment revert to any lower rank.

ARMS, AMMUNITION, UNIFORMS AND EQUIPMENT Issue of Arms, etc., to Detachments

58. (1) All arms, ammunition (including blank ammunition), uniforms, equipment and other stores required for the training of cadets shall be issued by the Officer Commanding Command to detachments according to a scale determined from time to time by the Army Chief of Staff in consultation with the Air or Naval Chief of Staff.

59. Whenever for the purpose of any specialised training or in other exceptional circumstances any articles of uniform or equipment, other than those referred to in regulation 58, are required for the training of the cadets in any detachment, such articles of uniform or equipment may, with the approval of the Chief of the Army in consultation, where necessary, with the Chief of another Arm of the Service concerned, be issued to such detachment by the Officer Commanding Command.

61. (1) Every officer commanding a detachment shall be responsible for all Government property issued to his detachment and may be required to make good any loss of or damage to such property caused by his wrongful act or omission.

(2) Such officer shall ensure that such property is at all times in serviceable condition and complete in every detail and, shall when requested to do so, produce such property to the Officer Commanding Command, any Member of his staff or any member of the staff of the Secretary, for inspection.

(3) No officer commanding any detachment shall at any time permit any person to use any such property for any purpose other than in connection with op in the course of the training of the cadets in the detachment.

62. Where a rifle range has been provided for the use of a detachment the officer commanding the detachment shall take all such steps as may be necessary for the maintenance and use of the range in Such a manner as to ensure its serviceability and the safety of persons present thereat or in the vicinity thereof during target shooting in accordance with instructions issued from time to time.

67. (1) The officer commanding any detachment shall without delay report to the Officer Commanding Command in writing any loss of or damage to any arms, ammunition, uniforms, equipment or other stores issued to his detachment or his corps and if he suspect that such loss or damage was caused by the commission of an offence, be shall also report it to the South Africa Police.

(2) Such report to the Officer Commanding Command shall reflect the date upon which the loss or damage was discovered or caused, the place where it occurred, the value of the property lost or the extent of the damage caused, the Police Station to which the matter has been reported and such other details thereof as are known to the officer commanding the detachment.

Uniforms and Equipment for Cadets, Student Officers and Cadet Band Instructors

69. The uniforms and equipment for cadets, student officers, and cadet band instructor shall be determined by the Quartermaster-general in consultation with the appropriate Chief of Staff, and the cost of such uniforms and equipment shall be defrayed from public funds.

70. (1) Every cadet or cadet band instructor shall maintain every article of uniform or equipment issued to him so as to ensure that it is at all times serviceable, clean and neat and shall be properly clothed when on parade.

(2) Every cadet officer, candidate cadet officer, cadet or cadet band instructor shall be responsible for the safe custody of all Government property issued to him, and to produce such property for inspection at any time when requested to do so by the officer commanding his detachment or the Officer Commanding Command or a member of his staff.

(3) Any officer commanding a detachment or corps may in his discretion provide any cadet with any article of uniform or equipment in substitution of any similar article previously issued to him which has been outgrown by the cadet concerned or has become unserviceable due to any cause other than the wrongful act or omission of the cadet concerned.

(4) Whenever any cadet is, due to his wrongful act or omission, deficient of any article of uniform or equipment issued to him for use in the course of or in connection with his training or whenever any such article becomes unserviceable due to any such act or omission the officer commanding the detachment concerned, may issue to such cadet another article to replace that of which he is so deficient or which has so become unserviceable and the cost thereof may thereupon be recovered from such cadet.

(5) Whenever any officer commanding a detachment has reason to believe that any

cadet in his detachment has been using otherwise than in the course of or for the purpose of his training, any Government property issued to him or is not taking proper care of such property, he may order such cadet to return any or all of such property to him immediately alter every period of training, instruction or exercise in which he has been using such property.

(6) Any cadet who permanently leaves his detachment shall return to the officer commanding the detachment all Government property issued to him.

Uniform to be Worn on Special Occasions

71. (1) No uniform other than a uniform prescribed under regulation 69 shall be worn by the cadets in a detachment which parades formally in honour of or for inspection by any civil or military dignitary or at any other ceremonial parade or by any cadet attending any camp, course of instruction or any inter-detachment or inter-command competition.

(2) The provisions of subregulation (1) shall not apply in respect of the cadets in any cadet band which at any time prior to the commencement of these regulations had been authorised to wear a uniform other than the uniform prescribed for cadets, under any regulation then in force. Disposal of Obsolete, Redundant and Part-worn Clothing

72. (1) The officer commanding any detachment or corps shall return every article of obsolete or redundant or of part-worn clothing which is unsuitable for re-issue, to the officer Commanding Command for disposal by him in accordance with the regulations for the Union Tender and Supplies Board.

(2) If any such article is sold in accordance with such regulations, the proceeds of the sale shall be credited to the Cadet Grant Account of the Command concerned.

DISCIPLINE Observance of Discipline

73. The senior officer or, in the absence of an officer, the senior warrant or non-commissioned officer, present at any parade or assembly of cadets shall be responsible for the due observance of discipline by every cadet present at such parade or assembly.

No cadet shall be punished for any breach of discipline unless and until the circumstances relating to such breach have been reported to and the method of punishment had been approved by the headmaster or person in charge of the school or institution at which the detachment has been established. ***

77. No officer or cadet shall by public discussion or by communication to the press, whether anonymously or otherwise, or in any other manner, publish, or be a party to the publication of any matter concerning the Cadet Corps or any detachment or adversely criticise the conduct of any officer of the SADF or cadet or by such means or in any like manner create or attempt to create or express a feeling of discontent amongst officers or cadets with any order or instruction issued under proper authority.

FINANCIAL MATTERS Expenditure Chargeable to Public Funds

78. Subject to the approval of the Secretary or an officer delegated thereto by him and in accordance with such instruction as many be issued by the Army Chief of Staff, in pursuance of such approval, there may be me from money appropriated by Parliament for the purpose other than the Cadet Grant Account referred to in regulation 89 expenditure in connection with -

(a) headquarters of detachments and office and store accommodation for detachments;

(b) drill halls and grounds;

(c) furniture, stationery, fuel light, water and sanitation;

(d) pay of storemen who are not members of any detachment and of Native labourers employed on the recommendation of Officer Commanding Command;

(e) the repair and maintenance of arms and equipment the property of the Government;

(f) the construction, maintenance and equipment of rifle ranges and armouries;

(g) the supply of camp equipment for use at cadet camps;

(h) the fees medical or hospital treatment provided for in regulation 98;

(i) such other matters as may be specially approved by the Secretary before the

expenditure concerned is incurred; and

(j) transportation by the most economical means of ammunition, arms, clothing and equipment including authorised camp equipment supplied for use in camps.

82. (1) Any, cadet who resides more than one mile from any place appointed for training or exercise (other than the school or educational institution where the detachment has been established or the range of such detachment) or as a rendezvous or any place where a special course of school of institution will be held duty approved by the Chief of Staff concerned is to be performed and who is required to proceed to or from any such place shall whenever practicable provided with free conveyance to or from any such place by ran or by other public or by government transport.

(2) Whenever it is necessary for any such cadet, owing to the non-availability of such

transport from his residence to the nearest railway station or other public transport rendezvous; to make use of his privately-owned motor vehicle as a means of conveyance to or from any such railway station or transport rendezvous, he may be re-imbursed for the use of such vehicle at the rate prescribed for member of the Public Service who make use of their privately-owned motor vehicles on official duty.

(3) Any cadet officer, candidate cadet office or cadet who is required to proceed to or from any place referred to in subregulation (1) may, save as provided in subregulation (4); make use of his privately-owned motor vehicle to proceed to or from such place and may, if he makes use of such vehicle, be paid an allowance not exceeding the cost to the Department of Defence if he had been provided with, free transport under subregulation (l) and, where applicable, reimbursed in terms of subregulation (2).

(4) The provisions of subregulation (3) shall not apply in any case where rail or other government transport, has been specially provided for the conveyance of the members of any detachment to or from any place referred to in subregulation (l).

83. Any cadet who makes use of his privately-owned motor vehicle in terms of subregulation (3) of regulation 82 to proceed to or from any place referred to in subregulation (1) of that regulation and conveys as a passenger in such vehicle any other cadet who is required to proceed to or from that place shall in respect of such passenger be paid an allowance at the rats prescribed for the conveyance of passengers in like circumstances by members of the Public

84. (1) Any cadet who is required to proceed to or from any place referred to in subregulation (1) of regulation 82 shall if any journey to be undertaken by him by rail includes night journey or ordinary meal hours, be provided with a sufficient number of free bedding or meal or both bedding and meal warrants, as the case may be, for every night to be spent and every meal to be partaken of by him on the train and no cadet who has been so provided with such warrants shall be entitled to the appropriate allowance provided for in this regulation.

(2) Subject to the provisions of this regulation, a student officer or cadet referred to in subregulation (1) may, subject to the provisions of that subregulation, for the duration of any journey of 24 hours or more undertaken by him for that purpose, be paid a subsistence allowance not exceeding R2.30 per day

(3) For the purpose of calculating any amount payable under subregulation (2), every period of 24 hours shall be deemed to be one day and for every completed hour in excess of 24 or a multiple of 24 there may be paid a subsistence allowance of 10 cents.

(4) Any cadet referred to in subregulation (2) may in respect of any journey of less than twenty-four hours’ duration undertaken by him. be reimbursed the reasonable expenditure actually and necessarily incurred by him on lodging, bedding, meals, liquid refreshment other than alcoholic liquor, or any two or more of those items: Provided that no amount payable under this subregulation shall exceed a full days subsistence allowance as provided in subregulation (2).

(5) No allowance payable under this regulation to a cadet who makes use of his

privately-owned motor vehicle under subregulation (3) of regulation 82, shall exceed the amount which would have been payable to him had he travelled by rail over the shortest route.

89. The Officer Commanding every Command shall keep a Cadet Grant Account into which shall be paid annually from moneys appropriated by Parliament for the purpose an amount not exceeding R3 in respect of every cadet on the strength of every detachment on the last day of February of the year in question for the purpose of providing a fund which may be charged with expenditure in connection with -

(a) cadet camps, bivouacs or manoeuvres;

(b) the conveyance of officers and cadets, their baggage and instructional appliances to or from any authorised camp, bivouac or manoeuvre;

(c) the purchase of band instruments and music;

(d) the purchase of musketry appliances not provided for in these regulations;

(e) the acquisition of distinctive badges or colours for any detachment;

(f) the purchase of extra ammunition;

(g) the acquisition of official text-books in excess of those issued at public expense;

(h) the payment of entrance fees for cadet competitions;

(i) the purchase of prizes to be awarded at cadet competitions;

(j) additional instruction;

(k) uniforms for cadets and training equipment;

(l) the conveyance or accommodation of or the supply of rations to officers or cadets participating in cadet competitions;

GENERAL Return Showing Strength of Detachment or Corps

90. The officer commanding every detachment shall as soon as possible after the last day of February of every year furnish the Officer Commanding Command with returns on the forms set forth in Appendices F and G showing, the rank and name of every officer of the detachment and the fill name, standard and date of birth of every scholar or student who was on that date enrolled as a cadet in the detachment.

91. (1) Whenever a change occurs in the post of adjutant and quartermaster or executive and stores officer of a detachment, the stores in the custody of the officer relinquishing the post shall be verified completely and the form set forth in Appendix H to these Regulations shall be completed and filed for reference, before responsibility is relinquished by him and assumed by his successor and the officer assuming the post shall be responsible for all discrepancies not placed on record when such stores and the relative books were taken over by him,

(2) Should exceptional circumstances render a complete check of the stores and equipment on taking over impracticable, the Secretary may grant prior authority for the use of such other certificate as may in his opinion, be adequate to the needs of the case a copy whereof shaft be filed for reference.

(3) If for any reason the officer from whom the stores should be taken over is not available to complete any certificate referred to in subregulation (2), an independent officer shall be appointed to assist the officer taking over with, the checking of the stores and the certification of any discrepancies.

(4) Whenever, for any reason whatsoever, no certificate is completed in terms of this regulation, the officer taking over shall be responsible for all shortages, unless it can be established that they existed prior to his taking over.

Participation in Public Functions or Ceremonies

92. No officer, cadet or detachment shall participate in any public function or ceremony without the approval of the Officer Commanding Command.

93. (1) A cadet officer who thinks himself wronged by any act or omission of his officer commanding and who on application to that officer, does not receive the redress to which he considers himself entitled, may complain to the Officer Commanding Command who shall, if he is unable to redress the wrong, submit the matter to the appropriate Chief of Staff.

(2) A cadet or candidate cadet officer who thinks himself wronged by any act or omission of a cadet officer other than the officer commanding the detachment or corps as the case may be, may complain to such officer commanding and if he thinks himself wronged by any act or omission of his officer commanding either because his complaint has not been redressed or in respect of any other matter, he may complain to the Officer Commanding Command through the officer commanding his detachment or corps.

(3) Any officer to whom any complaint is made under subregulation (1) or (2) shall investigate such complaint or cause it to be investigated and if after such investigation, he is satisfied of the justice of the complaint, tip shall take such steps as may be necessary for giving redress in the matter complained of: Provided that no such complaint shall be so investigated unless it has been made by the officer, candidate cadet officer or cadet concerned or by the father or guardian of the cadet or candidate cadet officer concerned. Boards of Inquiry

94. (1) Except where a board of inquiry may be convened in terms of section one hundred and thirty-six of the Military Discipline Code read with rule 105 of the Rules made under section one hundred and four of the Act (for giving effect to the Military Discipline Code) any officer prescribed in paragraph (b) of subrule (1) of that rule may convene a board of inquiry to investigate any matter relating to the Cadet Corps.

(2) Where a board of inquiry is convened under the authority contained in

subregulation (1) to investigate - (a) the good order or discipline of the Cadet Corps; or (b) any other matter relating to the Cadet Corps, such board shall consist -

(i) in the event of an investigation into any matter referred to in paragraph (a), of one or more officers of the Permanent Force; and

(ii) in any other case, of one or more cadet officers.

(3) The provisions of rule 105 of the rules made under section one hundred and four of the Act to give effect to the First Schedule to that Act except subrules (1) and (2) thereof shall apply mutatis mutandis in respect of any board of inquiry convened under this regulation. Cadet Bands

95. Any detachment may with the approval of the Army Chief of Staff, establish a cadet band consisting of so many members as he may determine.

Cadet Band Instructors

96. Subject to such conditions of remuneration as the Treasury on the recommendation of the Secretary may approve, the Army Chief of Staff may appoint any suitably qualified person as a cadet band instructor to give additional instruction to any cadet band or bands. Transfers of Cadets

97. Any cadet who transfers from one school to another where a detachment exists shall be absorbed in such detachment and his service in any previous detachment shall be reckoned as service for the purposes of the certificate of efficiency provided for in regulation 33. Illness and Injuries

98. (1) Any cadet who receives a wound or injury or contracts an illness in the circumstances specified in subsection (1) of section one hundred and forty-six of the Act may in terms of the provisions of that subsection be provided by a medical officer of the Permanent Force or if such’ an officer is not readily available, by any district surgeon or any other person authorised thereto by such officer or district surgeon, with any medical or other treatment necessary for such wound, injury or illness.

(2) No such treatment shall without the special permission of the Surgeon-general be provided after such cadet has ceased to be a member of the Cadet Corps: Provided that no such permission shall without the approval of the Secretary given in consultation with the Treasury, be granted in respect of any period beyond three months from the date on which such cadet ceased to be such a member.

(3) Whenever it appears to the officer under whose command he is serving at any time that any cadet has received a wound or injury or contracted an illness in the circumstances referred to in subregulation (1), a board of inquiry shall be convened to inquire into the circumstances in which the wound or injury was sustained or the illness contracted.

(4) Such board shall express no opinion on the evidence recorded by it other than on

the credibility of any witness and shall submit the proceedings of the board in quadruplicate to the officer who convened such board.

(5) The convening officer referred to in subregulation (4) shall record on such proceedings his opinion whether or not the wound or injury was sustained or, the illness was contracted in the circumstances referred to in subregulation (1) and thereupon submit the proceedings to the Chief of Staff concerned.

Funeral Expenses

99. (1) The funeral expenses of a cadet whose death occurred while, he was on military service or undergoing training, including the expense incurred in the removal of the body for burial, shall be met from public funds.

(2) Such costs shall not exceed the amount fixed in the contract arranged by the Union Tender and Supplies Board for burials in the area where the funeral takes place.

(3) Where no such contract exists, the amount payable under subregulation (1) shall not exceed twenty-five pounds. Application of General Stores Regulations

100. The General Stores Regulations published in Government Notice No. 1995 of the 8th December, 1922, and the Orders and Instructions issued in connection therewith shall apply in relation to the purchase, sale, disposal, control, care, custody, maintenance and issue of any arms, equipment, articles of clothing or other stores the property of the Government, to or by any Officer Commanding Command, detachment, cadet.

101. The Commandant General, SADF may delegate any power, duty or function conferred or imposed upon him in terms of these regulations to any officer of the SADF and may in any case when there are exceptional circumstances authorise a departure from these regulations: Provided that in relation to any provision of these regulations having financial implications such authority shall be given by the Secretary in consultation with the Treasury.
