G'day Denise,

Thought 1 would give you an update on the outcome from the DTMR EBA negotiations yesterday The TMR sagarolls on.We had two final offers put on the table yesterday regarding pay parity with QHealth and labour hire conversion.

First to parity, the money is there, but according to Dave Waters the DDG wants to be seen to be getting something for his money. They proposed a wording clause change for night shift from agreement o f the majority o f affected employees to w ill not unreasonably withhold agreement to work such shifts. I've consulted with delegates and they won't be accepting the change, further to this nights are already worked on a regular basis and employee requests to be able to work nights are often rejected. This is the first the Unions have heard of this claim from DTMR.The view o f the ETU and the AMWU is DTMR already have the ability to work with their workforce in a consultative manner to facilitate working nights and we can't allow an empioyerto have the ability to strongarm their employees in to being dictated to when they will work odd hours.

On conversion of the labour hire, DTMR provided wording that those with 12 months of service or more will be converted on in-principle agreement then annually from June next year. Updates on the labour hire would also be provided annually.Unions are happy with conversion offered on in-principle agreement, our counter offer is to allow a six month break for conversion and then commence the conversion quarterly commencing from 1 March 2017. Also quarterly updates on labour hire.Quarterly updates was tentatively agreed to. The conversions from 1 March 2017 then quarterly was rejected due to the employee cap.We again asked for detail of how many people will exceed the cap if this was implemented, DTMR can't provide any data around this at all and in contradiction to their claim of breaching the cap Bill Lansbury stated that a lot o f DTMR projects are winding up in December which will see their engagement with DTMR cease. Again we have asked for the detail around the time served by labour hire employees within DTMR which was first requested by the AWU in May.

The ETU and AMWU went in to the negotiations yesterday w ith a very positive mindset thinking the agreement would have been finalised. Unfortunately not. It appears the Employee Relations team in DTMR seem determined to niggle at the Unions.The members have made it clear they want to continue with the process of conducting the vote for the PAB. We meet again next Wednesday and are still hopeful that DTMR come to their senses.

Below is an email from Simmo to Mark, attached is the advice they have been given that they are pursuing across the Industry.

Given this approach and SCL refusal to comply and maintain a level playing field I will be seeking a resolution from our delegates this week to escalate this campaign given the potential threat to take us back to the Seqeb dispute.

This campaign will obviously involve, Industrial, legal, media and political pressure.

Fair chance the SCL blew will end up in Protected action and pickets, not a good look under a Labor Govt.

The Energex blew w ill likely end up with up to $1 million in fines for Energex.

Happy to have talk about potential solutions.

We have some contractors at ENERGEX that aren't paying the coiTect rate to their employees. Wc renegotiated a long established clause in the current E B A that ensures that contractors staff, on balance, are not paid less than in house staff, the history o f this clause goes back to the Use o f Contractors Industrial Agreement 1991, negotiated between the ETU and the then SEQEB, under the Goss Government, to finally settle the SEQEB dispute.

ENERGEX's IR team has engaged Barristers to give advice that the clause isn't enforceable and have flirther gone to Ergon and Powerlink advocating that they back the ENERGEX position.

We refer to your correspondence of 12 August 2016 to Peter Weaver, Acting Chief Executive Officer, Energex Limited. We act for Energex Limited in respect of the matters raised in your correspondence.

Clause 13.10.4 of the Energex Union Collective Agreement 2015 (Agreem ent) does not impose a legal obligation upon Energex to require contractors referred to In that clause to pay rates of pay and allowances to their employees as alleged by the ETU. In the circumstances, our client remains firm in Its position that the ETU's view of what is required by clause 13.10,4 of the Agreement is contrary to the proper construction of the Agreement.

In light of the view outlined aboye. no obliQBtion arises under the Agreement for our client to require Pole Foundations to payp3*MU^4CT^iri the way claimed by the ETU. Further, if such an arrangement was entered into by our client and the ETU, depending on the precise circumstances o f that arrangement, it could expose both the ETU and our client to potential claims under section 45E of the Competition and Consumer Act 2010 (Cth).

We are instructed that our client is open to having further discussions with the ETU on this matter. Should the ETU wish to engage in further discussions It should contact the Acting Executive General Manager, Service Delivery.

AER leaves Queensland network vulnerable to South Australian-style outages

The Electrical Trades Union has slammed the Australian Energy Regulators' (AER) decision to leave Queenslanders exposed to South Australian style power outages by dramatically reducing Powerllnk's capital expenditure.

The AER handed down its Draft Decision on Powerlink's 2018-22 Revenue Proposal, choosing to reduce expenditure on reinvestment into the state's electricity network - by 19 per cent.

ETU Queensland and NT Energy Supply Organiser Stuart Traill said the draft determination would put little to no downward pressure on energy prices and ultimately lead to Queensland having a transmission network which cannot be maintained to the necessary standard.

"By cutting away 19 per cent on capital expenditure the AER is leaving Queenslanders with a transmission network that is not going to be able to handle the challenges that lay ahead as severe weather brought on by climate change further impacts energy distribution," M r Traill said.

"The ultimate result of this kind of reduction in expenditure will be what we saw in South Australia yesterday - a poorly maintained, substandard network which cannot survive severe weather events.

"At least the AER did not reduce operating expenses, which Is where wages come from, so there should be no job losses.

"This is an acknowledgement that our frontline energy workers are essential to keeping our power on, especially in Queensland where we have regular extreme weather events such as cyclones, storms, floods and bushfires - all of which usually impact power supply.

"But that is also why it's critical capital investment is maintained"

Mr Traill called on Powerlink to reconsider the cut to capital expenditure in the final Powerlink Determination.

Hi Denise

Hoping you can help obtain a copy of the QPC Electricity Pricing Final Report which was delivered In to government in May and what the official response to the report was?

The QPC website hasn't made it available and I can't find too much about it elsewhere.

Regarding the government response, acceptance of the QPC the recommendation to deregulate retrial pricing was referenced in yesterday's media release about increased consumer protections, but I can't find any info on an official government response to the report.

Any advice appreciated.

Hi Lance,So the Final Report is not available publicly - it was presented to govt and govt has 6 months to consider and respond.The dereg recommendation was adopted when the draft report was released — we had made it widely known before that report that we would dereg in July 16 (after the deferral commitment during the election).Hope that helps Denise

Hi Denise

Hoping you can help obtain a copy of the QPC Electricity Pricing Final Report which was delivered in to government in May and what the official response to the report was?

The QPC website hasn't made it available and 1 can't find too much about It elsewhere.

Regarding the government response, acceptance o f the QPC the recommendation to deregulate retrial pricing was referenced in yesterday's media release about increased consumer protections, but I can't find any info on an official government response to the report.

Any advice appreciated.
