The Department of Planning and Permitting (OPP) is notifying you of our ACCEPTANCE of the FEIS for the subject project, as satisfactory fulfillment of the requirements of Chapter 343, HRS.

A. Proposed Action: The key components of the Proposed Action include: (1) Relocation of construction and demolition (C&D) waste receiving, materials sorting/recycling, and C&D disposal operations; (2) Relocation from the west side of Lualualei Naval Road to the east side of Lualualei Naval Road, modernization, and enhancement of recycling operations (e.g., installation of two materials recovery and diversion process lines); and (3) Installation of renewable energy facilities to power PVT operations (i.e., enclosed gasification unit and photovoltaic panels).

B. Procedure:

1. On January 23, 2019, an Environmental Impact Statement Preparation Notice (EISPN) for the proposed project was published by the Office of Environmental Quality Control (OEQC) in The Environmental Notice. The EISPN was distributed to various City, State, and Federal agencies, organizations, and individuals listed in Appendix J of the FEIS.

2. The 30-day consultation period for EISPN comments, and requests to be a consulted party, ended on February 22, 2019. The Applicant received 21 comment letters. The comment letters and the Applicant's responses are reproduced in Section 9 of the FEIS.

3. On July 23, 2019, notice of the Draft Environmental Impact Statement (DEIS) was published by the OEQC in The Environmental Notice. The DEIS was distributed to various City, State, and Federal agencies, organizations, and individuals listed in Appendix K of the FEIS.

4. The 45-day DEIS public review period ended on September 6, 2019. The Applicant received 184 comment letters. The comment letters and the Applicant's responses are reproduced in Section 1 O of the FEIS.

C. Environmental Impact Statement Content: The FEIS complies with the content requirements set forth in Section 11-200-18, Hawaii Administrative Rules (HAR).

D. Responses to Comments: The Applicant responded to substantial environmental comments that were raised during the public review and consultation process. The comment letters and Applicant responses are found in Section 9 and 10 of the FEIS. Revisions were appropriately made throughout the text of the FEIS.

E. Major Permits Required: The project is subject to obtaining a Special Use Permit and a Conditional Use Permit-Major.

F. Determination: The OPP has determined this FEIS to be acceptable under the procedures established in Chapter 343, HRS.

Project Summary PVT owns and operates the only publicly-available, commercial construction and demolition (C&D) debris management facility on Oahu, Tax Map Keys 8-7-009: 025 and 8-7-021: 026. Its facility is part of the City and County of Honolulu’s solid waste management plan and provides a critical service to the construction industry and the City’s disaster response efforts. PVT’s materials recovery facility reuses or recycles 80% of the C&D debris received. While this has extended the life of the landfill, the construction boom on Oahu has generated more C&D debris than anticipated. PVT is initiating landfill closure activities in accordance with its permit. The PVT facility closure would leave Oahu without a C&D landfill and materials recovery facility. PVT proposes to (1) relocate its existing C&D debris receiving, recycling, and disposal operation to a parcel, owned by a PVT-affiliate, on the opposite (eastern) side of Lualualei Naval Road from its current location, (2) upgrade its recycling operations by installing two materials recovery and processing lines, and (3) install renewable energy facilities (a gasification unit or anaerobic digestion system and photovoltaic panels) to power its operations. The relocation will allow uninterrupted C&D debris management, focusing on the diversion of 80% of construction debris from the landfill through reuse and recycling.
