Editorial Letter
In 2012, the Department of Political Science (Avaam) wanted to revive the culture of a
magazine and provide a platform for the ideas of the enthusiastic students. Thus began
our journey of publishing the annual departmental magazine Awaaz. We are pleased to
present before you the third issue of the magazine on the theme “Right to Life”.
No society can call itself fully emancipated and civilized unless it learns to value
and respect each individual life. Right to life is not limited to rejection of death penalty
alone. It is a much wider concept to incorporate a holistic understanding of the dignified
human life. A right to privacy, consumable food and water and access to clean
environment are important components of the larger concept of the right to life. In an
increasingly connected and unequal world, this is one right that deserves to be taken
seriously. In this year’s issue of Awaaz, we have made a humble attempt to record
students’ voices in this regard.
Our aim is not just to come out with a magazine every year but to enculcate the
habit of writing and to generate awareness about current affairs and bringing out
different perspectives about them. We value and appreciate the participation by the
students who sent us various articles and illustrations.
As students of the Political Science department and memebers of the editorial
board we would like to thank our respected principal Dr. R. Prabhakar Rao, for giving
us this platform to voice our opinions and for his tremendous support, and also a typist
Ms. Farha Naaz. We would like to thank all the members of the faculty of Political
Science department for their qualitative input and unending support throughout.

WHOSE RIGHT TO LIFE?
What is life? Well, the more appropriate question would be who has the
right to live. Is it only us the Homo sapiens that deserve a life of ease, comfort,
dignity and well being or the concept of life can be extended to the other ‘lesser’
organisms? Like for example a stray dog or a cat or a cow or a tiger for that matter.
Do they also own this planet like we humans do? Let us ponder on this matter
further.
Our species, i.e. the Homo sapiens have, for what seems to be an eternity,
ruled this planet. We have altered and crafted this planet as we wished. We’ve
killed for land and we’ve been killed for land. We’ve killed for love and we’ve
been killed for love. And we’ve also killed for fun. I would like to emphasize and
re emphasize the last line. Do we have any idea about the sheer magnitude of the
number of animals that have become extinct due to our love for killing? The
answer is No we don’t have the slightest of idea about how many innocent species
we’ve lost. To put things in perspective let me give you an idea of how many we
are losing each year. We’re losing 0.01-0.1 percent of the total number of species
we have on earth each passing year. Though the number seems insignificant at
first glance but let me warn you that it is everything but that. According to
estimates by the WWF we’re losing between 10,000-1,00,000 species each year.
Isn’t it tremendous? And the root cause of all this loss is just one species. The all
knowing Homo sapiens is the culprit.
Now the perennial optimist will like to argue that we humans are innocent
of the murder of innumerable species. But let us not kid ourselves. Maybe our
ignorance or our pride comes in the way of us realizing what we are doing to this
planet. This is not our planet where ‘our’ stands only for the human race but it is
our planet in the sense that it belongs to each and every life that exists on Earth
and one ignorant and proud species has no right to turn it into a living hell for all
other species.
What we see all around us is complete hypocrisy. When we hear news of
rhinos and tigers and elephants being killed by poachers we see everyone
complaining about how inhuman the poachers are being or how we are going to

lose another species. But it will not take long for us to see that same person who
was complaining being unkind to a dog or a cat that is starving. I do not know if
there is an omnipresent hierarchy with which we need to classify different animals
but according to me all animals are the same including us. EVS i.e. Environmental
Science has become a compulsory paper in almost all Universities of India. But
is learning about the environment through pen and paper enough for us to save
the environment? Is mugging up the course and scoring good marks in the paper
an end to all environmental problems that we have? The answer is a big NO.
So, what is the solution to all these problems? Is it the Climate Change
Summit in Paris an end to all environmental woes? Do all the global leaders going
to the summit in their chartered planes and chauffeured cars, conferencing in air
conditioned rooms and coming out with an agreement on paper an end to
environmental problems? Again the answer is an ironic no.
What we need is ground work. We need people to start realizing that it is
not only about us. And it is not only about our survival. It is about the survival of
this planet and all the millions and millions of different lives that inhabit this blue
planet. We need people to be sensitive towards other forms of life. We need to be
kind to a dog and even a rat if they pose us no harm. Each one of us needs to
contribute. And what we need more than anything else is an end to the hypocrisy
of the Homo sapiens.
I’m not suggesting that we go back to the prehistoric era where humans
were just another species on the face of earth but what I’m saying is that it is time
we start to respect other life. I know, this is plenty to ask from the ever selfish
human race but in this conundrum what we have not realized till date is that we
are scripting our own downfall. By killing all the flora and fauna around us we
are on the path of becoming extinct ourselves.
We all have a right to live. So does every other species on this earth. Let us not
blow our own trumpet. And as the saying goes, “It is not over till the fat lady
sings”. We’ve still time to make amends. But our actions must be drastic and
swift.

DEATH FOR DEATH?
"An eye for an eye will make the whole world blind"
- Mahatma Gandhi
Mahatma Gandhi lucidly argues us to pursue the way of illumination in
terms of morality. Here, he tries to convey us the need to embrace higher moral
principles. In these days, serious debates are taking place around the word 'capital
punishment'. The word "capital" originated from the Latin word 'capitalis' means
literally "regarding the head" (refering to execution by beheading). Latin being
an ancient language, the presence of such a word in Latin vocabulary implies that
there was a practice affiliated with it. It indicates, words like 'Capital punishment',
'death penalty', 'executions', etc. have been in use for a long time. Anthropological
studies prove this point.
Capital punishment is sentenced for people who have done capital crimes.
Capital crimes are different to nations, religions, culture etc. The fact that we are
practicing execution is a shame on whole of humanity. Through this acts, we are
going back to the old Hammurabi code of Justice. If we are executing someone,
with him we are hanging his natural and human rights. Here, we are digging the
grave for humaneness. Currently 103 countries, especially western countries
accept the USA abolished it the jure for all crimes. But 36 countries are still
actively practicing this old barbaric penalty.

Scientific studies have consistently failed to demonstrate that executions
deter people from committing crime. In accordance with the retributive justice,
our first instinct may be to inflict badly on someone who wrongs us, but a matured
society demands a more measured response. Our laws and criminal justice system
should lead us to higher principles that declare a complete respect for life, even
the life of a criminal.
Most capital crimes are committed during the moments of great emotional
impulse. In the case of planned crimes, even though people are well acquainted
with the legal penalties, heinous offences are happening. It is impossible to say
that severity of any punishment could prevent a crime. If severe punishment can
deter crime, then long-term imprisonment is severe enough to deter any rational
person from committing a crime.
Some people argue for the allowance of death penalty for terrorism. In this
regard Alan Dershowitz wrote in The Guardian, "when imposing death sentence
on someone, would turn him into a martyr. His face would appear on posters for
terrorist recruitment. Those seeking paradise through martyrdom would see him
as a role model". Teaching people to respond to violence with violence will only
breed more violence.
In 2012, some retired judges wrote a letter to President, pointing out that
the Supreme Court had erroneously given the death penalty to 15 people since
1996 of whom two were hanged. In US, a recent study by Colombia University
Law School found that for every seven people executed one man is innocent.
These kind of human errors lead to miscarriage of justice through the wrongful
execution of innocent people.
There are socio-economic and political elements playing in the field of
Jurisprudence. In practice, the death penalty doesn't single out worst offenders.
Rather, it selects an arbitrary group based on such irrational factors as the quality
of defense council, the country in which the crime was committed, or the class,
race, caste, religion etc of the defendant.
Racial bases in judgments are a naked truth. Most debated one is
McCleskey vs. Kemp (478-U.S-1019(1987)) case, in which though McCleskey's
arguments were true his arguments were nullified. His arguments were,
"murderers of whites are four times more likely to be sentenced to death than

murderers of black". Harper Lee's classic novel "To kill a mockingbird" is a
depiction of racial biases in the Judicial process.
Also a major chunk of our population does not have access to our legal
system due to illiteracy and poverty. In the sense, almost all defendants facing the
penalty cannot afford their own attorney. A poorly represented defendant is much
more likely to be convicted and given a death sentence. We can see mainstream
mindset through other cultural medias, especially in the renowned movie "12
Angry Men" there is a dialogue, "slums are the breeding grounds of criminals".
There is even a saying, "capital punishment means without the capital get the
punishment".
The imposition of death is not free from any political motivations. Our past
experiences are witness for that. The decision is bound to be influenced by
political calculations and hyped public opinion. Revenge is not the answer for
anything, but prudence is the real solution. What time needs is the complete
abolition of capital punishment and development of a suitable penological system
for rehabilitating hardened criminals and ensuring that they can be reintegrated
into society as responsible citizens. To conclude, as Talmud says, "whoever
destroys a soul, it is considered as if he destroyed an entire world. And whoever
saves a life, it is considered as if he saved an entire world".

RIGHT TO LIFE
There are varied interpretations of truth,
A hundred meanings to what's written on the legal paper.
They say all citizens have the 'right to life',
But does everyone actually have the right to live?
I, a 'Dalit' from a small village, I went to the temple the other day,
Kicked out like an outcast, put at bay.
I
Called me *Untouchable*, but what was my fault?
Being born a schedule cast?
I have
I, a woman from an educated family, I study law I'll tell,
My brothers are out all night, but no one puts a frown.
And I had meeting till late that night, and when I rang the house bell,
Mother came screaming about how I instead should've drowned.
I, a man from a Muslim family, I fell in love that day,
I told my lady to marry me, to forever with me stay.
She's a Hindu and I thought it didn't matter enough,
How wrong I was I knew when they lynched us, love was that tough.
We can't choose the subject of our choice, not the love, not the clothes,
But we have the right to life,

RIGHT TO LIFE VIOLATION
A SURVE CONDUCTED BY ACHR

In the last ten years from 2004-2005 to 2013-2014 as per
official records the right to life of atleast 130407 or 1086 person per
month were violated either by state agencies or caused by the failure
of the state agencies to fulfill their responsibilities to prevent
violation.
The majority of the victims are women (80947) followed by
victims of custodial deaths (16465) encounter death (10900) deaths
in police firing (2527), deaths of 10,219 civilians in militancy /Naxal
related violence, death in cast related violence (18138) and death in
communal violence (1,211).
From 2004-05 to 2013-14 their report counts (16465) case of
custodial death (with 1389 deaths in police custody 15076 death in
judicial custody & 23 cases of death in the custody of the army and
the central paramilitary forces). 10900 deaths in encounters (1654
deaths involving police & 9246 deaths involving the armed forced
& paramilitary forces of which 4005 in Jammu & Kashmir, 3650 in
North East & 1591 in Naxal effected areas) & 2527 deaths in police
firing.
Failure to Protect The Vulnerable:
The state’s failure to safe general the right to life of individual
citizens, particularly those belonging to vulnerable groups, during
the same period also resatled in the death of 80,947 women (79,404
dowry killing & 1,543 killing of those suspected of witchcraft),
10219 civilians in millitancy / naxal related violence 8138 (1646

scheduled tribes & 6492 scheduled castes) in identity –relating
violence; and 1211 persons in communal violence.
The report stated that impurity is the root cause of violators
of right to life. In the lighty unusual situation that an independently
& timer investigation is secures and a charge-sheet filed against
state security force personal, prosecution is virtually impossible to
pesue since section 6 of the Armed force special power Act &
section 197 of the Code of Criminal Procedure (CRPC) stipulate that
prior permission must be sought from the government.
There are well-known cases in which prosecution has stopped
for want of permission from the government to prosecute the
accused. “Unless impurity is addressed the violations of right to life
cannot be effectively reduced says Suhas Chavarna, Director of

Department of Political Science 2015-16
The department of Political Science (Avaam) remained
very active in this academic year. The society conducted a direct
election on 17th August, 2015 to elect the student office bearers.
In September,2015 the documentary Muzaffarnagar Baaqi Hai
was screened which was well attended by students and teachers
of the college. In October the department invited Prof Krishna
Kumar to speak on "Teaching Under Difficult circumstances".
A panel discussion on labour law reforms in India was also
organized in the same month. In January 2016, the department
went on a three day educational trip to Nainital. In February a
memorial seminar in memory of legendary teacher Prof Randhir
Singh was organized. Prof Singh taught at Zakir Husain Delhi
College for almost two decades and many of his former students
attended this seminar to pay tribute to the great teacher. The
department organized a one day UGC sponsored national
seminar on Ways of seeing on 8th March, 2016. Experts of Indian
Political thought such as Prof P.K.Datta and Dr Ananya Vajpai
participated in this seminar. In the same month the annual
festival of the department Abhivyakti was held. This was
followed by a panel discussion on nation and nationalism on 19th
March, 2016. This year the third issue of the departmental
magazine Awaaz on the theme Right to life was published.
