authorizes Presidential emergency or disaster

declarations, creates a framework for

Federal/State assistance

• DoDD 3025.18, Defense Support to Civil

Authorities Grants Title 10 Forces legal authority

to perform DSCA emergency life-saving missions

• The National Defense Authorization Act 2012,

authorizes an unlimited number of Army Reserve

forces for activation to assist in emergencies for

up to 120 days (Title 10,12304 (a)(b),12301(d))

• Presidential Policy Directive-8 (PPD-8)

contains 15 high-consequence threat scenarios

for both terrorist attacks and natural disasters.

Some USAR units are designated to assist with

these events under NORTHCOM CONPLANs

Defense Coordinating Element (DCE)

Mission

On order and in response to natural / manmade incidents, the

Defense Coordinating Officer / Defense Coordinating Element

(DCO/DCE) anticipates and conducts Defense Support of Civil

Authorities (DSCA) operations coordinating Title 10 forces and

resources in support of the Federal Primary Agency (PA) in order

to minimize impacts to the American people, infrastructure and

environment.

Immediate Response Authority

Immediate Response Authority (IRA): A Federal military commander’s authority temporarily

to employ resources under their control, subject to any supplemental direction provided by

higher headquarters, and provide those resources to save lives, prevent human suffering,

or mitigate great property damage in response to a request for assistance from a civil

authority, under imminently serious conditions when time does not permit approval

from a higher authority within the United States. Immediate response authority does not

permit actions that would subject civilians to the use of military power that is regulatory,

prescriptive, proscriptive, or compulsory. (DoDD 3025.18)

Commander: For DSCA Immediate Response Authority purposes is limited to only those

Commanders formally appointed in writing IAW AR 600-8-20 AND serving in a Command

Billet.

What constitutes a “civil authority”? “Those elected and appointed officers and employees

who constitute the government of the United States, the governments of the 50 states, the

District of Columbia, the Commonwealth of Puerto Rico, United States territories, and political

subdivisions thereof” (Joint Publication 1-02)

In the event of a split state strike, the

DCO for RGN VI, along with the

majority of DCE VI, would deploy

state of TX and FEMA. The RSV

DCO will coordinate all AE

operations in TX and LA (if

required). The RSV DCO would be

prepared to assist in Austin until

Katrina – Identified need for major improvements in DOD Regional and State pre-

event planning, coordination and preparation with Federal Partners for response to

disasters and catastrophes in the homeland.

One initiative was establishing permanent active-duty Army teams within the ten

Federal Emergency Management Agency regions across the United States.

DCEs are DoD’s forward presence in all 10 FEMA Regions; Tasked with

maintaining situational awareness; interagency planning; building relationships of

trust with State and Federal partners

Defense Coordinating Elements (DCEs) plan for & coordinate DOD capabilities

and requests for DOD assistance in support of a variety of events, including

National Special Security Events, domestic emergencies and other domestic

activities. Integrate DoD support plans in FEMA All Hazards Plans

The DCE's are DOD's first responders in planning for and responding to events to

save lives and protect the American people and their way of life.

Super Storm Sandy showed need for capable coordinated response from DOD to

assist the local, state and federal responders in a disaster.
