From recent Legislative Day in Sacramento… Some Pending legislation of particular note: SB1439 (Leno) requires landlords to remaing in business for at least 5 years. C.A.R. opposes. AB2405 (Ammiano) would prevent landlords from EVER going out of business. AB2405 has been killed. C.A.R. opposed.These 2 bills were a direct aim at the Ellis Act supported by C.A.R. and passed in 1985. The Ellis Act prevented local governments from from passing laws restricting the ability of landlords from going out of business. There are currently protections in terms of notice and relocation assistance and additional consideration for seniors and disabled when landlord elects to go out of business. AB2416 (Stone) creates a super-lien for wage claim disputes whereby employee/employer disputes allow employee to file a lien against employer’s property (residence), similar to a mechanics lien. SB391 (DeSaulnier) imposes a $75 fee on all non-sale document recordings: refinance, foreclosure, mechanics liens, deed adjustments, construction docs, business loan, and probate actions.Examples of typical recording cost increases: Refinance, $138 will be $588, Construction Loan, $171 will be $621, Business loan, $169 will be $769, Death of Spouse, $88 will be $463. AB2039 (Muratsuchi) C.A.R. is sponsoring this bill to prevent auction companies from shifting liability to sellers and listing agents. Once an agent has an accepted offer on a short sale, the lender may select an auction company who will solicit higher bids. Provisions in accepted contract require the homeowner to defend,

indemnify, and hold harmless the auction company from any costs, and damages resulting from the auction company’s actions.Since we mentioned auctions… A forum was held on Auctions with Rick Sharga, Exec. VP for Auctions .com. The forum was an interview format with time for questions from Realtors in attendance. In a nutshell, Mr. Sharga believes: The future will see home buying being

done on line via the auction process. Auctions have resulted in overall higher sales prices being realized by sellers in 75% of sales. Auction.com just markets properties, does not evaluate. Bidders set the value. Google is a partner with auction.com. Will be the tech arm of auction.com. Auction.com does not want

liability. Auction.com does use shill bidders and they have the legal right to do so. WOW, think about that one. Yes, successful buyers pay a buyer fee, or buyer premium. Admittedly there are MLS, commission and liability issues. These are being studied for solution.Believe me when I say there was soooo much more on this topic than covered here.

Please stay alert to these trends and legislative proposals. How will these trends effect your future business? What does your business plan look like 5 years out? 10 Years out? How will your personal interface with clients change? How is technology going to change your business?
