Budget Request Summary

The California Air Resources Board requests 1.0 position and $165,000 from various special funds to begin implementing SB 1. Several of the bill provisions directly affect California Air Resources Board (CARB) programs. Among these provisions, the bill requires the Department of Motor Vehicles (DMV), starting January 1, 2020, to verify that a medium-duty or heavy- duty vehicle is compliant with or exempt from CARB's Truck and Bus Regulation before allowing registration. Preparation for this requirement will necessitate developing a database/ data warehouse that provides DMV with a list of vehicles approved to operate in California, and is expected to result in an increase in one-on-one compliance assistance and enforcement resolution calls. This compliance database will house data from multiple databases and provide an accessible communication pathway for the DMV system. To prepare for the development and provide ongoing support of this compliance database, ARB is requesting 1 position to analyze multiple regulations and associated systems for the data required to make a compliance determination. This analysis includes assessing DMV technical requirements for data transfer, identifying an appropriate architecture to house and share data internally, and considering other SB 1 provisions to so that data collection and accessibility is consistent with other data needs.

A. Budget Request Summary

The California Air Resources Board (CARB) requests 1.0 position and $165,000 from various special funds to begin implementing SB 1. The 1 new position would be tasked with performing IT planning and analysis on the development of a compliance database/ data warehouse (compliance database) to house and share information associated with the SB 1 provision for Department of Motor Vehicles (DMV) so that only vehicles compliant with diesel regulations are allowed to register, and provide individually tailored pathways for compliance for those declined DMV registration.

Other benefits to be considered in compliance database planning and analysis would be to provide improved data that would aid program staff in modeling and tracking impacts on local emissions and compliance with State Implementation Plans. All IT components in this request will be further described in Project Approval Lifecycle (PAL) documents to be developed by the position requested in this BCP, in coordination with existing IT resources within CARB as needed. The PAL documents will be approved by the Department of Finance and the California Department of Technology, prior to any database updates or development of new database systems.

B. Background/History

Statewide, approximately 12 million Californians currently live in communities that exceed the federal standards for ozone and fine particulate matter (PM2.5). Two areas of the state have the most critical air quality challenges - the South Coast and the San Joaquin Valley air basins. Achieving federal air quality standards in these regions, as well as across the state, will provide essential public health protection by reducing hospitalizations for heart and lung related causes, decreasing emergency room visits, and reducing incidences of asthma. Most critically, exposure to PM2.5 and ozone is also associated with increased risk of premature mortality, which has been estimated to contribute to 7,500 premature deaths each year in California. In addition, toxic diesel particulate matter accounts for approximately 75 percent of air pollution-related cancer risk in the state. Mobile sources - cars, trucks, and myriad off-road equipment - are the largest contributors to the formation of ozone, PM2.5, toxic diesel particulate matter (PM) in California. In addition, the transportation sector - and the fossil fuels that power them - contributes the largest share of California's greenhouse gas emissions, and thus is California's greatest contributor to climate change. CARB's role in state government has included providing safe, clean air to all Californians; reducing California's emissions of greenhouse gases; and providing innovative approaches for complying with air pollution rules and regulations. Recognizing the need to reduce air pollutant emissions while making the comprehensive improvements to California's transportation system required by SB 1, the Legislature relies upon CARB's expertise in these and other areas so that implementation of SB 1 doesn't interfere with the achievement of better air quality and the reduction of greenhouse gas emissions, or other related tasks for which CARB is responsible.

SB 1, The Road Repair and Accountability Act of 2017, is intended to address the funding deficit for transportation infrastructure, and the backlog of California transportation system maintenance and rehabilitation projects. The bill creates the Road Maintenance and Rehabilitation Program to fund road maintenance and rehabilitation, safety projects, and active transportation projects, and creates the Solutions for Congested Corridors Program to address the state's most congested travel corridors. Several provisions in the bill acknowledge the impact of the transportation sector on California's air quality, and will require CARB to develop and implement new tracking, compliance, and enforcement processes so that reductions in emissions from motor vehicles are achieved, and to work in concert with other state agencies as an expert consultant for air quality and greenhouse gas related elements in the bill. First, the bill requires CARB to serve in a consultative role to the Department of Transportation (Caltrans) and the California Transportation Commission (CTC) as they administer the new programs created by SB 1, and to the University of California at Davis Institute of Transportation Studies as it reports on potential zero- and low-emission vehicle revenue mechanisms. Second, the bill requires the DMV, starting January 1, 2020, to verify that a medium-duty or heavy-duty vehicle is compliant with or exempt from CARB's Truck and Bus Regulation before allowing registration. This will require CARB to address a substantial increase in compliance assistance and enforcement questions, and current database incapabilities that will be needed for accurate communication between CARB and DMV databases. Also, in order to minimize future impacts on the trucking industry, the bill

sets a useful life period for commercial vehicles, precluding CARB from requiring, via potential future regulations, commercial vehicle fleet turnover in advance of specified deadlines. As part of this effort, the bill requires CARB to track the emissions impacts of the enhanced compliance provisions associated with implementation of the Truck and Bus Regulation, as well as evaluate the impact of the useful life provision on meeting clean air goals. Finally, the bill includes funding mechanisms to support improvements to California's transportation system and other projects that it contains.

SB 1 recognized that coordination and program integration with other state agencies is imperative for California to continue to meet its air quality and greenhouse gas goals and mandates. Calling upon CARB's expertise in improving California's air quality while encouraging the development and expansion of clean transportation, and in developing and implementing greenhouse gas emissions reduction solutions, SB 1 requires CARB's participation in this comprehensive set of strategies that address deferred maintenance on state highways, bridges, and culverts; local streets and roads; and transit systems, while accounting for resulting air pollutant and greenhouse gas emissions. Most of the provisions in SB 1 related to CARB, some of which are described further below, do not immediately become effective. However, it is critical that planning and analysis begin now for urgent IT-related work associated with the implementation of SB1. Specific SB 1 requirements for CARB addressed in this BCP are discussed below.

SEC. 45. Truck Emissions Standards: Compliance (Adds Section 4000.15 to Vehicle Code) and SEC. 46. (amends Vehicle Code 4156)

DMV Registration and Temporary Permits

CARB's most significant tool for achieving emissions reductions from diesel pollutants is the Truck and Bus Regulation (Regulation) which places clean air requirements on approximately one million trucks operating in California that are subject to the Regulation. Approximately 400,000 of these one million trucks are registered in California and about 600,000 are registered in other states. With an estimated compliance rate as low as 70 percent using traditional road-side enforcement stops alone, a more effective mechanism to achieve higher compliance rates is necessary. Failure to increase the rate of compliance to near 100 percent will result in 1) continuing adverse health impacts from the toxic compounds in diesel exhaust, 2) a continuing economic advantage for those illegally operating non-compliant vehicles over those that have spent tens of thousands of dollars to comply with the Regulation, and 3) possible federal sanctions under the Clean Air Act for failing to achieve the emissions reductions required by California's approved State Implementation Plans including the potential loss of more than $1 billion in federal transportation dollars.

SB 1 provides this more effective mechanism by requiring that a vehicle be in compliance with the Truck and Bus Regulation in order to register that vehicle with the Department of Motor Vehicles (DMV). The bill requires CARB to work with DMV to determine vehicles that are deemed compliant and allowed to register, or are given a temporary permit. Once the provision becomes effective, CARB would expect a significant increase in calls and emails specific to vehicles that are not allowed to register, due to their non-compliance with the Truck and Bus Regulation.

The proposed compliance database planning and analysis work would include the associated Truck and Bus Regulation and other ARB databases to identify needed data. It is critical that current data quality is assessed, as it is known that many vehicle identification numbers in these databases are incorrect. In addition, data resides in multiple databases, and a process for assembling and maintaining compliance information in a usable format from a singular location will be evaluated and may be necessary to minimize workload and address other issues associated with implementing SB 1. Compliance database planning and analysis work will also be leveraged for another SB 1 provision: to model and track emissions impacts of the enhanced compliance provisions of SB 1 associated with implementation of the Truck and Bus Regulation.

IT components impacted by this work include systems used to model emissions and assess economic factors to fully understand the impacts of various options on businesses, individuals, and the California economy. Novel strategies and projection modeling will be needed so that the recommendations meet the goals laid out

in SB 1. The results of this modeling aids CARB in developing plans to meet air quality and climate goals, including State Implementation Plans for meeting federal health-based air quality standards, and the Scoping Plan for meeting the state's greenhouse gas emissions reduction goals.

Additional IT-based systems used to maintain and manage these data include California's official criteria, toxic air contaminant, and greenhouse gas emissions inventories. These inventories are critical to assessing California's progress to meeting federal air quality standards and the state's climate goals, and provide a basis for developing recommendations on additional or different mechanisms for achieving clean air goals while recognizing the affected entities' financial investments.

As stated above, all IT-related components of SB 1 implementation will be documented in PAL documents and approved by the appropriate state agencies.

0. State Level Considerations

The resources requested in this proposal will enable CARB to perform analysis in support of initial IT-related work to plan for the requirements identified in SB 1 by:

• Performing analysis on relevant regulations and working with program staff to document compliance criteria;

• Identifying relevant data and assessing quality for modeling of emissions and economic factors, and for tracking local emission impacts and compliance with clean air goals, specifically as they relate to implementation of SB 1;

• Compiling data in support of compliance decisions associated with diesel regulations; • Conduct initial conversations with DMV to define scope of IT requirements for sharing compliance data;

and • Working with IT staff to develop required PAL documents.

CARB will work in concert with the DMV so that IT planning and analysis for a compliance database will result in meaningful and efficient program integration and support.

SEC. 45. and SEC. 46. Truck Emissions Standards: Compliance

DMV Registration and Permits

SB 1 requires CARB to work in coordination with DMV to improve compliance rates with the Truck and Bus Regulation prior to DMV issuing registration. Approximately one million trucks operate in California and are subject to the regulation, with about 400,000 registered in California and 600,000 registered in other states. The Truck and Bus Regulation requires nearly all heavy-duty trucks to upgrade to a 2010 or newer model year engine by 2023. Successful implementation with tying DMV registration to Truck and Bus Regulation compliance will require three key elements: . •

1. Increased compliance assistance; 2. Additional enforcement assistance; and 3. An accurate compliance database that can communicate seamlessly with DMV's registration database.

Given that the above provisions in SB 1 do not become effective immediately, the first two items, compliance assistance and additional enforcement assistance, will not require additional resources at this time. The third item will require the information technology services staff detailed below.

provisions are accurate. In addition, the APS position will work closely with DMV to assess how best to provide for efficient integration with the DMV vehicle registration process and associated system.

For implementation of SEC. 45. and SEC. 46, assessing the development of a compliance database will require planning and analysis so that relevant data is collected and is of high quality, and the system can communicate seamlessly with DMV's registration database.

Ongoing support of this system includes maintaining knowledge of associated regulations and data sources, performing ongoing data validation tasks, and providing support to program staff implementing other SB 1 provisions. The APS staff will work closely with DMV program analysts and IT staff so that the data transfer process will meet DMV's needs to implement compliance verification. The APS staff will develop reports and assess the efficiency of processes to meet SB 1 needs, and see that the database reflects current regulatory compliance information.
