Volume 6 - Issue 9 March 2016 Six subjects were arrested by the Division of Insurance Fraud (DIF) following a 14-month investigation into straw ownership and insurance fraud. Ivan Riano, 38, and Mariagny Jacomino, 31, husband and wife, were identified as the true owners of Care Resources Group, LLC, a PIP clinic in Miami. Riano and Jacomino paid Dr. Mario Torres, 61, to be the straw owner to avoid licensing of the clinic by the Florida Agency for Health Care Administration (AHCA). Since January 2012, the clinic billed nearly $1.5 million in claims while operating unlicensed. DIF launched the investigation, dubbed Operation Full Circle, into this clinic after an insurance carrier had obtained an affidavit from Dr. Mario Torres that he was not the true owner of Care Resources Group. After a series of interviews regarding the ownership of the clinic, and a closer look into the clinic’s financial records, DIF learned that Riano and Jacomino were the true owners. The investigation went on to reveal that Riano and Jacomino used a check cashing store to cash more than $518,000 in payments from insurance carriers and law firms, including 11 instances of structuring where checks were cashed in excess of $10,000 in an attempt to evade proper reporting. Riano and Jacomino also created and used two shell corporations, M J Billing and Medical Plus Equipment Rental, to launder monies received by Care Resources Group. Also charged as part of the scheme were Enrique Iglesias, 41, owner/manager of Convenient Check Cashing Corporation and his employee Alejandro Casanova, 37, for their involvement in cashing checks, laundering proceeds from the clinic and failing to maintain proper records. Six subjects were arrested by the Division of Insurance Fraud (DIF) following a 14-month investigation into straw ownership and insurance fraud. Ivan Riano, 38, and Mariagny Jacomino, 31, husband and wife, were identified as the true owners of Care Resources Group, LLC, a PIP clinic in Miami. Riano and Jacomino paid Dr. Mario Torres, 61, to be the straw owner to avoid licensing of the clinic by the Florida Agency for Health Care Administration (AHCA). Since January 2012, the clinic billed nearly $1.5 million in claims while operating unlicensed.

DIF launched the investigation, dubbed Operation Full Circle, into this clinic after an insurance carrier had obtained an affidavit from Dr. Mario Torres that he was not the true owner of Care Resources Group. After a series of interviews regarding the ownership of the clinic, and a closer look into the clinic’s financial records, DIF learned that Riano and Jacomino were the true owners.

The investigation went on to reveal that Riano and Jacomino used a check cashing store to cash more than $518,000 in payments from insurance carriers and law firms, including 11 instances of structuring where checks were cashed in excess of $10,000 in an attempt to evade proper reporting. Operating under the direction of Chief Financial Officer Jeff Atwater, Florida’s Division of Insurance Fraud (DIF) is a national leader in the fight against insurance fraud, continuously ranking in the top five among all states’ fraud bureaus and divisions. DIF investigates criminal acts of suspected insurance fraud perpetrated by individual citizens, insurance agents, insurance companies and businesses. The nature of our investigative duties involve, but are not limited to, workers’ compensation fraud, auto fraud, marine fraud, healthcare fraud, title fraud and homeowners fraud.

Insurance fraud is not a victimless crime. It is estimated that insurance fraud costs the United States $80 billion dollars or more a year, which is ultimately passed down to consumers. The Coalition Against Insurance Fraud (CAIF) estimates this fraud to cost approximately $950 per family.

30 Arrests For Staged Crashes in Miami / Jacksonville It was a busy month when it came to making arrests for staged crashes, as the Florida Division of Insurance Fraud (DIF) made 30 arrests in Jacksonville and Miami during February, including eight organizers and/or recruiters. Between January 2011 and May 2015, more than $781,000 in fraudulent claims were submitted by 40 different clinics and/or providers to 16 different insurance carriers in 17 separate staged crashes.

Four organizers were arrested in Miami, including Jorge Michael Iraldi Piriz, 40, for organizing three paper crashes in 2013 resulting in more than $14,500 in false claims; Jose Alberto Cruz Vigoa, 52, for organizing a 2012 staged crash resulting in more than $101,000 in false claims; Nolberto Perez, 37, for organizing a 2012 staged crash resulting in more than $89,000 in false claims; and Liusdany Delrisco, 24, for organizing two 2015 staged crashes resulting in more than $83,000 in false claims.

Four organizers were arrested in Jacksonville, including Danilo Padron, 40, for organizing a 2011 staged crash resulting in more than $47,000 in false claims; Denner Lopez Girbau, 37, for organizing two 2011 staged crashes resulting in more than $109,000 in false claims; and Jobitza Baine Berberena Soto, 36, and Ariel Martin Lopez, 41, for organizing a 2011 staged crash resulting in more than $53,000 in false claims.

David Brasil aka David Cavalcante Brasil White Male, 40 years old 5’10”, Brown Eyes, Black Hair Warrant Information: Warrant/Case #: 15007171CF10A Felony Warrant Charge: Staged Accident and Insurance Fraud. Details: The Florida Department of Financial Services, Division of Insurance Fraud (DIF) is attempting to locate David Brasil in reference to the outstanding warrant. Brasil is wanted for his role in multiple PIP fraud related crimes, including organizing a staged accident in 2011 resulting in more than $78,000 in fraudulent billing. Brasil was also the owner of the PIP clinic where participants were directed for treatment. Brasil has yet to be found since his warrant was issued in September 2015. His warrant is full extradition. Brasil may have returned to Brazil. If you know where Brasil can be located, please contact the Division of Insurance Fraud at 1-800-378-0445.

Lt Bill Lee Retires After 15 Year Career With DIF Lieutenant William “Bill” Lee is retiring from the Division of Insurance Fraud after 15 1/2 years.

Lt. Lee started with the Division as a Law Enforcement Investigator in September 2000. He joined the Division after taking an early retirement from the Sunrise Police Department where he served as a police officer, detective, and sergeant for almost 20 years. Prior to that he was a police officer for more than three years with the Police Department in New Haven, Connecticut. Lt. Lee was promoted to the position of lieutenant over the Ft. Lauderdale PIP Squad in April 2010. He has seen many changes in the agency and in the fight against fraud over the past 15 years. His last day with the agency is March 31.

We applaud Bill for more than 38 years of service in law enforcement and wish him a long and healthy retirement.

March is Fraud Awareness Month Every day in Florida, fake auto accidents result in millions of dollars in fake insurance claims being paid. Who pays for these claims? You do - in the form of higher insurance premiums. Personal Injury Protection (PIP) fraud is a serious crime with consequences. When someone commits auto insurance fraud, you pay the price. Auto insurance fraud can cost you and your family hundreds of dollars a year in higher insurance costs.

The Division of Insurance Fraud has eight dedicated PIP squads and more than 40 detectives to rein in these crimes and arrest the persons involved in fraud. Florida now has dedicated prosecutors throughout the state to handle PIP fraud, and the courts are sentencing persons convicted of insurance fraud to prison. Our goal is to promote a level of consistency in prosecutions to take a tougher stand against fraud, and impose harsher sanctions, including jail, fines, and licensing sanctions.

We are working to increase public awareness of insurance fraud, the seriousness of this crime and its impact on the community as a whole, and educate people about the potential penalties they face for participating in this activity. The Division of Insurance Fraud will pay up to $25,000 reward for information leading to the arrest and conviction of persons involved in insurance fraud.

PIP FRAUD SPOTLIGHT ON – FIFEC This year the Florida Insurance Fraud Education Committee (FIFEC) 24th Annual Conference will take place June 8-10, 2016, in Orlando. The conference is attended by various law enforcement officials, insurance investigators and professionals, members of International Association of Special Investigative Units (IASIU) and National Society of Professional Insurance Investigators (NSPII).

The Florida Insurance Fraud Education Committee began as the Annual Training Seminar representing the Florida Division of Insurance Fraud (DIF) and the Special Investigations Unit (SIU) community in 1992. DIF hosted this first seminar, which was actually a one-day, open forum-type workshop held in Altamonte Springs, with no agenda other than to foster a favorable working environment between the public and private sectors involved in the fight against insurance fraud.

The FIFEC seminar grew to more than 500 attendees in 2010, more than 700 attendees in 2012, and in 2014 and 2015 more than 1,000 individuals were present to celebrate our 22nd and 23rd years. FIFEC has offered continuous annual training seminars for DIF and SIU investigators, other law enforcement officers, prosecutors, insurance carrier adjusters and management, insurance defense attorneys and others in the ongoing fight to combat all forms of insurance fraud.

This year's conference will be held at the Caribe Royale Orlando All-Suites Hotel and Convention Center, located at 8101 World Center Drive in Orlando, where it has been hosted since 2004. Expected this year as speakers are Eric W. Miller, Inspector General, Florida Agency for Health Care Administration, Simon Blank, Director, Division of Insurance Fraud, Jeffery L.
